NOW, THEREFORE BE IT HEREBY RESOLVED that the law firm of
Graham and Hawkins is employed at an hourly charge of Thirty-Five
: Dollars plus expenses , with the assistance of the City Attorney, to
ipursue the class action declaratory judgment for the approval of

A meeting of the Committee of the Whole of the City Council of
!' the City of Jefferson was held in the Council Chambers on February
1973. In attendance were Councilmen Hager, Gordon, Scrivner
iOrtmeyer, Woodman, Seaman, Collier and Nacy, Chairman. Also in
i! attendance were Ted Herron and Forrest P. Carson, representing the
]! Housing Authority, Jerry Keene, and members of the Press and of
lithe public.

The purpose of the meeting was two-fold:
(1) To consider action necessary in connection with the proposed il
purchase of land bounded by McCarty Street, Monroe Street, Jackson I
Street and the Expressway, presently owned by the Housing Authority.:
(2) To consider revision of present City Ordinances as to Codes ,
concerning Housing, Construction, Electrical Work, Plumbing and
Fire Protection.
ITEM 1 - Housing Authority property
located between Monroe and
Jackson Streets .
Mr. Nacy reviewed briefly the history of this matter, the ;;`Committee
developments in it, and its present status, pointing out that the !1 of the
land involved was recommended in the Bartholomew Report as a site Whole
for a Municipal Complex, and further pointing out that the Report.
Bartholomew Report recommended a walk-over on McCarty Street to
additional land lying on the north side of McCarty Street between
Monroe and Adams. It was then explained that the present proposal
by the Housing Authority would eliminate the need for purchasing
the land on the north side of McCarty Street because of the high
expense involved, and instead proposed an alternate plan to be
explained by Mr. Herron.
Thereupon, the meeting was turned over to Mr. Herron for
presentation and discussion.
Mr. Herron explained that a certain designated portion of the
land involved, all illustrated by reference to maps and overlays ;i
produced by Mr. Herron, was ready now for purchase and use by the
School Board. The use of such land by the School Board was
described essentially being recreational land both for Simonsen andj
Freshman High Schools . The land involved has already been described;
in the contract between the City and HUD as desirable for that
purpose and has only awaited word from the School Board that the
School Board intends to utilize the land for that ppurpose. Mr.
Herron introduced a copy of the letter, addressed by Mr. Joe
Nichols, Superintendent of Public Schools, to Richard R. Nacy, Jr. , ;!
President Protem, indicating the School Board's desire to acquire
land as per the new proposal.
Mr. Herron further explained the costs involved, and the fact
that if the Housing Authority deeds the property to the School
Board, the deed and the contract will both assure that upon the I
discontinuance of Simonsen and Freshman High Schools as public
schools , the land would revert to the City of Jefferson nt a cost
very closely approximate to the price now being paid by the County I
to HUD.
Mr. Herron further explained the situation as to the parcels
of land still to be purchased by HUD, and the need for urgent
Council action in order to assure that this property would be
included in the program presently possible, but which might soon
be lost unless the City acted quickly. Mr. Herron explained what ;!
was needed from the City was an Agreement between the City and the
School Board that the land will be used for School Board recreationl,
al purposes, and that the Council must support HUD in its
acquisition of the additional parcel of land. s
Upon motion of Councilman Scrivner that a Resolution be
adopted to grant the necessary assurance to HUD to enable it to
complete its acquisition, that motion was unanimously carried, and
it was further determined that Forrest P. Carson, Counsel for HUD, 0
will prepare such a Resolution for introduction at the next Council '
meeting.
Councilman Hager thereupon moved that a meeting be set up
immediately with the School Board, for the purpose of adopting an
Agreement between the City and the School Board. Said motion was
unanimously passed and it was determined that such meeting shall be
held immediately upon preparation of an Agreement by Mr. Carson.
ITEM 2 - Codes .
Mr. Nacy outlined generally the idea involved in this item,
namely that a critical problem has arisen in connection with all
construction and development involved in the Ware's Creek pro ect
the Capital West project, the Riverside project, and the Hough Parki
project, in that all funds involved are being held up because the
present City Codes concerning Housing, Construction, Electrical 'r
work, Plumbing and Fire Protection, do not conform to the
standards required under law by HUD.

