Roll Call.Councilmen present: Borgmeyer, Haake, Hawes , Kliegel, Scrivner, Stone, Wildhaber, Riner and Walther. Councilmen absent: Hiesberger absent with leave. A quorum was declared present. Approval of The minutes of the meeting of August 5th meeting were approved as Minutes received. Public A public hearing was held on the rezoning of the S .W.O'Brien property Hearing located at northwest corner of Tanner Bridge Road and Arthur W. Ellis Tanner Brdg.Blvd. from "A-1" to "C" . & Ellis There was no opposition to the rezoning. Blvd. The following bids were received for the construction of the Aurora Street Sewer (Sewer Dist. No. 110) . Bids Sterling Excavation & Erection, Inc . $ 8,993 .29 Aurora Roy Scheperle Construction Co. $ 10,495.00 Street Mr. Hawes moved the contract be awarded to the lowest bidder. Sewer. The motion passed. The following bids were received for insurance for the city buses: Bids Nelson Vincent Insurance Agency $ 5, 901 .00 Bus Central Missouri Trust Company $ 5 ,568 .00 Insurance Mr. Riner moved the insurance be awarded to the lowest bidder. The motion passed. Councilman Haake not voting. Card Appreciation A note of appreciation was received from Mrs . Virginia Riner. Mrs . Riner. A request was received from Mr. Leonard McKinney to rezone property Rezoning bounded on the south and north by old and new Highway 50 from 'AA" request single family to "F" highway commercial. McKinney The request was referred to the Planning & Zoning Commission. property. A communication was received from Horner & Shifrin, Inc . , Consulting Contract Engineers , recommending that the Acton Construction Company, Inc. , Acton be awarded the contract- for the construction of the Water Pollution Consract. Control Plant and Walnut Street Pumping Station. Company. Mr. Scrivner moved that the contract be awarded to the Acton Construction Company. The motion passed . Cable A communication was received from Lathrop, Righter, Cordon & Parker T. V. in regard to pole attachment agreement for International 'telemeter Corporation. Resident A communication from Horner and Shifrin requesting an adjustment in Engineer. the fee for a resident engineer was referred to the Street Committee. September Mr. awes moved that the regular Council Meeting in September be Council chanced from September 2nd to September 3rd, due to Labor Day. Meeting. The motion passed. Mr. Kliegel, Chairman of the Finance Committee, reported to the Council that the Finance Committee had looked into the salaries of Finance the Fire Chief and the Police Clerk. The Fire Chief' s salary is Comm. presently at $7646.00 per year, the Police Clerk at $4011.00. Mr. Report. Wildhaber moved that the Police Clerk be moved to the 4th step, at $4212 .00 per year. The motion passed. Mr. Riner moved that the Fire Chief be moved to the 3rd step, at $8028.00 per year. The motion passed. Street The following report was presented by Mr. Hawes , Chairman of the Comm. Street Committee: Report. The Street Committee met at 7: 30 P.M. , August 15, 1968, with the following Councilmen attending: Chairman Hawes , Councilmen Stone Scrivner and Kliegel; also Mr. Rackers, Public Works Director, and Mr. Benton, Planning Director. 218 __...... ... ........._ _. . ._Regular Council Meeting, August 19, 196.8. Items discussed: 1) The Committee considered the request of Mr. Aubrey Roark for permission to cut the curb along the entire side of his building, located at the Northeast corner of Jefferson Street and Ashley Street. The request was approved. Street 2) The Committee discussed the problems concerning street naming, Committee duplication and inconsistencies , and voted to submit a Resolution at Report the August 19th Council meeting initiating legal procedure to make the desired changes , with the City Clerk notifying property owners residing on the streets effected by the name changes . Respectfully submitted, /s/ Perry W. Hawes, Chairman Mr. Hawes moved that the report be approved. The motion passed. Mr. Riner, Chairman of the Buildings and Grounds Committee, reported Bldg. & that the Committee had a list of parcels of land owned by the City Grounds and the Committee would hold a meeting to discuss the sale of such Committee properties. Mr. Scrivner, Chairman of the Police Committee, stated that his Police Committee would hold a meeting with the School Board in the near Committee future. Report The following report was presented by Mr. Wildhaber, Chairman of the Fire Department Committee: Fire Mr. Wildhaber read letter, dated August 15, 1968, from Drew & Committee Jablonsky, Architects, as follows: Report. On August 7 , 1968, we had a meeting in my office with Mr. Davis of the Missouri Power and Light Company and Mr. Newman of the electric heating equipment company. Effective immediately, Mr. Davis advised that you will have a lower rate on your utility service for hearing which should reduce your electrical bill over $300 per year. Other minor adjustments to your present controls and installation of some added refined automatic items should further reduce your utility bill by several hundred dollars . We feel that these new features should bring your monthly bill down to an acceptable level and want to continually assist in any way to resolve this situation. Cordially yours , /s/ Arthur R. The following report was received from the Public Utilities Committee: Your Utilities Committee recommends the following street light Utilities installation, if it meets with the Missouri Power & Light Master Plan: Report. 