I It is my policy to forward to the attorneys all correspondence Ireceived relative to a case which I have heard. I am, accordingly, forwarding copies of your letter, as well as this one, to Messrs. Housing The following communication^was wreceived from the Housing Authority Authority Dear Mayor Christy: The Board of Commissioners met in Special Session on Friday after- noon October 2, 1970 and passed a resolution recommending that the request from Hugo P. Street Comm+ A petition was received from property owners to vacate part of the City Att 'y. lunused right-of-way originally dedicated for Rosewood Street . Dir. of iThe petition was referred to the Street Committee, City Attorney Public Wrks and Director of Public Works. r Councilman Scrivner, Chairman of the Street Committee, presented the following report: I Street Committee Recommendations 1. We recommend that the High Rise Apartment for the Elderly be numbered 10 Jackson Street. ' 2. We recommend that the money accruing to the City from the Special Road District be used to improve Industrial Drive from Dix Road west. This amount is approximately $30,000 for this year. 3. The Accounts and Claims Committee recommends that $50.00 be allowed to Mr. J. W. Heard, 1429 East Miller for damages caused by a large elm tree that fell and damaged his property. This tree had been marked by the Health Department for removal but had not been removed up to the time of the accident. 4. We recommend that an effort be made soon to stabilize the creek , bank in the rear of 1300 Rose Valley. This recommendation is based on prior conversation and agreement. Street Committee Meeting 10/5/70 Meeting called to order at 7:00 P.M. Present were Chairman Scrivne Councilmen Wells, Riner, Strong. 1. What shall we number the High Rise Apartment for the Elderly? Moved by Riner that it be listed as 10 Jackson Street, seconded by Strong and passed. 2. The Special Road District has about $30,000 which we can use for street improvement; we need to specify so that it can be i earmarked for a certain project. Motion by Wells, seconded by Scrivner and passed, that the money be applied to resurfacing Industrial Drive from Dix Road west. Councilman Strong recommended that the Public Works Department renew its effort to stabilize the creek bank in the rear of 1301 Rose Valley Drive area. This is continuing some requests made Street formerly by Mr. Dave Frank, Jim Heeter and others . Since this ; Committee is a prior commitment we recommend that it be considered and -iReport taken care of as soon as possible. .1 4. Councilman Strong read a letter from J. W. Heard, requesting $ 50.00 damage caused by a tree that had fallen on his property. The elm tree had been marked for removal but had not been removed at the time of accident. Councilman Wildhaber, Chairman of the Fire Department Committee, jFire presented the following report: Department �Committee Fire Committee September 23rd, 1970 12 :00 noon Report The Committee recommended the approval of plans and specifica-� tions for Fire Station No. 2 and that bids be taken for the ((! construction. The Committee also recommended the payment of $2,815.05 to the Architect as the partial payment due for the No. 2 Station. The Committee also recommended and approved $310.00 to be added to the Fire Department Building Maintenance Budget for the ,I payment of contract on painting. �i Councilman Flager moved that the Fire Department Committee be authorized to go up to $113 ,000 on Fire Station No. 2 . The motion passed. Councilman Wildhaber then moved that the report be approved . The ff motion passed. Ii - r Councilman Scrivner, Chairman of the Police Department Committee, Committee presented the following communication to the Council: of the :� hole RE: Junked, discarded, etc . vehicles . Storage and disposal. ' Section 10. 290, Sub-Sec . 1. Dear Sir: As you, and most of the City Councilmen, know since the Missouri �! Vehicle Inspection Law became effective, we have numerous discarded,li Junked, etc . vehicles left on the City streets, as well as on priva e property, due to the fact vehicles will notpass inspection and are discarded when their licensesexpire. In the past, tow companies have towed vehicles and stored them according to the City Ordinance, and then have sold them to a salvage company and have, at least, been able to salvage a small part of the towing and storage bill. In the past months we have had difficulty in getting these tow companies to pull off these vehicles , due to the fact that they do not have the storage lots, garages, etc . , to place the vehicles and cannot even give the Junkers away, after keeping them. It is respectfully requested that in the very near future a meeting be held to discuss this problem, possibly with some of the tow companies, etc . to attempt to find a solution. At the present time we do not have any place to store additional vehicles, and as it appears now, will not be able to dispose of the vehicles that are in storage. Respectfully yours , CLAUDE E. Install 6800 lumen mercury vapor light on Chestnut Street near the Baptist Union Building. 