Jobe, Kliegel, Scrivner, Vanderfeltz and Willcoxon. 9 Absent: D. Jobe . 1 A quorum was declared present. Reports were received from City Officers for the month of August, 1959 . Mrs. B. B. Bolden, Kenborg Hills, reported that her car was parked on Jefferson Street while it was being resurfaced and was spotted with tar. She would like for City to pay coy- of having it cleaned and waxed which would amount to $21.59 . On motion made and seconded, the City Clerk was instructed to draw warrant for that amount: Mr. W. W. Smith asked the Council for permission to erect .a sign four feet from the property line at the new shopping center on Highway 50 West. The request was granted. A communication was received from Gus A. Erhart, Holt Summit, Mo. , asking the City to pay $35.00 for the removal of fences on his property on North Ten Mile Drive, to permit the City access to remove dirt for fill on Industrial Avenue as per cdntract. The bill was ordered paid. The following request was received from Robert Livingston, "I respectively request that I be allowed to build on the lot at 401 Castle Drive where you have a drainage easement on said lot. I have paid for street improvement on 109 feet and it will run a hardship on me if I am not allowed to build on the lot as the easement is in the center of the lot and I cannot build a house in keeping with the class in this neighborhood without putting the :garage over this easement. I will pipe the drainage easement with the proper size pipe with the City Engineer' s supervision and will maintain the pipe and will not hold the City responsible for any damage." On motion made by Mr. Dorr, seconded by Mr. Hager, the request was granted, provided that Mr. Livingston signs a release with the City to protect City from damage and add to abstract so purchases of property knows that condition exists. The following communication was received from the Capital City Telephone Co. "The Capital City Telephone Company hereby petitions the City Council to change the zoning from A-1, single family dwelling district, to F, highway commercial district, of the following .described property: Beginning at the Southwest corner of Lot No. 50 of Vista Place, which lot is addressed as 506 Vista Place, and is identified as the Southeast corner of Lot 63 of Vista Place on the plat recorded in Book No. 4, Page No. 80 in the County Recorder' s Office of Cole County, Missouri, and is located on the northerly property line of the Missouri Pacific Railroad Bagnell Branch Line; thence northerly along the westerly line of Vista Place 156.95 feet to the Northeast corner of Lot 28 of the Strong Tharp Subdivision; thence westerly along the northerly line of Lots No. 28, 27, 26, 25 and 24, 336.7 feet; thence westerly along the northerly line of Lot 23, fifty (50) feet to the Northwest corner of Lot 23; thence southerly on the westerly line of Lot No. 23, approximately 116 r234_ Regular F feet to the northerly property line of the Missouri Pacific Railroad tract; thence easterly along the northerly property line of the Missouri Pacific Railroad tract approximately ` 430 feet to the point of beginning. The above parcel of land- includes all of Lots Nos. 23, 24, 25, 26, 27 and 28 and the f 30 feet drive adjacent to the above lots, as shown on the plat of the Strong Tharp Subdivision on Page 80 of Book 4 in the Recorder' s Office of Cole County, Missouri. 'This property lies immediately north of Industrial Drive and the iUSP&F office of the Missouri National Guard. i If the requested change is made the company will build a two 'r 1,stobrick building on the premises very much like the building ry in the accompanying sketch. The premises also would be landscaped �:as indicated. The company would use such building as a storage garage and ;warehouse. In addition, there would be some repair work done to ,telephone equipment. The company would expect that the building .would be occupied by its personnel from approximately eight A.M. until five P.M. o'clock six days a week. The company contemplates investing approximately $125,000.00 ;in this property and in the construction of the improvements thereon. ,iEstimated completion date is July 1, 1963. The company has an option for the purchase of this property from Ithe owners, Mr. and Mrs. Tom C. Strong. We are authorized to tell you that they join in this request for rezoning. Our check for $25.00 as required by the ordinance accompanies this application." The request was referred to the Planning and Zoning Commission. A protest was received from-property owners in regard to ;request for rezoning 1800 block Industrial Avenue from Residential to Commercial. On motion made and seconded the protest was ordered kept on ;file for use at a later date- A communication was received from Safety Sargeant, Lloyd C. Cordes, submitting his resignation with the Jefferson City Police Department, effective September 1, 1959. The resignation was accepted. ( A communication was received from Mayor Whaley submitting the,: ::name of Samuel Lyman Moore for appointment as Traffic Officer with the Jefferson City Police Department effective September 15, 19590 The appointment was approved. A communication was received from the Duncan-Miller Parking Meter Company, requesting permission to meet with the Parking and traffic Commission to submit and discuss their proposition and to #show their parking meter. On motion made and seconded, the City Clerk was instructed to advise the Company to send a representative to meet with the City Council at its meeting of September 21st. On motion of Mr. R. Jobe, seconded by Mr. Hager, the matter of stop signs at corner of Clark Avenue and East Elm Street (signs 'facing East Elm) was referred to the Parking and Traffic Commission. A request was received for a stop sign to be placed at the porner of Riverside Drive and East Water Street. !!