A request was received from property owners to rezone Lots 13, 14, Planning
159 16, 179 189 199 209 21, 22, 23, 24 and parts of lots 25, and 12 &
of the W. A. Beck Addition from "A-2" Residential to "E" Local Zoning
Classification. Commission.
The request was referred to the Planning & Zoning Commission.

Councilman Hawes, Chairman of the Committee: Committe
February 21, 1969 Report.
Gentlemen:
STREET COMMITTEE REPORT
The Street Committee met at 7:30 P.M. on Thursday, February 20, 1969
Present for this meeting were: Chairman Hawes, Councilmen Ririer,
Scrivner, Kliegel, and Director of Public Works Rackers .
Items discussed were:
1) Sewer District in Mississippi Street - St. Paul Street area
The Committee discussed the issue with several of the property
owners involved and accordingly recommends the sewer district be
formed.

A letter of resignation was received from Creston Austin, Jefferson Resignation
City Fire Department, effective February 26, 1969. Creston

The following report of the Fire Department Committee was presented Fire
by Councilman Wildhaber: Committee
Fire Committee Report.
Thrusday, 7:00 P.M. City Hall
Four Committee members present, one member reporting by phone.
Working drawings of Fire Station No. 4, to be located on Ellis Blvd. ,
were submitted by Mr. Jablonsky for the Committee approval. Recom-
mendations were made by Mr. Rackers, Public Works Director and Mr.
Benton, Planning Director, concerning a few minor changes .
The Committee approved the Working drawings, as amended, to be
submitted for bids . - Setting March 27, 1969, for bid openings by
the Committee.
The Committee approved Fire trucks specifications and Fire
truck equipment request, as submitted by Fire Chief Hunter, setting
March 27, 1969, for bid opening for Fire trucks.

. Dr. Nemer, City Physician, reported that the Health Department funds
appropriated for insect control has been used and asked for an
emergency appropriation in the amount of $2800 through June 30th.
, He, also, asked for another full-time man for environmental sanita-
. tion and part time help for the fogging operation. The request was
referred to the Finance Committee.
'Councilman Stone moved that the Council approve the employmnt of
Mr. Hohenstreet on a part time basis .

Public Councilman Haake, Chairman of the Public Utilities Committee,
Utilities presented the following report:
Committee March 3, 1969
Report. Mayor Christy:
Your Utilities Committee recommends the following street light
installations and installation of fire hydrants if they meet with
the Master Plan.
1. Install 6800 lumen mercury light at Ellis and Notre Dame, two
poles west.
2. Install 11,000 lumen mercury light at intersection of West Main
' and West High.
3. Install 6800 lumen mercury light at 2507 Twin Hills Road.
4. Install fourteen (14) fire Hydrants in Area B.
5. Install twelve (12) fire hydrants in the Garden View Terrace
' Subdivision.

Annexation Councilman Hawes, Chairman of the Annexation Committee, presented
Committee the following report:
Report. ANNEXATION COMMITTEE
The Annexation Committee met on Monday, February 24, with the
following members present: Councilmen Hawes, Riner, Haake and
Wildhaber. Others present were Annexation Committee counsel R. L.
Hawkins, Jr. ; Winston Cook and Gene Knipp, owners of a tract of land
west of the City, and representatives of the State of Missouri
headed by John Paulus .
A request was made by Mr. Paulus to annex a portion of the land
owned by Mr. Cook and Mr. Knipp, which portion will be deeded to the
State of Missouri for the purpose of constructing a complex of
state office buildings.
A proposal was put before the Committee by Councilman Hawes
to annex the entire tract of land in order that the City could
exercise some degree of zoning and other supervision over the planned
development of that portion of land which will not be deeded to the
State of Missouri. This proposal was supported in discussion by
the Committee' s annexation consel, Mr. Hawkins .
Mr. Cook, representing himself and Mr. Knipp, advised the
Committee they were not in a position at the present time to present
a development plan but that they planned eventually to petition the
City Council for annexation into the City.
The proposal to annex only the tract of land to be deeded to
the City was also supported by Director of Public Works Rackers
in a letter dated February 21.
Councilman Riner moved to annex only that portion to be deeded
to the State. The vote was 3 to 1, with Councilmen Riner, Haake,
and Wildhaber voting Aye and Councilman Hawes voting no.
The meeting adjourned.
Councilman Haake moved that the report be approved.

