Attaway Construction Company was awarded a contract to complete the sanitary sewerage system for the Town of Savannah Beach, Tybee Island, Georgia; and WHEREAS, the said J. G. Attaway Construction Company has submitted to the municipality a final quantity change order for its approval; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council- men of the Town of Savannah Beach, Tybee Island, in Council assem- bled, that the municipality does hereby accept the final quantity change order on Project No. Ga. 9 -244 (NF) and that the Clerk of Counoil be and he is hereby directed and authorized to oertify this resolution to the Federal Works Agency with the request that said Federal Works Agency approve same as submitted and approved by this resolution. There being no further business Council adjourned subjeot to the call of the Mayor. ®,•� lark . Council JALP, Mayor Savannah Beach, Tybee Island, Ga. April 5, 1945. The regular meeting of Council was held today at 4;00 P.M. in the Council Room, in the Town Hall and was attended by Mayor Dutton, who presided, and Councilmen Biotin, Lovell, Hosti, Walsh, Young, and Town Attorney Alexander. The minutes of the meetings of February gth and February 12th were read and adopted. Mayor Dutton stated that when in Atlanta, he was informed that the oost of reworking the sewerage system would be approved as planned, now the cost is estimated at *77,600.00, Mr. 0. T. Ray re- fused to approve it for this amount, the Mayor informed Mr. Ray that the Town could not spend any more money than as previously stated, Mr. Ray would not recommend.the grant for more than #45,000.00. It was decided that the matter should be appealed to Senators George and Russell and Congressman Petersen to get their assistance in an effort to get additional funds. It was decided that the Mayor and Councilman Biotin would go to Washington relative to this. Councilman Siotin requested that the land in the vicinity of the Berman, Mazo lots near 18th Street be leveled. 112 Councilman Biotin moved that the Clerk set up the aocounts on the Town's books to agree with the budget. CouncilmanWalsh sec- onded and the motion passed. Mr. S. F. Smith petitioned for a reduction in the charge of $150.00 for stubbing on his lot 104, ward 5, Councilman Walsh moved that he be allowed a reduction of $30.00, making the total $120.00. Councilman Lovell seconded and the motion passed. Mr. Young requested that the fees collected by him for Service Connection Charges be paid to him. The matter was referred to the Chairman of the Finance Committee. There was some discussion as to whether all the places are complying with the midnight closing curfew. The matter of the Town Engineer surveying property and not turning the money into the Town Treasury was discussed. The matter was referred to Councilman Young to handle. The Mayor informed Counoil that Mr. Rybun Clay, Chairman of the State Highway Board, had written him that he had instructed the engineer of this district to make a survey of First Street. Councilman Biotin moved that the Mayor be appointed a committee to make an investigation as to the cost of indexing the Town's Ordinances. Councilman Young seconded and the motion passed. The Tybriaa Company protested the assessments on their property and requested a reduction. Councilman Biotin moved that the request be denied, Councilman Walsh seconded and the motion passed. Petition of Mrs. Elizabeth M. Bailey for a reduction im her assessments on lot 62 -A, ward 4 was, on motion of Councilman Siotin, reduced $100.00, and seconded by Councilman Young the motion passed. Petition of J. Gordon Miller, Jr. for a reduction in his assessments on lots 25, 26, and part of 27, ward 4 was on motion of Councilman Young declined, seconded by Councilman Walsh and passed. Petition of Leroy F. Walden for reduction in assessments of lots 6 and 7, Blook 2, Hay Ward. Councilman Biotin moved that a $25.00 reduction be allowed on Lot 6 and that a $100.00 reduction be allowed on Lot 7. Councilman Young seconded and the motion passed. Councilman Biotin moved that bills for General Government for the month of March amounting to $S9S.b4 and bills for the Sew- erage Account for the month of March amounting to $330.62 and bills for the Stubbing account for the month of March amounting to $5.10 be paid. Councilman Walsh seconded and the motion passed. Councilman Lovell moved that the following ordinance be adopted. Councilman Biotin seconded and the motion passed. 