passengers who have already started on trips on said busses, and is
apparently adopting a policy of refusing to transport any colored'
passengers if there are white passengers who wish.to be transported;
And whereas said policy has - rendered it very difficult for
colored passengers who work in the Town of Savannah Beach and who
must travel on said busses, to secure such transportation;
And whereas this situation is of concern to many residents
of Savannah Beach who employ said colored persons either in their
homes or places of business, and in the opinion of the Mayor and
Councilmen of the Town of Savannah Beach is unfair and discrimina-
torn;
Be it therefore resolved by Mayor and Councilmen of the
Town of Savannah Beach, Tybee Island, Georgia, in council assembled,
that a copy of this resolution be sent to Atlantic Stages, and that
it be requested to immediately take such'steps and issue such orders
as may be necessery_to prevent unfair and unjust discrimination be-
tween white and colored passengers wishing to travel on its busses
between Savannah and Savannah Beach.
There being.no further business the Council adjourned sub -

The regular meeting of Council was held today at 4;00 p.M.
in the Council Room and was attended by Mayor Dutton, who presided,
and Councilmen Welsh, Young, Farrell, Slotin, Lovell, Hosti and Town
Attorney Alexander, also by Mr. M. T. Singleton, Mr. Carl Espy, and
Mr. R. F. Gambill.
The minutes of the meetings of June 7th and 25th were read
and adopted.
Mr. Singleton stated that he had gotten in touch with the
Espy Company relative to their bid of $135,447.58, which with the
deductable items of $53,850.47, made the net figure of $81,597.11.
Espy' a revised figure was $74,672.55 less deductable items of
$1,162.50 and less oyster shells for $3,325.00 made a net total of
70,185.05 with additions of $133.00 made the total $70,318.05.
Mr. Espy stated that he hoped to start work by July 26th, the Mayor
stated that whoever got the contract, that they should be requested
to correct and complete some of the work that the Attaway Company
should have done and charge this to Attaway's bonding company.

Councilman Hosti asked if when the work is completed this time will
it cure the, ills of the system, Mr. Singleton stated that .the only
difficulty would be when the power would cut off occasionally.
Councilman Young moved that the following Resolution be adopted,.
Councilman Walsh seconded and the motion passed.
RESOLUTION
WHEREAS at a special meeting of the Mayor end Councilmen
of the Town of Savannah Beach, Tybee Inland, Georgia, held at noon
on June 25th, 1945, at the Town Hall in said. Town of Savannah Beach,
sealed bids were received in response to proper advertisement, for
the completion of the sewerage system in said .town, in .accordance
with plans and specifications prepared by Messrs. Wiedeman and Sing-
leton, employed by the said Town of Savannah Beach;
AND WHEREAS said bids were then and there opened and tabu-
lated, and the Mayor and Councilmen of said town were advised by said
Engineers that the bid of the Espy paving and Construction Company
was the lowest bid, said bid being in the amount of One Hundred Thir-
ty -Five thousand Four Hundred Forty -seven Dollars and Fifty - eight
Cents (135,447.58),' with the deductible alternates amounting to
Fifty -three Thousand Eight Hundred Fifty Dollars and Forty -Seven
Cents.(. 53,850.47)0 making a net bid of Eighty -one Thousand Five
Hundred Ninety -seven Dollars and Eleven Cents 081,597.11);
BE IT THEREFORE RESOLVED by the Mayor and Councilmen of
the Town of Savannah Beach, Tybee Island, Georgia, in council as-
sembled, the Mayor and all members of Council being present, and
upon the advice of Messrs. Wiedeman and Singleton, that said bid
of Espy Paving and Construction Company in the amount of Eighty -
one Thousand Five Hundred Ninety -seven Dollars and Eleven Cents
(81,597,11) be, and the same is hereby, accepted.
BE IT FURTHER RESOLVED by the authority aforesaid, that
said Town of Savannah Beach pay out of its general treasury any
amount which may be necessary to pay for said work in accordance
with said contract over and above the funds. available for said
purpose by Federal grant and an appropriation already made by
said .town for said purpose.
A petition was presented by Carl Espy, Jr. requesting
the Town to sell Sixth Street from Butler Avenue to the Strand,
as he and some of his associates had recently purchased the pro-
perty of the Estate of H. P. Smart. The opinion of the Town
Attorney was that since Sixth Street has been open to the public
it cannot be sold. The Mayor informed Council that some of the
property owners had instituted injunction proceedings against the
disposal of Sixth Street and the case is called for July 20th in
the Superior Court, Mr. Alexander stated that he expected to be
in Macon, Georgia on that date, that he would ask the Court to
grent him a leave of absence.

