Councilmen present: Borgmeyer, Hiesberger, Iuen, Kliegel, Riner, Scrivner, Strong, Walther and Wildhaber. Councilmen absent: Haake, absent with leave. A quorum was declared present. Approval of The minutes of the meetings of September 15th. and 24th. , 1969 Minutes . were approved as received. Street Petitions were received from property owners objecting and protest- Committee. ing the proposed improvement of West Main between Forest Hill and Ridgeway. They were referred to the Street Committee. Street Petitions were received from property owners requesting permanent Committee. surfacing of 719 Rear Dix Road. The request was referred to the Parking & Traffic Commission. Kinance A request was received from Donald V. Cline, Executive Secretary ofl I'Committec . Mid-Missouri Regional Law Enforcement Planning Council to completed form relating to a financial commitment in the amount of 40% ($1, 216.00) which is the local government' s share for eommuni.cation equipment which has been requested by the Jefferson City Police Department. The request was referred totheFinance Committee. - r - Finance A recommendation by the Municipal Buildings Committee of the Greate Committee Jefferson City Committee to rent office space located on the second floor of the building adjacent to the City Hall and owned by Mr. Herman for use of City Departments to alleviate excessively crowded conditions in the City Hall Building was received by the Council. Councilman Strong moved that the matter be referred to the Finance Committee. The motion passed. Finance A petition was received from Street and Sewer Department employees Committee. requesting that they be paid weekly. The petition was referred to the Finance Committee. Street A communication was received from Gregory A. Wankum, Secretary- Committee. Treasurer of Old St. Louis Road Improvement Association requesting that the Council or the Street Committee obtain bids on widening and installing curbs on St. Louis Road using the present road bed and filling in between it and the new curbs. He suggested getting bids on a 36-foot street and also a 32-foot street. If it is found economically feasible to build a 32-foot street as a minimum width, he suggested restricting parking to one side only. The request was referred to the Street Committee. City Attorne Councilman Strong presented communications from Norman W. Kolar and Dir. of and Mrs. J. 0. Kolar concerning the flooding of Mrs . Kolar' s pro- Pub. Works. perty located at 214 E. Ashley and threatened suit for damages. The communication was referred to the City Attorney and Director of Public Works . ---------- Regular Council Meeting, October 6, 1969 The following communication was received from the Special Road Special District: October 2, 1969 Road Gentlemen: District. Your correspondence of Sept. 23, 1969, was received and studied by the Special Road District Commission. We are in accord with the streets in question - Cedar Hills Road, Vieth Drive, Dogwood, Riverview and the streets in Landwehr Hills Sub-division. We are not pleased with the problem of St. Louis Road. We will contribute funds to the City this year (1969) with a commitment that St. Louis Road will be completed in the year 1970 and if com- pleted,we will make our contribution for 1970. We make this statement based on the fact that a large number of residents have worked for over two years to see the completion of this project plus the fact that the commission has spent a large sum of money for engineering work and feel those people are entitled to a commitment definite in terms of time. The Jefferson City Police Personnel Board on 23 September, 1969, examined and found eligible for employment as a Police Clerk- Typist, Mrs . Councilman Iuen, Chairman of the Publis Utilities Committee presen d the following report: October 6, 1969 Utilities Mayor Christy: Committee Your Utilities Committee recommends the following street light Report. installations and installation of fire hydrant, if they meet with the Master Plan: 1. Move light on Adams to pole near the corner of Building occupied by the Division of Health. 2. Install three (3) fire hydrants on Tanner Bridge Road and one (1) on Nelson Drive. 3. Install Mercury Vapor Light on existing pole located at the Southwesterly corner of Inlot No. 940 and being in the alley runni B between Jackson and Adams Street. 1 4. Replace existing light in the 500 block of East Atchison with Mercury Vapor Light. 5. Install Mercury Vapor light at 317 Fredricks Lane. 6. Install Mercury Vapor light approximately 200 feet north of the intersection of Nelson Drive and Bald Hill Road. All Public Utilities are to submit copies of tariff to the Public Utilities Committee. the Committee also recommends the purchase of twenty-eight (28) fire hydrants in Public Water District No. 1. Police Dept. Councilman Scrivner, Chairman of the Police Department Committee, Committee presented the following report: Report . The Council' s Police Department Committee met on September 22 for the purpose of public hearing on Bill 62. Committee members present were Councilmen Borgmeyer, Hiesberger, Haake and Vice- Chairman Riner. Other Councilmen present were Iuen, Strong and Wildhaber. At that meeting the Committee also heard an explanation by Donald Cline of the Mid-Missouri Law Enforcement Planning Counci pertaining to a request that would be made to the Council later. The Committee also met at 7 P.M. October 6 for the purpose of reviewing suggestions made concerning Bill 62 and recommends the Council "do pass" Bill 62 with the following Committee amendments as Council Committee Substitute for Bill 62: 1. Amend section 3.9, by deleting it. 2 . Amend the repeal clause of the bill (Section 5) so as NOT to repeal Section 1198 by striking it from the list of those sections to be repealed, and inserting it in the bill in lieu of Section 10. 3. 3. Amend section 8. 1, subsection "B" to read as follows : "(B) "Minor" means an unmarried person under the age of seventeen (17) years ." 4. Amend section 8. 2 by striking the work "shall" in the third line of the section and inserting in lieu thereof the word "to" . S . Amend section 8. 5, "Publication of obscene material" by enacting a subsection to be known as "B" to read as follows: " (B) It shall be a misdemeanor for a person, with know- ledge of its content and character to knowingly or negligently display any material or conduct any per- formance wh ,ch is obscene or harmful to minors in a manner so as to be visible to minors while in the use of any public sidewalk or thoroughfare." 6. Amend section 8. 9 to read as follows : 118.9 Exceptions. Nothing in this Code shall be construed so as to apply to any political subdivision or to any department, agency, office or facility thereof or to any employee or agent thereof when engaged in the per- formance of his official duties, or to prohibit or res- trict any person in the conduct of a legitimate activity for bonafied educational, scientific or medical purposes. ' 7. Amend Section 1. 1 by deleting $10.00 in line #4 and in- serting in lieu thereof $1.00. I move the adoption of the Committee report. The following report of the Parking and Traffic Commission was P ing & presented to the Council: Traffic REPORT OF PARKING AND TRAFFIC COMMISSION Commission. SPECIAL MEETING September 22, 1969 Regular Council Meeting, October 61 1969 Meeting was held Monday, September 22, 1969, 4:30 P.M. , with the following members present: Chairman Crewz, Councilman Haake and Members - Vetter, Findlay and Rackers . The following items were discussed: 1. From an aesthetic viewpoint, the Commission favors removal of the parking meters on the west side of the 100 block of Madison. However, in view of the lack of adequate parking facilities in the downtown area and the problem of enforcing unmetered on-street parking, the Commission feels that the parking meters should be retained, unless an effective legal enforcement agreement can be worked out between the City and the State . 2 . The Commission concurs with the proposal for constructing an off street parking facility adjacent to the Student Union at Lincoln University. Respectfully submitted, /s/ Warren Crewz, P.E. The City Attorney stated that the City cannot loan money to persons on the weekly payroll in order that they may be paid monthly.