1 1 1..13 AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE TO REQUIRE THE OWNERS OF PROPERTY IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, TO CONNECT PLUMBING FIXTURES ON THEIR PROPERTY WITH THE SANITARY SEWERAGE SYSTEM NOT LATER THAN APRIL 30th, 1945, AND TO PROVIDE THAT SAID FIXTURES SHALL BE CONNECTED WHEN PROPERTY OWNERS ARE NOTIFIED BY THE PLUMBING I1SPECTOR THAT SAID FIXTURES ARE UN- SANITARY, AND TO PROVIDE A PENALTY FOR THE FAILURE TO DO S0, AND FOR OTHER PURPOSES„. SECTION 1. Be it ordained by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, Georgia, in 0ounoil assembled, and it is hereby ordained by the authority of the same that an ordinance adopted by said Mayor and Councilmen entitled An Ordinance to Require the Owners of Property in the Town of Savannah Beach, Tybee Island, Georgia, to connect plumbing fixtures on their property with the sanitary sewerage system not later than April 30th, 1945, and to provide that said fixtures shall be con- nected immediately when property owners are notified by the plumb- ing inspector that siad fixtures are unsanitary, and to provide a penalty for the failure to do so, and for other purposes," be and the same is hereby, amended by striking therefrom the phrase "on or before the thirtieth (30th) day of April, 1945" and inserting in lieu thereof the phrase "on or before the let day of January, 1946", so that said section shall read as follows:- "SECTION 1. Be it ordained by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, Georgia, in council assembled, and it is hereby ordained by authority of the same, that all owners of real property within the limits of said Town shall, on or before the first (1st) day of January, 1946, con- nect, or cause to be connected, all plumbing fixtures located on the real estate owned by him or them with the sanitary sew- erage system in said Town; provided that this requirement shall not apply to outside showers or hydrants on said property." SECTION 2. All ordiances and parts of ordiances in oonfliot with the provisions of this ordianoe are hereby repealed. Councilman Young moved that the following ordinance be adopted. Councilman Walsh seconded and the motion passed. AN ORDINANCE < AN ORDINANCE TO AMEND AN ORDINANCE ENTITLED " AN ORDINANCE TO PROVIDE FOR ASSESSMENT OF TAXABLE PROPERTY IN THE TOWN OF TYBEE AND MODE AND MANNER OF VALUING SUCH PROPERTY FOR TAXATION: AND TO CARRY INTO EFFECT THE PROVISIONS OF THE ACT OF THE GENERAL ASSEMBLY OF THE STATE OF GEORGIA, APPROVED AUGUST 21, 1922. SECTION 1. Be it ordained by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, Georgia, and it is hereby ordained by the authority of the same, that a certain ordinance entitled "An Ordinance to provide for assessment of taxable property in the Town of Tybee and the mode and manner of valuing such property for taxation; and to carry into effect the provisions of the Act of the General Assembley of the State of Georgia, approved August 21, 1922" be and the same is hereby amended by adding thereto another section to be numbered Section 3 -A and to read as follows; - Seotton 3 -A Be it further ordained that any and all persons being dissatisfied with the decision of Coun- oil on the appeal provided for in Section 3 of this Ord- inance shall have the further right to appeal from said decision to the tax assessors of Chatham County, Georgia, within twenty (20) days after said decision is rendered, in accordance with the provisions of the Act of 1945 amending the Charter of said Town of Savannah Beach rel- ative thereto. Ath the time of filing said appeal, in writing, said appellant shall pay to said tax assessors a fee of Ten Dollars ($10.00) which amount shall be di- vided equally among the tax assessors passing on said appeal. SECTION 2. Be it further ordained, that all ordinances or parts of ordinanoes in conflict with this ordinance be and the same are hereby repealed. Councilman Young moved that the following amendment to the License Ordinance be adopted, Councilman Lovell seconded and the motion passed. AN ORDINANCE AN ORDINANCE TO AMEND AN ORDINANCE ENTITLED " AN ORDIN- ANCE TO PROVIDE FOR THE RATE OF LICENSES FOR DOING BUSINESS IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR THE FISCAL YEAR ENDING APRIL 30th, 1946; FIXING PENALTIES FOR THE VIOLATION; AND FOR OTHER PURPOSES". SECTION 1. Be it ordained