Savannah Beach, Tybee Island, Ga.
March g, 1945.
The regular meeting of Town Council was held today in the
Council Room at 4100 P.M., and was attended. by Mayor Dutton, who
presided, and Councilmen Lovell, Biotin, Walsh, Young, Hosti and
Town Attorney Alexander.
The Mayor informed Counoil that the Tilton, First and Eighth
Streets jetties should be repaired now, it was decided to have En-
gineer Davis survey same and report to the Mayor.. .
Town Engineer Davis stated that he had made an inventory of
all the equipment of the Town, it was the opinion of Council that
when any new equipment is received it should be added and when
any goes out it should be deducted.
Town Engineer Davie requested that one rodman and one line-
man and one man . to operate the equipment be employed, Councilman
Slotin asked if Mr. Kent and the darkies working with him could
not do this work, Councilman Young stated that they were needed
to look after the Sewerage System, Mr. Davis also asked'for two
men to take oare of the equipment eto., he presented a list of
work to be done. Counoilman Slotin moved that. Mr. Davis be auth-
orized to employ two helpers as rodman and ohainman, the pay not
to exceed 40¢ per hour each, also that he be authorized to employ
two laborers temporarily, subject to approval of the Mayor, Coun-
cilman Walsh seconded and the motion passed.
The Mayor informed Council that he had read a letter from
Wiedeman & Singleton to the Division Engineer of the F.W. A.
showing proposed changes etc. to the sewerage system, also he
had a letter from John Daniels of the F.W.A., in connection with
the final inspection by Wiedeman & Singleton, that Mr. Daniels
stated that whatever was necessary to be fixed must be taken oare
of, and also.that data must be gotten from the J. B. McCrary Co.
Town Attorney Alexander said he called on J. B. MoCrary, of the
McCrary Company, and requested the information, Mr. McCrary stated
he would give it but he would have to use a new man to get it lip,
he had received a letter from Mr. McCrary that the information was
being worked up.
Councilman Young moved that a set of cleaning tools for use
on the sewerage system be purchased, amounting to 463.8o, plus
freight, Councilman Hosti seconded and the motion passed.
Counoilman Young stated that the two darkies employed on
the sewerage system wanted an increase of $10.00 per month each,
Councilman Slotin moved that the increase be granted effective
Maroh lat, Councilman Lovell seconded and the motion passed.
Councilman Young informed Council that he had had Mr. Reeves,
Superintendent of the Hunter Field Sewerage Department, come down,
and inspect the treatment plant, and that Mr. Reeves, himself, Mr.
Davis and Mr. Carter went over the entire plant, and that Mr.
Reeves stated that the plant was being operated efficiently, Coun-
cilman Young stated that Mr. Carter is doing a good job and that
his impression is that Mr. Davis is not very familiar with the
sewerage system.

Councilman Walsh stated that the Estate of Marie C. Powers
had protested the high assessment on their property and wanted it
reduced. Councilman Biotin moved that the value of the lot be re-
duced to $1404'.04, Councilman Hosti seconded and the motion passed.
Town Attorney Alexander stated that some complaints had been
made relative to the conduct of the driver of the school bus, Mayor
Dutton stated that he had handled the matter with Mr. Dunn of the
Board of Eduoation.
Mr. A. C. Carter presented a quit claim deed covering part
of the old CRR right of way adjoining his property, requesting
that this portion be conveyed to him. The matter was referred to
the Town Attorney.
It was decided that the parking area be opened on Sundays
effective April 15th.
Mr. S. '. Smith petitioned that the charge for stubbing fees
on his Lot 104, ward 5, be reduced. The matter was referred to
the. Chairman of the Sewerage Committee to handle.
The petition from Mrs. C. H. Cobb and other property owners
in the vicinity of 17th Street and the Strand, requesting that the
bad, unsanitary condition existing caused by water running from
the street on to their property, be corrected. The matter was re-
ferred to Councilman Young.
A letter was read from Mr. E. S. Stoddard suggesting that
the Town buy some of the newly released government inseot destroyer.
Received as information.
Petitions were presented from C. L. Laoour, as operator of
Scrumpy's and T. B. MoCarroll, as operator of the Ocean View Hotel
requesting the privilege to sell whiskey at these locations and
also that they be granted a pro -rated license to April 17th for
the sale of whiskey. Councilman Hosti moved that they be granted
and that a proviso be made that the Town do not issue any more
whiskey licenses, also that in the future that a maximum of eight
be allowed, Councilman Walsh seconded and the motion passed.
Councilman Biotin moved that the following Ordinance be
adopted, Councilman Young seconded and the motion passed.
ORDINANCE
AN ORDINANCE TO PROVIDE FOR THE RATE OF LICENSES FOR DOING
BUSINESS IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA,
FOR THE FISCAL YEAR ENDING APRIL 3OTH, 1946; FIXING PENALTIES FOR
THE VIOLATION; AND FOR OTHER PURPOSES.
. SECTION 1. Be it ordained by the Mayor and Councilmen of
the Town of Savannah: Beaoh, Tybee Island, Georgia, in Council
assembled, and it is hereby ordained by the authority of the same,
that.the licenses for doing business in the Town of Savannah Beach,
Tybee Island, Georgia, for the fisoal year ending April 30th, 1946,
shall be payable on or before the commencing of such business and
shall be as follows:

