APPROVING THE RENEWAL OF PLENARY RETAIL CONSUMPTION
LIQUOR LICENSE NO.1201-33-043-004 FOR THE 2022-2023 LICENSE TERM
PURSUANT TO A SPECIAL RULING
WHEREAS, Pursuant to Resolution No. 07-22 adopted by the ABC Board of the
Borough of Carteret ("ABC'Board") on June 28, 2022, Plenary Retail Consumption
'License No. 1201-33-043.004-("License") held by the Carteret Redevelopment Agency,
was formally renewed for the 2022-2023 Licensure Term; and
WHEREAS, the ABC Board was subsequently notified by the New Jersey Division of
Alcoholic Beverage Control ("Division") that a Special Ruling pursuant to the provisions
of N.J.S.A. 33: 1-12.39 was required for the renewal of the aforesaid License for the
2022-2023 Licensure Term; and
WHEREAS, the Licensee, the Carteret Redevelopment Agency, filed the required
Verified Petition with the Division for the required Special Ruling pursuant to the
provisions ofN.J.S.A. 33: 1-12.39; and
WHEREAS, according to the Director's Special Ruling, dated January 9, 2023, the ABC
Board has been authorized to now properly consider the Licensee's application for
renewal of said License for the 2022-2023 Licensure Term, in the reasonable exercise of
the ABC Board's discretion,and subject to the Licensee complying with all of the
established legal requirements therefore; and
NOW, THEREFORE, BE IT RESOLVED by the ABC Board of the Borough of
Carteret, County of Middlesex, State of New Jersey, as follows:
1. That Plenary Retail Consumption Liquor License No. 1201-33-
043-004 is hereby approved for renewal for the 2022-2023
Licensure Term, as authorized pursuant to the N.J.S.A. 33: 1-12.39
Special Ruling relief granted by the Director on January 9, 2023,
subject to the' Licensee having met all of the other requisite
requirements therefore.
3. That two (2) certified copies of the within Resolution be forwarded
to the New Jersey Division of Alcoholic Beverage Control,
Licenses Bureau as may be required or provided for,