by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, Georgia, and it is hereby ordained by the authority of the same, that a certain ordinance entitled "An Ordinance to provide for the rate of licenses for doing business in the Town of Savannah Beach, Tybee Island, Georgia, for the fiscal year ending April 30th, 1946; fixing penalties for the violation; and for other purposes" be and the same is hereby amended by adding thereto another sub- seetion of Section 1 to read as follows : - Every owner or operator of a moving picture show, $25.00 SECTION 2. Be it further ordained, that all ordinances or parts of ordinances in oonfliet with this ordinance be and the same are hereby repealed. Councilman Slotin moved that the following amendment to the Town Charter be adopted. Councilman Walsh seconded and the motion passed. AN ACT To amend the charter of the Mayor and councilmen of the town of Tybee, now known as the town of Savannah Beach, Tybee Island,. Georgia, and the several acts amendatory thereto, incorporating the mayor and councilmen of the town of Tybee, now known as the town of Savannah Beach,,Tybee Island, Georgia, relative to and supplementary thereto; and for other purposes. SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF GEORGIA, AND IT IS ENACTED BY THE AUTHORITY OF THE SAME, that Sec- tion Four (4) of a certain Act approved larch 24, 1941, and incor- porated in the Acts of 1941 on pages 1745 -1750 inclusive, and entit- led "An Act to Amend the Several Acts Incorporating the Mayor and Councilmen of the Town of Tybee, to grant authority to the Mayor and Couonilmen to deed a certain portion of the strand to the pro - perty owners adjacent thereto, and for other purposes", be and the same is hereby repealed. SECTION 2. Be it further enacted that the following portion of a certain Act approved March 9, 1943, and incorporated in the Acts of 1943 on pages 1571 -1573 inclusive, and entitled "An Act to Amend the several acts incorporating the Mayor and Councilmen of the Town of Tybee, and particularly to amend said Act for the purpose of increasing the power of the Mayor and Councilmen to impose and col- lect additional as valorem tax and assessments, and for other pur- poses ", "and shall have full power to levy, impose and collect, when and if necessary, a special tax in a sum not to exceed one - helf ( *) of one (1) per cent on the total value of the assessments on the books of said municipality as of January 1, 1943. Said levy and assessment shall be separately made and collected, and all amounts so oolleoted shall be applied exclusively to the opera- tion and maintenance of said sanitary sewerage system only after final completion of the same. ",, be and the same is hereby repealed. SECTION 3. Be it further enacted that Section Two (2) of said Act approved March 9, 1943, be amended by striking from the new Sec- tion 21 of the Act approved August 19, 1922, the figures "two (2)" and "Two Dollars ($2.00)" and .substituting in liew thereof the figures "three (3)" and "Three Dollars ($3.00)" and by adding to said Section the right for taxpayers to appeal to the Tax Assessors of Chatham County, Georgia, so that said Section 21 as amended shall read as follows: "Section 21. Be it further enacted by the authority aforesaid that said Mayor and Councilmen shall have power to levy, impose and collect an ad Valorem tax upon all real and personal property within the corporate limits of said municipality that they may deem advisable and not in conflict with the laws of this State; provided that such tax does not exceed three (3) per cent of the value of said property. Said Mayor and Councilmen shall provide an ordinance for the annual assessment of the taxable property in said Town and the mode and manner of valuing such property for taxation. However, any taxpayer shall have the right, within thirty (30) days after said assessment has been made on the taxable property, to appeal from the assessment made by the Mayor and Counoilmen to the Board of Tax Assessors of Chatham County, 116 Georgia; but said Mayor and Councilmen shall not collect a tax of more than Three Dollars ($3.00) on each one hundred dollars valu- ation of property.0 SECTION 4. Be it further enacted that in the event any taxpayer appeals from any assessment made by the Mayor and Councilmen to the Board of Tax Assessors of Chatham County, Georgia, no Tax As= sensor who is himself a property owner in said Town of