Reports of City Officers for the month of July were received.
hA letter was received from L. E. Laurian, Col. , Corps of {
; Engineers on the matter of the City extending utilities to the
; proposed site of the Army Reserve Training program.
' The matter was referred to the Building and Grounds Committee
for further study.
Requests were received from the Capital City Telephone Company !`
,: and Mr. E. V. Nash, Warden of the Penitentiary, requesting permission
. to install an outdoor public telephone booth at the southwest corner
`iof. East State and Lafayette Streets.
The request was granted.
A bill was presented by the State Highway Commission in the ;!
; amount of $207,309.860 being 50 percent of the cost of procurement
' of the parcels of real estate indicated on the statement, together
!; with incidental costs of right-of-way agents and appraisors.
On motion of Mr. Willcoxon, seconded by Mr. Jordan, the bill
! was allowed.
i The City Attorney was instructed to write a letter to the State',
' Highway Department asking if the City Council can be consulted and
take part in the selection of appraisers of property for right-6f-w4y
for highways through the City.
A request was received from Mr. Tennis Harrold requesting the
paving of 225 feet on Castle Drive in West Hill Subdivision.
The City Engineer was instructed to prepare proper resolutions. ."
Request was received from Mr. Floyd Mattlage, Executive Directov
of the Housing Authority of Jefferson City, for a copy of the
:' revised ordinances of Jefferson City, 1956 to be submitted as an
, exhibit of the workable program.
On motion of Mr. Hager, seconded by Mr. Jordan, the request was±
granted.
A communication was received from Mr. Opel, Assistant Postmastet,
`, asking authority to anchor collection, storage or mail chute boxes. 0
On motion of Mr. Willcoxon, seconded by Mr. Condit, the request''
'; was granted and the City Clerk instructed to notify the Assistant i
! Postmaster.

!" A request was received from ten property owners for permission ii
; to extend Allen Drive from the end of the concrete street, approxim#te
ly 700 feet with an all weather street, and requesting the City
', Engineer to establish the street grade.
The request was granted and the City Engineer instructed to
establish the grade all under supervision of the City Engineer.
A complaint was received from owner and residents, regarding
the matter of noise and parking in the alley between Monroe and
:Madison in the 100 block.
The matter was turned over to the Police Department.
City Clerk, Henry Ells, advised the Council that the following
amounts had been expended from the General Revenue Fund in
! connection with the issuance and sale of the $190009000.00 Public
Improvement Bonds. ,

It was moved by Mr. Jordan and seconded by Mr. Dorr, that the
bove amount be remitted to the Revenue Fund, two tenths from the

Construction report was received from the City Engineer on the ;
Lonstruction of Debra Street between Thompson Street and City Limits:
e work being done under private cotitract.
Mr. Charles Howard, representing Mrs. Ina Green, reported that ,
s. Green had fallen on Madison Street near Roy Scheperles place,
at hospital and doctors costs amounted to $316.30. Asked if
ouncil would authorize settlement for $1,000.CO.
The matter was referred to the City Attorney and Finance
ommittee.

Mr. Fausell, 908 Minnesota Street asked the City to move dirt

On motion of Mr. Willcoxon, seconded by Mr. D. Jobe, the
bills which were approved by the Accounts and Claims Committee were
ordered paid.

the City Attorney and City Engineer take the necessary steps to pave ,

Mr. Hager spoke about people coming to Councilmen complaining
bout the raise in asked valuation of their property, causing increase
n taxes.
Mayor Ellis spoke of the work of the Board of Equalization on ?'

