HomeMy Public PortalAbout2013-07-16 ZBA minutes VILLAGE OF PLAINFIELD ZONING BOARD OF APPEALS RECORD OF MINUTES DATE: July 16 , 2013 Chai rman Sobkoviak called the Zoning Board of Appeals meeting to order at 7:10 p.m. ROLL CALL: Commissioners Seggebruch, O’Rourke, Renzi, Kiefer, Green , and Chairman Sobkoviak were present. Commissioner Heinen w as absent ; Fire, Park , School and Library Dist rict s were absent. Also present were Michael Garrigan , Village Planner, and Merrilee Trotz, Recording Secretary Approval of Minutes: The ZBA minutes from July 1 7 , 2012 w as accepted as presented. PUBLIC COMMENTS: Chairman Sobkoviak asked for public c omments on items that were not on the agenda. There was no response. DEVELOPMENT REPORT The development report w as presented during the Plan Commission portion of this meeting. OLD BUSINESS : - None NEW BUSINESS: Case No. 16 25 -062113 .V Ingersoll Ho use Mr. Garrigan stated this is a public hearing for a variance being heard pursuant to public notice being published and posted in accordance with state statute and all applicable village ordinances. The correct address for the property is 24010 W Commer cial. This house was previously located on the property of Dr. Muraglia who wanted to proceed with demolition and construct a new parking lot. Staff worked with the applicant to relocate this historic house to the adjacent lot to the west and re -subdivid e the lots. The app licant will probably seek a landmark designation at a future date. The Pioneer house to the west is already landmarked. At this time the applicant is seeking a variance to construct an addition to the north of the existing structure to make the house more marketable. Mr. Garrigan stated this house is a good example of a classic upright wing with Greek revival influence dating back to 1835. The applicant is seeking a variance as the addition would exceed the limit of 30% floor area rat io for an R -1 lot. The lot is 6180 sq. ft. The existing house with the addition would be approximately 2,000 sq. ft. excluding the garage; the overall impervious surface for the house and garage would be 41.5% of the lot. Mr. Garrigan reviewed the fin dings of fact. a) The variance is in harmony with the general purpose and intent of this Zoning Ordinance . Michael P. Peck James Racich Dan Rippy Plan Commission Minutes July 16 , 2013 Page 2 of 3 Staff stated this house dates back to 1835; the area was platted in the 1830s; incorporated smaller lots with a classic grid street system; and the l ots in this neighborhood are substantially smaller and consistent in size with this lot. b) The plight of the owner is due to unique circumstances and thus strict enforcement of the Zoning Ordinance would result in practical difficulties or impose excep tional hardships due to the special and unusual conditions that are not generally found on other properties in the same zoning district . The relocation and renovation of this structure were completed under unique circumstances to save this historical stru cture. c) The property cannot yield a reasonable use if permitted only under the conditions allowed by the Zoning Ordinance . The applicant could construct a smaller home addition but the smaller home would be very difficult to market. d) The variance, if gr anted, will not alter the essential character of the locality and will not be a substantial detriment to adjacent property . The existing character of this neighborhood will not be impacted by this proposed variance; many homes in this neighborhood have s etbacks that do not conform as the lots and setbacks were smaller. Mr. Garrigan described the location of the addition and garage. Mr. Garrigan stated this is a very unique situation and Staff recommends a favorable recommendation with the two stipula tions noted in the staff report. Chairman Sobkoviak swore in Debra Olsen. Mrs. Olsen stated she has a potential purchaser for the house upon completion; described the proposed addition. Commissioner Seggebruch asked if this would be a one story additi on; height of roof and setbacks. Mr. Garrigan indicated the setbacks will be met and this variance is for lot coverage only. Commissioner Kiefer asked what would be protected if the property were to be landmarked. Mr. Garrigan felt it would be only the original structure. Commissioner O’Rourke asked for clarification of the percentage of the impervious area. Commissioner Renzi asked if there were any agreements made when the house was moved and the lots were re -subdivided. Chairman Sobkoviak indicat ed there were no agreements. Commissioner Green suggested the patios and walks could be made of permeable materials that would not add to the impervious area. Discussion was held regarding the impervious area and the possibility of adding a third stip ulation. Plan Commission Minutes July 16 , 2013 Page 3 of 3 Commissioner Kiefer and Chairman Sobkoviak thanked Ms. Olsen for preserving the building. Commissioner O’Rourke asked if there were any comments received from the neighbors. Mr. Garrigan indicated there were no comments from the residents. Com missioner O’Rourke made a motion to make a favorable recommendation of the proposed variance for the proposed relief from the 30% and 42% FAR requirements as outlined in the R -1 district. 1. Compliance with the requirements of the Village Engineer. 2. Complianc e with the requirements of the Plainfield Fire Protection District. 3. The total impervious area shall not exceed 50%. Commissioner Seggebruch seconded the motion. Vote by roll call: Renzi, yes; Kiefer, yes; Green, yes; Seggebruch, yes; O’Rourke, yes; Sob koviak, yes. Motion carried – 6 -0 with 1 Commissioner absent. Discussion: Commissioner Green commended Ms. Olsen for working with Staff to conserve and bring new life into our history. Commissioner Renzi asked about the new landscape and berm barrier th at was placed between what was a bank and daycare located on 135 th Street; asked if there was a cross access. Mr. Garrigan indicated there was a cross access; both the family therapy business and the daycare owners wanted the access removed. Mr. Garrigan stated the cross access could easily be restored if either business were to relocate. Commissioner O’Rourke asked if the chain and “Do Not Enter” signs would be removed now that that barrier is in place. Mr. Garrigan indicated the signs should be remov ed now. Commissioner Seggebruch mentioned that in the reuse of a bank building with a business that does not need the drive -thru that drive -thru might be removed. There was no further discussion.
