AN ORDINANCE OF THE CITY CF TEMPLE CITY,
CALIFORNIA, FINDING AND DETERMINING THAT
THE PUBLIC INTEREST AND NECESSITY REQUIRE,
AND ORDERING, THE ACQUISITION AND IMPROVE-
MENT FOR VEHICLE PARKING DISTRICT NO. 2
OF SAID CITY AND ESTABLISHING THE BOUNDA-
RIES OF SAID DISTRICT.
WHEREAS, a petition for the formation of a vehicle parking
district under the provisions of the Vehicle Parking District Law
of 1543 (Part 1 of Division 18 of the Streets and Highways Code) was
filed in the office of the City Clerk on January 27, 1964, and said
petition was duly signed by the requisite number of qualified signers
and contained all of the matters and things required by law and was
in every respect sufficient; and
WHEREAS, said petition was checked by said City Clerk, and
said Clerk made a certificate to the effect that said petition is
signed by the requisite number of qualified signers and presented
said petition and said certificate to this City Council; and
WHEREAS, proceedings were taken, a report was duly prepared,
and a hearing duly held pursuant to notice duly given, under the
Special Assessment Investigation, Limitation and Majority Protest Act
of 1931 (being Division 4 of the Streets and Highways Code) and no
written protest was filed by the owners o-o more than one -half of the
area to be assessed for the proposed acquisition and improvement, and
this City Council, by resolution duly adopted, determined that the
public interest, convenience and necessity require the acquisition
and improvement substantially as set forth in the report on file in
the office of the City Clerk and that the project is feasible; and
WHEREAS, this City Council duly adopted Ordinance No.
64 -127 of said City (hereinafter referred to as said Ordinance of In-
tention) declaring the intention of this City Council to Form said
district to be known as Vehicle Parking District No. 2 of said City,
and to acquire the lands and construct the improvements proposed in
said petition, and fi>cing a time and place for the hearing of protests
and objections by this City Council; and
WHEREAS, said Ordinance of Intention was duly published,
posted, and mailed as provided by said Law, and said hearing was duly
held at the time and place so fixed and all continuances thereof, if
any, were duly made and ordered; and
WHEREAS, at said hearing, all persons desiring to be heard
were fully heard, and all protests and objections, if any, made or
filed were fully heard and the same have been overruled and denied
by order entered on the minutes of this City Council, and said hear-
ing has been duly concluded; and
WHEREAS, this City Council has determined by order entered
on its minutes that written objection or protest to the thing or
things proposed to be done as set forth in said Ordinance of Inten-
tion has not been made by the owners of more than one -half of the
area of the land included within the proposed district and subject
to assessment; and has further determined " :y said order that there is
no majority protest within the meaning of Sections 2930 and 2931 of
the Streets and Highways Code; and
WHEREAS, at said hearing written and oral evidence was re-
ceived by this City Council and it is the judgment of this City Coun-
cil that all of the land within the proposed district as hereinafter
described will be benefited by the proposed acquisition and improve-
ment;
NOW, THEREFORE, the City Council of the City of Temple City
does ORDAIN as follows:

SECTION 1. That this City Council hereby finds and deter-
mines that the public interest and necessity require the acquisition
and improvement described in said Ordinance of Intention and herein-
after described and that the property to be acquired as hereinafter
described is necessary for the purpose.
SECTION 2. That this City Council hereby orders the ac-
quisi-tion described in said Ordinance of Intention, namely, the ac-
quisition in fee simple for parking places of the following described
property in said City, to wit:
The northerly half of Lot 252 and all of Lots
253 and 254, Tract No. 6561 as shown on map
recorded in Book 72, pages 34 and 35 of Maps
in the office of the Recorder of Los Angeles
County.
SECTION 3. That this City Council hereby orders the im-
provement described in said Ordinance of Intention, namely, the im-
provement of the parking places to be acquired as described in Sec-
tion 2 hereof, by the construction thereon of work and improvement,
as follows:
1. Clearing and grading, including the removal
of any existing structure or other obstruction
as necessary.
2. Paving with asphaltic material, together with
suitable base, where required.
3. Construction of portland cement concrete drive-
ways as required, to provide ingress to and egress
from said parking lot.
4. Removal, construction and reconstruction of
sidewalks, curbs and gutters, as required.
5. Construction of wheel bumpers.
6. Painting stall lines and directional lines and
arrows, and installation of appropriate information
signs.
7. Installation of lighting system.
8. Construction of retaining walls, as required. ;•
9. Installation of walls or fencing, or both as
required.
10. Construction of planting areas, together with
landscaping, water lines and sprinkling system.
11. Any necessary work and materials appurtenant
to any of the foregoing or necessary to comply with
city ordinances.
SECTION 4. That the boundaries of Vehicle Parkince District
No. 2 of said City are hereby fixed and established as follows:
Beginning at the northwesterly corner of Lot 222,
as shown on map of Tract No. 6561 recorded in
Book 72, pages 34 and 35 of Maps in the office of
the Recorder of Los Angeles County, thence southerly
in a direct line to the northwesterly corner of Lot
232, said tract; thence easterly in a direct line
to the northeasterly corner of said last mentioned
lot; thence southerly in a direct line to the south-
easterly corner of Lot 233, said tract; thence
westerly along the southerly line of said last
mentioned lot and its westerly prolongation to a
line that is parallel with and 5 feet westerly

measured at right angles fromwthe westerly line of
Lot 236, said tract; thence southerly along said
parallel line to the center line of Las Tunas Drive
(formerly San Gabriel Boulevard 100 feet wide) as
shown on said map; thence easterly along said center
line to the center line of Temple City Boulevard
(formerly Sunset Boulevard, GO feet wide) as shown
on said map; thence northerly along said center line
to the easterly prolongation of the northerly line
of said Lot 222; thence westerly along said easterly
prolongation and said last mentioned northerly line
to the point of beginning.
Said boundaries are shown on a map of said assessment dis-
trict entitled "Map indicating by a boundary line the extent of the
territory included within proposed Vehicle Parking District No. 2 of
the City of Temple City" which map was filed in the office of the City
Clerk of said City on March 5, 1964 and a copy of which map was filed
with the County Clerk of Los Angeles County on March 19, 1964, as re-
quired by Sections 3111 and 3112 of the Streets and Highways Code.
Such map shall govern for all details as to the extent of such dis-
trict.
SECTION 5. That this City Council hereby declares that a
vehicle parking district as above described and designated and number-
ed as Vehicle Parking District No. 2 of the City of Temple City has
been duly formed under the provisions of said Vehicle Parking District
Law of 1943.
SECTION 6. That the City Attorney of said City is hereby
directed to bring an action in the Superior Court in the name of said
City for the condemnation of the property necessary and ordered to be
acquired as described in this ordinance; provided that this City Coun-
cil may contract for the purchase of any of said lands, and any part
of said lands acquired by purchase or by gift need not be included
in the condemnation action or, if included therein, need not be con-
demned. Except as otherwise provided in, said Vehicle Parking District
Law of 1943, the condemnation action shall be filed and the condemna-
tion proceedings taken substantially as provided in the Street Open-
ing Act of 1903, and particularly in Chapters 7, 8, 9 and 10 thereof.
SECTION 7. That the City Clerk shall certify to the adop-
tion of this ordinance and shall cause this ordinance to be published
once in the TEMPLE CITY TIMES, a newspaper of general circulation in
said City.
SECTION 3. This ordinance shall take effect thirty (30)
days after its passage.
