A quorum was declared present. I The minutes of the meeting of September 5th were approved as iApproval of received. Minutes . I Mayor Christy presented the following to the Council, for approval: ',Appointment "I have the honor to transmit herewith, for your consent and JEnv.Quality approval, the following appointment to office: C William R. Tweedie, Jr. , 407 Schellridge Road, as a member of the Environmental Quality Commission, vice Joe Majersky, resigned. Respectfully submitted, /s/ John G. Christy, Mayor. Councilman Gordon moved that the appointment be approved. Motion I passed. A communication was received from the Missouri State Highway o.State Commission relative to traffic markings on U.S.Route 54, Cole Count Highway and Stadium Drive North. ;;Commission. The communication was received and ordered filed. - - - - - _ - - - - - A communication was received from John L. Hearne, Attorney, ,,Street Comm. representing the Capital City Christian Church, regarding their ;Director of method of paying the tax bill for the street improvement on Swift 's ,Public Highway. The matter was referred to the Street Committee and the 'Works . Director of Public Works . - - - - - - - - - - - - re 11 for $2,000.00 to finance the twenty-four hour "Crisis finance Line' Was received from Donald V. Cline, Director of the Juvenile :Committee ttention Center. The request was referred to the Finance Committee. - pplications for the position of Bus Driver were received from 'Applications yron D. Sullens , 313 Benton Street, and Earl W. Patterson, 1503 Pius East High Street, for approval by the Council. Drivers . Councilman Ortmeyer moved that the appointments be approved. j! Walz, Inc. , to reconstruct the , Milo H. original front of their building, located at 128 East Dunklin Street Walz. for a period of six months , to celebrate their 50 years of business .. Councilman Hager moved that the request be granted on a temporary basis . Motion passed. public hearing was held on the rezoning of Pt. of Lot 21 and all Public of Lots 22, 23 and 24 of Sun Valley Addition, from single family to iearing. multiple dwelling, for the purpose of erecting Tri-Plex Apartments . letus J. Kramer, 1731 Overlook Drive, and Bill Burton, 1734 verlook Drive, appeared in opposition to the rezoning. They also resented a petition signed by property owners in opposition to the ezoning. ichael P. Present were Councilmen Hager, Nacy, Ortmeyer,1 Finance orgmeyer, Gordon andStrong. Also present was Larry Haake, 1Committee hairman of the Mayor's Sub-Committee of the Firemen's Pension and ( Report. etirement Fund. 514. ..___..._........ . .... Regular. Council. Meeting, Sep.temb.er .18, 1972. _._. j Mr. Haake advised the Councilmen of the condition of the Fund, ;; !(which according to insurance actuarials , the accrued liabilities 0,amount to more than $763,000. Although the Fund, according to Mr. Haake, has assets of $443,887, it is necessary for the next two ,years to fund an additional $35,000 per year. That along with the ! full 1ft. per $100.00 valuation now voted by the Council should bringi the Fund in better condition. I! Mr. Haake said the $35,000 from the General Revenue Fund, for I ithe next two years stop-gap measure and not a solution. He also ;suggested a re-examination of the plan which he claims is outmoded. ' On a motion by Mr. Borgmeyer the Committee recommends to the ;'Council that $35,000 for each of the next two years be paid from 'the General Revenue Fund to the Firemen's Retirement Fund. The emotion passed. Finance Mr. Haake also asked for $2300.00 for replacement of the I; CommitteeCushman Motor Vehicle that was crushed by the collision with the Report. Fire Engine at Madison and McCarty the day of the Blackwell Garage ,Fire. The Committee passed on Councilman Strong's motion for the ;$2300.00 request; this would naturally come from the General {Revenue Fund. Councilman Nacy made the motion, which was passed, that the ;City Attorney follow up on the insurance of the driver of the auto- ' imobile that caused the accident. This would include purchase of ;;the aforementioned Cushman vehicle, fire truck, and any liabilities ]!the City is responsible for, such as Doctor and hospital bills on ;zany of its employees . � �I A motion by Mr. Strong that a supplemental salary ordinance bell ;]drawn for payment of Police and Firemen for October passed, but a 11 j,,stipulation was inserted that this budget shortage be better ;i 'explained - Police $24,190.00 - Firemen $32,417. 