Approval
of The minutes of the meeting of November 4, 1968, were approved as
Minutes received.
Opening of No bids were received for the sale of $1,500,000 Sewer Revenue Bonds .
Bids Mr. John Fogarty of Stern Brothers, explained that the interest rate
Sewer was too low. He stated that their company would negotiate if no bids
Revenue were in, if it pleased the Council.
Councilman Hawes moved that the City readvertise for bids to be
opened December 2nd. The motion passed.

Petitions John Hearne, Attorney for the Committee to preserve Citizens Rights,
Fair presented petitions signed by 1097 persons to refer to the vote of
Housing the people at the next city election the Fair Housing Ordinance.
Councilman Wildhaber moved that the petitions be accepted and filed.

Petition Councilman Hawes presented the following petition:
Nelson
Drive Jefferson City, Mo.
November 18, 1968.
Honorable Mayor, John G. Christy and The City Council of the City
of Jefferson:
The undersigned residents and property owners of Nelson Drive, south
of Elm Street, respectfully request relief from a business operation
in a restricted residential area. This operation of said business
is objectionable and harmful to residents in the 500 and 600 blocks
of Nelson Drive. The said property owners purchased their homes in
this area with the understanding that this was a restricted residen-
tial area and thereby would preclude any business operation. It is
so zoned under the city zoning ordinance # 5880.
Said business is operated under the name of "Nelson Insured Tree
Service" with numerous Ads in the classified section of the telephone
directory, one of which is a large display Ad, stating that he has
stove and fireplace wood for sale, in addition to his Tree Trimming
and stump removal service.
The base operation of this business , involving numerous trucks and
other equipment, as many as twelve or more pieces at times, is
actually a street owned by the City, and designated as Magnolia
Place. The location of this business is opposite 600 Nelson Drive,
and near 601, 602 Nelson Drive, 535, 537, and 542 Nelson Drive, with
other equipment stored on property opposite 615 Nelson Drive.
This business operation is a public nuisance to the residents of
this area. They feel it has a derogatory effect on the value of
their property, which was purchased in good faith, with the expecta-
tion that the City Government, under the zoning regulations, would
protect such investments .
The undersigned request the City Council have this business of sell-
ing "top soil" "wood" and "storage of all equipment" completely and
permanently removed from this area.

Mrs. Tom Cunningham, 600 Nelson Drive, spoke on the above matter.
Mr. Rose, City Attorney, stated that Trucks or vehicles parked on
city streets or private property was not in violation of any city
ordinance, but the sale of materials in a residential area was in
violation of the zoning ordinance. Mrs. Cunningham stated that

Mr. Nelson was selling top soil, which is piled on the lot and wood
loaded in trucks. Mr. Rose then said that if Mrs. Cunningham would
. testify, he would file charges .
Councilman Hiesberger moved that the City Attorney take immediate
action necessary to see to it that City Ordinances are fully com-
plied with in the case of the reported operation of a business in a
residential area as outlined in the petition presented to the City
Council by the residents of Nelson Drive in the Fifth Ward. The
motion passed.
The following Resolution was presented to the Council:
RESOLUTION TO DIRECT READVERTISEMENT FOR SALE OF BONDS
:.BE IT RESOLVED by the Council of the City of Jefferson, Cole County, Resolution
Missouri, that One million, Five hundred thousand dollars Direct
($1,500,000) of bonds of said City, being part of the Five million, Readvertise

Standard Time, on the aforesaid date and that all of the terms of
the reoffering of said bonds as aforesaid be the same as those terms
set forth in that certain resolution adopted by this Council on the
21st day of October, 1968 directing the sale of said bonds on the
18th day of November, 1969, except that bids will be permitted which
. specify a purchase price of not less than ninety-eight per centum
(98%) of their par value for bonds bearing interest at the rate or
rates not to exceed six per centum (6%) per annum.
BE IT FURTHER RESOLVED that the City Clerk be and she is hereby
authorized and directed to give notice of the sale of said bonds by
mailing to all interested banks, bond houses , and investment bankers
in the State of Missouri or elsewhere a copy of this resolution and
two (2) copies of the bidding form specified in the aforesaid resolu-
tion heretofore adopted on the 21st day of October, 1968, revised so
as to reflect the changes in the terms of the reoffering, to be used
in bidding for the aforesaid bonds.
Councilman Riner moved that the resolution be adopted. The motion

