AN ORDINANCE TO RELOCATE, RENAME AND AMEND ARTICLE 4, FINANCE
AND TAXATION, CIUkPTER 8, SHORT —TERM RENTAL PERMIT
WFEREAS, the Town of K'awah Island Municipal Code carently contains Article 4, Finance
and Taxation, Chapter 8, Short -Term Rental Perna, Sections 4-801, 4-902, 4-803, and 4-804;
and
WHEREAS, the Town wishes to continue reguiating the use of residential property as short
term rentals; and
WHEREAS, the Town wishes to relocate, renamo aid amend die cu -ren' sections relating to the
regulation of residential 1`70perty as short term re-itnls.
NOW, THEREFORE, BE IT ORDERED AND ORDAINED BY THE COUNCIL OF THE
TOWN OF KIAWAH ISLAND, SOUTH CAROLINA, AND IT IS ORDAINED BY THE
AUTHORITY OF SAID COUNCIL.
Section 1. Purpose
The purpose of this Ordinance is to delete from Article 4, rename, and relocate Article 4, Finance
and Taxation, Chapter 8, Short -Term Rental Pe=it, Sections 4-80I, 4-802,4-803, and 4-R04.
Section 2. Ordinance
The Town hereby deletes Article 4, Finance and Taxation, Chapter 8, Short -Term Rental
Permits, Sections 4-801, 4402, 4-803, and 4-804.
Article 15, Ce7cral Offenses, Chapter 8, Short -Term Rental Permit and Reguiations is hereby
created as follows.

An owner (or his agent) who applies for a Business License and a Short -Tenn Rental permit
shall, at the same time, prepare a "Rental Residence data Sheet" for each rental unit and file it
with the Town.
This application shalt attest to its accuracy. The License Inspector, defined in Article 4,
Section 4-309, shat` determine the information to be required which may include, but not limited
to, address, and rental agent information, number of bedrooms, bathrooms, and garage bays,
maximurr, murber of overnight guests permitted, maximum vehicles permitted, on-site parking
locations for vehicles and storage location for bicycles, beach and other gear.
In addition, all applicant owners shall provide the Town with a "Rental Specification Shue^," and
place a copy thereof in a clearly visible location within each rental unit. The License Inspector
shall determine the infom;ation to be required which m :y include, but not be Limited to, the
address and phone m:.m"ler of' he rental property; the location of the trash co-taine- and beach
gear storage area; the approved overnight guest occupancy; and the approved overnight vehicle
capacity.
Before any citation is issued, a first nrk'ender shall have Eve (5) days to comply with the
provisions of this section. Any person convicted of violating this provision shall be subject to a
`'.ne of not less than One Hundred ($100.00) Dollars nor more than Five Hundred ($500.00)
Dollars. Each day of violation shall be considered a separate offrn:.e.

The Town shall promulgate and distribute Rules and Regulm:ons a,.; licable to the rental of
residential pror-y. Further, an owner (or his agent) who rents residential property shall f. rn'sh
a copy of the Rules aged Regulations to each rentor guest, and each rental guest shall
acknowledge receipt of such Rules aid Regulations. In addition, the owner (or his aeentl shall
post a copy of the Rules and Regulations in a clearly visible Inc, t:on within each rental unit.
Any p^ -son convicted of violating this provision shall be subject to a fine of not less than. One
Bund -cd ($300.00) Dollars nor m^ -c than Five Hundred ($500.00) Dollars. Each day of
violation shall be considered a separate offense.
Seeaion I5-503 Shot -Tera¢ Rental Perrrk
An owner (or his agent) shall apply to the Town and obtain a Short -Tee=n Rental Pemit
for each calendar year that his residential property is used for short -terra rentals;
.rov;dad, however. that the Town shall not grant a Short -Term Rental Permit until the
following conditions are satisfied:
The owner shall provide evidence sufecient to indicate that all solid waste
collection fees have been paid in full.
b. If the ann'.icant is someone other that: an owner, the applicant shall submit a copy
of 012 owner's wr'ten authorization of his right to apply for the Short-Tc-ra
Rental Pe= t.
C. The owner (or his agent) shall provide a written acknowledge -en" that a violation
of the Town's Short -Terra Rerl." Permit provisions, either by the a- dicant,
prru-17 mzrorer or rental guest, shall be considered a violation by'he owner.
2. Short Tenn Rental Permit Violations
—r, ensure that residential neighborhoods are not disrupted by renters, the Town shall
notify the owner of the residential rental unit of altos:ances in which nuisance behavior
of the rental guest, or the conduct of his agcat or property manage., results in a
conviction for a Code Violation. Points for such convictions shall be assigned to the
owner according to the following schedu.e:

