Council regular Council Meeting will be held, September 10, 1962 . Meeting. -------- j Desk On motion of Mr. Willcoxon, seconded by Mr. Scrivner, the City Sergeant . Attorney was ordered to draw up an ordinance, revising Section 419 of the Revised Ordinances of the City of Jefferson, making the Desk Sergeant of the Police Department an appointee of the City Marshal. Bicycle On motion of Mr. Scrivner, seconded by Mr. Willcoxon, the Council Riding. went on record, asking for the cooperation of parents in prohibiting their children from riding bicycles on busy streets . On motion of Mr. Kliegel, seconded by Mr . Scrivner, the matter of riding bicycles on heavily traveled streets was referred to the Parking and Traffic Commission . Hwy. 54 & On motion of Mr. Kliegel, seconded by Mr. Willcoxon , a study of Stadium. making a left turn at the intersection of Highway 54 and Stadium Blvd. was referred to the Parking and Traffic Commission . Jackson St . On motion of Mi. . Willcoxon, seconded by Mr. Cline, two-way traffic two-way is to be allowed on Jackson Street, between McCarty Street and traffic. Dunklin . Police Bd. On motion of Mr. Scrivner, seconded by Mr. Cline the following Report. report was approved. "The committee met in three separate meetings and the following business was discussed. 1. The committee wishes to instruct the City Clerk to furnish the Chief of Police with information as to what items were cut out of the Police Dept . Budget that was originally submitted for approval. ' 2. Methods of improving the operation of the Department was discussed 3. The Board voted to set up a meeting with the Operators of Taxi Companies for a discussion of their operations. A meeting was held on August lUth and the following complaints that had been received were discussed at length. (a) untidy appearance of drivers . (b) Drivers hauling women companions on trips. (c) Drivers offering passengers a drink. (d) General conduct of drivers . 4. The owners of cab companies were instructed to see that drivers 142 Regular Meeting, August 20, 1962 ;wear uniform caps in compliance to the ordinance governing the ;'operating of taxis in this city. 5 . The owners of cab companies were informed that there world be safety inspections made at any time that the committee thought that it was advisable. !6 . The Safety Sgt . was instructed to set up measured zones in order; to check on the accuracy of Cab meters at time of inspection or at any ;time that it was deemed necessary. '17 . The committee recommends that additional copies of Ordinance No.'; 719U ypertaining to taxi operations be sent to the Police Dept . and made 'available to Companies not having one for reference. ;8 . The committee further recommends that section 12 of Ordinance No. 7190 relating to meter flags be corrected through amendment as ?ewe have found that this section is in error. !9 . The committee recommends that all applicants for drivers permits, ;in the future be fingerprinted by the Police Dept . 1U . The committee instructed the City Attorney to send written notice "to Virgil Wells of City Cab to appear before the board to show cause or reason why that his permit should not be revoked because 'of being found guilty of violating State Liquor laws by selling :liquor without a license. The hearing was set for Thursday August 16th and after discussing the charges with Mr. Wells, the case was taken under advisement ." On motion of Mr. Burkhalter, seconded by Mr. Scrivner, the Board of :following report was approved. ; Fire Wardens ?Present: Committee members: Willcoxon, Watt, Sullivan, Burkhalter Report. Representing Taos Fire Department, Inc: Messrs . Stegeman, Vanderfeltz, Nolte, Walters and Markway. .The announced policy regarding the use of equipment of the Jefferson City Fire Department outside the City limits of the City of Jefferson was discussed. Representatives of the Taos unit stated that the council action : restricting the Jefferson City equipment to the confines of the :City had aided their membership drive, and the newspaper .'contradiction had placed them in an embarassing position with .;people living close to the City limits . They did acknowledge that at the present time they were not in a position to provide .fire protection to their subscribers . 'Their equipment is ready r'.