' Mr. Vanderfeltz reported a drainage problem at alley south of
17 and 119 W. Dunklin Street. {{
The matter was referred to the Street Committee.
Mr. Vanderfeltz spoke of the matter of Mr. George Hildebrand, i
former Street Department employee, who has been ill for some time
and asked if the City would assume the cost of his medicine bill.
Mr. Condit suggested that the cost of the medicine be run
hrough our Welfare Department.
It was moved by Mr. Willcoxon and seconded by Mr. Jordan, that
s. Convery be contacted on the matter.
The motion was adopted.
City Attorney, Rose, spoke of the suit which has been filed
gainst the City on a special tax bill in Hays Park and asked if the
ity should pay the tax bill or let the property go by default.
It was moved by Mr. Willcoxon and seconded by Mr. Condit, to

let the property be sold by the court on default.
The motion was adopted.
City Attorney, Rose, asked if college students who attend school
out of town should be required to buy city license stickers.
It was moved by Mr. Hager and seconded by Mr. Willcoxon, that
the matter be left as it now is.
The motion was adopted.
The following report was submitted by the Water and Light
Committee,,
The Water and Light Committee recommends to the City Council that
;; one light be placed on the west side of Howard Street in the 600
; block at alley north of Highway 50 West, by written request from
,, property owners.
on motion of Mr. Hager, seconded by Mr. Scrivner, the report
was approved.
The following report was submitted by the Street Committee.
Vacate street at Hart and Miller, Committee approves, providing
. adjoining property owners will pay City for small triangle shaped

Krieger complaint about bridge under McCarty Street, committee
recommends that City Engineer have channel dredged when river goes

On motion of Mr. Jordan, seconded by Mr. Willcoxon, the report
was approved.
The following report was submitted by the Finance Committee.
The matter of hiring a secretary for the Mayor was referred to
the Finance Committee. The Finance Committee recommends that the
request be denied.
On motion of Mr. Hager, seconded by Mr. Dorr, the report was
approved.
The following report was submitted by the Police Board.
The Committee recommends that a stop sign be placed at the
intersection of Union and Adams Streets, the sign to face Adams,
also that a stop sign be placed at the intersection of Houchin and ?,
Dunklin Streets, the sign to face Houchin.
We recommend that a loading zone be established at the front
of the warehouse of Missouri Van and Storage Co. in the 100 block
Lafayette Street and request that the Chief of Police determine
the location and length of the space to be alloted for this purpose'
On motion of Mr. Dorr, seconded by Mr. Jordan, the report was
approved.
The Committee of the Whole made the following report:
The Committe of the Whole met three times during the month of
,, July, 1958, tocconsider and study the matter of the collection,
transportation and disposal of garbage, trash and rubbish for
residents of Jefferson City, Missouri. This problem had been
previously referred to the Committee of the whole by the City Council
: at the regular meeting for the month of July, which was held on
Monday, July 7, 1958.
The first meeting of the Committee of the Whole was held at
' 7:30 p.m. on Tuesday, July 15th. The Committee discussed the
following topics:
1. That the city has been operating the city dump for the
benefit of residents of the city for approximately fifteen years.
2. The County Court of Cole County, Missouri, on June 10, 19580
adopted the provisions of Sections 64.460 to 64.487, termed the
County Option Dumping Ground Law.

3. The effect of the action by the County Court was to make
' it mandatory in Cole County that any disposal area be licensed by the
County Court after approval of the method of operation by the State ,:
lBoard of Health.

4. That the County Court, in the adoption of the provisions of
'! the County Option Dumping Ground Law, did not make any order, directly
' or indirectly, requiring the City Council of Jefferson City to clean
! up the present city dump.
i 5. That the city had four alternatives to select from in any' [
(; action that it might desire to take to be in compliance with the 3;
, law as adopted by the County Court, which were:
a) To municipally operate any system for the
( collection, transportation and disposal of garbage trash and refuse
Miof the residents within the city. This would entail an anticipated ;
expenditure of between $75,000 and $100,000.
j' b) To contract with some private person, firm or
Icorporation in order to provide the aforementioned services to
residents of the city. The contract would be let to the lowest and
l+ best bidder submitting a bid on such specifications and conditions
as might be determined by the City Council after study and
consideration.
i c) To combine the two methods set forth in paragraphs
!. (a) and (b) in such a manner that the City would operate a disposal ';
11area for the benefit of those residents of the City who desited to
1personally transport their garbage, trash and refuse to the municipal
i, disposal areaj :and that a contractor would provide the same service :
111for those residents of the City, who wished to pay for same, by
1collecting, transporting and disposing of said materials at a
1! disposal area to be privately operated by the contractor.