FINANCE COMMITTEE REPORT
The City Council ' s Finance Committee held a meeting 7: 30 p.m.
Monday, November 11, 1968, for the purpose of hearing proposals
relative to the hiring a resident engineer for the Sewage Treatment
Plant.
Present: Borgmeyer, Stone, Walther, Riner, Wildhaber,Scrivner,
Hawes, Heisberger, and chairman, Kliegel. Also,
attending were Planning Director, Tom Benton, and
Director of Public Works , Ed Rackers .
Firms appearing were Richard Groner of Groner & Picker, Forrest
Capps and Associates, and Architects Engineers Planners . Correspon-
dence from the firm of Horner & Shifrin, Inc . , was distributed to
the council members .
After considerable discussion the following motion was made,
"That the firm of Horner & Shifrin, Inc . be hired as the resident
engineer to oversee the construction of the city' s new sewage treat-
ment plant."
Motion passed on a 5 to 4 vote.

Report Gentlemen: STREET COMMITTEE REPORT
The Street Committee met at 7: 30 p.m. on Tuesday, November 12,
1968. Present for this meeting were: Chairman Hawes, Councilmen
Stone, Kliegel and Scrivner, Sewer Commissioner Trotter and Director ,
of Public Works Rackers.
Items discussed were:

Council Meeting,. November 18, 1968.
1) Sewer problem (E.E1m) - The Committee met with the property own-
ers of the E. Elm and E. Miller Street area to discuss the sewer
problem in that area. After the progress on the rehabilitation
of this sewer line was outlined, the Committee recommends the
remaining portion of this line be televised to help locate the
infiltration problem. The Committee further recommends that
steps be initiated to replace portions or all of the lines as
deemed necessary by the results of the television inspection.
2) Overhead conveyor at Central Dairy - The Committee recommends
approval of the request of Central Dairy for permission to con-
struct an overhead conveyor across Cedar Street from the exist-
ing building to the new building now under construction. A 14
foot clearance shall be required and the actual design and
layout shall be subject to the approval of the Director of
Public Works.
;;3) The Steve O'Brien sewer - The Committee discussed the request of
Mr. O'Brien for reimbursement from the City for part of the cost
of the sewer serving City property on Ellis Boulevard and
referred the matter to the Director of Public Works for analysis
of the cost of the sewer on a sewer district basis to ascertain
the City's proportionate share of the cost.

, Your Utilities Committee recommends the following street light
installations and changes of existing lights, if they meet with the
Missouri Power and Light Master Plan:
1. Install new 6800 lumen mercury vapor light at 2521 Orchard Lane.
: 2. Replace existing light with 6800 lumen mercury vapor light at
1445 Major Drive.
3. Install fire plug in the vicinity of the 2500 block Orchard Lane
as recommended by the Missouri Inspection Bureau and approved by
Fire Chief Hunter and the Capital City Water Company.

The following constitutes a report of the regular meeting of the
Parking and Traffic Commission, held at 7: 30 o'clock A.M. , November
12, 1968. The Commission makes the following recommendations to the
Mayor and members of the City Council:
1. Recommends that the Loading Zone on the East side of Madison
Street at Capitol Avenue be changed to the North side of Capitol
Avenue East from Madison Street fifty-six (56) feet.
2. Recommends that the parking on the North side of Williams Street
be eliminated.
3. The Parking and Traffic Commission will defer any further con-
sideration of one-way streets until the receipt of the comprehensive
plans being prepar6d by the Missouri Highway Department and the
Department of Public Works is received.
4. The Commission has asked the Department of Public Works to
survey the intersection of Woodlawn and Oak Streets .
5. Recommends that the parking be restricted an additional seventy-
five (75) feet on Broadway Street, and an additional thirty (30)
feet on Jefferson Street, on the northwest corners of the respective
Streets at Dunklin Street, in order that the through traffic in the
left turn lane can use this intersection simultaneously.
6. Recommends that the parking be prohibited on the East side of
Lafayette Street, from Dunklin Street to the Lincoln University
entrance, to improve the traffic flow and increase the safety of
the Dunklin - Lafayette Street intersection.
7. Recommends that the Ordinance governing truck traffic on High
Street be amended to conform with our present plan of allowing
trucks on High Street until 10:00 o'clock A.M. , and to allow trucks
up to twelve thousand (12,000) pounds at all times.

