!� A quorum was declared present.
,'After the special meeting was called to order by the mayor a
`discussion ensued concerning a demand entered by the Cure-Linhardt
(Construction Company for payment of $62,898 .94 for rock
!;excavation at the Municipal Off-Street Parking facility, and of
Ithe offer of Cure-Linhardt Construction Co. , to settle this claim
(for $50,000.00, as transmitted in a letter dated May 9, 1962,
11from Mr. Tweedie Fisher, Attorney-at-law, representing Cure-
Linhardt Construction Co. , was had by the members of the Council
sipresent.
fl The following motion was offered by Mr. J. George Robinson, and
seconded by Mr. Vernon 0. Burkhalter:
"The claim for $62,898.84, for rock excavation and the offer of
')Cure-Linhardt Construction Co. , to settle said claim for $50,000.00
11be rejected because: (1) The architect has not approved the
claim of Cure-Linhardt Construction Co. , for $62,898 .84, for excess
rock excavation, and (2) the terms of the Contract relating to
procedure to be followed for claims for extra work were not complie
!with and observed by the contractor."
IA11 members present voted unanimously in favor of the motion .
!{On motion duly made and seconded the council adjourned subject to
`' the call of the chair.
