("Developer"),.Middlesex Avenue and Port Carteret Drive, Carteret, New Jersey, is the tenant of property identified as Block I, Lots 2.2, 2.11, and 2.12, in the Borough of Carteret, County of Middlesex, State of New Jersey (the "Site") upon which Site the Developer is about to commence construction; and WHEREAS, prior to commencement of construction, the Developer and the Borough of Carteret are required to enter into a Developer's Agreement outlining the terms and conditions and other requirements of the Borough of Carteret, which the Developer must meet prior to, during, and subsequent to the construction process on the Site; and WHEREAS, pursuant to the Resolution of Findings and Conclusions, regarding Applications No. P-99-8, P-99-11, and P-99-12, of the Planning Board of the Borough of Carteret, finally adopted on February 23, 2000, which approved a major subdivision and final site plan, in order to construct a 234,153 square foot warehouse facility with ancillary office areas and the alignment of certain lot lines in Application No. P-99-8; a major subdivision and site plan, in order to construct a 99,799 square foot addition to an existing warehouse, and the realignment of certain lot lines in Application No. P-99-11; and a major subdivision and site plan in order to construct certain site improvements, but no new structures, and the realignment of certain lot lines in Application No.P-99-12; and WHEREAS, The Municipal Land Use Law, N.J.S.A. 40:55D et seq., provides for the entry of such agreements where performance guarantees or public improvements and/or contributions towards said improvements are to be required or performed pursuant to an approval. NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. The Borough of Carteret shall enter into a Developer's Agreement in a form acceptable to the Borough Attorney. 2.