Dear Mayor Christy and City Council Members:
At a regular meeting of the Planning and Zoning Commission which was
held November 14, 1968 at 7: 30 P.M. in the Board Room of the Chamber
of Commerce the following items were received, discussed and acted
upon.
The report is as follows:
1. Request from Nelson Vincent of Nelson Vincent Insurance Agency
to rezone property (approx. 150' x 241) on N.E.corner of E.
McCarty and Benton Streets, to "E" Local Commercial for purposes
of remodeling old abandoned service station to make it useable
for insurance agency office. .
Recommend that the request be granted.
2. James W. Schwerdtfeger presented plat (including street, sani-
tary sewer and storm sewer easements and layouts) of proposed
Heritage Hills Subdivision. This is to be a small 11 lot sub-
division located in the east section of the city just off Moreau
Drive. The street has frontage on Leslie Blvd. and Rosewood
Drive.
iIt is recommended that the plat be approved and accepted after the
following conditions are complied with and certified by Ed Rackers,
Director of Public Works.

a. Set back on first 115' of Heritage Hill Street be changed
from 15' to the normal 25 ' .
b. that adequate metal storm drain be extended from southerly
end of Heritage Street to a drainage ditch along the school
property.
c. that a 5' easement to the city be shown along the 115'
distance on both sides and adjacent to the Heritage Street
right of way.
3. Major Brothers (Robert and Keith) plat of Twin Hills Subdivision,
which is located between Belair Drive and Sue Drive was presented
for review and approval.
As the plat was not complete as to easements , drainage, storm sewers
sand streets it . is recommended that only the lot layout or prelimin-
ary plan be approved. Finally plans should be presented to the
:Commission for approval at slater date.
-Malcolm C. Drummond and Scott Cantine of Harland Bartholomew and
Associates, City Planners; presented for the Commission's review the
following:
1. Building use plan.
2. Condition of present building chart.
3. Building Distribution Plan. These charts were all concerned
with the uptown area - between the river and the expressway and
Mulberry .Street and Jackson Street. Some very interesting and
informative facts were brought out in the presentation.
A committee from the Chamber of Commerce - William Quigg, Rev. Jerry
Bohn and Lucille Geary sat in on this portion of the meeting.
A 54 page paper, setting out the proposed Zoning Regulations for the
new City Plan was presented and explained by Mr. Drummond. The new
regulations are quite a change from those now in use, however at
first glance it appears that the changes are necessary and wiil work
well in future planning of Jefferson City.

the establishment of a Police Department Merit System is hereby
repealed and the following new provision is hereby enacted:
!'Section 10. Persons elected or appointed to office prior to an
adoption of a merit system police department in the City of Jefferson
shall continue in office for the remainder of the term for which they
were elected or appointed."
Councilman Hiesberger moved that the amendment be adopted.

Redefining "An Ordinance of the City of Jefferson, Missouri, repealing
the City Ordinance No. 7995 of the City defining the existing city boundary,
Limits. and enacting a new ordinance pertaining to the same subject."
Read first time by title and ordered distributed to members of the
Council.

Resolution The following Resolution was presented by Councilman Walther;
Street BE IT HEREBY RESOLVED by the City Council, City of Jefferson,
Lights Missouri, that the Missouri Power & Light Company make the following
installations in accordance with recommendations presented to the
City Council by its Committee on Public Utilities, and adopted by
said City Council on November 18, 1968.
1. Install new 6800 lumen mercury vapor light at 2521 Orchard Lane.
2 . Replace existing light with 6800 lumen mercury vapor light at
1445 Major Drive.

Resolution The following Resolution was presented by Councilman Walther;
Fire BE IT HEREBY RESOLVED by the City Council, City of Jefferson,
Hydrant. Missouri, that the Capital City Water Company make the following
installation, in accordance with recommendations presented to the
City Council by its Committee on Public Utilities, and adopted by
said City Council on November 18, 1968.
1. Install fire plug in the vicinity of the 2500 block of Orchard
Lane, as recommended by the Missouri Inspection Bureau and
approved by Fire Chief Hunter, and your Company.

Parking Councilman Hawes moved that the Director of Public Works ask the
Garage. Scheperle Construction Company to hold up on the work on contract
for the Parking Garage until after the meeting of the Committee-of-
the Whole. Motion passed.
