HomeMy Public PortalAboutOrdinance 64-132ORDINANCE 64 -132 AN ORDINANCE OF THE CITY OF TEMPLE CITY CHANGING THE ZONE OF AN IRREGULARLY SHAPED FOUR ACRE PARCEL SITUATED ON THE NORTH SIDE OF GREEN STREET BETWEEN BALDWIN AND GLICKMAN AVENUE PURSUANT TO REQUEST MADE IN ZONE CASE 64 -83. THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN AS FOLLOWS: SECTION 1. That certain real property described in the application for change of zone in Zone Case No. 64 -83, and as set forth in Tentative Tract Map No. 29569 on file with the City Clerk of the City of Temple City, is hereby rezoned to R -1 -5000 as said zone is described in Los Angeles County Ordinance No, 1494 (as amended) which Ordinance is hereby in- cluded herein by reference. SECTION 2. The change of zone of the subject real pro- perty referenced in SECTION 1. is hereby so zoned based upon the facts set forth in Resolution 64 -72PC of the Planning Commission, which facts are adopted herein by reference. SECTION 3. The change of zone set forth in SECTION 1. is to be deemed to have been made and have been in existence prior to the adoption of Ordinances 63 -112 and 64 -117 of the City of Temple City and the City Council expressly finds that development of the subject property shall lawfully proceed as R -1 -5000 property pursuant to the development as shown on Tentative Tract Map No. 29569 and subject to the conditions as fixed in respect thereto by the Planning Commission and City Council; that after the subject tract development has been fully completed the zoning as determined by the master zoning map, adopted by Ordinance No. 64 -124 shall apply, but only upon the property in like manner as Ordinance No. 64 -124 ap- plies to all other properties in which the new zoning of Ordinance 64 -124 applies as to non - conforming previously exist- ing zoning. SECTION 4. This Ordinance shall take effect immediately. This Ordinance is found to be an Ordinance necessary for the public peace, health and safety pursuant to Section 36937(b) of the Government Code. The fact supporting this declaration of urgency is that the through traffic flow as provided by this subject tract will provide more immediate and better police and fire protection required in the area and the ordinary second reading and thirty -day waiting period thereafter serves only useless delay and no public purpose.
