Town Attorney Alexander stated that he had written both the
Chicago Pump Go. and the J. B. McCrary Co. placing the blame on
them, and that the Chicago Pump Co. sent representatives to Tybee
in response but that the J. B. McCrary Co. did-not respond. The
Mayor stated that he had an appointment with F.W.A. representa-
tives Saturday and that they will fix responsibility and endeavor
to remedy the same, Mr. Alexander stated the matter should be taken
into court if necessary, Biotin - suggested that a letter be written
to the J. B. McCrary Co. citing what had been done and holding them
responsible - Alexander - he will write a letter to J. B. McCrary
Co. informing them that they had not answered a previous letter -
some other firm of engineers should be employed to examine the sys-
tem before we can go into court - Biotin believes that the United
States will come in and protect it - Young - the same government
engineers that approved this system will have to pass on any other
system, the Mayor stated that he had already consulted another en-
gineering firm, Mr. Alexander stated that the Town is negligible as
they employed the J. B. McCrary Co. as experts and also that, he was
going to write the J. B. McCrary Co. that unless the Town had a
satisfactory reply he was going to advise the Byck Co. to sue the
Town, Biotin stated that none of them should be released until the
final settlement.

A special meeting of the Council was held today, in the office
of Mayor Dutton in the Commercial Building in Savannah, Georgia,
and was, attended by Mayor Dutton who presided and Councilmen Walsh,
Lovell, Biotin, Young and Town Attorney Alexander.
The meeting was called for the purpose:
1. To discuss conditions existing in connection with the
Sewer System and take whatever action is necessary.
2. Authorize the purchase of one new and one used truck.
The Mayor read a letter from Chicago Pump Co. in which they
refused to accept responsibility in connection with the installa-
tion of their equipment. Mr. Dutton stated that in conference in
Atlanta-with Mr. 0. T. Ray and four other engineers all admitted
that the system in its present condition will not work, that in-
filtration of sand is considerabley more than it should be, that
the cost to redesign and repair parts of the system would cost
around $35,000.00, that the F.W.A. will not spend any more money
with the J. B. McCrary Co., that another engineer must be gotten.
The Mayor stated that he had requested the McCrary Co. to give

The following is part of the minutes held on October 5, 1944,
and through error was left out.
Councilman Slotin moved that the following resolution be adopted,
Councilman Walsh. seconded and the motion was passed:
RESOLUTION
WHEREAS a contract between J. B. McCrary & Company and The
Mayor and Councilmen of the Town of Savannah Beach, Tybee Island,
Georgia, has this day been rescinded by resolution;
AND WHEREAS it is desirable and necessary that competent
engineers be employed by said Town of Savannah Beach in order to
properly complete the installation of the sanitary sewerage system
in said town without further unnecessary delay;
BE IT THEREFORE RESOLVED by The Mayor and Councilmen of the
Town of Savannah Beach, Tybee Island, Georgia, that the Mayor of
said town be, and he is hereby, directed and authorized by said
Mayor and Councilmen in council assembled, to employ such engineer
or firm of engineers as he may deem best to represent saidTown in
properly completing and installing said sanitary sewerage system
in said town; and to enter into a contract with such engineer or
firm of engineers on behalf of said Town in order to carry out the
purpose of this resolution.