The Mayor informed Council that he had received a letter
from Mr. H. M. Garmany, a Civil Engineer, relative to a difference
of measurements between his and Mr. Davis' surveys of the Town's
streets, and asked that a check be made and made a matter of record.
The Mayor stated that Mr. Davis informed him that there was a differ-
ence of 39.71 feet from First Street down to Nineteenth Street on
Butter Avenue and that the Town Map does not tie-in with the survey,
Mr. Garmany stated that he was including the overage in the streets,
and that Mr. Davis was putting the overage into the streets. Council-
man Young stated that at the waterworks lot the fence was put on the
original stakes and Mr. Davis has it out of line, Mr. Davis stated
that in his checks that the monuments are all out of line and that he
used the U. S. and C.R.R. monuments as a base to work with, Council-
man Young said the pavement on Butter Avenue was not in the center.
Councilman Walsh moved that the following Ordinance be

TO REQUIRE PROPERTY OWNERS IN THE TOWN OF SAVANNAH BEACH
TO PROVIDE SURVEYS BEFORE SECURING BUILDING PERMITS IN THE TOWN OF
SAVANNAH BEACH, TYBEE ISLAND, GEORGIA; AND FOR OTHER PURPOSES.
Section 1. Be it ordained by the Mayor and Councilmen of
the Town of Savannah Beach, Tybee Island, Georgia, in council assem-
bled, and it is hereby ordained, that, from and after the adoption
of this ordinance, that any person, persons or corporation applying
for a building permit in said town shall accompany said application
with a survey of the property on which said building is proposed to
be erected, said survey to be made by an engineer, licensed by the
State of Georgia, in accordance with the provision of the laws of
Georgia, as -such. .
Section 2. Be it further ordained, by the authority afore-
said, that no building permit shall be issued unless the requirements
of this ordinance are complied with.
Section 3. Be it further ordained, by the authority afore-
said, that all ordinances, and parts of ordinances, in conflict here-
with be, and the same are hereby, repealed.
The Mayor informed Council that the authorities at Hunter
Field are insisting that the Town employ more life guards, establish
a first aid station and also have a doctor in attendance, that Dr.
Holton had informed him that no doctor at the present time is avail -
able, that he had sent a Dr. Fitzsimmons,,a retired- Navy doctor, to
him who wants to live on the island but that a place could not be
found in which he could live, that Hunter Field had agreed to send
some expert technician, but not on Government time, only when a man
if off duty and wants to do some extra work, and will be paid for
his services and that since the expense of maintaining. extra life
guards, and first aid stations etc. had developed into quite an ex-
pense to the Town that the Mayor called a meeting and requested all
merchants to attend, he put the matter before them and the number
agreed to contributing to a fund to help pay for the expense of main-
taining life gurard facilities.