£or delivery, and after several months training they feel that t' ,they can meet their obligation to their members . Their membership 'and organization was reviewed along with the general plan of the County for rural fire protection . As a result of this discussion, the Board recommends that the Jefferson City Fire Department: continue to serve areas adjacent to `the City at the discretion of the Fire Chief until January 1, 1963 !at which time services will be available from departments outside tithe City and runs from the Jefferson City Fire Department will be +'discontinued outside the City limits except for mutual aid calls ." "The Street Committee recommends that�a�Sewer District be Street .'established per petition request submitted to this Council by Committee ,Mr. Thomas Graham." .; Report. !The matter was referred to the Committee of the Whole, August 27th ,at a public hearing and the Clerk was ordered to make the ',necessary advertisement . :On motion of Mr. Kliegel, seconded by Mr. Willcoxon, the following report was approved, with the exception of Item Nu. 9, which was 'ordered held over until Mr. Watt returns . "1. The property owner of Betts Tavern has been requested to make -the necessary repairs to his sidewalk and has negotiated with the .Schell Construction Co. to do this work. 2. A request to install guard rails on certain portions of Schott ;Road was discussed with the highway maintenance people and they ;concluded that there does not exist enough shoulder space to make .; guard rails effective on this curve section but they will place reflectorized boards in lieu thereof. This Committee so approves . �a ` 4.3 Regular Meeting, August 20, 1962 ; 3. Mr. Robinson and the City Engoneer received verbal approval ' from the adjoining property owners to improve the intersection of lee Lane and Moreau Drive by increasing the entrance curb into Lee Lane. The Committee recommends that the Street Department do this ; work with the help of the City Engineer. 4. This Committee recommends that the drainage study for Bald Hill :! ; Road be set aside until after the Drainage Study Report is received from Horner & Shifrin in order to eliminate a duplication of work and further, it is felt that the Drainage Study Report will better i ` show the full scope of the related drainage areas . i :r5. There exist a drainage condition developed from a drop inlet i (1900 Block Hayselton Drive) and discharging onto private property.,] ' (Lot 5 & part of lot 4; Sunset Place Addition .) According to the ' City Attorney the correcting of this drainage is the responsibility !lo the City. It will require approximately 215 feet of 15 inch pipe plus installation . The property owner will give the City an easement . . The cost will approximately $700 .00 . This Committee recommends thi6 work to be done by the Street Dept. 6. As regards the petition for the improvement of Lavinia Street between So. Circle and No. Circle and the improvement of So. Circle'; between West Circle and Lavinia Street , this Committee recommends that the petition be received and filed due to lack of the required ' support for this improvement . 7 . This Committee recommends that the alley between Moreland Ave . j and Elmerine Avenue be improved for a distance of 15 or 20 feet i with "cold patch" by the Street Department . 8 . This Committee recommends that monies be made available in next years Street Department budget for the improvement of Stadium Drive from Southwest Blvd. to the proposed Hwy. 54 So. improvement . The improvement would consist of scarifing the existing roadbed, install underdrains, improve the present drainage, re-compace and increase the depth of the base and then cover with a double seal I coat . Total cost to be $20,000 .00. 9 . This Committee recommends that the improvement of Virginia Street be handled either by tax bill petitioning or, with Council approval, by means of private contract . We do not feel that the installation of curb and gutters in itself will be acceptable since a surfacing will be required if curb and gutters are installed. 10 . The matter concerning a drainage problem presented by Mr . James N. Nichols which was referred to this Committee, was evaluated and this Committee concluded the following: a. No written permit was issued for the installation of a 24 inch pipe but it is possible that a verbal permit was issuedo b . That there does exist , as Mr. Nichols states, a drainage problem in his yard from the natural flow of water coming from the back and side of his property which cannot completely enteri the existing 24 inch pipe. c . That Mr. Nichols is very possibly correct in stating - quoto "I feel the past or present owner should put in another pipe, 4 a proper entrance to the pipe, and either fill my yard or fix his yard so the water will not drain over in my yard"-unquote. d. That this Committee cannot commit itself to the solution of this problem until such time as it is made clear as to the City' s responsibility legally and/or morally regarding this drainage problem on private property." Report of On motion of Mr. Willcoxon, seconded by Mr. Burkhalter, the following Downspout & report was approved. Area Drains . "Having completed the survey of downspout and area drains discharging into our sanitary sewer system, following is a preliminary report of the results of this investigation, the cost thereof and conclusions regarding correction of these violations . Downspouts discharging into city sewers-------------59 Area Drains discharging into city sewers------------43 144 Regular Meeting, August 20, 1962 ;;Cost of Survey - Fiscal 1961-62 Man hours and material-------------------------------$980 . 