said contract, that said contract is now terminated due to the
failure of said McCrary Company to properly perform its obligations
under said contract.
BE IT FURTHER RESOLVED that said Town Attorney be, and he is
hereby, directed to send a copy of this resolution to said McCrary
Company forthwith. -
Councilman Slotin mooed that the Mayor be authorized to contact
the F.W.A. authorities and ascertain what would be the very least
amount that it would be necessary for the Town to put Up to get
government aid, to complete the job, subject to the approval of the
Council. Counoilman Young seconded the motion and it passed,
Councilman Walsh moved that the Mayor be authorized to employee
$a<< engineering firm to take over
and complete the sewerage system. Councilman Lovell seconded and the
motion passed,
. Councilman Walsh moved that the Mayor be authorized to purchase
a new truck for the use of the Town and that the old International
truck be traded in on the`purohase price also that the Town purchase
a used International truck from M. R. Young for use on the Sewerage
System, for 0500.00. Councilman Lovell seconded and the motion passed.
There being no further business the Council adjourned subject
to the call Of the Mayor.

A special meeting of Council was-held today in the office of
Mayor Dutton in Savannah, and was attended by Mayor Dutton who pre-
sided, and Councilmen Lovell, Walsh, Young, Slotin, Town Attorney
Alexander and also by Messrs. J. A. McCrary, C. V. Wagner, S. R.
Kent and H. D. Breen.
The meeting was called for the purpose of discussing with
representatives of the J. B. MoCrary Company the cancelling of the
contract between the Town and the J. B. McCrary Company.
Mr. McCrary stated that he wanted to open the discussion and
approach the matter in a cooperative manner, first was that he did
not believe that the company would-be dismissed without a hearing
and he was not willing to let it pass lying down, as far as the
money was concerned the company needed it but that was secondary,
their reputation is at stake, he wanted to work it out and can do
it cheaper without any other engineer, to hire-another engineer is
going to be expensive, as to the companys responsibility the old
Council gave assurances that they were all right, that 90% of the
company's clients were satisfied and it was his hope that they
would be reinstated as they were very proud of their reputation.

The type_of system installed here has worked elsewhere, the prin-
ciple is right -- the Chicago Pump Company have their side and he
was not prepared to say they have not fulfilled their obligations,
they were two months to correct defects which implied that they
knew they were wrong, Mr..MoCrary showed the original plans dated
May 5th, 19+1 -- . :Mrs. MoC ary^ stated the Chicago Pump Company
did not see the original specifications -- Mr. McCrary stated the
McCrary Company did not buy the pumps,that it was done by the pro-
curement division of W.P.A. -- Mr. Alexander asked Mr. McCrary did
Mr. Vinson make a statement that if the Chicago Pump Company could
not furnish 250 GPM pumps that they substitute 200 and 300 GMP
pumps -- Mr. Wagner stated that at stations one and two and seven
and eight specifications called for 100 GPM pumps, the U. S. Govern -
ment ordered the pumps not the J. B. McCrary Company -- Mr. Alex -
anderasked if the government ordered pumps from the Chicago Pump
Company which differed from those specified by the McCrary Company
-- Councilman Slotin asked if the J. B. McCrary Company as engineers
would permit anything to go into the system unless it was right --
Mr. McCrary stated that the pumps and equipment remained packed in
crates fourteen months before being opened -- Councilman Slotin
stated that the McCrary Company should have let the Town know if
anything was wrong as practically no one on the Board knew what a
sewer system was and for that reason they hired what they thought
were the best engineers to look after the job so as to protect the
interests of the town -- Mr. McCrary stated that when the pumps
were bought his company knew nothing of the specifications as the
government was in the picture -- Councilman Slotin stated that the
system must be finished, everyone is blaming each other and who was
going to pay the Byck Electric Company's bill Mr. Alexander
stated that on September 9th, 1944 letters were written to the J.
B. McCrary Company and also the Chicago -Pump Company about the con-
ditions existing, the Chicago Pump Company sent their representi-
tive but that the McCrary Company never answered the letter -- Mr.
McCrary stated that'his Company made mistakes as all do -- Council-
man Slotin stated that regardless of who made the mistakes is it
fair for the Town to take all of the blame -- Mr. Wagner stated
that Mr. Cappy of the Chicago Pump Company denied making any criti-
cism df:.the system -- Mayor Dutton read a letter from Mr. Jacobson
of. the Chicago Pump Company stating that the equipment furnished
was to exact specifications but that the equipment was not adequate
-- Mr. Wagner stated that the Chicago Pump Company informed him
that they had complied with the specifications, but to cooperate
would send an engineer to the job with the necessary materials to
correct the defects -- Mayor DuttonEeked if bronze flaps were in-
stalled would the system work -- Mr. Wagner informed him that it
would -- Mr. McCrary stated that Mr. Wagner originally designed the
system with the motors above ground -- Mr. Wagner statedthat he
would not put pumps. in any system if he could avoid it, that at
Tybee it was necessary to use pumps and that he wanted to place
the motors above ground on this system but due to the additional
oast this could not be done as sufficient funds were not available
-- Mr. Alexander asked that if the efficiency of the motors would
be effected by their being placed underground -- Mr. Wagner stated
not necessarily that,,the original switches were defective but that
new switches have been installed Councilman Young asked if the
system was designed to meet a certain count of money or to take
pare of the population -- Mr. Wagner stated that it was designed
to meet a set amount of money, and that this same type of plant is
all over this area -- Mayor Dutton asked if Mr. Vinson could have