CORPORATED AREA HEREIN DESCRIBED CONTIGUOUS TO THE PRESENT CORPORATE
LIMITS OF THE CITY OF JEFFERSON, MISSOURI; AUTHORIZING AND DIRECT-
ING THE CITY ATTORNEY TO FILE AN ACTION IN THE NAME OF THE CITY IN
THE CIRCUIT COURT OF COLE COUNTY, MISSOURI, PRAYING FOR A JUDGMENT

AND CONSUMMATE SUCH ANNEXATION AS OTHERWISE AUTHORIZED BY LAW.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
1.
That the City Council of the City of Jefferson, Missouri,,
a municipal corporation, finds and declares that the annexation of
the following unincorporated area of land, adjacent and contiguous
to the present corporate limits of the City, and more particularly.
described as follows, to-wit:
All that part of the following described tract of land
lying south of the quarter section line of Section 9, Town-
ship 44, Range 11:
A part of the north one half of the south east quarter
and a part of the south one half of the north east quarter
of Section 9, Township 44, Range 12, Cole County, Missouri,
described as follows:
Beginning at the south east corner of the north east
one quarter of Section 9, Township 44, Range 12; thence
north 76 degrees 55 minutes west 316.18 feet to the point
of beginning; thence south 29 degrees 38 minutes west 240

2. That the City Attorney be, and he is hereby, authorized
and directed, in the name of the City, to file an action in the
Circuit Court of Cole County, Missouri, praying a declaratory
judgment authorizing such annexation as proviede by law.
3. That upon the entry of the final judgment in such

are known for civic interest and active participation in those
activies which have made Jefferson City a finer City;
NOW, THEREFORE BE IT RESOLVED that the City Council
recognize the dedication and efforts of these Public Utilities and
calls upon the Missouri Power and Light Company and the Capital
City Telephone Company to exert further leadership in beautifying
Missouri' s Capital City by undertaking voluntarily an immediate
program to remove those utility poles from public right-of-way
which could be considered marginal and by indicating to the people
of Jefferson City a desire to further beautify the City by filing
voluntarily with the City Council a proposed time table for remov-
ing unsightly poles from the downtown area of the City.
BE IT FURTHER RESOLVED that the City Clerk of Jefferson
City forward a copy of this resolution to the Presidents of the
Missouri Power and Light Co. and United Utilities, Inc. , and other

Elbert H. RESOLUTION
Raithel. WHEREAS, Elbert H. Raithel purchased the following described
real estate in Cole County, Missouri, in December of 1968:
Lot No. 73, in Section No. 4, of Garden View Terrace
Subdivision, being a part of the West half of the
Northeast quarter of Section 34, Township 45, Range 12$
as per plat of record in Plat Book 7, page 73, Cole
County Recorder' s Office:
and
WHEREAS, the said Elbert H. Raithel is a building contractor
and commenced construction of a two-family duplex on said real
estate in December of 1968, and
WHEREAS, there were no building restrictions of any nature on
said real estate or the surrounding real estate at the time con-
struction was commenced, and
WHEREAS, the above described real estate became a part of the
City of Jefferson, Missouri, by annexation on January 1, 1969, and
immediately became subject of its zoning ordinances , and
WHEREAS, immediately thereafter the Council of the City of
Jefferson, Missouri, passed a resolution advising the Building
: Inspector of the City of Jefferson, Missouri, not to issue any fur-
ther building permits for the area above described for other than
single family residences, and
WHEREAS, the past policy of the City of Jefferson, Missouri,
as to areas that have been annexed has consistently been that if
.. footings were in place for the construction of a building that said
footings constituted a pre-existing no-conforming use and building
permits have been issued accordingly, and
WHEREAS, the said Elbert H. Raithel had footings in place for
a two-family duplex on said property 'prior to the effective date
of annexation of said area and said footings did constitute a pre-
existing non-conforming use, and
WHEREAS, it would be inequitable and discriminatory not to
issue the said Elbert H. Raithel a building permit as set forth
above:
NOW, THEREFORE- , BE IT RESOLVED by the Council of the City of
Jefferson, Missouri, that the Building Inspector of the City of
Jefferson, Missouri, be and is hereby authorized to issue to the
said Elbert H. Raithel a building permit for the construction of a
two-family duplex on the land described above upon a proper
application by the said Elbert H. Raithel and his compliance with
the other requirements as provided for by law.

until interested property owners could be advised.