The Mayor informed Council that in connection with Dr.
Fitzsimmons locating on Tybee unless something is done quickly he
will go elsewhere as severel other places are trying to get him,
after some discussion Councilman Walsh moved that the matter be
referred to the Mayor and Councilman Biotin with power to act,
Councilman Young seconded and the motion pawed.
A communication was read from Mr. A.C. Carter in which
he requested-that his salary be raised to that promised him at the
time he was employed, March let, 1944: the matter was referred to
Councilman Young.
Councilman Slotin moved that bills for General Government
for the month of July amounting to $3,221- .,32 be paid. Councilman
Young seconded and the motion passed.
Wiedeman and Singleton submitted a bill for $4,394.94
covering $3,000.00 for their engineering contract and for plans
end specifications, etc. and also $1,319.94 as expense of chP%nging
some of the J. G. Attaway Company's work. Councilman Slotin moved
that they be paid, Councilman Young seconded and the motion passed.
Councilman Slotin stated that Vr.. A. F. Solms had paid
the insurance premium on the small building erected for the use of
the military personnel but that he felt the Town should pay it,
Councilmen Walsh moved that we pay Mr. A. F. Solms $41.10. Council-
man Young seconded and the motion passed.
Councilman Slotin stated that he had made a survey of all
streets that should be paved and that it would be a good ple.n to
have all of them paved at one time as this would save money and
solve the problem, that he had checked Second and Third Avenues and
found that it would require paving for 16,000 feet . by 20 feet wide,
that the estimate on this was $45,000.00, but that this:was too high,
he suggests that we buy the material and using the convicts, we do
the work ourselves, Councilman Young moved that the concrete mixing
machine, which could be used for the mixing of the asphalt, be re-
paired, Councilman Hosti seconded and the motion passed.
Councilman Slotin stated that he had contacted Mr. Jospeh
S. Espy in an effort to ascertain why we have to pay such a high
insurance premium on the Town Hall. Councilman Walsh moved that Mr.
Slotin be authorized to hendle the matter with Mr. Espy with the
view to having this corrected, Councilman Young seconded and the
motion passed.
Councilman Slotin inquired as to whether people could
be required to build not less than 10 feet from their property
line. The matter was referred to the Town Attorney, he was also
requested to check on the Zoning Law.
• Councilman Biotin moved that Councilman Farrell be auth-
orized to make a survey of what equipment the Town hes on hand and
that what is not needed that it be sold. Councilman Walsh seconded,
and the motion passed. The following committee was appointed:

Councilman Slotin asked about the deeds covering property
sold for taxes and was informed that the Clerk did not have them.
Mr. Alexander said he thought they had been sent if not he would
attend to the matter at once. Councilman Slotin stated that he had
talked to Mr. C. B. Moats, C.P.A., with reference to his auditing
the Town's books for the past fiscal year and Mr. Moats agreed to do
the work for $300.00, Councilman Slotin moved that he be engaged for
$300.00. Councilman Walsh seconded and the motion passed.
Councilman Slotin stated that quite a number of street
signs that had been erected by the Town are down end made a motion
that concrete posts for use as street signs be erected, Councilman
Young seconded and the motion passed.
Councilman Slotin stated that he instigated hiring a Town
Engineer for post -war projects'end that eight months have gone and
nothing has been done as yet, he was informed that Mr. Davis, the
Town Engineer, was doing all that he could, the Mayor stated that he
would check on the matter, Councilman Young stated that storm sewerage
and street paving plans would -have to be gone into together. .
Councilman Lovell stated that the groins and wooden bulk-
head from First Street to Tilton Street have been taking considerable
pounding and as there are no back stays supporting the bulkhead, this
should be fixed at once, tide water is also coming in through openings
in the bulkhead, Mayor Dutton-stated that the U. S. Engineers had been
requested to check the groins-on the beach.
Councilman Hosti made a request for C. J. Hosti for the use
of Tybrisa Pavilion on Saturday nights for the showing of moving pic-
tures. Councilman Slotin moved that the matter be referred to the
Committee in charge of the pavilion for handling, Councilman Young
seconded and the motion passed.
Councilman Walsh informed Council that the Catholic Church
wanted to use the auditorium during part 'of Sundays for-Church services
during the winter season. The'request was granted.
Councilman Walsh stated that he had been approached by Mr.
Frank Exley. to ascertain if the government has discontinued the -use.
of the wooden tower at the south end, as.apparently it is not being
used except for acts of indecency committed by the public. It was
the opinion of Council that both this tower and the one at Twelth
Street should be removed, as the government has discontinued the use
of them. .
A bill for 018.550 covering advertising for bids for the
sewerage system in the nixie Contractor', was submitted by Wiedeman
and Singleton, Councilman Young moved that it be paid out of the
Sewerage Project Account Funds, Ga.-9-244, Councilman Hosti seconded
and the motion passed.
A petition was presented from the property owners on Shir-
ley Road requesting that it be _paved, the petitioners claimed that
the road was paved originally at their expense end that it was torn
up by the J. G. Attaway Company when they were installing the sewerage