Mr. Herron resented the entire matter to the Committee
1pointing out that in the case of the Electrical Code, the Fire
;;Protection Code, and Construction Code, the City is now using
National Codes but they are not updated. In the area of Housing a
;purely local Code is in effect ; the same is true in the matter of al
Plumbing Code. In connection with the latter, it was pointed out
that the uniform National Plumbing Code is the most palatable to
'local plumbers . I
Committee' It was further pointed out that the local plumbers would stilll
of the be completely in control of all licensing of plumbers because the !j
Whole Aicensing examinations are prepared by the local plumbers . One of ;;
Report, the principal problems concerns the use of plastic pipe and the i'
'inability of certain plumbing aspirants to handle any kind of pipe I�
other than plastic. Mr. Herron further pointed out features of thej
Electrical Code would make it unacceptable to HUD.
The chief feature of Mr. Herron s presentation was the need
for immediate abolition of Codes as they presently exist and the j
,adoption of Codes which would be acceptable to HUD. This urgency

is prompted by the prospect of losing approximately $54, 700,000 in
, City improvements unless these Codes are adopted.
After a general discussion of the foregoing matters a motion
-was made by Mr. Hager that Jerry Keene and the City Attorney prepare
.an Ordinance repealing all present Codes and enacting separate and �l
individual Ordinances adopting those Codes recommended by HUD.
:After further discussion, Mr. Hager's motion was unanimously !
.approved by the Committee.

The regular meeting of the Jefferson City Planning and Zoning
Commission was held at 7:30 p.m. , Thursday, February 8, 1972. The
. following rezoning requests and other items were discussed and
recommendations were made as follows :
(1) Request from Dr. E. David Scott, 2009 E. McCarty St . , to
Planning rezone lots 1, 2 4 & 5 of Scott 's Subdivision from single
and family to multiple dwelling. This land is located along
Zoning Old St. Louis Road.
Commission ;, Commission tabled the request until next meeting due to absence of

(2� Request from Lee Neutzler to rezone land along Southridge Dr.
from single family to multiple dwelling, this land is located

A request by the Housing Authority for approval of the Hough
,; Park Renewal Plan was delayed pending a conference between the

The request for the approval of Riverside Park Renewal Plan
was approved by the Commission.

URBAN RENEWAL PLAN AND THE FEASIBILITY OF RELOCATION FOR NEIGHBOR-
,!HOOD DEVELOPMENT PROGRAM MO. A-12

WHEREAS, under the provisions of Title I of the Housing Act of
! 1949, as amended, the Secretary of Housing and Urban Development is �
!authorized to provide financial assistance to Local Public Agencies
; for undertaking and carrying out the Neighborhood Development
;Programs; and
WHEREAS, it is provided in such Act that contracts for
;' financial aid thereunder shall require that the Urban Renewal Plan
!' for the respective urban renewal areas comprising the Neighborhood
Development Program be approved by the governing body of the
;; locality in which the areas are situated and that such approval �}
include findings by the governing body that: (1) the financial aidt'
:, to be provided in the contract is necessary to enable the Program I
to be undertaken in accordance with the Urban Renewal Plan; (2) the
lUrban Renewal Plan will afford maximum opportunity, consistent with
;; the sound needs of the locality as a whole, for the rehabilitation
or redevelopment of the urban renewal areas by private enterprise;
11 (3) the Urban Renewal Plan conforms to a general plan for the
,': redevelopment of the locality as a whole; and (4) the Urban Renewal
:; Plan gives due consideration to the provision of adequate park and
, recreational areas and facilities , as may be desirable for neigh-
borhood improvement, with special consideration for the health, I
lsafety, and welfare of children residing in the general vicinity of
1the sites covered by the Plan; and
WHEREAS, it is desirable and in the public interest that the
AlHousing Authority of the City of Jefferson (herein called the
"Local Public Agency") undertake and carry out the Neighborhood �?
; Development Program (herein called the "Program") identified as
''Project Mo. A-12" and encompassing the area or areas located in
the City of Jefferson, State of Missouri (herein called the
"Locality") and described as follows :
RIVERSIDE PARK AREA:, Beginning at the intersection of the
northerly line of Riverside Drive (street running east and
Resolution;; west at this Point) and the westerly line of Riverside Drive li
Urban (street running north and south at this point) ; thence
Renewal ; southerly with aforesaid westerly line to the intersection of
Plan. the southerly line of Water Street; thence southeasterly along
� aforesaid southerly line to the intersection o f the westerly

