Staff provided the Guidelines for Comercial Activity in City Parks as outlined in Resolution NO.11-25 and discussed the time frame and process to submit a proposal for review. The applicant has since worked with the Parks & Recreation Department to address staff’s questions and concerns prior to presenting the propsol to the Parks and Recreation Advisory Committee. The Parks & Recreation Advisory Committee has had two touches on this proposal. The committee first reviewed with staff during the Committee’s October meeting and provided feedback to the applicant. The applicant then presented and discussed the proposal at length with the Advisory Committee during their November 24 meeting. The Advisory Committee voted in support of the concession, pending the conditions outlined in the minutes from the November 24 committee meeting. The applicant and Department staff presented the proposal to City Council on December 16 for comments and concerns from the Council. The attached proposal and draft concession agreement reflect the applicant’s work to address those questions and concerns. Both department staff and the applicant would like to continue this discussion and capture any other concerns and or revisions to the concession agreement the Council deems necessary to achieve approval of an agreement. Staff requests that Council review, discuss, and revise the proposal and draft concession agreement as it relates to impacts to public facilities, facility use, budget, and recreational opportunities. Once it is determined that the agreement meets all of the Council’s requirements, staff is requesting approval of the agreement.  RECOMMENDED ACTION: Approve the concession agreement [as modified] and approve the Mayor to sign all necessary document.  RECORD OF COUNCIL ACTION  MEETING DATE ACTION