system they contend it is the duty of the Town to do something about
it. Councilman Siotin stated that they all pay taxes as well as
others on other streets Councilman Lovell asked that if every two
adjoining beach lot ownere have an eaeement , should the Twon pave
all of them, he contended that the public streets should be repaired
and maintained first. Councilman Young moved that Shirley Road and
the .easement running down to the cotteges of Sidney Register and W.
A. Johnson at Ninth Street from Butler Avenue to the Strand be paved.
Councilman Walsh seconded and the motion passed.
The Jones Plumbing Company submitted an estimate of $215.00
for repairing and installing plumbing in the building owned by the
Town at 409 Butler Avenue and now occupied by Mr. W. F. Benet. Coun=
cilman Young stated that all plumbers should be asked to submit sealed
bide on this work.
L. F. Hodges petitioned for a refund of X0.00 overpaid by
him for stubbing, Councilman Young moved that the ,50.00 be refunded
Councilman Lovell seconded and the motion passed.
. A communication was read from Dr. Hamm of the Health Depart-
went calling attention to the bad unsanitary condition of the Townes
rest rooms,'the matter was referred to Councilman Farrell, Young and
Hosti with request that the bad conditions be corrected or the rest
rooms be closed. Councilman Young wanted to know if the Town was
going to let the rest rooms remain where they are.
Council was informed that some of the business licenses
*are still unpaid, after some discussion Councilman Hosti was requested
to instruct Chief Stewart that all licenses must be paid by Saturday,
noon or Council be advised why they have not been paid after that time.
Mayor Dutton read a letter from Councilman Siotin complain-
ing about the way the Clerk's office is being conducted, he wanted
certain rules and regulations adopted, after some discussion the mat-
ter was thrashed out.
In the conduct of the operations of the various departments
the Mayor requested the Chairman of the several committees to call a
meeting of their committee and have each employee attend the meeting
and report beck at a subsequent meeting of Council. The Mayor aleo
requested each Committee Chairman to report to Council at each month-
ly meeting on the activities of his committee for the previous month.
It was also decided that there should be.closer cooperation between
Mr. Kent and Mr. Carter in the operation of the Sewerage system.
In connection with surveying fees charged by the Town En--
gineer, a committee consisting of Councilman Walsh, Lovell and
Siotin was appointed to contact the city engineer in Savannah and
ascertain how the matter is handled there and report back.
Councilman Siotin moved that the following Resolution be
adopted, Councilman Young seconded and the motion paesed.

RESOLUTION
WHEREAS a resolution was adopted at a meeting of the
Mayor and Councilmen of the Town of Savannah Beach, Tybee Island,'
Georgia, held on June 25th, 1945, requesting Atlantic Stages to
investigate and correct a situation existing rendering it ex-
tremely difficult for colored persons traveling on its busses
between Savannah and Savannah Beach to secure transportation;
AND WHEREAS it has now been brought to the attention
of said Town of Savannah Beach by a communication from Atlantic
Stages that it has taken steps to comply with the request of
said town, said communication stating said Atlantic Stages wel-
comed any criticisms or suggestions for improving its service;
BE IT THEREFORE RESOLVED by the Mayor and Councilmen
of the Town of Savannah Beach, Tybee Island, Georgia, in council
assembled, that the thanks of said Town of Savannah Beach be
extended to Atlantic-Stages for its prompt attention to the
request made of it in said resolution.
Councilman Siotin moved that the following Resolution
be adopted, Councilman Hosti seconded and the motion passed.
RESOLUTION
WHEREAS on August 20th, 1915, a resolution was passed
authorizing the Mayor and Councilmen of the Town of Tybee to
lease certain property on Tybee Island to the Board of Education
for the City of Savannah and the County of Chatham for the pur-
pose of erecting a school house;
AND WHEREAS said school house was erected on said prop -
erty, but there is 'no record that said lease was actually executed;
AND WHEREAS said school house is now in need of repairs,
and said Board of Education is willing to make said repairs, pro-
vided that title to said property is vested in it;
BE IT THEREFORE RESOLVED by the Mayor and Councilmen of
the Town of Savannah Beach, Tybee Island,' Georgia, in council assem-
bled, that the Mayor of said town be, and he is hereby, authorized
and directed to execute a deed to The Board of Education for the.
City of Savannah and the County of Chatham, conveying'to it that -
portion of the public domain on which said school house is now loca-
ted, extending from the Western line of Butler Avenue, and extending
ten feet (101) North and ten feet (101) South of the present school
house; and the Clerk of Council of said Town is hereby authorized to
and directed to attest said deed and to affix the corporate seal of
said town thereto.
Councilman Walsh moved that the following Resolution be
adopted, Councilman Young seconded and the motion passed.

