Jobe, Kliegel, Scrivner and Vanderfeltz. 7 ;;Absent: Condit, D. Jobe, and Willcoxon. 3 A quorum was declared present. Attorney Charles Howard, stated that Harold Butzer has a sewerage problem on Highway 50 West where he wants to locate his il ;plumbing shop. City sewer runs across the property and the ;►building would be constructed over the sewer. The matter was referred to the Street and Sewer ;Committee for further study. . I It was moved by Mr. Dorr and seconded by Mrs. Fisher that the issuance of a special permit to Carter Peters for a !! �1processing plant be approved. �! Jobe and seconded by Mrs. Fisher EIthat Mr. Nance be given a special permit to operate a concrete ;mixing plant on Industrial Avenue. f The motion was adopted. I� Mayor Whaley presented a letter from the Missouri State j Highway Commission stating that they do not advise any chdnge in j ,!the bridge over Wears Creek on Jefferson Street gust south of the ,new Route 50 Highway. The letter was ordered filed. The following communication was received from E.P. Barnett. "Permission is requested to pave the west 145' of :Hillsdale Street in Jordan Sub-division. Property on both sides !of the street is owned by applicant and this will complete the street as far as it is surveyed in the City." The request was granted under the supervision of Engineers Rf i The following motion was made by Mr. Dorr and seconded by Mr. R. Jobe. "I move that the minutes of this council meeting reflect f ; that the City Council officially places itself on record that the issuance of a Special Permit to Carter Peters d/b/a Rite Way :Poultry for the operation of a Poultry Processing and Distributing .Plant in the Highway Commercial "F" District' shall not be construed ;as a precedent in any manner for the approval by this Council of :future petitions or requests for either (1) Rezoning of land in the .Highway Commercial "F" District to any other district or classifi- cation, and (2) the issuance of special permits that could authorize the use of lands situated within any Highway Commercial "F" District for any purpose not presently authorized by Section 1102 of Article XI of Ordinance Number 5880, which is the zoning ordinance of this . city. I further move that this motion be entered verbatim in the minutes of this meeting by the City Clerk." Short, hief of Police. si "It is requested that the following listed person be appointed as Patrolman of the Jefferson City Police Department, , efferson City, Missouri, effective July 1, 1959, NORMAN ARTHUR BOYD " The appointment was approved. ;I j ---------- 3 The following reRPvt was received from the City Planning an ' , oning Commission. { { "The Planning and Zoning Commission held a special meeting !? it 3:00 P.M. on Monday, June 22, 1959, to take action on two matters {; reviously referred to it by the City Council. i The two matters considered were (1) the preliminary plat of f Raymond Scheperle pertaining to a proposed subdivision located ofd` f Schott Road just inside of the eastern city limits, and (2) the a equest of Carter Peters for a special permit to operate a poultry processing plant within the Highway Commercial "F" District. 11 The Commission after prolonged discussion, study and onsideration, took the following action: i 1. Approved the preliminary plat of Mr. Scheperle and dvised him to submit his final plat of the proposed subdivision by he next monthly meeting to be held on July 20, 1959, and to conform :: o all of the requirements relating to final plats as outlined in the; ity ordinance relating to subdivisions. The Commission also gave Mxe cheperle permission to locate and place four houses to be moved froo, he new expressway right of way onto four bf the lots located in said ubdivision, and then instructed Mr. Scheperle not to take any urther action to construct or build homes in said subdivision until:; he final plat was approved. 2. The Commission on motion, made and seconded, and carrie4, Xecoamended to the City Council than said body issue a special permitl' 4o Carter Peters to conduct a poultry processing and distributing plant in the Highway Commercial "F" District under such terms and conditions as the City Council believes are reasonable and necessary., Mrs. L.M. Construction Co. , be awarded the Contract': for the widening of Chestnut Street between High and McCarty Streets �he said Hunter Bros. "An Ordinance of the City of Jefferson, Missouri, amending ?; Section 1701 of Ordinance Number 5880 of the City of Jefferson by { adding thereto subparagraph twenty (20.) authorizing the issuance 31of a special permit for the use of land for a poultry processing and distributing plant but only in the "£" Highway Commercial District." I Read first time at length, second time by title and on motion lof Mrs. Fisher, seconded by R. Jobe, the rules were suspended and the ordinance was read the third time by title and placed on final ; passage and was passed by the following vote. Ayes - Dorr, Fisher, Hager, R. Jobe, Kliegel, Scrivner and Vanderfeltz. 7 Absent - Condit, D.
