HomeMy Public PortalAboutORD-CC-1994-17ORDINANCE # 94-17 AN ORDINANCE AMENDING SECTIONS 15.04.010,15.04.015, 15.04.040,15.08.010, 15.12.010, 15.16.010,15.20.010, 15.20.020, 15.24.010, 15.25.010, 15.26.010, 15.27.010, 15.28 AND 15.32, TITLE 15, OF THE MOAB MUNICIPAL ORDINANCES. BE IT ORDAINED BY THE MOAB CITY COUNCIL AS FOLLOWS: That Sections 15.04.010, 15.04.015, 15.04.040, 15.08.010, 15.12.010,15.16.010, 15.20.010, 15.20.020, 15.24.010, 15.25.010, 15.26.010, 15.27.010, 15.28 and 15.32, Title 15 of the Moab Municipal Ordinances shall be amended to read as follows: BUILDING CODE 15.04.010 Adoption. Certain codes establishing rules and regulations for the regulation and control of the design, construction, quality of materials, use and occupancy, location and maintenance of buildings, and structures entitled "Uniform Building Code," 1991 Edition, printed as a code in book form, adopted by the International Conference of Building Officials is adopted as the building code of the city, and by this reference is made a part of this chapter. Three copies of the Uniform Building Code are filed for use and examination by the public in the office of the city recorder. 15.04.015 Uniform Building Code 1991 Edition --Chapter 70 adopted. Chapter 70 of the 1991 Uniform Building Code is hereby adopted in its entirety. 15.04.040 Permit fees. The permit fees applicable in the city for use under the model codes adopted by this chapter shall be established by the Uniform Administrative Code, 1991 Edition. Other developmental fees shall be established by resolution. Delete the rest of 15.04.040. ELECTRICAL CODE 15.08.010 Adoption --Where filed. That certain code establishing rules and regulations for the regulation and control of the design, construction, and quality of materials used in electrical installations, entitled "National Electrical Code, " 1993 Edition, printed as a code in book form, approved by the American Standards Association and adopted as the standard of the National Board of Fire Underwriters for electric wiring and apparatus, as recommended by the National Fire Protection Association, is adopted as the electrical code of the city, and by this reference is made a part of this chapter to the same extent and effect as though such code were copied herein in full. Three copies of the National Electrical Code are filed for use and examination by the public in the office of the city recorder. O MECHANICAL CODE 15.12.010 Adoption --Where filed. Certain documents, three copies of which are on file in the office of the recorder of the city, being marked and designated as "Uniform Mechanical Code" (and "Uniform Mechanical Code Appendix"), 1991 Edition, and the "Uniform Mechanical Code standards," 1991 Edition, published by the International Conference of Building Officials are adopted as the code of the city for regulations and controlling the design, construction, installation, quality of materials, location, operation, and maintenance or use of heating, ventilating, cooling, refrigeration systems, incinerator and other miscellaneous heat -producing appliances within this jurisdiction, providing for issuance of permits and collection of fees thereof; providing penalties for violation of such code; and each and all of the regulations, provisions, penalties conditions and terms of such code. FIRE CODE 15.16.010 Adoption --Where filed. Certain documents, three copies of which are on file in the office of the recorder of the city, being marked and designated as "Uniform Fire Code" (and "Uniform Fire Code Appendix"), 1991 Edition, and the "Uniform Fire Code Standards," 1991 Edition, published by the International Conference of Building Officials and Western Fire Chiefs Association, are adopted as the code of the city for prescribing regulations consistent with nationally recognized good practice for the safeguarding to a reasonable degree of life and property form the hazards of fire and explosion arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the use or occupancy of buildings or premises; and each and all of the regulations, provisions, penalties, conditions and terms of such "Uniform Fire Code," 1991 Edition, and the "Uniform Fire Code Standards," 1991 Edition, on file in the office of the city are referred to, adopted and made a part hereof as if fully set out in this section. Chapter 15.20 ENERGY CONSERVATION CODE 15.20.010 Adoption. That certain code dealing specifically with energy conservation that applies to the design, construction, and modification of any buildings requiring a building permit, as mandated by the Utah State Legislature, entitled, "Model Energy Code," 1989 Edition published by the Conference of American Building Officials, printed as a code in book form, is adopted as the energy conservation code for the city. 15.20.020 Administration and enforcement. The organization and enforcement of the Model Energy Code shall be administered by the building department and be under the enforcement of the building official as defined in Chapter 2 of the Uniform Building code under Chapter 15.04 of this code. PLUMBING CODE 15.24.010 Adoption --Where filed. The "Uniform Plumbing Code," 1991 Edition, published by the International Association of Plumbing and Mechanical Officials and adopted by the International Conference of Building Officials, three copies of which are, and shall remain, on file in the office of the city recorder for examination and use buy the public, are adopted by the city and by this reference incorporated as a part of this section as fully as if completely set out 0 herein, together with all amendments and additions that may hereafter be made thereto, and the provisions thereof shall regulate the use, construction and installation of all plumbing within the city. Chapter 15.25 BUILDING CONSERVATION 15.25.010 Adoption. That certain code establishing rules and regulations for the continued use or reuse of legally existing buildings and structures constituting the minimum standards for change of occupancy, alteration or repair of existing buildings and structures entitled "Uniform Code for Building Conservation," 1991 Edition, published by the International Conference of Building Officials is adopted as the building conservation code of the city, and by this reference is made a part of this chapter to the same extent and effect as though such code were copied herein in full. Three copies of the Uniform Code for Building Conservation are filed for use and examination by the public in the office of the city recorder. Chapter 15.26 SWIMMING POOL, SPA AND HOT TUB 15.26.010 Adoption. That certain code establishing rules and regulations for the erection, installation, alteration, addition, repair, relocation, replacement, maintenance, or use of any swimming pool, spa, or hot tub plumbing system entitled "Uniform Swimming Pool, Spa and Hot Tub Code," 1991 Edition, published by the International Association of Plumbing and Mechanical Officials is adopted by the city, and by this reference is made a part of this chapter to the same extent and effect as though such code were copied herein in full. Three copies of the Uniform Swimming Pool, Spa and Hot Tub Code are filed for use and examination by the public in the office of the city recorder. Chapter 15.27 ADMINISTRATIVE CODE 15.27.010 Adoption. That certain code establishing the administration and enforcement of the technical codes adopted by the city entitled "Uniform Administrative Code," 1991 Edition, published by the International Conference of Building Officials is adopted by the city, and by this reference is made a part of this chapter to the same extent and effect as though such code were copied herein in full. Three copies of the Uniform Administrative Code are filed for use and examination by the public in the office of the city recorder. Chapter 15.28 NATURAL GAS CODE Delete all of 15.28 Chapter 15.32 LIQUEFIED PETROLEUM GAS CODE Delete all of 15.32 This Ordinance shall take effect immediately upon passage.
