HomeMy Public PortalAboutORD-CC-1994-15ORDINANCE 94-15 AN ORDINANCE AMENDING CHAPTER 17 OF THE MOAB MUNICIPAL ORDINANCES CREATING AN 0-1 OFFICE -RESIDENTIAL ZONE. BE IT ORDAINED BY THE MOAB CITY COUNCIL AS FOLLOWS: That Chapter 17.37 of the Moab Municipal Ordinances shall be amended to read as follows: Sections: 17.37.010 Objectives and characteristics. 17.37.020 Use regulations. 17.37.030 Area, width and location requirements. 17.37.040 Special provisions. 17.37.050 Supplementary regulations. 17.37.010 Objectives and characteristics. A. The objective in establishing the 0-1 office -residential zone is to facilitate the development of attractive areas within the City that accommodate offices for professional persons. Uses permitted in the 0-1 zone would typically include offices for doctors, dentists, accountants and other similar professions which provide a room or group of rooms for conducting the affairs of a business, profession or service and are generally furnished with desks, tables, files and communication equipment. The sale of commodities shall be limited in this zone to items that are incidental and secondary to the services provided. B. The 0-1 office -residential zone is characterized by attractive and well -maintained office and residential buildings set back from public streets and surrounded by landscaped yards. In order to accomplish the objectives and purposes of this title and to stabilize and protect the essential characteristics of the zone, the regulations set out in this chapter shall apply in the 0-1 office -residential zone. 17.37.020 Use regulations. The following uses shall be permitted in the 0-1 office -residential zone upon compliance with requirements set forth in this title: 1. Office buildings, clinics and utility buildings excluding service yards and drive through services; 2. One -family and two-family dwellings, apartment houses and court apartments; 3. Churches; 4. Home occupations (conditional use approval required); 5. Schools, hospitals, public buildings and public parks; 6. Signs (shall adhere to the residential requirements of the sign code); 7. Rest homes and day care centers; 8. Other uses similar to the foregoing uses which are ruled by the planning commission to be in harmony with the intent of this zone. 17.37.030 Area, width and location requirements. Area, width and location requirements shall be the same as for dwellings in the R-3 zone for both commercial and residential buildings. 17.37.040 Special provisions. A. A strip of land at least fifteen feet in width adjacent to all public streets shall be landscaped as set forth in Sections 17.09.360 (Landscaping --Required) and 17.09.370 (Landscaping-- Specifications) of this title, except for permitted driveways. B. No dust, odor, smoke, vibration or intermittent glare or noise shall be emitted which is discernible beyond the premises, except for normal traffic movements. C. Storage of all merchandise, material and products shall be carried on within a building or within an area enclosed with a sight -obscuring fence or wall, except for vehicles in running order. D. All off-street parking shall be hard -surfaced. 17.37.050 Supplementary regulations. See also Supplementary Requirements and Procedures Applicable Within Zones (Chapter 17.09 of this title).