1. Install 6800 lumen mercury vapor light along Country Club Drive, between the Paul Hager residence and the Don Neely residence . Respectfully submitted - /s/ Larry Haake, Chairman. Councilman Haake moved that the report be approved. Motion passed. The report of the Accounts & Claims Committee was presented by Accounts, Councilman Walther Chairman. It reads as follows: and The Accounts and Claims Committee met on Friday, August 16th, with Claims the following members present: Ken Wildhaber, Ed Kliegel, Omer Committee Stone and Jerry Walther. Listed are the Committee recommendations on items discussed: 1. Bid from Colonial Life Ins. Co. was approved with the exception that the premium not be collected through payroll deduction . 2. With reference to a communication from a local printing company that all printing business in Jefferson City be given an opportunity to bid on city printing. The Committee recommends that Sec . 1319 of the Revised Ordinancesof Jefferson City, which requires that all printing used and ordered by City of Jefferson shall bear the imprint of the union label, be repealed. We quote an Attorney General ruling dated 3-22-66 to the State Purchasing Agent - "Sections 34.200 and 34.210 R.S .Mo. 1949, provides that the State Purchasing Agent shall prepare specifications for state printing which shall be let to competitive bids in a manner specified in the latter section. After careful research we are unable to find any applicable statutes or court decisions of Missouri to the effect that State printing speci- fications shall include or omit the union label from State printing." 3 . The item of three weeks vacation for employees with five or more years of service in the Street, Sewer and Transit Authority, which ;was referred to this Committee by the Finance Committee, was held `,over for further stud 279 9 __Regular. Annexation Mr. Hawes, Chairman of the Annexation Committee , reported that the Comm.Report annexation proceedings of Area "F" had been filed with the court. The following report of the Planning & Zoning Commission was received: At the regular monthly meeting of the Planning and Zoning Commission held at the Chamber of Commerce Offices last evening, August 8, the Commission viewed and commented on plans and work maps that were prepared by Harland-Bartholomew and Associates in connection with Jefferson City' s Comprehensive Plan. The plans were presented by Malcolm C . Drummond who gave a detailed Planning explanation of steps taken thus far in the program. and It appeared to Commission members that the work was being well done Zoning and was on schedule. Report A subdivision plat of a piece of land owned by John Groner and John Guy Gibson which lies between Industrial Drive and St. Mary' s Blvd. in the vicinity of the Von Hoffman Press property was presented for acceptance and re-zoning. The plat shows a proposed roadway extend- ing north and south between Industrial Drive and U.S .Highway 50. It was recommended by the Commission that all of the Groner.-Gibson land lying between New Highway 50 West and Industrial Drive be re-zoned to I-Light Industrial and that the Groner-Gibson land lying south of the New Highway 50 West to St. Mary' s Blvd. be re-zoned to F. Highway Commercial. It was further recommended that all land lying west of Dix Road and south of the New Highway 50 West to St. Mary' s Blvd. which is not zoned F. Highway Commercial be rezoned F. Highway Commercial . It was recommended that paragraph two (2) of Section 1102 be deleted from Zoning Ordinance No. 5880. (Revised June 1 , 1964) . A request from Ralph Kalberloh, Milo Walz Jr. and David Bryan as officers of S . S . Enterprises to rezone the 600 block of West High Street south to alley to zone D. Multiple Dwellings was subject to approval of the Jefferson City Housing Authority. Bill No. 38, introduced by Councilmen Wildhaber and Hiesberger, entitled: "An Ordinance of the City of Jefferson, Missouri, regulating the sale and rental of real estate and dwellings in the City, prohibiting discrimination in the sale or rental, in the advertisement for the sale or rental, or in the financing of real estate and dwellings in the City, providing for the administration of said Ordinance and the enforcement thereof, and providing a penalty for violations thereof." Mr. Wildhaber offered Amendment No. 1 to Bill No. 38, which reads as follows: "Amend Bill 38, Section 9, paragraph (c) by striking out all of paragraph (c) and inserting in lieu thereof the following: Sec. 9. (c) After the filing of any complaint, the Chairman of the Commission shall designate one of the members of the Commis- sion to make a prompt investigation in connection therewith and to report his findings to the Commission. If the Commission shall determine After the investigation that reasonable cause exists for crediting the allegations ot, the complaint it shall immediately endeavor to eliminate the unlawful discriminatory practice complained of by conference , conciliation and persuasion. Nothing said or done in the course of such informal endeavors may be made public or used as evidence in a subsequent proceeding under this ordinance without the written consent of the persons concerned. Any member of the Commission or officer or employee of the City of Jefferson who shall make public any information in violation of this provision shall be punished on conviction thereof by a fine not exceeding One Hundred Dollars ($100) or by imprisonment in theMunicipal jail for a period of time not to exceed three (3) months , or by both such fine and imprisonment. Mr. Wildhaber offered Amendment No. 2 to Bill No. 38, which reads as follows: "Amend Bill No. 38, Section 4, paragraph (a) by striking out the "," after the word "religion" in the last line thereof and inserting in lieu thereof the word "or", and by striking out the words "or ancestry" at the end of said line.
