Councilman Walsh moved that the taxes against this property be cancelled. Councilman Farrell seconded and the motion passed. Councilman Walsh moved that. Saturday, May 19th, be desig- nated as official opening day for the 1945 season. Councilman Hosti seconded and the motion passed. The Mayor informed Council that there were quite a number of requests from the public that Tybrisa Pavilion be opened, that he had talked to Councilman Slotin and W. H. Haar, and he believed that the Town could get together with the owners for the Town to lease it on a nominal basis. Councilman Slotin stated that the cost of operation to the Town should be very small. Councilman Walsh moved that the Mayor appoint a committee with power to act to nego- tiate with the owners for the use of Tybrisa Pavilion. Councilman Farrell seconded and the motion passed. The Mayor appointed the following committee: Councilmen Walsh, Slotin and Lovell. There being no further business the meeting adjourned subject to the call of the Mayor. C -_ er o Council I °\ Mayor Savannah Beach, Tybee Island, Ga. June 7, 1945. The regular meeting of Council was held today in the Coun- cil room at 4;00 P.M., and was attended by Mayor Dutton, who pre- sided, and Councilmen Lovell, Slotin, Farrell, Walsh and Town Attor- ney Alexander. The minutes of the meeting of May 10th were read and adopted. Councilman Lovell moved that effeotive with the regular July meeting of Council, that the hour be changed to 5 :00 P.M. in- stead of 4:00 P.M. Councilman Farrell seconded and the motion passed. Councilman Slotin moved that a. new automobile for use of the Police Department oosting 0,197.80 be purchased. Councilman Walsh seconded and the motion passed. Councilman Biotin moved that bills for purchases made for General Government during the month of May amounting to $1665.45 be paid. Councilman Walsh seconded and the motion passed. 128 It was the sense of the meeting that no councilman should approve any request for purchases in any other than his own Committee, and also that each department head be notified that no bills will be approved by Council until approved by the Chairman of the Committee in charge of that department. Councilman Walsh informed Council of the serious accident that former Councilman William W. Henry had just experienced and moved that some flowers be sent to him where he is confined. Councilman Slotin seconded and the motion passed.. Councilman Slotin informed Council that in connection with , liability insurance that three employees of the Town own their own cars and that they are used in connection with Town work and also that there were nine employees who did not own oars and that the addi- tional coverage for these employees is $26.31, and he suggested that the Town take out this insurance. Councilman Walsh mod that this be done. Councilman Lovell seconded and the motion passed. Mayor Dutton announced that he had appointed a Town Hall and Pavilion Committee consisting of himself as Chairman, and Council- men Walsh and Hosti. There was some disoussion as to some of the salaries paid some of the Town employees without the approval of Council, namely, employing one Edgar Johnson at a salary of $125.00 per month to drive the garbage truck and transferring Pat Mock from the garbage truck to work on the sewerage system, he to assist the Police Department at a salary of $140.00 per month. Councilman Lovell moved that Pat Mock be returned to the Public Works Department to drive the garbage truck at a salary of $110.00 per month and also that he be paid an additional $30.00 per month to work as an extra Policeman, and that a man be employed at $100.00 per month to work on the Sewerage System. Councilman Farrell seconded and the motion passed., Dr. L. J. Rebhan petitioned that the driveway adjacent to his cottage be repaired, he contending that this driveway was torn up when the Town was installing a sewer line in this area, he stated that he had gotten an estimate covering the cost of having this work done and it amounted to $27.00. The matter was referred to the Town Attorney. In connection with the application of Smitty1s Taxi Service for a license it was decided that aside from the policy required to be deposited with the Town, that also the responsibility of the driver should be approved. Referred to the Town Attorney subject to approval by him. Councilman Slotin moved that the 1945 Whiskey License issued to the Seabreeze.Hotel by Pete Pappas and the 1945 Beer and Music Box License issued to the Seabreeze Hotel by E. G. Goros be transferred to John Wall in the same location. Councilman Walsh seconded and the motion passed. 