ORDINANCE AUTH/ORIZING ACQUISITION OF CERTAIN
REAL PROPERTY WITHIN THE BOROUGH
OF CARTE RET FOR PUBLIC PURPOSES
WHEREAS, by Ordinance No. 21-3, adopted on April 8, 2021, the Mayor and Council
of the Borough of Carteret (the "Borough") determined that a need exists to acquire the
real property (or portion thereof), designated as Block 7401, Lot 1 (150 Roosevelt
Avenue), among others, in the Borough, necessary to effectuate public parking, roadway
extensions, sidewalk/traffic signal improvements, Waterfront access mad easements, and
such other public purposes as are authorized by law; and
WHEREAS, the Borough determined that said uses are public purposes and will
promote the general health and welfare of the community; and
WHEREAS, pursuant to N.J.S.A. 40A:12-5(a)(1) of the Local Land and Buildings Law,
N.J.S.A. 40A:12-1 at seq., the Borough may provide for the acquisition of any real
property, capital improvement, or personal property by purchase, gift, devise, lease,
exchange, condemnation or installment purchase agreement; and
WHEREAS, the Borough desires to clarify that, if necessary and if the Borough so
determines, it may, in its discretion, acquire all or a portion of the property referenced
herein.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF
THE BOROUGH OF CARThRET; THAT:
Section 1. The aforementioned Recitals are incorporated herein as though set
forth at length.
Section 2. The Borough is hereby authorized to acquire all or a portion of the
property designated as Block 7401, Lot 1 (150 Roosevelt Avenue),
if, in its discretion, it is necessary and desirable to do so.
Section 3. The remainder of Ordinance 21-3 shall remain in effect as
applicable to such property.
Section 4. The ordinance shall take effect upon publication and final passage
according to law.

AN ORDINANCE AUTHORIZING AGQVISITION OF REAL PROPERTY
WITHIN THE BOROUGH of CARTER ET FOR PUBLIC PURPOSES
This Ordinance authorizes acquisition of Block 7401, Lot 1 for public'
purposes that will promote the general health and welfare of the
community, it also amends Ordinance #21-3.
The foregoing Ordinance was Introduced at a meeting of the
Council of the Borough of Carteret held February 2nance , 2012 when It