d) The city could eliminate the city dump and not
' provide any municipal or contracted service for the residents of
'! the city.
6. It was tentatively decided that the City would explore the .
; possibility of action along the lines suggested in paragraph five,
; subparagraph (b) .
E 7 . it was agreed that an exclusive contract would be given to
the bidder who submitted the best and lowest bid on such specifics- '
!! tions as might be decided upon by the City Council.

B. The City attorney was requested to contact in writing all
+, persons who had evinced an interest in the problem and who had
ilexpressed a desire or intent to make a bid for the contract in the
+levent the City contracted for the service. These persons were to
;. be invited to appear at a second meeting of the Committee of the
Whole which was set for Monday, July 21st, 1958 . The meeting then
i' adJ ourned.

The second meeting of the Committee of the Whole was held on
+Monday, July 21, 1958, at 7: 30 p.m. Present in attendance from
'ilthe public were: Mr. John Rathouz, Mr. Robert Bosch, representing
lthe three local garbage haulers, DeLuxe, Sanitary and Dependable
' Garbage Companies, Mr. David of the Mexico Disposal Company and f
;Mr. Joe Pace, operator of the Disposal Company at Cape Girardeau,
;Missouri. Mr. Herman Huber, an attorney, appearted on behalf of
I Mrs. Louis Stein, operator of the Max Baer Salvage Company, of
iJefferson City, Missouri.
I It was decided that Mrs. Stein would be permitted to pperate
1the paper salvage business presently operated on Industrial Drive,
land that the exclusive contract awarded the best and lowest bidder
1would be subject to the continued operation of any legitimate paper ;
; salvage business.
Each of the representatives of the garbage, trash and rubbish
9businesses who appeared at the meeting were asked to present their
!views on the operation and to make any suggestions they might have.
; The matter of a difference in rates for persons contracting with
`{ the operator for service and those persons who haul their own
11materials to the disposal area was discussed. The hours in which

the contractor would do business, and the number of days a week for
the business to be operated were discussed. The need for a disposal,
area to be located near to the corporate limits was discussed. The
; possibility of a residential rate based on the number of cans to be :
! used by each family was discussed. The maximum size of the garbage ;
containers and the composition of same was discussed. The length
of time in which any bidder would have to be given to prepare his
bid was discussed. The amount of time within which the operation
;, would be initiated after advertisement of the notice to bidders
was discussed. The need for a bidder' s cashier' s check and a
performance bond was discussed. The term of any contract to be
executed was discussed. The number of collections per week for non ;;
:; residential users was discussed. The need for an ordinance
iregulating the burning or dumping of garbage within the city .limits
, was discussed.
After the conclusion of the discussion, it was voted to have a
third meeting on Tuesday, July 29, 1958. to carefully consider all
:; suggestions made at this meeting and to formulate the specifications
; and conditions of a Notice to Bidders which would thereafter be
( prepared.
The third meeting of the Committee of the Whole was held on
:' Tuesday, July 29, 1958. After a lengthy discussion and consideration
l of the many matters raised at the previous meeting, the following
Notice to Bidders was formulated:
:i NOTICE TO BIDDERS
The City of Jefferson City, Missouri, requests all interested
persons, firms or corporations to bubmit written bids to the City
for the collection, transportation and disposal of (1) the garbage
; and trash of residences, hospitals, hotels, restaurants, grocery
stores, meat markets, drug stores and other places where food may
be handled, used or consumed, and (2) the rubbish of residences and
Of all commercial or business establishments within the city.
The word "garbage" is defined to be all putrescible animal and
Vegetable wastes resulting from the handling, preparation, cooking
and consumption of food.
The word "trash" is defined to include paper, empty food and
drink containers, cans, bottles, glass and crockery.
The word "rubbish" is defined to include such items as boxes,
Wood, construction or repair refuse, grass and shrubbery cuttings,
tree limbs and other normal home or yard refuse, but does not include,,
garbage or trash.
The bids shall contain the following information:
1. That the bidder will acquire a license from the County Courq'
of any county in which the bidder' s disposal area is located if said
disposal area is located in a county which has adopted the provisional;
of Sections 64.460 - 64.487, Revised Statutes of Missouri, known as
the County Option Dumping Ground Law.
2. If the bidder' s proposed disposal area is to be located in
county which has not adopted the provisions of County Option Dumping
Ground Law, that the bidder will operate and maintain said disposal
area is full and complete compliance with all rules and regulations
of the Missouri State Division of Health as enacted pursuant to the
provisions of Section 64.477 Revised Statutes of Missouri.
i 3. The location, total number of acres, and type of title to
the land which the bidder has to the land intended for use as a
disposal area.