1 1 1 1 4.29 Town Attorney Alexander informed Council that as the policy of Mr. E. C. Eastin to operate the Merry -Go -Round etc., was not issued by a concern licensed to do business in Georgia that Mr. Eastin has designated Mr. Dennis Pierce, an attorney, to represent him. Under these conditions he approved the issuance of the license. Councilman Slotin moved that the following Ordinance be adopted. Councilman Walsh seconded and the motion passed. AN ORDINANCE AN ORDINANCE TO AMEND AN ORDINANCE ENTITLED °1 AN ORDINANCE TO PROVIDE FOR THE RATE OF LICENSES FOR DOING BUSINESS IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR.THE FISCAL YEAR ENDING APRIL 30th, 1946; FIXING PENALTIES FOR THE VIOLATION AND FOR OTHER PURPOSES". SECTION 1. Be it ordained by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, Georgia, and it is hereby ordained by the authority of the same, that a certain ordinance en- titled "An Ordinance to Provide for the Rate of Licenses for Doing Business in the Town of Savannah Beach, Tybee Island, Georgia, for the fiscal year ending April 30th, 1946; fixing penalties for the violation; and for other purposes" be end the same is hereby amended by adding thereto another sub - section of Section 1 to read as follows Each coin operated scale, $ 2.50 SECTION 2. Be it further ordained that all ordinances, or parts of oridnances, in conflict herewith be, and the same are hereby, repealed. Councilman Lovell moved that the following Resolution be adopted. Councilman Walsh seconded and the motion passed. A RESOLUTION WHEREAS, the Town'of Savannah Beach has leased Tybrisa Pavilion from the Tybrisa Company for a period of one year with the right to renew the same from year to year not to exceed five (5) years; AND, WHEREAS, in the opinion of the Mayor and Councilmen of the said Town of Savannah Beach it is desirable to grant a con- cession for certain purposes on said pavilion; AND, WHEREAS, Anthony Kent has offered to lease said con- cession from May 25th, 1945, to September 5th, 1945, at and for the sum of Two Hundred Dollars 1$200.00), upon certain terms and condi- tions which are•set forth in a written agreement which is hereto attached; 130 BE IT, THEREFORE, RESOLVED by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, Georgia, in Council assembled, that the Mayor of said Town of Savannah Beach be, and he is hereby authorized, to execute said agreement hereto attached in the name of said municipal corporation, and the Clerk of Council of said Town of Savannah Beach be, and he is hereby, authorized to attest the same and to affix the corporate seal of said municipality thereto. STATE OF GEORGIA ) COUNTY OF CHATHAM ) THIS AGREEMENT made -and entered into this day of May, 1945, between THE MAYOR AND COUNCILMEN OF THE-TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, a municipal corporation of said County, hereinafter called the Landlord, and ANTHONY KENT,• of said State and County, hereinafter called the Tenant, :W I T N E S S E T H: 1.- That said Landlord. agrees to sublease to said Tenant that portion of the improvements on the Eastern end of Beach Lots Numbers.Ninety -five (95) and Ninety -six (96) Ward Four (1)- in the Town of Savannah Beach known as Tybrisa Pavilions, leased by it from the Tybrisa Company, located on the Northwest corner of said pavilion-including and behind a.counter now erected thereon, upon the terms and conditions hereinafter set forth. 2 - Said Tenant is hereby granted the use of said portion of said pavilion for the storage and sale of'soft drinks, sandwiches, crackers, foods and food products of all kinds, tobacco and tobacco products, novelties and souvenirs, but expressly excluding liquor, wine and beer, and for the distribution thereof anywhere on the said pavilion. 3 - Said Tenant is also permitted to place at some point on said pavilion to be designated by said Landlord an automatic coin operated vietrola or musical device. 4 - Said Tenant agrees that he will not keep said concess- ion open for business or permit the operation of said musical device except between the hours of 10:00 o'clock A. M., and 5 :00 o'clock P. M., Eastern War Time, and shall not operate said concession or per- mit the operation of said musical device at any time on Sunday. 5 - Said tenant agrees that he will, at his expense, re- move from said pavilion all papers, trash, garbage and rubbish of all kinds, and keep said pavilion in a clean condition, to be judged of by the Mayor of said Town of Savannah Beach, and a violation of this shall be sufficient cause for said Mayor, in his sole discre- tion, to declare this lease terminated forthwith, and in such case said Tenant shall not be entitled to a refund of any rent or any license charges which he may have paid to said Landlord. 1 1 1 1 1 6 - Said Tenant further agrees that he will provide and be solely responsible for any electricity or water used on said pavilion. 7 - Said Tenant further agrees to pay the said Landlord the sum of $200.00 as rent for said concession, said amount to be paid upon the execution of this agreement. 