The minutes of the meeting of May 3 and May 11, as corrected, were approved. ----------- A public hearing was held on the rezoning of property owned by Mr. Public Ed Costello from "A-2" single family classification to "D" multiple Hearing on dwelling classification. The property is located in the W. A. Beck rezoning of addition. Mr. Costello explained that small multiple units would land from be built in the area and office buildings. "A-211 to 11D11 Herschel Bledsoe, 620 Beck Street, Eli Schneider, Conrad Street and Residential. Ernest L. Fischer, 1611 St. Mary' s Blvd. opposed the rezoning as W. A. Beck they wanted the area to stay residential because it would devaluate Addition. their property. A petition was received from property owners pro- testing the rezoning. The Parking & Traffic Commission met at 7 : 30 p.m. in the Council Chambers on Wednesday, May 5. Present were Councilmen Scrivner, Van Loo, Haake and Hawes and Captain Lawrence Patton. The following recommendations were made: 1. To establish two-hour parking in the 600 block of West Main Street. 2. To eliminate parking on the north side of West Main Street. for 40 feet in each direction from a point across from j; the entrance to Jordan Street. 3. To establish no-parking on the new street connecting the Ij Plaza Shopping Center with Waverly Street. 4. Chamber with Councilman Montie Willcoxon, President j'Pro Tem, presiding. ?� Present were: Willcoxon and Councilmen Perry Hawes, Dr. .,Richard Skain, Forrest Scxivner, Jack Riner, Francis VanLoo, Larry ;!Haake, Omer Stone, Edward Kliegel and Robert Debo. 'G Dr. J. R. Robinson of 1402 Isom Drive asked 'the Committee to ;'recommend to Council that a number of violations occurred when a ;sewer was connected to his home several years ago. On motion of Mr. 'Hawes, the Committee instructed the City Plumbing Inspector to 'study Dr. Robinson' s complaints and give his ,judgement at the May ; 17 , 1965 meeting of the City Council. j Atty. Byron Kinder appeared before the Committee representing j;the Holiday Hills Subdivision. He asked that owners of the sub- ltdivision be reimbursed $7, 880 .50 for 1, 248 feet of trunk line sewer they were forced to install. Kinder said the sewer was installed }after City voters approved the sewer bond issue. He told the t;Committee tha sewer has never been used and will eventually become ja part of the City' s Sewer trunk system. Public Works Director Ed. ;;Backers verified Kinder' s report. On motion of Councilman Hawes, 0the Committee voted to recommend to Council that Holiday Hills be i" t , .� � ..�,. w. ._..,..__.. _ Regular Meeting - May. 17, .1.96.5 reimbursed $7,880. 50 for the sewer in return for all the easements the City will need for the other sewer work in this subdivision and that the City be relieved of all liabilities in this sub- division. Spencer Thomas promised he would bring construction costs to the May 17, 1965 City Council meeting. C. C . Carson appeared before the Committee representing Fred Thompson, owner of Fred' s Taxt Company. Carson said Mr. Thompson ' s franchise with the City to operate limosine service at the Airport should not be cancelled as was recommended by the Airport Commission. Carson argued Thompson has been complying with the Ordinance and :; never was presented any facts that could cancel the franchise. Airport Manager Bill Asel said letters were sent to Thompson on ; Aug. 19, 1964 and again on Oct. 28, 1964 instructing him that com- aplaints had been received on appearances of drivers and that they , were not meeting all planes. Jim Haake who is seeking the new franchise said he will operate a new Volkswagon and a 1962 Buick , Electra if he is given the franchise. He said these vehicles will . be insured for $100,000, $300,000 and $50,000 and will guarantee he will meet every flight. Haake said he holds the Air Mail contract now and must meet all flights. He said he would use students from Lincoln University as drivers and that he intended to purchase another nine-passenger vehicle if awarded the contract. Councilman Scrivner moved that the recommendation of the Airport Commission be . upheld and that City Attorney Tom Rose be instructed to prepare an Ordinance awarding the franchise to Mr. Haake . The motion was approved by a voice vote. Mr. Willcoxon brought up the request for improvement of Miller , Street between Broadway and Mulberry. He said curb and guttering, drainage repairs and street improvement would cost approximately $3,000 ., On motion of Mr. Riner, the Committee agreed to recommend that the Street Commissioner repair chuck holes in the street but hold up any major reparis for the time being. Ted Heron of the Housing Authority requested the Committee to approve employment of a City Housing Inspector and a new home , inspection ordinance. The Committee by a Grote of 5 to 4 approved employing a Housing Inspector at a salary in line with payments to other inspectors. Mr. Willcoxon, moved that the report be adopted and that permission be given to hire a Housing Inspector. The motion passed. Planning & The following report was received from the Planning & Zoning Zoning Commission: May 14, 1965 Commission Gentlemen: Report, The Planning & Zoning Commission met Thursday, May 13, 1965 at 6:00 p.m. at the Missouri Hotel . The Commission members were guests of Mayor John Christy. Election of officers was held. The following officers were elected: Chairman Bert Koester V. Chairman G. M. Threlkeld Secretary Ralph J. Kalberloh The following requests were considered: a. Request of Emily Waterman at 1200 Busch Street for a change in zoning from B - two family district to a district which would allow her to conduct a children ' s nursery, (continued from April. ) The Commission recommended that the reaction of other property owners in the neighborhood who are located within 185' be determined. Irwin for acceptance of Orchard Heights Subdivision Plat. The Commission recommends that the plat be accepted. c. The request of Lillian Reed Tweedie for a change of zoning of a part of Outlot 78 from B - two-family district, to C- multiple dwelling district. i The Commission recommended that the request be returned for additional information. The additional information shall show the reaction of property owners in the adjoining l neighborhood, a plot and type of construction and size of buildings. A 30 day extension of time is requested for this'. information and further study. d. The request of Harold Thomas and Mrs. Theodore Engelbrecht for the approval of a subdivision known as Riverview Addition, Sec. 2 The Commission recommended that the plans as presented be accepted with the condition that provision for the dul-de- sac be dedicated by the property owners. e. The Commission recommends that no action be taken on the request of Ray Brummet. The motion passed. Mr. Willcoxon, Chairman of the Street Committee reported that his Street Committee had met. The Director of Public Works had established the Committee grade on Taylor Street and have given them an estimate on concrete Report. or macadam surface. Mr. Willcoxon moved that the report be adopted. The motion passed. Dr. Skain stated that on page 515, Section 1269 of the Revised Skateboards. Ordinances of the City of Jefferson, 1956, prohibits skating on sidewalks. lie asked that proper publicity be given in the newspapers in regard to the danger of skateboards. Dr. J. R. Robinson presented the following complaint for violation Complaint for of the Plumbing Code of the City of Jefferson: violation of COMPLAINT FOR VIOLATION OF PLUMBING CODE OF CITY OF JEFFERSON Plumbing Code Dr. J. R. I, J. R. Robinson, of 1402 Isom Drive, Jefferson City, Mo. , Robinson. file this complaint for violations of the plumbing code for the City of Jefferson. 1. I reside at 1402 Isom Drive, Jefferson City, Missouri, which place was purchased by me December 30, 1958, from Major Brothers Construction Company of Jefferson City, Missouri, 2. This was a new house and had not been occupied by anyone else as of the time of my purchase. 3. Within a year, I first experienced difficulty with the sewer system in connection with the residence. The sewer backed up into my basement because of the failure of the fall on drainage. I contacted the plumbing inspector of Jefferson City and he and his men came out and ran a line and unstopped the sewer. 4. This same problem developed the following year in 1961 and ' was handled in the same manner. This was a continuous experience t; Regular Meeting - May 17 , 1965 throughout 1962. On April 3, 1963, I called Phil G. Bauer, Plumber, and he sent a man to unstop the entire drainage system of the house. 5. After these repeated failures of the sewer line, I con- tacted Major Brothers and was advised that the plumbing work had been done by Phil G. Bauer Plumbing of Jefferson City, whom I contacted and reported the failure of the sewer system, The Phil. G. Bauer Plumbing Company sent men over on four different times within four weeks to ream out the sewer line. This work was performed from June 18, 1964, to July 3, 1964. On .July 3, 1964, an employee of the Phil Bauer Plumbing Company, John Brockman, dug two deep holes in the front yard attempting to locate the sewer line they had laid. He called the office asking if they knew where the line was laid. On this occasion the Bauer Plumbing Company pulled Brockman off the job saying that they were too busy to give further relief. This advice was given to me on the third day of July, 1964. Later that day, the sewage was backed up in my basement and I was unable to use the facilities of the premises and I called Eno Walters Plumni.ng who reamed out the sewer line and advised me that they would be able to give permanent relief but that it would be necessary to re-lay the sewer. The plumbing inspector agreed to this. Inquiry was made of Phil Bauer as to the location of the sewer line and he did not firnish the information. Since Phil Bauer showed no interest and failed to advise us of the location of the sewer line, it was neces- sary to use nechani.cal ditch equipment to the depth of 10-12 feet over a wide area in our front yard and we eventually located the sewer line. Upon opening the sewer line we found: a. That it did not go straight to the street as is customary but angled