PUTNAM COUNTY" LIBRARY The Greencastle Common Council met in Regular Session Tuesday, May I3, 1997, 7:00 p.m. at the Putnam County Library. Mayor Michael called the meeting to order. On the Roll Call, the followin_> were found to be present: Councilor Roach, Councilor Hammer, Councilor Green, Councilor Baynard and Councilor .Masten. Also present was City Attorney Zeiner. Resolution 1997 -15, A Resolution Authorizing Additional Appropriation, was read by Mayor Michael. This Additional Appropriation is for a change order for the ISTEA local match. Motion to approve was made by Councilor Masten, seconded by Councilor Hammer. Vote was unanimous. 4 There were no public petitions or comments. Kathy Staton, Park and Recreation Director, took her oath of office and cave the Park and Recreation Department Report. Councilor Roach asked about South Putnam's use of the tennis courts. Mayor Michael responded that she asked the Park Board and there was no objections so it was left as is. Wastewater Superintendent Charlene Nichols was absent. BC /CP Andonov stated that in Appendix A of the Building Permit Fees regarding Accessory Buildings there needs to be an asterisk ( *) to include S.05 per square foot. Councilor Roach made the motion to approve minutes from March 3, 1997, Regular Session and April 8, 1997 Regular Session as submitted, seconded by Councilor Masten. Vote was unanimous. Mayor Michael presented Council with a Proclamation for Municipal Government Week. Motion to accept made by Councilor Masten, seconded by Councilor Roach. Vote was unanimous. TCI Update was given by Dave Bohmer. Mr. Bohmer stated that not all issues are resolved at this time and stated that a three month extension would be in order. Councilor Masten requests O a Cable Committee meeting be called to discuss issues. Mayor Michael asked Council to authorize her to sign a three month extension. Councilor Masten made the motion to authorize the Mayor to sign a three month extension on the TCI Cable Contact. Motion was seconded by Councilor Roach. Vote was unanimous. Mayor Michael requested item N, Resolution 1997 -22, A Resolution Declaring An Economic Revitalization Area (H.A. Parts Products of Indiana Co.), be addressed at this time due to representatives from HAPPICO being present. President Sasaki stated HAPPICO is requesting a five year tax abatement for the equipment on a new 45,000 square foot paint building. No abatement is being requested for the building. Councilor Masten made the motion to waive the reading and approve Resolution 1997 -22. Motion seconded by Councilor Baynard, vote was unanimous. Mayor Michael read Resolution 1997 -16, A Resolution Authorizing Creation of Yard Waste Appropriation 201001316 and Transfer of Budgeted Part-Time Pay to said Appropriation in the 1997 Budget of the City of Greencastle. Motion to approve made by Councilor Hammer, seconded by Councilor Green. Vote was unanimous. City Claims were approved on a motion by Councilor Baynard, seconded by Councilor Hammer. Vote was unanimous with Councilor Masten abstaining. Ordinance 1997 -8, An Ordinance Amending Parking and Traffic Control in the Area of Gobin Methodist Church, second reading. Mayor Michael read Ordinance 1997 -8 with revisions. Motion to approve made by Councilor Masten, seconded by Councilor Hammer. Vote was • unanimous. Resolution 1997 -17, A Resolution Appropriating ISTEA Reimbursement to Appropriation 402001315, was read by Mayor Michael. Motion to approve made by Councilor Hammer, seconded by Councilor Green. Vote was unanimous. Ordinance 1997 -7, An Ordinance Regarding Adult Bookstore/Business Regulation, second reading. Mayor Michael stated that this is listed as first reading, should be second, first reading was at Plan Commission. Motion to approve made by Councilor Hammer, seconded by Councilor Baynard. Engineer Barnes stated the two locations permitting Adult Businesses are Putnam Plaza and at the intersection of Doc James Road and U. S. 231 North. Councilor Roach stated that he understands the well meaning and intent of the Ordinance, but there are only two very impractical locations. I am alluding to Video Stores who have a separate area that contain Adult Videos explained Councilor Roach. BC /CP Andonov stated that this Ordinance would not have any effect on these stores. This Ordinance is to address the "primary intent of the business ". Councilor Roach stated that it needs to be clarified in the Ordinance. Councilor Masten stated that the intent is to keep clearly stated Adult Businesses out of residential areas. Councilor Roach stated that he is opposed to this on personal freedoms. Vote as follows: Ave Nay Councilor Hammer Councilor Roach Councilor Green • Councilor Baynard Councilor Masten " Ordinance 1997 -10, An Ordinance Creating a Police Training Class Fund and Appropriation, first reading, was read by Mayor Michael. Motion to approve made by Councilor Roach, seconded by Councilor Masten. Vote was unanimous. Councilor Roach made the motion to appoint Councilor Masten to the Subcommittee on County Wide Building Department. Motion seconded by Councilor Green, vote was unanimous. Resolution 1997 -3, A Resolution Approving Payment of College Street Storm Drainage Project. Motion to table made by Councilor Masten, seconded by Councilor Green. Vote was unanimous. Bill Dory gave a brief summary of compliance regarding HAPICO, Crown and Wal -Mart. All are in compliance. Resolution 1997 -19, A Resolution Affirming HAPPICO Compliance with Statement of Benefits. Motion to approve made by Councilor Roach, seconded by Councilor Hammer. Vote was unanimous. Resolution 1997 -20, A Resolution Affirming Crown Compliance with Statement of Benefits. Motion to approve made by Councilor Roach, seconded by Councilor Hammer. Vote was unanimous. Resolution 1997 -21, a Resolution Affirming Wal -Mart Compliance with Statement of Benefits. Motion to approve made by Councilor Roach, seconded by Councilor Hammer. Vote was unanimous. Ordinance 1997 -9, An Ordinance Approving a Water and Trash Deposit Increase, first reading, read by Mayor Michael. Motion to approve made by Councilor Roach, seconded by Councilor Masten. Vote was unanimous. Councilor Baynard reported that the property at Berry and Sycamore has been offered for sale if the City is interested in purchasing for a neighborhood park. The approximate purchase price is $25,000.00. Councilor Masten stated that a core sample has to be done to investigate contamination. Council asked Park Director Staton to look into this.