HOUGH PARK AREA. Beginning at the intersection of the
northerly line of Ellis Boulevard and the easterly line of
Hough Park Golf Course extended; thence southerly along
aforesaid easterly line to where it intersects the city
boundary line (prior to annexation January, 1968) ; thence
easterly along aforesaid boundary line to the easterly line
!1 of Hough Park Road; thence northerly along aforesaid easterly
line .to the intersection of the northerly line of Ellis
Boulevard; thence westerly along aforesaid northerly line
to the point of beginning, containing 41+ acres,
WHEREAS, the Local Public Agency has applied for additional
ifinancial assistance under such Act and proposes to inter into an
'additional contract or contracts with the Department of Housing and !
,,Urban Development for the undertaking of, and for making available
'additional financial assistance for, the Program; and
i! WHEREAS, the Local Public Agency has made studies of the
`location, physical condition of structures, land use, environmental
Unfluences , and social, cultural, and economic conditions of the
urban renewal area or areas comprising the Program and has
determined that the areas are a blighted area and that it is

inhabitants and users thereof and of the Locality at large, because
of (1) an improperly drawn subdivision plat in Hough Park which
permitted 33 wide lots ; (2) streets in the Hough Park area being
mostly graveled or non-existent; (3) inadequate storm drainage
with 2/3 of the Hough Park Area lacking city water or sanitary
sewers; (4) topography in Hough Park is of prime concern; (5) 'Resolution
some structures in Riverside Park Area because of terrain forced to 'Urban
front on alleys rather than streets ; (6) streets in the Riverside 'Renewal
Park Area are unsafe, poorly designed streets without curbs and : Plan.
gutters; (7) right-of-ways in Riverside Park Area have been
platted on a grid system that makes actual construction impossible
without right-of-way adjustments ; (8) Riverside Park Area lacks
adequate storm drainage and approximately 1/4 of the area is with-
out sanitary sewers; (9) the entire Riverside Park Area has for
the above reasons deteriorated and the dwellings there are almost
universally in need of rehabilitation to meet city standards ; and
the members of this Governing Body have been fully apprised by the
Local Public Agency and are aware of these facts and conditions ;
and
WHEREAS, there has been prepared and referred to the City
Council of the Locality (herein called the "Governing Body") for
review and approval an Urban Renewal Plan for the urban renewal
areas dated January 31, 1973, and consisting of 7 pages and 2
exhibits ; and
WHEREAS, the Urban Renewal Plan has been approved by the
Governing Body of the Local Public Agency, as evidenced by the copy;;
of said Body's duly certified resolution approving the Urban
Renewal Plan, which is attached thereto; and
WHEREAS, a general plan has been prepared and is recognized
and used as a guide for the general development of the Locality as
a whole; and
WHEREAS, the Planning and Zoning Commission, which is the
duly designated and acting official planning body for the Locality,
has submitted to the Governing Body its report and recommendations
respecting the Urban Renewal Plan for the urban renewal areas
comprising the Program and has certified that the Urban Renewal
Plan conforms to the general plan for the Locality as a whole, and
and the Governing Body has duly considered the report, recommends-
tions , and certification of the planning body; and
WHEREAS, the Local Public Agency has prepared and submitted
a program for the relocation of individuals and families that may
be displaced as a result of carrying out the Program in accordance
with the Urban Renewal Plan; and
WHEREAS, there have also been presented to the Governing Body+;
information and data respecting the relocation program which has
been prepareed by the Local Public Agency as a result of studies,
surveys , and inspections in the areas comprising the program and
the assembling and analysis of the data and information obtained i
from such studies, surveys, and inspection; and
WHEREAS, the members of the Governing Body have general !�
knowledge of the conditions prevailing in the urban renewal areas
and of the availability of proper housing in the Locality for the
relocation of individuals and families that may be displaced by the"
Program and, in the light of such knowledge of local housing condi,
tions , have carefully considered and reviewed such proposals for L
relocation; and
WHEREAS, it is necessary that the Governing Body take
appropriate official action respecting the relocation program and
the Urban Renewal Plan for the Program, in conformity with the
contract for financial assistance between the Local Public Agency f
and the United States of America, acting by and through the '
Secretary of Housing and Urban Development; and
WHEREAS, the Governing Body is cognizant of the conditions
that are imposed in the undertaking and carrying out of urban
renewal activities and undertaking with Federal financial assist- i}
ance under Title It including those prohibiting discrimination ?`
because of race, color, creed, or national origin.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JEFFERSON:
1. That it is hereby found and determined that the urban
renewal areas comprising the Program are blighted areas and qualifyjl
as eligible areas under Section 99.300 - 99.660 R.S.Mo. 1969.

