HomeMy Public PortalAboutOrdinance 64-129ORDINANCE NO. 64 -129 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, ADDING ORDINANCE NO. 63 -112 TO THE TEMPLE CITY MUNICIPAL CODE AND PROVIDING NUMBERING OF SECTIONS IN REGARD THERETO WHEREAS, the City Council did adopt Ordinance No. 63 -112 adopting a new zoning ordinance for the City of Temple City on Septem- ber 9, 1963, and WHEREAS, the particular section numbers therein contained have become familiar to the City Officials by the study and adoption of same, and WHEREAS, it is desirable to retain the section numbers of the said Ordinance No. 63 -112 as sub - section numbers of Section 9100 of the Temple City Municipal Code, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN AS FOLLOWS: SECTION 1. All section numbers of Ordinance No. 63 -112 are hereby added to the Temple City Municipal Code, and all numbers are to remain the same as numbered in Ordinance No. 63 -112 EXCEPT that all numbers shall be preceeded by Temple City Municipal Code number 9100 and the said Municipal Code shall be amended as follows by the addi- tion of the following Article, Chapter, and Section: "ARTICLE IX. PLANNING AND ZONING REGULATIONS "CHAPTER 1. ZONING REGULATIONS "SECTION 9100.7" Ordinance No. 63 -112 is hereby incorporated into the Temple City Municipal Code, All of the Articles and Section numbers of the said Ordinance No. 63 -112 are retained but all of said Article and Section numbers shall be deemed preceeded by the number 9100, follow- ed by a decimal point, to wit; "9100.100 DECLARATION ", "9100.1204: PERMITTED HEIGHT ", "9100. ARTICLE 13, UNCLASSIFIED USES ". SECTION 2, Sections 9107, 9108, and 9109 of the Temple City Municipal code are hereby repealed, and Ordinance No. 62 -73 adopting said sections is likewise repealed. SECTION 3. Ordinance No. 63 -103 and Ordinance No. 63 -104 are hereby added to the Temple City Municipal Code and numbered as fol lows: (a) Section 1 through 12 of Ordinance No. 63 -104 are hereby numbered 9108 through 9112. (b) Section 1 of Ordinance No. 63 -103 is numbered 9113. SECTION 4. Sections 9150 through 9155 of the Temple City Municipal Code are hereby repealed and likewise Ordinance No. 61. -5 enacting said sections is repealed. SECTION 5. Chapter 2 SUBDIVISION REGULATIONS OF ARTICLE IX of the Temple City Municipal Code is hereby repealed in its entirety. SECTION 6. Chapter 2 SUBDIVISION REGULATIONS OF ARTICLE IX is hereby added to the Temple City Municipal Code to read as follows: "CHAPTER 2 - SUBDIVISION REGULATIONS" SECTION 7. The provisions of Ordinance No. 63 -107 are here- by added to the Temple City Municipal Code and Section 9200 -A is here- by added to the Temple City Municipal Code to read as follows: "9200 -A. Sections 100 through 601 of, Ordinance No. 63 -107 are hereby added to the Temple City Municipal Code as follows and each of said section numbers 100 through 601 shall be deemed to have added in front thereof the Temple City Municipal Code Number "9200 ", to wit: "9200. SECTION 100. AUTHORITY." 400 Ord. 64 -129 SECTION 8. Ordinance No. 62 -87 is hereby repealed. SECTION 9. Section 9100.1602.1 is hereby added to the Temple City Municipal Code, to be numbered as all other 9100 numbers being deemed to have 9100 preceed it, and which shall read as follows: "1602.1. Driveway minimums for all zones permitting apart- ment houses and in particular Zone R -3, nothing in the Municipal Code withstanding, the following are minimum widths and unobstructed height limits for vehicular access driveways to any garage, carport, or automobile storage space in any and all zones in which apartment houses are permitted and in particular, but without limitation in Zone R -3. (a) Vehicular access driveways, the length of which is less than 125 feet, shall be twelve (12) feet in width and shall have un- obstructed vertical clearance. (b) Vehicular access driveways of greater length than 125 feet shall be twenty (20) feet in width and shall have unobstructed vertical clearance. (c) As an exception to section (b), immediately above, the Planning Director may permit a driveway twelve (12) feet in width where the length of the driveway is greater than one hundred twenty - five (125) feet upon the Planning Director determining that the par- ticular driveway submitted to him for approval: (1) provides adequate circulation of vehicles, (2) has no less than two different places of access and (3) the driveway submitted meets the height limit provi- sions of paragraph (a) immediately above. (d) As a further exception to section (b), immediately above, the Planning Director may modify the height limitations on a twenty (20) foot driveway providing the Planning Director shall de- termine that the modification will provide reasonable ingrees and egress with no less than twelve (12) feet of driveway width with un- obstructed vertical clearance as provided in paragraph (a), above." SECTION 10. This ordinance shall take effect immediately upon its passage. This ordinance is found to be an ordinance neces- sary for the public, peace, health and safety, pursuant to Section 36937 (b) of the Government Code. The facts in support of the declar- ation of urgency, hereby made, are as follows° a new zoning ordinance for the City of Temple City, Ordinance No. 63 -112 was adopted on Sept. 9, 1963, the effective date of said ordinance to be the date upon which an ordinance adopting a new zoning map was adopted and effective; that on March 9, 1964, Ordinance No. 64 -124 was adopted, its effective date to be April 8, 1964; that hence concurrently on the said April 8, 1964, Ordinances No. 63 -112 and No. 64 -124 will become the law of the City of Temple City. That it is essential that all sections of Ordinance No. 63 -112 and Ordinance No. 63 -107 be added to the Temple City Municipal Code to prevent public confusion in regard thereto; that hence the City Council finds these ordinances to be necessary for the public peace, health and safety, and it shall as aforestated be- come effective immediately upon its adoption.