to the left under the front concrete driveway toward a cut in the street in front of my neighbor' s proberty. There was no cut in the street in front of my property. b. The sewer line coming out from the basement footing came through a rough open hole with no collaring; and the clay drain tile extended under and into this opening instead of an extension of three feet of the cast iron sewer pipe outside. c . On attempting; to locate tale sewer line and in cutting; a new Glitch to the street ,ewes, 'it was foLlnd that there was only a one (1) inch full from the house to the treat metro sewer. It is respectfully suggested to the Mayor and City Council that the plumbing; code of the City of Jefferson was violated in the following particulars in the laying; of the sewer line: a. Page 2 of the plumbing code of the City of Jefferson, 1957, under Definitions - building; Drain states: The building; (house) drain is that part of the lowest piping of a drainage system which receives the discharge from soil, waste, and other drainage pipes inside the walls of the building and conveys it to the building (house sewer beginning 3 feet outside the building wall . b. Page 7 , Chapter 3, 3. 2. 1 states: Horizontal drainage piping shall be run in practical alinement at a uniform grade. (See Section 12. 3. 3 for specific slopes. ) Section 12. 3. 3 Large Piping states: Horizontal drainage piping of larger than 3-inch diameter shall be installed with a fall of not less than one-eight inch per foot . The distance from foundation to the street sewer is 68 feet . This would require a fall of eight and one-half (8�) inches. C. Section 3. 5. 3 Health or Safety states: Wherever compliance with all the provisions of this code fails to eliminate or alleviate a nuisance which may involve health or safety hazards, the owner or his agent shall install such additional plumbing or drainage equip- ment as may be Found necessary by the administrative authority. . 6 d. Section 3. 7 . 1 Support of piping states: Buried piping shall be supported throughout its entire length. e. Page 8, Section 3. 10. 1 Breakage and Corrosion states: Pipes passing under or through walls shall be protected from breakage. Pipes passing through or under cinder or concrete or other corrosive material shall be protected against external corrosion by protective coating, wrapping, or other means which will prevent such corrosion. f. Section 3. 10. 3 Pipes through footings or foundations walls states: A soil or waste pipe, or building drain passing under a footing or through a foundation wall shall be provide with a relieving arch; or there shall be built into the masonry wall an i iron pipe sleeve two pipe sizes greater that the pipe passing ithrough or equivalent protection shall be provided as may be app- ; roved in writing by the administrative authority. g. Section 3. 14. 1 Exterior openings states: All exterior openings provided for the passage of piping shall be properly sealed with snugly fitting collars of metal or other approved ratproof material securely fastened into place. h. Page 9, Section 3. 21. 1 states: Every building in which plumbing fixtures are installed shall have a connection to a public , sewer except as provided in paragraph 3. 22. 1. i. Section 3. 22. 1 states: When a public sewer is not avail- able for use, sewage and drainage piping shall be connected to an individual sewage-disposal system. J . Page 27, Section 12. 2. 3 Sewer in filled ground states: A building sewer or building drain installed in filled or unstable ground shall be of cast iron pipe, except the nonmetallic drains may be laid upon an approved concrete pad if installed in accor- dance with paragraph 12. 2. 1. Patton Requests for of the Jefferson City Police Department: May 17, 1965 Parking Gentlemen: Stalls. At the present time we have two requests for reservation of parking in the Uptown area. (1) Sears Roebuck has requested two stalls on May 20, 21, and 22 so that a trailer load of paint may be located close to the store. Stalls requested are on the West side of the 300 block Monroe alongside the Thrifty Dress Shop. (2) Chamber of Commerce has requested that the entire 100 block of Bast Capitol Avenue be reserved on June 10, 11, and 12 for the display of equipment. This consists of (26) parking daily for three (3) days. Effective January 1, 1964, a fee of $5 .00 a day per stall was agreed upon with the Chamber office to discourage the request for unwarranted stalls. The $5.00 fee per stall daily was quoted to everyone requesting reserved parking in the uptown area. A number of complaints were heard about the $5.00 per stall daily was rather high, however, the request for six of seven stalls was reduced con- 1! siderable. Only one convention failed to pay during 1964. It is requested that a policy regarding reservation of parking stalls for convention and etc. , be established by the Council. The amount of fee per stall daily is unimportant to this Department, however, the number of stalls to be reserved at one time, for what purpose and the amount established so that everyone concerned will know and equal treatment can be given to everyone.
