Jobe, Jordan, Scrivner, Vanderfeltz and Willcoxon. 10 Absent: None. A quorum was declared present. i Reports were received from City Officers for the month of October, 1958. I A letter was received from Mr. Jerry E. Hayes, 2303 Hayselton ;Drive, regarding the drainage situation in the 2300 block Hayselton Drive. The matter was referred to the Street Committee. ' !i A letter was received from Mr. Forrest Carson, asking that �a strip of land, 60 feet wide along Howard Street, be rezon ed. The matter was referred to the Planning and Zoning Commission. :'. .j A letter was received from Mr. Floyd Mattlage, Executive Director of the Housing Authority, asking that the City allow an amount not exceeding $100.00 for incidental expenses during the next fern months The request was granted. i A letter was received from Mr. Wendell Manchester, asking the City to pay a plumbing bill to Mr. Eno Wolters for installing a new sewer at his property at 1144 E. McCarty Street. The request was referred to the Street Committee, Plumbing ;i Inspector and Street Commissioner. ! A letter was received from Mr. Paul Doll, requesting the j Council to reconsider his original bid to purchase a lot designated as "tract 2" in his bid. On motion of Mr. R. Jobe, seconded by Mr. Scrivner, the bid was accepted and the question of giving a warranty deed or a quit-cliii .deed was left to the City Attorney. A letter was received from Fire Chief Sullivan, inviting the Council to attend a demonstration of extinguishing actual fires in the 500 block Washington Street at 9: 30 a.m. , November 12, 1958. The letter was ordered filed. Request was received from Mr. Robert Livingston, requesting :that the grade be established on Livingston Drive from Castle to Under Drive and also permission to grade above street after grade Is established. i The request was granted. Request was received from Mr. Robert Livingston for permission;; to grade Binder Drive from Mar� l}n Drive to Livingston Drive. The request was referred to the Street Committee. A request was received from Mr. George W. Jones for a permit to make a 20 foot break in the curb between 1125 and 1127 Darlene Driv The request was granted under supervision of the City Engineerk A petition was received from residents on Ridgewood Drive stating they do not want the name of "Ridgewood Drive" changed to West Miller Street" . li The petition was ordered filed. f 1 A letter addressed to Mr. Monte Willcoxon, was received from Dr. A.P. Stephan, stating that no repair work has been done on the road on his property at Renn Addition. The matter was referred to the Street Committee. 4 i; rIto Regular Meeting- NovembAr 3- Ig5a OF { Request for a street light in the 1500 block of Notre Dame was ' received and was referred to the Water and Light Committee. j Request was received from Mr. George Rehagen for a rezoning 'fit 600 and 602 Clark, Lot No. 92.93 and part of 94-95-96. The matter was referred to the Planning and Zoning Commission. , Request was received from Mr. Buell Baclesse for a rezoning bf certain property a part of Reserved Tract of Block 5 in Jefferson;; eights Subdivision. The matter was referred to the Planning and Zoning Commission. ,, I A letter addressed to Mr. R. D. Fowler, City Engineer, was f eceived from Haskins, Riddle and Sharp, regarding the Grays Creek atershed. i; The matter was referred to the Street Committee, along with ;the City Attorney, City Engineer and a representative of Haskins, ±t Riddle and Sharp, and of the State Board of Health and Mr. Hager. 1! A letter was received from Mr. Alex Vetter, regarding the 'approval of the Bartholomew Plan for Off-Street Parking in the ,"Central Business District" . ;1 The letter was ordered filed and on motion of Mr. Willcoxon, econded by Mr. R. Jobe, Mr. N. R. Beagle and the Advisory Committee4 , ere authorized to begin negotiations with the property owners for '.. ' ff-street parking sites with view of obtaining options to purchase h ; and for a reasonable price to be determined by the Bond Advisory i! ommittee on a basis of official or unofficial estimates made for fhe Committee. r I A letter was received from Mr. E. C. L. Wagner, in regard to he request to locate a large electric sign closer to the property line than 25 ft. , the sign to be located on property in District Oighway Commercial. ! Mr. Wagner advised that the Planning and Zoning Commission recommends that the zoning ordinance not be changed to permit the erection of a sign closer than 25 ft. to the property line. After a discussion, it was moved by Mr. Jordan and seconded �y Mr. R. Jobe, that McDonAld Company be allowed to put sign on l property line. The motion was adopted. The resignation of Mr. Robert Neeley as a Traffic Officer was received and was accepted by the Council. Appointment of Mr. Forest Whaley, as a member of the Housing 1uthority to succeed Mr. E. C. L. Wagner, whose term expired at this ;; ime and who requested that he not be reappointed. The appointment was approved. i� Appointment of Mr. Roy B. Burnette as a Traffic Officer to jl Teplace Mr. Robert Neeley was received from Mayor Ellis. The appointment was approved. i I Appointment of Mr. Jack Schneider as a traffic officer to replace Mr. Carl Monteer, who was appointed to Sergeant of the ;? olice Department. The appointment was approved. Mr. Jack Wilson spoke to the Council concerning the proposed ewer District at his property on West Main Street and asked that he outline of the District be changed. The matter was referred to the Street Committee, City Attorney,; end City Engineer to confer with Mr. Wilson and report to the ouncil Meeting on November 17th. �i Reg ular Me tin ovember 3 1958 Mayor Ellis explained the situation at the old City Dump and the farm of Mr. Wolken and advised that Mr. Denning, Peat Exterminator, is working on the extermination of the rats by the purchase and I lacing