2. That the Urban Renewal Plan for the Program, having been
;duly reviewed and considered, it is hereby approved, and the City
:Clerk be and is hereby directed to file said copy of the Urban

3. That it is hereby found and determined that where
:!clearance is proposed that the objectives of the Urban Renewal Plan
;cannot be achieved through more extensive rehabilitation of portions
Hof the urban renewal areas comprising the Program.
4. That it is hereby found and determined that the Urban
;Renewal Plan for the Program conforms to the general plan of the
';locality.
5. That it is hereby found and determined that the financialll
,,aid provided and to be provided pursuant to the contracts for 1
!Federal financial assistance pertaining to the Program is necessary
to enable the Program to be undertaken in accordance with the Urban
.'Renewal Plan for the areas comprising the Program.
6. That it is hereby found and determined that the Urban �!

;will afford maximum opportunity, consistent with the sound needs of
"the Locality as a whole, for the renewal of the areas by private
enterprise.
Resolution 7. That it is hereby found and determined that the Urban

idwellings in conformity with acceptable standards is feasible and
'can be reasonably and timely effected to permit the proper prosecu-
tion and completion of the Plan; and that such dwellings or
:dwelling units available or to be made available to such displaced
:;individuals and families , are at least equal in number to the numbs ,
of displaced individuals and families , are not generally less
'desirable in regard to public utilities and public and commercial
; facilities than the dwellings of the displaced individuals and
families in the areas comprising the Program, are available -at
rents or prices within the financial means o£ the displaced
';individuals and families , and are reasonably accessible to their
Iplaces of employment.
9. That, in order to implement and facilitate the effectua-
!tion of the Urban Renewal Plan hereby approved, it is found and
; determined that certain official, action must be taken by this Body
,with reference, among other things , to changes in zoning, the
11vacating and removal of streets , alleys, and other public ways , the
;establishment of new street patterns , the location and relocation
?;of sewer and water mains and other public facilities , and other
?public action, and, accordingly, this, Body hereby (a) pledges its
( cooperation in helping to carry out the Urban Renewal Plan, (b)
; requests the various officials, departments , boards, and agencies
! of the Locality having administrative responsibilities in the
;'premises likewise to cooperate to such end and to exercise their
respective functions and powers in a manner consistent with the
;!Urban Renewal Plan, and * (c) stands ready to consider to take
!appropriate action upon proposals and measures designed to
;;effectuate the Urban Renewal Plan.
10. That additional financial assistance under the provisions
'`of Title I of the Housing Act of 1949, as amended, is necessary to

the land in the areas comprising the Program to be renewed
in accordance with the Urban Renewal Plan for the Program, and
i,'accordingly, the proposed Program and' the annual increment are
�approved and the Local Public Agency is authorized to file an
:application for financial assistance under Title I.

WHEREAS, it is the consensus of the council that the proposal

Councilman Scrivner asked that Ted Herron, Executive Director of
the Housing AuthoA ty explain the urgency of the passage of the
above Bills .
Mr. Herron stated that in the recertification of the 1971 - 1972
Workable Program the code section had not been properly updated,
thereby holding up the Wear's Creek and Ca itol West Projects.
{The Mayor Protem then stated that a SpeciN Council Meeting could
(not be called earlier than Thursday, February 22nd, at 8:00 p.m. ,
Mby Rule 17. He then called a Special Council Meeting at 8:00 p.m. ,
February 26, 1973, to consider the passage of Bills 91 through 96,
hand a Public Hearing.
Councilman Borgmeyer moved that an ad be placed in the newspaper,
advising the public as to the time and place of the meeting.