4. The number of vehicles and a description of the vehicles
.which are intended to be used in the collection, transportation
and disposal of garbage, trash and rubbish. Pictures or photographs
of the equipment should accompany the bid.
5. The number of vehicles and a description of the vehicles in-
tended to be used in the excavation and backfilling of the disposal
urea.
6. The number of collections, which in no event .shall be less
,,than two, to be made each week for residential users of the garbage
And trash service.
7. That daily collections, if requested between Monday and
Saturdays inclusive, of garbage and trash will be made for hospitals,
hotels, restaurants, lunch rooms, drug stores, meat markets, grocery`
stores and all other places where food may be handled, prepared,
served and consumed, excluding private residences.
8. The bidder will be solely and completely responsible for the
collection of all charges made to users of said services.
9. The bidder will maintain an office in Jefferson City, with
a telephone therein, staffed with an employee between the hours of
.`,8:00 a.m. and 5:00 p.m. Monday through Friday inclusive of each
week and from 8:00 a.m. to 12:00 noon on Saturday of each week to
;answer telephone and personal calls pertaining to the services of
the bidder and to receive collections of charges from users of said
;services.
10. The date upon which the bidder will commence his proposed
,service, which in no event shall be more than sixty (60) days from
:!August 5, 1958.
11. That the disposal area will be open to accept the garbage,
trash and rubbish of residents of Jefferson City as same may be
privately transported to the disposal area by them from time to
,;time between Monday morning and Saturday noon of each week.
12. That the bidder will allow residents of Jefferson City
to transport and dump their own garbage, trash and rubbish in
the bidder' s disposal area for a reasonable charge to be agreed
` upon between the bidder and the resident, said charge to be based
:`upon the size, wkight and type of materials involved.
13. That the bidder will make extra or additional collections
`of garbage, trash and rubbish for a reasonable charge for any
;residential user of said service, said charge to be agreed upon
between the bidder and the person desiring said service, and said
!charge to be based upon the weight, size and type of materials
;;involved.
14. That the bidder will charge a reasonable price, which shall:
be negotiated and agreed upon between the bidder and the owners or
operators of hospitals, hotels, restaurants, grocery stores, meat
markets, drug stores, clubs, churches, schools, stores, shops,
:industrial plants, factories and all other commercial and business
;'places, for the collection, transportation and disposal of garbage,
'trash or rubbish, taking into consideration the frequency of the
service provided, loading conditions encountered, and the size,
weight and type of materials involved.
15. That the bidder will charge the following rates for services
'to the following private residential users:

A.
_per month for each single family residence
,for the collection of garbage, trash or both, not to exceed thirty
' (30) gallons per collection.