of poison at the dump and also advised that Mr. Wolken had been notified as to the termination of the rent of the dump and Mr. Opal Roark had been notified as to the termination of his salary On motion of Mrs. Fisher, seconded by Mr. Condit, the hills which were approved by the Accounts and Claims Committee were ordered paid. I A report was received from Mr. E. C. L. Wagner, chairman of ;the Planning and Zoning Commission, recommending that a permit be I( granted to the Capital City Water Co. to make the slight change } ;requested in the location of their proposed clear water well. On motion of Mr. R. Jobe, seconded by Mr. Dorr, the following J permit was granted. II SPECIAL PERMIT i li ;WHEREAS, Capital City Water Company of Jefferson City, Missouri, !! did petition the City Council for the issuance of a Special Permit j 'to use certain hereinafter described property for the construction of a clear water basin or clear-well in furtherance of the purposes, ;: objects and operations of the utility' s business, and WHEREAS, the City Council did refer the matter to the Planning and I Zoning Commission for its recommendation and consideration jointly 0 with the Water and Light Committee of the City Council, and WHEREAS, the Planning and Zoning Commission as well as the Water and;' 'Light Committee of the City Council did consider and study said -petition and did recommend to the City Council that said Special Permit should be issued to the Capital City Water Company so that hereinafter described property might be used for normal purposes I incidental to the operation and expansion of the utility' s facilities, and WHEREAS, by newspaper publication in the Jefferson City Post-Tribune which appeared more than fifteen days prior to the date of the hearing on the issuance of said Special Permit aforesaid notice was `given to all members of the public in said City advising that a ;hearing would be held by the City Council in the Council Chambers "of the City Hall at 8 p.m. on the evening of Monday, June 2, 1958, i 'at which time all members of the public might appear and be heard on the issue, and <f ,F WHEREAS, the City Council did conduct said hearing and did hear all f ;persons who desired to be heard on the issue, and ,WHEREAS, there were no objections to the issuance of such Special Permit and the City Council did adopt the following Resolution: "BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: i f "Section 1. The Capital City Water Company is hereby !i issued a special permit permitting the use of the following described land, which is located in a �i District ' C' Multiple Dwelling District, for public utility purposes and for any purpose which is normally incidental and necessary to the operation and expansion 112 Reaular Mpetin2, November 3. 1959 of its utility facilities: j i "' Part of Inlots 12 and 13 of the City of Jefferson, i Missouri, and more particularly described as follows: Beginning on the north line of said Lot no. 12 at I a point 35 feet west of the northeast corner thereof; thence south parallel with the east line of said Inlot No. 12, 175.0 feet; thence east parallel with It the north line of said Inlots 12 and 13, 139 feet !± 4� inches to the east line of said Inlot 13; thence r north along the east line of said Inlot no. 13, ' 175.0 feet to the northeast corner thereof; thence west along the north line of said Inlots 13 and 12, if 139 feet 4� inches to the point of beginning.'II "Section 2. This Special Permit shall be effective when � approved by the City Council" , and t EREAS, said Special Permit was approved by the President of the !± ity Council on June 11, 1958, and EREAS, an investigation made by engineers for Capital City Water ,pompany has now determined that it would be better in the interest of he utility' s business to locate the clear water basin or clearwell farther to the north and west than the location hereinabove described, 'end ' HEREAS, Capital City Water Company has requested the City Council to 'teconsider the matter and re-issue such Special Permit permitting he use of the hereinafter described property for construction of the said clear water basin or clearwell, and "EREAS, the City Council has considered the change in location which �s a part of the original location and immediately adjacent thereto or which the Special Permit was granted and is an integral part of he property owned by Capital City Water Company for its purposes, ,Objects and operations of a utility business, and ' ' HEREAS, the Planning and Zoning Commission as well as the Water and ',,fight Committee of the City Council did recommend issuance of a ,tpecial Permit for construction of a clear water basin or clearwell on the originally described property and there were no objections i�naade by members of the public to the issuance of said Special Permit : fter proper notice had been given as set forth above, and EREAS, the new location is a part of the original location and mmediately adjacent thereto, and is an integral part of the property weed by Capital City Water Company for its purposes, objects and ' perations of a utility business, now, therefore, E IT RESOLVED BY THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: ection 1. The following report was submitted by the Police Board "The Committee recommends that no parking be allowed on the {. east side of Dix Road from West Main to St. Mary' s Blvd. "Recommend that the request for a stop sign on Capitol and iJackson be denied. �t "The Committee approves the apointment of Carl Monteer for the position of Sergeant created by a vacancy. "The Committee approves the appointment of William D. Jobe, the bids ;Mere referred to the Street Committee, City Attorney, City Engineer i And Special Road District, to report at next Council Meeting. { The following resolution was adopted. