Mr. Robinson inquired of the Chair as to what type of Council meeting was being held, Mr. Hawes, explained that it was an Adjourned Meeting to finish j the business of the December 2nd meeting, that it had been formally announced 1� as to time and place. Mr. Robinson objected as Rule 2 of the Council was not complied with; that this is an illegal meeting. The following statement was read by Mr. Robinson: Statement from "For the record, the undersigned declares it to be his opinion that the Mr. Robinson, proceedings of the City Council of the City of Jefferson are not legal and are without force and effect because the laws of Missouri and of the City have not �! been complied with. " ' Mr. Debo moved that the minutes of the meeting of December 2nd be approved. Minutes. ?I 11 Mr. Robinson stated that he would like to move for corrections. That on page 385, immediately before the paragraph entitled "Gun jf Cabinet and Police Dept, " the words "On motion of Mr. Robinson, the communication was referred to the Street Committee and City Attorney" be €' stricken, By voice vote, the motion failed to carry. E 13. That on page 387, the last sentence of the paragraph entitled "Insurance Program, hire Dept. " be changed to read: "Mr. Robinson requested that the Chairman of the Fire Department Committee might resign when matter comes before Committee, as he has a brother on the Pire Department which might causO conflict of interest. " By voice vote, the motion failed to carry. 14. That on page 387, entitled "Fire Dept. Committee Report" line 11, the word 11 adopted" be stricken and the word "accepted" be inserted in lieu thereof. By Voice vote, the motion failed to carry. 15. That on page 389, the item entitled "Parking and Traffic Commission Report" show that each item was individually adopted. By voice vote, the motion failed to carry. ,Mr. Riner then offered a substitute motion to Mr. Debo's motion, that the minutes of the meeting of December 2nd be approved, as follows: "That the ;Council subpoena the tape from Radio Station KWOS, so that the City Clerk could i 'copy the minutes from that tape word for word. " After some discussion, that motion was withdrawn. Mr. Debo's motion that the minutes be approved as submitted, was upon roll call and carried by the following vote: Ayes: Debo, Hawes, Hogg, Jobe, Scrivner and Willcoxon. 6 Nayes: None. Presnet: Cline, Kliegel, Riner and Robinson. City Atty's. Mr. Hawes stated that the City Attorney had cast a cloud on the validity of Opinion. proceeding with the President Pro tem elected at a meeting December 2nd in the `Chair. The City Attorney stated that even if the President Pro tem is not 'lawfully elected and consequently does not hold that office, he is a de facto officer and under the law all ordinances and actions otherwise properly enacted by the Council would be valid and legal, but that only a Court could give a final judicial opinion. Finance Vencent Willmeno, Fire Inspector, requested purchase of additional air packs Committee, for use of the Fire Department at an approximate cost of $1500. 00. On motion of Mr. Debo, the matter was referred to the Finance Committee, to report back to the Council at next meeting. Bill No. 106 Bill No. 1003, introduced by Councilman ,Jobe, entitled: Appropriation "An Ordinance to appropri ate money for the month of October-, 1 963. " October, 1963. :Read first and second time by title and on motion of Mr. Willcoxon, the ruler were ruspended and the hill was read the third time by title and placed oil final passage and was passed by the following vote as Ordinance No. 7450. Bill No. 108, introduced by Councilman Jobe, entitled: Salary of "An Ordinance of the City of Jefferson, Missouri, amending Section 4 of Maintenance :Ordinance Number 7365 relating to the salaries and compensation of City Elective Man, Parking and Appointive Officials, by providing for the salary and compensation of the Garage. maintenance man for the Municipal Off Street Parking Garage. " Mr. Scrivner made a suggestion that the maintenance man should get the same salary as he did when he worked for the Street Department. On motion of Mr. Debo, Bill No. 108 was referred to the Parking and Traffic Commission, motion was withdrawn. Install one new 6, 800 lumen mercury vapor light in the middle of the 400 block on Locust Street. "Be it hereby revolved by the City Council, City of Jefferson, Missouri, that the Capital City Water Co. , make the following installation in accordance with a recommendation presented to the City Council by its Committee on Public Utilities and adopted by said City Council, on December 4, 1963: Install a fire hydrant on Industrial Drive about 675 feet east of another hydrant now located near the intersection of Industrial Drive: and Jaycee Road. The City Attorney is to take the matter under advisement. Parking and Mr. Hogg referred the matter of a stop sign at Ridgeway and Livingston to the Traffic Parking and Traffic Commission.