These regulations apply to rental dwelling units in all Residential Zoning Districts,
R-1, R -E, R-2 and R-3. These reguiafins address nuisance and behavic-al
issues in Residential .Zoning DistHct, renta! licensing and non-cornplianre issues.
The following format is des=igned for dissemination to all owners and apents, The
owner or agent shall assure compliance with all applicable regulations.
Rental l9nit Business License°,
An owner or anent is equired to obtain an annual Class 7 business license from
the Town of Kmwah Island fcr each d,,vP!ling unit prior to renting any dweiiing
unit. A license is no! transferable bet A een owners, A change of ov metre^p of the
rentai unit shall require the new owner or his agent to ob`ain a new I cenFF for the
unit.

Rental Specification Sheet
The applicant for a licsrs= shall complete the Rental Brnperty Specifo^tion
Sheet (Table 2). A copy of this Specification Sheet shall be placed in each
Rental Unit.
Residence Orcupancv for Rental Units
The -laximurr numhe- of occupants permitted includes children of all ages. The
standard for all rental dwelling units is based on two occupan"s per permitted
bedroom. Two other occupants can be added per dwelling unit. -,jerefnre, a 4
BR renal unit shall have a maximum of 10 occupants.
The number cf bedrooms deemed to exis` in a rental dwelling unit shall be based
on Charleston County records as given on the filed plat and/or building parrrit.
Should a rents, business license applicant claim more bedrooms than sho°om in
county records for the purpose of gaining more occupants, he or she shall
petition the Town of Kiewah Code Enforcement Officer in wdt'ng for,eview and
determinaticn prior to rentng the unit if the issue is not resolved by the Town of
Kiawah Code Enforcement Cfficer, it shall be referred to the Charleston County
Zoning O'ficer. Such review will take into account if the ?ddit`onal bedrooms
and/or conversions were caned out as per the building code recuirememz.
Temporary conversion of rooms such as dining moms, living rooms, etudiea, oto.
for use as bedrooms for rental purposes is not permitted.
Residence Vehicle Capacity and Vehicle Type
The maximum number of vehicles permll?ed for each. dwelling unit shall be
deterrihed by the requisite parking available. All overnight parking shall be off-
rlree< in a garege, on a paved driveway, on a platted driveway or, on a driveway
bump -out. Should an applicant claim more burnp-outs than shown in the original
building pian documents, he or she shall petition the. Charleston Colmlly Zoning
Officer for revieenr and determination. In all cases, unencumbered driveway
access to structures must be maintained for fire deparment and other
emergency vehicles as per Zoning Ordinance 2001-8 and summarized in the
`7re Code" section here In. Driveways must allow emercency vehicles to within
25 feet of `he unit.

Should cottages and some single-family dwelling units have no g -rage, and in
some cases, only a short driveway, overnight vehicle parking may be permitted
under the dwelling unit and/or on the drivewav, provided "hat there is adequate
access for fire and other emergency vehicles (as stated above) when the off-
street parking areas are occupied.

recreation vehicles (RVs), buses, trailers, boats and other large vehlclas as
defined, are prohibited from. oarking overnight. Vehicles shall not be used for
sleeping or overnight accommodations.