,SECTION 2. In the event any business or calling not speci-
fically mentioned in the above list set forth shall be established
in the Town of Savannah Beach, Tybee Island, Georgia, the Mayor and
Counoilmen reserve the right to establish a license fee for same
by Ordinance, which fee is to be of equal dignity as the license
speoifioally mentioned in the above Section, provided, however,
that such license shall not be more than the sum of Five Hundred
Dollars ($500.00).
SECTION 3. This Ordinance shall be subjeot to alterations
or repeal in whole or in part at any time during the fiscal year
beginning May lst, 1945, should it be deemed advisable, and no
such amendment or repeal shall be construed to impair the right
of Council to assess or levy tax for the whole of such year when-
ever made.
SECTION 4. Any person, firm or corporation owning or opera-
ting any riding devices, or passenger vehioles for hire, before
being issued a lioense therefor, shall deposit with the Clerk of
Council a policy of insuranoe against personal injury and property
damage, with a receipt showing that the premium thereon has been
paid for the length of time covered by the license, in suoh com-
pany and in such amount as may be approved by the Mayor and Coun-
cilmen, for the benefit of any person or persons who may be killed
or injured or sustain damage to property by reason of the operation
thereof.
SECTION 5. The Mayor and Councilmen reserve the right to
refuse to issue any lioense for any purpose for reasons deemed
suffioient by them.

SECTION 6. Any person procuring a license on or after
November L, 1945, shall pay one -half the fee therefor set forth
in this ordinance.
SECTION 7. Any person, firm or corporation violating any.
of the provisions of Section One (1) of this Ordinance shall, upon
conviction before the Mayor's Court of said Town, be subject to be
fined in the sum of not more than One Hundred Dollars ($100.00) or
be imprisoned not more than thirty (30) days, either or both or
any portion of either or both in the discretion of the Court.
SECTION g. All ordinances or parts of ordinances conflict-
ing with the provisions of this Ordinanoe are hereby repealed.
Councilman Biotin moved that the following bills covering
purohases for the month of March for the following be approved:
General Government $ 504.64 , Sewerage Account 11133.09, Stubbing
Account $257.90. Councilman Hosti seconded and the motion passed.
Councilman Walsh moved that the Sewerage Account, Operations
and Maintenance, be closed out effective April 30th and the balance
be transferred to the General Fund, Councilman Young seconded and
the motion passed.
Councilman Young moved that the following resolution be ad-
opted, Councilman Hosti seconded and the motion passed.
RESOLUTION
WHEREAS that portion of First Street in the Town of Savannah
Beach, Tybee Island, Georgia, being also a part of United States
Highway No. gO, lying between Campbell Street and Butler Avenue,
is the only route by which traffic may move in and out of said
Town of Savannah Beach;
AND WHEREAS due to the heavy traffic moving over said road
or street in repent years the pavement thereon has become badly
broken, uneven and in need of repairs;
BE IT THEREFORE RESOLVED by the Mayor and Councilmen of the
Town of Savannah Beach, Tybee Island, in council assembled, that
the State Highway Department be, and it is hereby, requested to
make an inspection of said portion of First Street in order to
determine what repairs or repaving are necessary in order to put
it in good condition, and is further requested to cause such re-
pairs to be made or such repaving to be done at the earliest
possible time.
BE IT FURTHER RESOLVED, by the authority aforesaid, that a
copy of this resolution be sent to the Chairman of the State High-
way Department, and to the member of said Commission representing
the First Congressional District, with the request that they lend
their assistance in having said work performed.

