RESOLUTION RESCINDING RESOLUTION 407-22 AS TO THE RENEWAL
OF PLENARY RETAIL CONSUMPTION LIQUOR LICENSE NO. 1201-33-
009-008 FOR THE CARTE RE, BUSINESS PARTNERSHIP, INC.
WHEREAS, on June 28, 2022, the ABC Board of the Borough of Carteret, County of
Middlesex and State of New Jersey ("ABC Board") passed Resolution # 07-22
approving the renewal of the Plenary Retail Consumption Liquor License #1201-33-
009-008 held by the Carteret Business Partnership, Inc., ("CBP"), among other
licenses, for the 2022-2023 license term; and
WHEREAS, it subsequently became apparent that the aforesaid license could not be
properly renewed by the ABC Board without a Special Ruling issued by the Director
of the New Jersey Division of Alcoholic Beverage Control pursuant to the provisions
ofN.J.S.A. 33:1-12.39;and
WHEREAS, as a result, the ABC Board must rescind the aforesaid renewal of the
CBP License.
NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED, by the ABC
Board of the Borough of Carteret, County of Middlesex, State of New Jersey, as
follows:
That the provision of Resolution 407-22, previously adopted by the ABC Board of the
Borough of Carteret, providing for the aforementioned renewal of ABC License
#1201-33-009-008 is hereby rescinded only as to said License.
BE IT FURTHER RESOLVED, that the Municipal Clerk/ABC Board Clerk is
hereby authorized and directed to take any and all action required to implement the