10. Mr. Tom Beaman of the Drug Abuse Committee inquired what had happened to the $2,000.00 request from Mr. Don Cline for assistance �� "in creating a Crisis Line. Mr. Hager agreed to check and inform ;�r. Beaman. j Mr. Ed Cole gave each of the Committee members a statement of ;!the City's financial conditions and also advised the Committee of j !the good and bad points as the Committee starts examination of 'Budget requests . Motion passed. li ;'The following report .of the Planning and Zoning Commission was jlpresented to the Council for approval: The regular meeting of the Jefferson City Planning and Zoning �! +'Commission was held at 7: 30 P.M. , Thursday September 14, 1972- The following ,rezoning requests and items tems were discussed and recommendations were made as follows . 1(1) Reqquest from Michael Riley in behalf of his clients the j j Jefferson City Auto Supply Company, to rezone lots 37 &. 38 of j� Jones Add. to permit the construction of, a wholesale auto j parts warehouse. These lots are located on Virginia Street just off Missouri Boulevard. BMW 515. (2) Request from Martin Oidtman to rezone land in the area of Sunset Lake known as the Oidtman Tract from "A-1" to "D" Multiple Dwelling., The Commission denied the re quest to change the zoning from "A-1" tq "D" Multiple Dwelling. The Commission recommended for the i; Council 's approval that the area be changed to "C" Multiple ;Planning Dwelling. This action was taken because the Commission felt and that because this land bordered on the rear of single familyy ';Zoning residences fronting on Southwest Boulevard, that it should be :Commission kept residential in nature. Offices and other businesses ;Report. which could be built in "D" but not in "C" Multiple Dwelling would not be in the best interest of the City's future development in this area. (3) Request from Leo W. Neutzler to rezone land along old Route C, ` known as the Neutzler Property, to Local Commercial zoning. The request was denied, but the Commission recommended that it be I rezoned to "C" Multiple Dwelling. This land adjoins the Marti Oidtman tract to the east. (See item 2. ) The portion of the land in item 3 that adjoins old Route C may need local f commercial zoning at some future date when a specific business ; is planned. When such time arises , the Commission will consider such requests . (4) Review of final plat of River Bend Estates , Section 2, for study and approval of the Planning and Zoning Committee. �} Review of final plat was made and approved as submitted. The Commission respectfully requests that the City Council approve an expenditure of $300 for the purpose of purchasing large ; scale aeriel photographs of Jefferson City and the surrounding land : in the two-mile belt. If these photographs are made available, thej Commission will. keep them in their office where reference can be �. made when considering various zoning requests . " II Amending Thomas Pawley, 1014 Lafayette, objected to increasing the speed P.& T. ,limit for the following reasons : !i Code. (1) There is traffic congestion on Lafayette Street at the present time, and increasing the speed limit would tend to cause more accidents . (2) Small children attend Lincoln Lab School and it would be a dangerous condition for them. i Vaurice Bayless , instructor at Lincoln Lab School, objected to the �passage of the Bill since children from kindergarten through the twelfth grade attend the Lab School, there is also a nursery school �J.n the area, and the children at the Lab School use the recreational acilities at Dunklin and Lafayette Streets . Increasing the speed I imit would cause a hazardous condition. i ouncilman Hager moved that Bill No. 47 be placed on the Informal �� alendar. Councilman Borgmeyer amended Bill No. 51 as follows : Code. "Section 1, ?aragraph (654) , by striking the period after "Block" and adding and this exception to remain in force for one year only! ." Motion passed. On motion of Councilman Seaman, Bill No. 51, as amended, was read the third time by title and placed on final passage and was passed by the following vote as Ordinance No. 8497: Councilmen voting Aye: Borgmeyer, Gordon, Hager, Nacy, Ortmeyer, Riner, Seaman, Strong and Woodman. Missouri, that the Missouri Power and Light Company make the following installation in accordance with recommendations presented to the City Council by its Committee on Public Utilities , and adopted by said City Council on September 18, 1972. 1. Councilman Strong referred-the-request of Ed Goldammer, of forming Director of a sewer district in the Adams and Hickory Streets area, to the Public Director of Public Works . Works . - - - - Councilman Strong referred a-complaint of 0. W. Muck, 710 Monroe, Street in regard to trucks pulling curbs off, to the Street Department. Department. Councilman Borgmeyer referred a petition, requesting a paved Director of street in the 3000 block of Country Club Drive, to the Director Public of Public Works .