The Town of Kiawah Island Municipal Code, Artie% 6 "Het lh and Sanitation",
regulates trash collection. Single family (R-1, R -E), Single family (R-2) and
Cottage (R-2) rental dwelling units shall have backdoor trash collection two (2)
fames oer week. After emptying, trash ccr"liners shall be returned to the
"backdoor" or storage location. Trash reoeptactes shall be stored in an enclosed
garage or approved screened enclosure whereby the recenta^les are not vlsb+e
frorm the street.
Villas (R-3 dwsfin,g units) shall use provided durnpsters for trash disposal.
Dumpeter pickup service shall be sc ``Iciently frequent to avoid nssh ove•ficwn
Cumpsters shall he stored on an approved, screened pad.

Bicycles, beach gear and a°her personal a-tioles shall he stored in an enniosed
garage or approved screened enclosure. All such srfcles shall be-, placed in the
appropriate storage location overnight and shall not be left in a drlvevrmr, yard or
parking lot, No articles of clothing, beach towels or other items shaft be draped
over railings or deck chairs or be visible bevond prope-hr lines.
Vile cornplexes shall provide adequate bicycle racks for overnight bicyoo
storage. All other gear shall be stored indoors or in provided stc-Age close°s.

The Town of Kinv`<ah, island Municipal Code, A-f;ole 16, Chapter 1 Sentions 16-
101 to 16-100 regulates beach ligM4ng to protect sea turtle hatchl'ngr.. To
- inirnize the "mpact and disturbance of nighttime lighting on ne'ghherhoods and
their residents, the following shall Lie required:
o Wall mourled flood lights shall be sh'eldedthooded and directed
;downward llmt°ing the field of light within property boundaries. Hooded
flood lights should be limited to 2 per residential building and be tumnd off
from 11:00 PM to 7:00 AAS.

Fire Code
The T. wn of Ifiawah Island Municipal Code ArticWe 9, Section 9-102, Fir,- Code
and at`endont ordinance. 2001-8 cover fire safety raguiations for residential
districts as follows

For safe conduct of operations, all single-family aro cottage rental dwelling unts
shall meat these recqui ements as a condition of qualifying for a rental business

When an owrer has accumulated 16 (or more) pointe for a particular property within a
period of twelve (12) consecutive months or 24 points within a period of twee+v-four
(24) consecutive months, the Town shall suspend the Short-term Rental Permit fn• that
property for a period of twelve (12) consecutive months subject rc the right of appeal set
forth in Section 4-804. Further, the Town shall not issue a new Short-term Renfai
Permit duhrg the period of suspension. However, twenty-four (24) months after the
date of conviction, the Town shall expunge all points associated therewith, and
outstanding points relating to the subject property, if any, shall be recalculated to
indicate the reduction.

Short- r=rr Rental Permit, may appeal the decision to the Town Council.
The appeal mnsf be filed in writing within thirty (30) calendar days a`fe-the
revocation, suspension or denial, and it shall set forth a concise -tatcrnant
of the reasons for the appeal. Timely filing of an appeal shall stay the
revocation, suspension or denial pending a decision on the appeal by the
Town Council.
2. The Town Council shall consider the appeal in an open hearing at a
regular or special meeting within thirty (30) calendar days after receipt of a
request unless otherwise agreed to, in writing, by the Town and the
aggrieved party. Ti:e Town Council shall prescribe the rules of evidence
and 'estimony and the procedures app!lcable to the conduct of the
hearing. All interested paries shall have the fight tr: be renr*sented by
counsel, to present testimony and evidence, and to cross-examine
witnesses. —!is proceedings shall be electronically recorded and
transcribed at the expense of the pahy so -equeating. The Town Council
shall render a decision by a majority vote of members present. The
decision shall be in writing based upon findings of fact and the application
of relevant standards. The decision shall be served upon all parties or
their designated representatives and shall be final unless appealed to a
court of competent jurisdiction within ten (10) days after service.