� The matter was referred to the Parking and Traffic Commission. Regular Meeting, Se tember 1 1959 A request for the Parking and Traffic Commission to study the sparking situation on Buchanan Street from Riverside Park entrance .to Hough Street was received. On motion made and seconded, it was referred to the Parking .and Traffic Commission. A request was received from property owners petitioning the 'Council to pave the alley between High Street and McCarty Street, Chirch Street and Vetter Lane, under the $1.00 law. The request was granted. Mr. Jake Hartman requested that a study be made of laying ,drain pipe on what is known as Walnut Street, south of Elm Street. IIf this is done it may be filled to conform with adjacent property. The matter was referred to the Street Committee. 1 A report of delinquent Liquor Dealers was received from the City Clerk and referred to the Chief of Police. Mr. Scrivner spoke of complaints received from Taxicab Companies in regard to not being able to double park in uptown area, and that ;they would like permission to double park for five minutes. On motion made by Mrs. Fisher, seconded by Mr. R. Jobe, the Mayor was given authority to see about improving Hough Park Road from Greenberry Road south to Winston Drive. Mr. Scrivner stated that Mr. Truman Walker, Contractor, had -been given permission to use a city owned lot on Johnson Street for ingress and egress to property where he is working. This has caused the necessity for a drainage pipe. On motion made and seconded, the City Clerk was instructed to .notify Mr. Walker to put in drainage pipe. Mrs. Fisher spoke of the bad condition in which plumbers leave; the city streets after making an opening to connect with sewers or water mains. On motion made and seconded, the Mayor was authorized to send out form letters to all plumbers notifying them that they will be .given one chance to fill streets properly or will be fined and that the Plumbing Inspector will now issue the permits for street cuts, instead of the City Clerk. -wwww-- On motion made by Mr. Willcoxon, seconded by Mrs. Fisher, the bills which were approved by the Accounts and Claims Committee were ordered paid. The Finance Committee recommended that Mr. Floyd Mattlage, be paid $75.00 to make trip to Fort Worth, Texas, to attend the Urban 'Renewal Workshop, September 23rd and 24th. w w w w w w w Mr. Dorr, Chairman of the Street Committee, reported that the request of Mr. John Van Hise, Manager of Missouri Hotel, had been held over for further study. w w ww .ww The Police Board referred the placing of a stop sign at the corner of Edwards and Pierce Streets to the Parking and Traffic .Commission. •.•www ww Mrs. Fisher, Chairman of the Water and Light Committee, reported that the Fire Chief did not recommend the placing of a fire hydrant at Gordon Street and Cottage Lane as it would not serve enough houses. On motion of Mr. Dorr, seconded by Mr. Hager, the matter of a .stop sign at the intersection of Dix Road and Industrial Drive was referred to the Parking and Traffic Commission. Regular I On motion made and seconded, the Chief of Police was Instructed to place an advertisement in newspaper, over weekend !asking citizens not to burn trash in gutter. The following resolution-was^adopted. "Be it resolved by the City Council of the City of Jefferson,,; ;'Missouri, that the Capital City Water Company, be and hereby is (instructed to install one fire hydrant at the turn going east on ;Mimosa Lane and one fire hydrant at the corner of Lark Street and Schott Road." The following resolution was adopted. "Be it resolved by the Council of the City of Jefferson, IIMissouri, that the City of Jefferson does hereby give authority to jthe Mayor or representative, to attend and sign in favor of the ' Agriculture Levee on the north side of the Missouri River, protecting the Jefferson City Air Port along with other property, in Cedar City, Tuesday, September 8, 1959 ." "An Ordinance prohibiting the placement, throwing, deposit and dumping on public property and certain private property, or ;within streets and alleys, and within streams and ponds whether ,public or private, certain specified materials, and providing a ;penalty for the violation thereof." "An Ordinance repealing section 844 of the Revised Ordinances of the City of Jefferson, Missouri (being Ordinance Number 6137 of ' the City of Jefferson) relating to the improvement of any street, avenue, alley or public place by sprinkling, oiling, repairing, surfacing or resurfacing, and enacting a new Ordinance pertaining to the same general subject to be known as Section 844 of the Revised Ordinances of the City of Jefferson, Missouri, 1956."