8 - Said Tenant further agrees, before beginning business, to apply and pay for any and all licenses which may be required by the Ordinances of said Town of Savannah Beach for the particular operations to be conducted by him. 9 - This lease shall begin at midnight May 25th, 1945, and shall terminate at midnight September 5th, 1945, and may be renewed for all or any part of the year 1946 and subsequent years provided that said Landlord is the Lessee of said premises at said time. 10 - Said Landlord agrees' that it will not during the per- iod covered by this lease, unless this lease is terminated, execute any lease or grant any concession to any other person, partnership or corporation to engage in any of the activities permitted by this lease on said pavilion,-or any part thereof, but said Landlord re- serves the right to permit the use of said pavilion or any part there- of except the Northwestern corner therof which is covered by this lease, by any person, persons or organizations for the purpose of holding dances or other entertainments, but shall not permit such other person, persons, or organizations to engage in the sale or to give away, any of the articles or things, sold by said Tenant, be- tween the hours of 10:00 otclock A. M., and g :00 o'clock P. M. on weekdays. 11 - Nothing in this lease shall be construed to require the Landlord to make any repairs or perform any work on said pavilion, or any of the personal property which may be located thereon, and any additions, repairs or alterations made to the part of the pavilion hereby leased shall be made only with the approval of the Landlord, but at the expense of the Tenant. 12 - This lease shall not be assignable by the Tenant, in whole or in part, without the consent of the Landlord. A RESOLUTION WHEREAS, in connection with the approval by the Federal Works Agency of Project No. Ga. 9 -244- N for the completion of sewerage facilities in the Town of Savannah Beach it is necessary that wage rates and classifications as the prevailing wage rates for the project be adopted by the Mayor and Councilmen of the Town of Savannah Beach in order that they may be incorporated in the proposed preliminary contract documents; AND, WHEREAS, there is attached to this resolution °a schedule of classifications and wage rates applicable to said project; BE IT, THEREFORE, RESOLVED by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, Georgia, in council assembled, that the attached schedule and wage rates be, and the same is hereby, adopted and approved as the wage rates and calssi- ficationa applicable to said Project No. Ga. 9- 244 -N. Councilman Lovell seconded and the motion passed. AN ORDINANCE TO REQUIRE OWNERS OF PROPERTY IN THE TOWN OF SAVANNAH BEACH TO FILL IN OR REMOVE SEPTIC TANKS AND DRY WELLS ON THEIR PROPERTY; TO PROVIDE A TIME FOR THE DOING THEREOF; TO PROVIDE A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; AND FOR OTHER PUR- POSES. SECTION 1. Be it ordained by the Mayor and Councilmen of the Town of Savannah Beach, .Tybee Island, Georgia, in Council assembled, and it is hereby ordained by the authority of the same, that all owners of property in said Town of Savannah Beach who may have septic tanks and dry wells on their property, shall, at the time their private sewerage systems are connected with the sewerage system in said town, remove or refill in said septic tanks and dry wells in such manner as may be approved by the plumbing inspector of said Town. SECTION 2. Be'it further ordained that all property owners in said Town whose private sewerage systems are already connected with the sewerage system in said Town, shall, on or before January lst, 1946, remove or fill in any septic tanks or dry wells on their property in such manner as may be approved by the plumbing inspector of said town. SECTION 3• Be it further ordained that any person, firm or corporation violating any of the provisions of this ordinance shall, upon the conviction thereof, be fined not to exceed one hundred dollars ($100.00), or be imprisoned not to exceed thirty (30) days, or both, and each days violation shall constitute a separate offense. 134 SECTION 4. All ordinances and parts of ordinances in conflict with the•provisions of this ordinance are hereby repealed. Councilman Lovell moved that the following Resolution be adopted. Councilman Walsh seconded and the motion passed. RESOLUTION WHEREAS, the Mayor and Councilmen of the Town of Savan- nah Beach deem it-desirable to provide a place for the use of the public where persons may eat lunch, hold picnics and engage in other recreational AND, WHEREAS, Tybrisa pavilion has for some years been closed, and has not been available for such purposes as in former years; AND, WHEREAS, The Tybrisa Company, the owner of said pavil- ion, is willing to rent said pavilion to the Town of Savannah Beach for a period of a•year, with the privilege of renewals from year to year for not exceeding five (5) years at a rental of One Dollar ($1.00) per year under certain terms and conditions which are set forth in a written lease, a copy of which is attached to this resol- ution; BE IT, THEREFORE, RESOLVED, by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, Georgia, in Council assembled, that the said lease tendered by The Tybrisa Company be, and the same is hereby, accepted and approved, and the Mayor of said Town of Savannah Beach be, and he is hereby authorized and directed to execute said lease, a copy of which is hereto attached, on behalf of said municipal corporation, and the Clerk of Council of said Town, be, and he is hereby, authorized And directed-to attest the same and to affix the corporate seal of said municipal- ity thereto.