B. $ per month for each family residing in a
multiple family residential duelling for the collection of garbage,
trash or both, not to exceed thirty (30) gallons per collection.
16. That the bidder will pay an annual fee in the amount of
Fifty ($50.00) Dollars to the City of Jefferson City as a license
to operate said collection and disposal business.
17. That the bidder will agree to execute a contract for a
: term of five (5) years with the City of Jefferson City, Missouri,
embodying therein generally the matters contained in said bid and
such other matters as may be mutually agreed upon by and between
the bidder And the City Council of said city; that the bidder will
agree that said contract may be renewed for an additional term of
five (5) years at the expiration of the original five year term
if both parties are mutually agreeable thereto; that the contract
will provide a clause that if either party does not desire to renew
said contract for the additional five (5) year term, then said party
shall give notLce in writing at least six (6) months before the
expiration of the original term of its intention not to renew said
contract.
18. That the bidder will charge only the rates set forth in
paragraph fifteen (15) of this notice of bids for the services
mentioned in paragraph fifteen (15) during the term of said original
; contract and any additional extended term thereof, and that the bidder
will not increase said rates, with respect to the services provided
for in paragraph fifteen (15) without the authorization of the City
Council of Jefferson City, Missouri.
19. Each bid shall be accompanied by a cashier' s check in the
amount of Five Thousand ($5,000.00) Dollars to guarantee to the City
of Jefferson that the bidder will abide by and honor its bid and
enter into a contract with the City if said bid is accepted. if
the bidder, whose bid is accepted, fails to execute a contract with
the City, the $5,000.00, evidenced by the cashier' s check, shall be
forfeited to the city. Upon the execution of the contract, the
cashier' s check of the successful bidder and all unsuccessful bidders
will be returned.
20. The bidder to whom the contract shall be awarded shall be
required to give a corporate surety bond, to be approved by the Mayor
and the City Council of the City of Jefferson, in the sum of Twenty
Five ($25,000.00) Thousand Dollars to guarantee to the City the full
and faithful performance of the bidder' s obligations under the terms
of said contract.
21. Under the terms of said contract, the bidder shall agree to
indemnify and hold harmless the City of Jefferson, Missouri, from
any and all liability, obligations, suits, or damages resulting
from the operation of the bidder, his agents, servants or employees
in the performance of the contract; the bidder shall be required
and shall agree to carry Workmen' s Compensation Insurance on all of
his employees, and the bidder shall be required and shall agree to
have in force and effect during the existence of the contract Public
Liability and Property Damage Insurance in the minimum amounts of
$50,000.00 for one person, $100,000.00 one accident or occurrence,
and $10,000.00 property damage.
22. The City of Jefferson, by ordinance, will require all
residential users of the bidder' s services to use corrugated
galvanized metal or durable plastic garbage containers, of a
capacity not to exceed thirty (30) gallons, equipped with tight
fitting lids, and the bidder will not be obliged to serve residents
of the city desiring service whose garbage and trash containers do
not meet the above mentioned requirements.

23. The person, firm or corporation, whose bid is accepted by
!the City, will be granted an exclusive contract to render the services
;;mentioned in this notice to bidders with the exception that any person,
;firm or corporation, presently or hereafter engaged in the collection
�Jof paper, cardboard and paper products for the purpose of resale or '
;reuse, shall be permitted to collect and sell said paper, cardboard ;,
"and paper products.

24. All bids shall be in writing, sealed and delivered to the
!office of the City Clerk in the City Hall Building, Jefferson City,
Missouri, by 5:00 p.m. on Monday, August 25, 1958.

25. The City of Jefferson, Missouri, through its Mayor and
;,City Council, reserves the right to reject any and all bids, to i!
;!refer said bids to any appropriate Committee of the Council for
: study, analysis and consideration, and to award the contract to
the person, firm or corporation which submits the lowest and best
