APPROVING SETTLEMENT OF GRIEVANCE- SAMUEL LUGO
WHEREAS, the Borough of Carteret (the "Borough") had previously instituted formal
disciplinary action against Samuel Lugo; and
WHEREAS, pursuant to said disciplinary action, the Borough issued Mr. Lugo a five (5)
day suspension; and
~VHEREAS, Mr. Lugo, through AFSCME Local 2291 ("Local 2291"), has filed a
grievance and requested a hearing with regard to his suspension; and
WHEREAS, the Governing Body has determined that it is in the public interest to settle
Mr. Lugo's grievance ~vithout the additional cost and expense ora potential hearing.
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of
Carteret, County of Middlesex, State of New Jersey, as £ollows:
1. That the previous disciplinary suspension issued against Samuel Lugo is
hereby rescinded, and he is to receive five days back-pay based upon his rate of
pay at the time of the initial suspension.
2. That ASFCME Local 2291 has agreed that settlement of the within grievance
shall not constitute, or be asserted to constitute, any past practice on the part of
the Borough.
3. The appropriate Borough officials are authorized to imp!¢ment thc terms of
this settlement.
4. That Samuel Lugo and AFSCME Local 2291 will provide a Release to the
Borough, in a form acceptable to the Borough Attorney, as to any and all claims,
or causes of action, both knoxvn and unknown, in any way related to the above
described disciplinary action.
5. That a copy of this Resolution shall be forwarded to Samuel Lugo and the
Payroll Department, with a copy to be placed in Mr. Lugo's permanent personnel
file.