told if the equipment he had was not up to speoifications -- Mr.
Wagner stated he did not know -- Mr. Alexander stated that Mr. Vinson
allowed the equipment to be installed and asked if a competent
engineer would inform Council to accept the system if it was not in
order, Mr. Vinson didnOt protect the interests of the Town -- Coun-
cilman Slotin stated that he had Mr. Attaway - examine a cave -in in
front of a cottage and Mr. Attaway informed him that this was caused
by the design of the system and that it was happening all over the
island, blowouts caused by not having eoncre- to -caps in the wyes, in
quite a number of instances Q.B. packing -- Councilman Slotin stated
that when the bids were opened under F.W.A. Mr. Vinson was pulling
for the J. G. Attaway Company and that one could not confer with him
-- Mr. McCrary stated that his oompany covers a large territory but
that they should have known of conditions existing with Mr. Vinson --
Mayor Dutton stated that when an engineer is employed it is the en
gineer's responsibility to see that work is done right -- Mr. Alex-
ander stated that contradictory letters make it difficult to fix the
blame -- Mr. McCrary stated that at the beginning of the work if he
had known the conditions that were existing that the Town would have
gotten a better system, but that the defects can be remedied, that
the Town can get another engineer -- that the remedy now is for the
Town to go after the U. S. Government for more money, that they are
willing to relieve the situation -- Mr. Wagner stated that the proper
thing to do would be to put the motors above ground in the present
location putting small houses over them about g feet square -- Mayor
Dutton stated the original design shown a force main -- Mr. Wagner
stated that it was out out on a000unt of the cost, but that if the
money could be gotten it would be well to put it in, that the F.W.A.
did not think it necessary to put in a force main, that the cost to
put in a force main, enlarging the pumps and put the motors above
ground would be about el40,000.00 -- The Mayor stated that he had a
letter from the J. G. Attaway Company that they willnot do any more
work until we pay them what we owe, how is the Town to know whether
Attaway has breached his contract or not -- Mr. Wagner stated he
didn't think Attaway was liable except for the wyes etc. -- The Mayor
stated that an engineer 18 needed to say what Attaway should do,
that two thirds of the time when Attaway was laying the pipe there
was no supervision of the work being done -- Councilman Slotin asked
what we were going to do with Attaway -- Mr. Wagner stated that Mr.
Attaway had said that if the Town had paid him he would not have
left the job -- Mr. Alexander stated that the purpose of the meeting
was to discuss the reoinding of the Town's contract with the J. B.
McCrary Company -- Mr. McCrary stated he wanted to avoid a law suit
if possible and if all would cooperate the job can be completed --
Councilman Biotin asked how we were going to get the money from the
government for the balance -- Mr. McCrary stated the government is
in it from the time they bought -the pumps, and that no more money
could be gotten until the Atlanta office of the-F.W.A. approves, the
J. B. McCrary company will take their mistakes and cooperate --
Councilman Slotin stated that the Attaway Company claimed we owe them
$5,200.00 which we do not have to pay until the U B..government pays
us -- the Mayor stated that Mr. Attaway informed him if engineers
tell him what to do he will do it -- Mr. McCrary stated that through
courtesy the Board was holding this meeting and he wished to extend
thanks for this courtesy, that Mr. Vinson made mistakes but when he
was sent to this job he was the best that could be gotten at the
time, he would not be returned but that another engineer would be
sent in his place -- the Mayor asked if the wyes were fixed would
that correct the situation also that the J. B. McCrary Company give

The Mayor asked Mr. McCrary to write a letter to him advising
as the Town's engineers, how much of the job the J. G. Attaway Co.
had completed, and also what would be required for Attaway to complete
the job according to his contract. Mr. McCrary agreed to do this.
There being no further business the Council adjourned subject

The regular meeting of Council was held today at 5:00 P.M., in
the Council Room, and was attended by Mayor Dutton, who presided,
and Councilmen Hosti, Lovell, Siotin, Young, Walsh and Town Attorney
Alexander.
The minutes of the meetings of October 5th, 10th and 23rd were
read and adopted.
The Mayor informed Council that he had requested Mr. J. G.
Attaway to give him certain information relative to the Sewer System
and Mr. Attaway informed him that he could not give it.

The Mayor informed Council that Mr. E. H. Abrahams had made a
request for a refund of $50.00 paid by him for a stubbing fee, as
this•fee had•aiso been paid by Mr. W. D. Prescott, his plumbing
contractor, Mr. Blair, the plumbing inspector, was called in and he
stated that Mr. Abrahams had had the stub placed at one location but
that it had been placed so high that it was necessary to go into the