2. Install 6800 lumen mercury vapor light at 1106 Vineyard Square. 3. Install 6800 lumen mercury vapor light in the 200 block West Elm. 4. Replace 72 old type lights existing with 6800 lumen mercury vapor lights . Respectfully submitted, Frank J. With the following Council members present, lWildhaber, Iuen, and Chairman Borgmeyer. Committee recommends the ifollowing: Rezoning Fees be changed from $25 .00 to $35.00 to help cover ( the cost of advertising for public hearings . The Committee wants legal opinion from City Attorney Mike Riley, on what we may tax under third class City on the following: Out of town Transfer and Delivery trucks delivering into Jefferson City. The following report of the Planning and Zoning Commission was Planning 'presented presented to the Council: and Zoning This is an amended report of the regular monthly meeting of the Commission IJefferson City Planning and Zoning Commission which was held at Report Q:30 p.m. September 10, 1970, in the Chamber of Commerce Board Room at the Governor Hotel. The following items were presented and discussed by the Commission and recommendations are as follows: 1. Request from Attorney L. H. Wilbers in behalf of Roling Construction Company, Inc. , to rezone land on Southwest Boulevard from "D" Multiple Dwelling to "E" Local Commercial for the pur ose of constructing a Veterinary Clinic for small animals. Recommend that a special permit for use of the following described land for above purpose be issued and that the Zoning of the entire tract be unchanged. IU _--Regular.--Council. 'Councilman Strong offered the following amendments to Ordinance , No. 8254: AMEND ORDINANCE NO. 8254, Section 3, by striking out all of Section 3 and inserting in lieu thereof a new Section, to be known as , Section 3, and to read as follows: "Section 3 . Establishment of Parking Authority Fund. There is hereby established a Parking Authority Fund. All monies collected from parking meters , parking lots , shall be deposited with the City Collector to the credit of the Parking Authority Fund. All funds from the Parking Garage shall be deposited to the Parking Gara e Fund Nth the City Collector. All funds now hefd in the Parking Lots Fund shall be deposited to the credit of the Parking Authority Fund. " AND FU11THER AMEND ORDINANCE NO. 8254, Section 4 , by striking out the last sentence in Section 4 , beginning after the period in Line 6, and all the remainder of Lines 9, 7, 9, and inserting in lieu thereof the following: "For fiscal 1971 all parking meter funds shall be transferred from General Revenue and deposited to the Parking Authority Fund. This shall become effective November 1, 1971 . " AND FURTHER AMEND ORDINANCE NO. 8254, Section 8, by striking out all of Section 8 and inserting in lieu thereof a new Section, to be known as Section 8, and to read as follows: "Section 8. The Parking Authority shall consist of eight (8) members . Of the eight members one (1) shall be the Director of Public Works, or his designee; one (1) shall be the Chairman of the Parking and Traffic Commission, and one (1) shall be a duly elected City Councilman. The City Councilman and the remaining five (5) members shall be selected by the Mayor, with the approval of the Council. Of the remaining five members three (3) shall be appointed for a period of, two 2) years and two (2) shall be appointed for a period of one R) year. After the expiration of the first year, Commission members shall be appointed for a period of two (2) years so to have staggered terms . The Mayor, with the approval of the Council, shall appoint a Chairman from among the eight members . " Councilman Strong then moved that the amendments be adopted. The motion passed. Councilman Strong moved that Ordinance No. 8254, as amended, be placed on final passage. The amended Ordinance passed by the following vote: Councilmen voting Aye: Borgmeyer, Hager, Iuen, Nacy, Riner, Scrivner, Strong, Wells and Wildhaber.