10 :Cost of Survey - Fiscal 1962-63 s Man hours and material_______________________________ 250 .50 L_ TOTAL----$1,230 .6U ;Notices of these violations have been sent to the respective property ;;owners with a request that corrective measures be initiated within j;thirty (30) days . iIn most cases downspout violations could be corrected with a minimum of expense . The area drains, on the other hand, might of necessity be quite expensive. In many cases a pump installation fl !would be required to bring the water from these area drains to street �,or yard level. �f 1110ur ordinances covering storm water are very indefinite. In other j;words, there is no definition of how rain water should be handled, +`!other than to say that it must not be discharged into the sanitary !!sewers . 'We can anticipate that discharge into back yards might cause ;!further drainage problems for the City' for example, the water that bight be discharged onto a back yard could conceivably course across; :'and wash out an alley. We can anticipate, too, that damage could result it the adjoining property, which problem should be resolved by the ;.parties involved. In view of the relatively small number of violations observed, it "pis the opinion of this office that our problem is not one caused by roof and yard drains alone, but rather that other faults (such as broken lines, faulty and deteriorated manholes, etc .) exist in Four City sewers and that further study should be initiated to find these points of infiltration and correct them." on motion of Mr. Willcoxon, seconded by Mr . Scrivner, the following lReport - report was approved. Full-time ,"The Committee charged to discuss and study a matter concerning a Mayor & recommendation for a full time Mayor and City Attorney for the City Atty. ,City of Jefferson, Missouri, convened August 13, 1962, in the City Council Chamber. .This committee hereby recommends to the City Council that this not be accomplished at this time. It is the recommendation of this Committee that the mayor' s salary, ;which is now $2,400 .00 per year, be raised before the next- City :,Election ." The following resolution was adopted. iResolution "Whereas , the Cole County Grand Jury has just completed more than Cole County two months of diligent work and Grand Jury. Whereas this work was for the benefit of the City of Jefferson, as well as all of Cole County .Now, Therefore be it RQSolved that the City Council does hereby ,extend its gratitude to foreman Paul D. Adams and all members of the' ;Jury for a job well done." iThe following resolution was adopted. Resolution "Whereas , Fire Chief John Sullivan has been signally honored by Fire Chief. ;having been elected as Secretary-Treasurer of the Missouri ;;Association of Fire Chiefs at its annual conference on August 17-18-19, 1962 and, ;Whereas , this honor and distinction is reflected upon the City of Jefferson Now, Therefore be it Resolved that the City Council does hereby commend Chief Sullivan for this well deserved recognition ." The following resolution was ordered to be recorded in the minutes : Resolution for study by Mr. Robinson. Annexation. "Whereas , there has been much recent publicity on the subject of annexation of territory adjacent to Jefferson City and, Whereas, such annexation carries with it an obligation for the City to extend Municipal services to such annexed territory and ;' 145 Regular Meeting, August 20, 1962 Whereas, there exist numerous areas in the City which were annexed as much as twelve or more years ago, which have not yet been given gall municipal services and yet have paid city taxes during those years, ;Now, therefore, Be it Resolved by the City Council that additional ! areas be annexed only after reasonable assurance has been apparent that regular city services can be given to both the old and new I areas and that all existing ordinances will be complied with." 7278 ({The following Ordinance was introduced: 'Plat of 17278/ "An Ordinance of the City of Jefferson, Missouri, accepting Westwood land approving the plat of Westwood Subdivision, Part 2, A Subdivisi n Subdivision lof the City of Jefferson, Missouri, as hereinafter described." Part 2. Read first time at length, second time by title and at the request of Mr. Robinson, seconded by Mr. Willcoxon, reading of the Ordinanc for the third time was ordered held up. 7279 The following Ordinance was introduced: Traffic 7279/ "An Ordinance repealing Ordinance Number 6152 and Sections Division 20-28 of Ordinance Number 6000 (being Sections 430-439 Revised Police Dept.