Councilman Walsh moved that the following Ordinance be
adopted, Councilman Young seconded and the motion passed.
AN ORDINANCE
AN ORDINANCE TO PROVIDE FOR THE TAXATION OF REAL AND
PERSONAL PROPERTY IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND,
GEORGIA, FOR THE FISCAL YEAR COMMENCING MAY lst, 1945; AND FOR
OTHER PURPOSES.
SECTION 1. Be it ordained by the Mayor and Councilmen of
the Town of Savannah Beach,. Tybee Island, Georgia, in Council
assembled, and it is hereby ordained by the authority of the same,
that the rate of taxation upon real estate and personal property
within the limits of the said Town of Savannah Beach, Tybee Island,
Georgia, for the fiscal year oommenoing May lst, 1945, shall be
TWO AND TWENTY-TWO HUNDREDTHS (2.22) PER CENT upon the assessed or
returned value of same, the value of real estate improvements to be
ascertained from the returns of the Committee on Assessments of
said Mayor and Councilmen, and the valuation of personal property
to be ascertained from the returns of the dwners. thereof, in pur-
suance of the scheme and plan contained in Sections One, Two, Three
and Four of the Ordianance to provide for the assessment of taxable
property in the Town of Savannah Beach, Tybee Island, Georgia, and
the mode of valuing such property for taxation and to carry into
effect the provisions of the Act of the General Assembly of the
State of Georgia, approved August 19, 1922, Seotion 21, passed in
Council assembled October 13, 1922; and it is further ordained that
if any person or persons shall refuse or neglect to pay the tax
required by this ordinance within seven (7) months after same shall
become due, or shall fail or refuse to pay an DOUBLE TAX assessed
as above provided within thirty (30) days after same shall become
due, the Clerk of Council, as Ex- Officio Treasurer of said Town,
shall issue execution therefor and the further sum of One Dollar
($1.00). for costs, and the Chief of Police and Ex- officio Tax
collector shall prooeed with suoh execution in the same manner as
now provided by the law in such cases of execution lodged with the
Sheriff of Chatham +County.
SECTION 2. Every person who shall pay one -half (1/2) of his
taxes on or before the 15th day of May, 1945, and the balance of said
taxes on or before the 15th day of November, 1945, shall be entitled
to a deduction of ten (10) per cent on account thereof, and the Clerk
of Council and Ex- officio Treasurer of said Town is hereby authorized
to make such deduction upon receipt of tax. The provisions of this
section shall not apply to licenses for doing business in said Town,
the rate for such licenses being net. The provisions of this section
shall apply, however, to those persons or companies required by the
provisions of Section 92 -5902 of the Code of Georgia to make returns
to the. Comptroller General of Georgia.
SECTION 3. All ordinances or parts of ordinances conflict-
ing with the provisions of this ordinanoe are hereby repealed,; pro-
vided, however, that so much and such parts of ordinances passed as
provided for the execution of tax assessments, or part thereof, shall
continue and remain in force so as to authorize the Clerk of Council
and Ex- officio Treasurer to issue executions and the Chief of Police
and Ex- officio Tax Collector to collect same until said taxes or,ass-

essments shall be fully paid.
There being no further business Council adjourned

March 21, 1945.
A special meeting of Council was held today to the office
of Mayor Dutton, and was attended by the Mayor, who presided, and
Councilmen Slotin, Walsh, Lovell, and Town Attorney Alexander.
The meeting was called for the purpose of:
1. To accept. the contract of the J. G. Attaway Company
as completed as of February 26, 1945.
2. To adopt a resolution accepting the final quantity
change order on Project No. Ga. 9 -244 (NF) as submitted by the J. G.
Attaway Construction Company.
Councilman Slotin moved that the following resolution
be adopted. Councilman Lovell seconded and the motion passed.
RESOLUTION
WHEREAS, the J. G. Attaway Construction Company was a-
warded a oontraot to complete the sanitary sewerage system for the
Town of Savannah Beach, Tybee Island, Georgia; and
WHEREAS, J. G. Attaway, owner, has notified the munici-
pality that he has completed said work in accordance with said contract;
and
WHEREAS, it will be necessary for the municipality to ac-
cept by resolution the final approval of said contract; and
WHEREAS, the work of the J. G. Attaway Construction Com-
pany was substantially completed on June 3, 1944, and finally completed
on February 26, 1945;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Councilmen
of the Town of Savannah Beach, Tybee Island, in Council assembled, that
the said municipality does. hereby accept the oontraot of the J. G. Atta-
way Construction Company as completed as of February 26, 1945, and on
the basis of the contractor's bond which covers the _project for a per-
iod of twelve (12) months from and after February 26,E 1945.
BE IT FURTHER RESOLVED that the Clerk of Council send
four (4) certified copies of this resolution to the Federal Works
Agency.