Savannah Beach or who is a stockholder in any corporation owning property in said municipality shall be qualified to act as a member of said Board of Tax Assessors with regard to said appeal. SECTION 5. Be it further enacted that said Mayor and Counoilmen shall set aside from the total ad valorem tax not exceeding Three Dollars ($3.00) per hundred a sum equal to an assessment of one quarter ( *) of one (1) per cent of the assessed value of all real and personal . property within the corporate limits of said municipality for the purpose of maintaining a sea wall and groins, and for beach erosion, and said special fund shall be used for no other purpose. SECTION 6. Be it further enacted that said Mayor and Counoilmen shall have the rights to close off any part of the public Domain, which will include public streets and the Strand, for the purpose of creating and maintaining a public playground or recreational park, without the necessity of approval by the qualified voters of said municipality. SECTION 7. Be it further enacted that this pct shall beoome opera - tive at midnight April 30, 1945, but shall not affect the assess- ment of any tax heretofore levied under the provisions of Section Four (4) of said Aot approved March 24, 1941, or. Section One (1) of said Act approved March 9, 1943, or any pending or which may instituted to collect the same. SECTION S. Be it further enacted that upon the effective date of this Act said Mayor and Councilmen shall cause any funds on hand collected under the provisions of said Section One (1) of said Aot approved March 9, 1943, to be transferred to the general treasury of said municipality. AN ORDINANCE AMEND AN ORDINANCE ENTITLED "AN ORDINANCE TO REGULATE DOGS ON THE STREETS, LANES, HIGHWAYS OF THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA; TO PROVIDE A PENALTY FOR THE VIOLATION: AND FOR OTHER PURPOSES. SECTION 1. Be it ordained by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, Georgia, in Council assem- bled, and it is hereby ordained by authority of the same, that an ordinance of said Town of Savannah Beach entitled nAn Ordinance to Regulate Dogs on the Streets, Lanes, Highways of the Town of Savannah Beach, Tybee Island, Georgia; To provide a penalty for the violation: And for other purposesn, be, and the same is hereby amended by adding thereto a new section to be numbered 1A, reading as follows "Section 1 -A. Be it further ordained if any dog shall be found running, or having access to run, on the streets, lanes or highways of said Town, except under the conditions set forth in Section 1 of this ordinance, the same shall forthwith be taken up and/or destroyed in a humane manner by any police officer of said Town." SECTION 2. Mayor Savannah Beach, Tybee Island, Ga. April 23, 1945. A special meeting of Council was held today at 5 :00 P.M. in the Town Hall, and was attended by Mayor Dutton, who presided, and Councilmen Hosti, Farrell, Young and Lovell. The meeting was called for the purpose of authorizing the Mayor to sign a contract with Wiedeman & Singleton. Councilman Farrell moved that the following resolution be adopted. Councilman Hosti seconded and the motion passed. A RESOLUTION WHEREAS, H. L. Wiedeman and M. T. Singleton, a partner- ship doing business as Wiedeman & Singleton, Engineers, of Atlanta, Georgia, have .tendered to the Town of Savannah Beach a proposed contract whereby said engineers offer to - perform services and give advice in the preparation of designs, plans, specifications, esti- mates and supervision of construction of improvements to said Town's sewerage system, F. W. A. Project No. Ga. 9- 244-N, said improvements to be as set out in a report to said Town by said engineers and as approved by the Federal Works Agency; AND,. WHEREAS, said engineers agree to furnish said ser- vices, specifically set forth in said proposed contract at and for the sum of Five Thousand Seven Hundred Dollars ($5700.00) payable as forth in said contract; BE IT, THEREFORE, RESOLVED by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, Georgia, in Council assembled that the Mayor of said Town be, and he is hereby author- ized and directed, to execute on behalf of aaid Town said proposed contract containing substantially the above mentioned provisions and the Clerk of Council of said Town be Wand he is hereby author- ized and directed to attest the same and to affix the corporate seal of said Town thereto.