him a complete set of plans with elevation, etc. but that the
McCrary Co. stated that it would cost $120.00 for them. He noti-
fied the McCrary Co. that Mr. Ray was interested as this is the
only job that doesn't work, Mr. Ray stated that the government
cannot participate 100% in a grant, the Mayor informed him that
the Town did not have any money, Mr. Ray was leaving for Washing-
ton on the 21st and stated that whatever engineer the town employed
must be competent, the Mayor stated that he had had Mr. Wylly Gil-
lespie an engineer to come to the island and inspect the job --
the F.W.A. engineers have designed what was necessary to make the
system work, and Mr. Ray stated that the Town must make additional
application for funds as it is not a federal job, Mr. Ray suggested
if the town could raise $10,000.00 the F.W.A. could allow approxi-
mately $35,000.00. Mr. J. G. Attaway had been to see Mr. Ray, and
Attaway stated he couldn't get any sense out of the J. B. McCrary
Co., Mr. Ray wanted another contractor to finish the job. Council-
man Biotin asked if the town didn't hold the J. B. McCrary Co. re-
sponsible, and stated that the Mayor and Town Attorney should handle
the matter. The Town Attorney stated that the J. B. McCrary Co. be
notified that the town is holding them responsible for damages, the
Mayor stated that John Daniels would be in Savannah on the llth and
Mr. Gillespie would meet him there, Councilman Slotin stated that
it would be worth $10,000.00 to get the system finished but if we
were able to put up $10,000.00 what assurance would the Town have
that they would hot be called upon to put up more, Mayor Dutton
stated that the F.W.A. says the system will work and they will see
that it does work, Councilman Slotin asked what could be done, the
Town Attorney stated agree to put up the $10,000.00 provided the
United States Government participates, the Mayor Stated the J. B.
McCrary Co. should be relieved and that the firm of Smith and Gil-
lespie be employed, he stated that Mr. Gillespie had asked for a
record plan.
A letter was read addressed to the Town Attorney from the J.
G. Attaway Co. putting the town on notice that he would not perform
any more work until his bills had been paid, the Attorney was in-
structed to write the Attaway Co., the Mayor stated that Mr. Ray
informed him if the people wanted to connect to the system to let
them do it but they should not be compelled to do it. Councilman
Young moved that the following resolution terminating the contract
with the J. B. McCrary Co. be adopted, Councilman Walsh seconded
and the motion was passed:
RESOLUTION
WHEREAS, on November 4, 1943, an engineering contract was
entered into between the Mayor and Councilmen of the Town of Savan-
nah Beach and J. B. McCrary Company, Inc., providing for the ren-
dition of engineering services in connection with the construction
of sewerage system in said Town of Savannah Beach:
AND, WHEREAS, in the opinion of the Mayor and Councilmen of
said Town of Savannah Beach the said McCrary Company has failed to
properly perform its obligations under said contract;
BE IT THEREFORE, RESOLVED by the Mayor and Councilmen of the
Town of Savannah Beach, Tybee Island, Georgia, in Council assembled,
that the Town Attorney be, and he is hereby, directed and instructed
to notify the said McCrary Company, in a000rdance with the terms of

said contract, that said contract is now terminated due to the
failure of said McCrary Company to properly perform its obligations
under said contract.
BE IT FURTHER RESOLVED that said Town Attorney be, and he is
hereby, directed to send a copy of this resolution to said McCrary
Company forthwith. -
Councilman Slotin mooed that the Mayor be authorized to contact
the F.W.A. authorities and ascertain what would be the very least
amount that it would be necessary for the Town to put Up to get
government aid, to complete the job, subject to the approval of the
Council. Counoilman Young seconded the motion and it passed,
Councilman Walsh moved that the Mayor be authorized to employee

and complete the sewerage system. Councilman Lovell seconded and the
motion passed,
. Councilman Walsh moved that the Mayor be authorized to purchase
a new truck for the use of the Town and that the old International
truck be traded in on the`purohase price also that the Town purchase
a used International truck from M. R. Young for use on the Sewerage
System, for 0500.00. Councilman Lovell seconded and the motion passed.
There being no further business the Council adjourned subject
to the call Of the Mayor.

October 23, 1944.
A special meeting of Council was-held today in the office of
Mayor Dutton in Savannah, and was attended by Mayor Dutton who pre-
sided, and Councilmen Lovell, Walsh, Young, Slotin, Town Attorney
Alexander and also by Messrs. J. A. McCrary, C. V. Wagner, S. R.
Kent and H. D. Breen.
The meeting was called for the purpose of discussing with
representatives of the J. B. MoCrary Company the cancelling of the
contract between the Town and the J. B. McCrary Company.
Mr. McCrary stated that he wanted to open the discussion and
approach the matter in a cooperative manner, first was that he did
not believe that the company would-be dismissed without a hearing
and he was not willing to let it pass lying down, as far as the
money was concerned the company needed it but that was secondary,
their reputation is at stake, he wanted to work it out and can do
it cheaper without any other engineer, to hire-another engineer is
going to be expensive, as to the companys responsibility the old
Council gave assurances that they were all right, that 90% of the
company's clients were satisfied and it was his hope that they
would be reinstated as they were very proud of their reputation.
