Jobe and Vanderfeltz. 3 A quorum was declared present. The following resolution was adopted. ! "Be it resolved by the City Council of the City of Jefferson f ity, Missouri, as follows: Whereas the City Council of Jefferson City has been advised ;that a petition has been presented to the County Court of Cole County Missouri requesting that body to refuse to issue to Mr. John Rathouzo ,of 2000 Meadow Lane, Jefferson City, Missouri, a license to operate a sanitary landfill disposal area on a 240 acre farm which is located 'bn the Old Elston Road about 5.3 miles west of the western city limits of Jefferson City, Missouri, and Whereas the City Council has received a copy of a letter directed to Mr. John Rathouz, the original of which is in the possession of the County Court, and written by the Division of Health of the State of Missouri, wherein the Division of Health states that it has inspected and approved the above located 240 acre farm site As a suitable location for a sanitary landfill disposal area in Cole: County, Missouri, and Whereas the City Council is of the opinion that Mr. John Rathouz is a reasonable and suitable person to conduct and to operate said sanitary landfill disposal area under the terms of Sections 64.460-64.487, R.S. Mo. , and Whereas the City Council at a meeting of said body on the 29th day of August, 1958, did award to the said John Rathouz a contract providing for the collection, transportation and disposal of garbage, trash and refuse of all Cole Countians who reside within, Jefferson City, Missouri, said contract having been awarded to the lowest and best bidder after the examination of three competitive bids, and Whereas the City Council of Jefferson City has devoted a considerable amount of its time and study in working out a satisfac- tory solution to the garbage and trash problem in Jefferson City after the CountyCourt adopted the County Option Dumping Ground Law I n June 10, 1958, in order to comply with the law as adopted in Cole County, Missouri, and Whereas the City Council is of the strong opinion that the .award of the contract to John Rathouz, under the terms of the I roposal submitted by Mr. Rathouz to the City Council, has resulted in a complete obligement and fulfillment by the City Council to the Cole Countians who reside within Jefferson City for the maintenance of a proper garbage, trash and rubbish collection, transportation and disposal service, NOW THEREFORE" 1. The City Council requests the County Court of Cole County, ', Missouri, to issue a license to operate a sanitary landfill disposal area on the 240 acre farm heretofore referred to which has been inspected and approved by the Division of Health of the State of Missouri. 2. The City Council declares its position to be that should the County Court refuse to issue said license to John Rathouz solely because of the location of the proposed disposal area, then the City Council is of the opinion that the County Court should take the proper action to repeal its adoption of the County Option Dumping Ground Law entered of record by the Court on June 10, 1958. 3. That the City Clerk of Jefferson City, Missouri, is hereby directed to make a Certified Copy of this Resolution and deliver the same to the Presiding Judge of the County Court of Cole County, Missouri, before 900A.M. of the 8th day of September, 1958. 4.