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF JEFFERSON, ISSOURI, REQUESTING THE RESERVATION OF CAPITAL GRANT FUNDS, APPROVI�G E UNDERTAKING OF SURVEYS AND PLANS FOR AN URBAN RENEWAL PROJECT, D THE FILING OF AN APPLICATION FOR FEDERAL ADVANCE OF FUNDS. 1WHEREAS, Under Title I of the Housing Act of 1949, as amended, and he Housing Act of 1954, the Housing and Home Finance Administrator l.s authorized to extend financial assistance to localities in the elimination and prevention of the spread of their slums and urban ;light through the planning and undertaking of urban renewal projecti�; and WHEREAS, it is desirable and in the public interest that the Housing;; Authority of the City of Jefferson, Missouri, prepare surveys and lane, presently estimated to cost approximately fifty thousand, even hundred sixty-three dollars ($50,763) , in order to undertake 'end carry out an urban renewal project of the character contemplated!; . y Section 110 (c) of said Title I, in that certain area, proposed ,�s an Urban Renewal Area, situated in the City of Jefferson, County of Cole, and State of Missouri, and described as follows: Beginning at the southeast corner of Lafayette Street and ,wranklin Street, thence west along the south side of Franklin to the' est side of Jackson Street, thence north along the west side of Jackson Street to the right-of-way of the proposed Highway U.S. 50 , and 63; thence east along the south limit of the Highway right-of-way to the east side of Clark Avenue, thence south along the east side 6f Clark Avenue to the south side of East Dunklin Street, thence ' eat along the south side of East Dunklin Street to the east side of fayette Street, thence south along the east side of Lafayette treet to the point of beginning. i. �MEREAS, the above-cited Federal law requires as a condition to the �xecution of. a contract for a loan and capital grant for an urban enewal project that the locality present to the Housing and Home Finance Administrator a workable program, as set forth in Section 40(c) of said Title I, for utilizing appropriate public and private ! resources to eliminate and prevent the development or spread of, slums and ;rban blight, to encourage needed urban rehabilitation, to provide or the redevelopment of blighted, deteriorated, or slum areas or o undertake such other feasible community activities as may be luitably employed to achieve the objectives of such a program; and WHEREAS, it is recognized that contracts for loans and capital granto for urban renewal projects will require,, among other things, (1) the :, approval of the urban renewal plan by the governing body of the locality in which the project is situated; (2) the provision of local grants-in-aid which may consist of donations of cash, land, +Xlemolition or removal work, and the installation, construction or reconstruction of streets, utilities, parks, playgrounds or other improvements or the provision of other public buildings or facilitieq; #nd (3) the development of a feasible method for the relocation of families displaced from the urban renewal area. �OW, THEREFORE, BE IT RESOLVED BY the City Council of the City of Jefferson, Missouri: P ection 1. That the proposed Urban Renewal Area described above is i` slum, blighted, deteriorated or deteriorating area in need of { Ii Begulgr Meeting, November 3. -1958 redevelopment and appropriate for an urban renewal or land clearance project and that the undertaking by the Housing Authority of the City of Jefferson of surveys and plans for an urban renewal project of the character contemplated by Section 110(c) of the Housing Act of 1949, as amended and supplemented, in the proposed Urban Renewal Area described above, is hereby approved. i Section 2. That the financial assistance provided under said Title to assist urban renewal projects is needed and that the Housing and ! Home Finance Administrator is hereby requested to reserve for an .;urban renewal project in the proposed Urban Renewal Area described ',above Federal capital grant funds in an amount sufficient to enable the Housing Authority to finance the undertaking of the project. i ;Section 3. That it is cognizant of the conditions that are imposed in the undertaking and carrying out of urban renewal projects with ' :Federal financial assistance under Title I, indluding the requirements of said Title I respecting the workable program mentioned above, and; that it is the sense of this body (a) that a feasible method for the, ,relocation of families displaced from the urban renewal area, in 'conformity with said Title I, can be prepared, and (b) that local grants-in-aid, consisting of donations of cash, land, demolition or ;removal work, and the installation, construction or reconstruction ,'of streets, utilities, parks, playgrounds or other improvements or ithe provision of other public buildings or facilities, necessary Ifor carrying out in the Urban Renewal Area the urban renewal objectives of said Title I in accordance with the urban renewal plan, can and ;will be provided in an amount which will not be less than one-third ';.of the netr project cost and which, together with the Federal capital: ;grant, will be generally equal to the difference between gross project costs and the proceeds or value of project land sold, leased ;or retained for use in accordance with the urban renewal plan. 'Section 4. That the filing of an application by the Housing Authority of the City of Jefferson, Missouri, for an Advance of funds from the United States of America to enable to defray the cost of the surveys : And plans for an urban renewal project in the urban renewal area d described above is hereby approved." �i 6669/ The following ordinance was introduced. Erhart which related to the grading and excavation by II he City of the Erhardt' s land touching on the improvement of Industrial Drive, and enacting a new Ordinance pertaining to the s ubject."