RESOLUTION
Whereas William S. Lovell is the owner of certain
property on the Southwest corner of 1st Street and Butler Avenue
in the Town of Savannah Beach;
And Whereas the said William S. Love].l has given per-
mission to said Town of Savannah Beach to encroach on the North-
east corner of his said property for the purpose of widening the
turn from 1st Street into Butler Avenue, and said Town has en-
croached on said property for said purpose;
And whereas it was understood and agreed between said
William S. Lovell and said Town of Savannah Beach that said encroach-
ment should not in any manner impair the title of said William a.
Lovell to said part of said lot on which said encroachment has been
or may be made;
Be it therefore resolved by the Mayor and Councilmen of
the Town of Savannah Beach, Tybee Island, Georgia, in council as-
sembled, that said Town of Savannah Beach renounces any title. or
right of easement which it may have, or which may hereafter accrue
to it by reason of said encroachment on said. property of William S.,
Lovell,-.so that said William S. Lovell may reclaim possession of
said property at any time -he may so desire, and this right shall
insure to the benefit of the executors, administrators, heirs and
assigns of the said William S. Lovell.
Councilman Walsh moved that the following Amendment to
the License Ordinance be adopted, Councilman Young seconded and the
motion passed. •
ORDINANCE
AN ORDINANCE TO AMEND AN ORDINANCE ENTITLED "AN ORDINANCE
TO PROVIDE FOR THE RATE OF LICENSES FOR DOING BUSINESS IN THE TOWN
OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA,. FOR THE FISCAL YEAR END-
ING APRIL 30th, 1946; FIXING PENALTIErS FOR THE VIOLATION AND FOR
OTHER PURPOSES."
SECTION 1. Be it ordained by the Mayor and Councilmen of
the Town. of Savannah Beach, Tybee Island, Georgia, and it is hereby
ordained by the authoritg of the same, that a certain ordinance en-
titled 'lAn Ordinance to rovide for the Rate of Licenses for Doing
Business in the Town of Savannah Beach, Tybee Island, Georgia, for
the fiscal year ending April 30th, 1946; fixing penalties for the
violation, and for other purposes" be and the same is hereby amended
by adding thereto another sub - section of Section 1 to read as follows: -
Each and every person engaged in the business
of renting inner tubes, or similar articles $5.00
SECTION 2. Be it further ordained that all ordinances
or parts of ordinances, -in conflict herewith be, and the same are
hereby, repealed.

passed on the death of Mr. Thomas Gamble, former Mayor of Savannah
Beach, Councilman Walsh seconded and the motion passed.
RESOLUTION.
WHEREAS, Thomas Gamble, Mayor of the City of Savannah,
died on July 13th, 1945, thus bringing to a close a life spent in
the service of his fellow men, and particularly of his fellow
citizens of Chatham County;
AND WHEREAS, Thomas Gamble for many years, and up until
the time of his death, was keenly interested in the welfare of the
Town of Savannah Beach and its people, having served said Town of
Savannah Beach as Mayor from May 3rd, 1926, until he resigned on
December 29th, 1932, in order to become the Mayor of the City of
Savannah;
BE IT THEREFORE RESOLVED by the Mayor and Councilmen of
the Town of Savannah Beach, Tybee Island, Georgia, in council
assembled, that in the death of Thomas Gamble, the Town and the
people of Savannah Beach have lost a friend who was constantly
interested in the wellbeing of the town and its people,'and who
on numerous occasions throughout the years proved his friendship
by actions too numerous to mention in detail;
AND BE IT FURTHER RESOLVED that a copy of these resolu-
tions be spread upon the minutes of the said Town of Savannah
Beach, and that copies be sent to the family of Thomas Gamble.
