RESOLUTION AUTHORIZING EMERGENCY REPAIRS
FROM AGATE CONSTRUCTION COMPANY, INC.
FOR MARINA FIRE DAMAGE AND PIER EXTENSION
COLLISION EMERGENCY REPAIRS
WHEREAS, N.J.S.A. 40A:11-6 provides that a purchase, contract or agreement may be
made, negotiated or awarded without public advertising for bids and bidding therefore,
notwithstanding that the cost of contract price will exceed the amount set in the
prevailing bidding threshold, when an emergency affecting the public health, safety or
welfare requires the immediate delivery of performance of services, provided: A written
requisition for the performance of such work or labor, or the f imislung of materials,
supplies or services is filed with the contracting agent or his deputy in charge describing
the nature of the emergency, the time of its occurrence and the need for invoking this
section, certified by the officer or director in charge of the department wherein the
emergency occurred, or such other officer or employee as may be authorized to act in the
place of said officer or director, and the contracting agent or his deputy in charge, being
satisfied that the emergency exists, is hereby authorized to award a contract for said work
or labor, materials, supplies or services; and
WHEREAS, an emergency situation meeting the criteria set forth above resulting from
MARINA FIRE DAMAGE AND PIER EXTENSION COLLISION EMERGENCY
REPAIRS; and
WHEREAS, an emergency purchase/repair was made by Agate Construction Co., Inc.,
1030 Route 83, Clermont, NJ, 08210 in the amount not to exceed of $1,446,000.00 for
said Emergency Repairs with regard to Marina Fire Damage and Pier Extension Collison
Emergency Repairs.
NOW THEREFORE BE IT RESOLVED that the Mayor and Council of the Borough
of Carteret, does hereby authorize the payment of $1,446,000.00 to Agate Construction
Co., Inc., for the emergency repairs as described herein in accordance with N.J.S.A.
40A:11-6.

Dear Mayor and Borough Council:
Our office has responded to and inspected damages related to the proceeding Marina vessel fire
and Pier Extension collision events that occurred at the Carteret Waterfront on October 24 and
31, 2022, respectively. Based on these inspections, our office has prepared detailed scopes of
work and solicited quotes from qualified contractors for emergency repairs to restore the affected
structures to their original conditions. Each of these events and the scope of associated repair
recommendations are detailed herein:
Event #1 — Dock A & B Fire Damage
On October24, 2022, a fire involving multiple vessels originating at the east end of Dock B caused
significant damage on Dock B as well as collateral damage on Dock A. We understand the
Incident is currently under investigation. The "T" end of Dock B has since been closed to protect
the public and the vessels involved have been recovered and removed from the marina. The
effected portion of the electrical system on Dock B was isolated by an electrician on the day of
the incident and power restored to unaffected slips.
CME has surveyed the site and identified the following damages related to the fire:
0 Dock A:
o Fire damage to one (1) electrical pedestal and one (1) dock box.
Dock B:
Fire damage to the concrete dock surface, polymer corner slabs, fendering, dock
boxes, and internal floatation of three (3) floating concrete modules;

o Fire damage to the treated timber waler system, totaling approximately 104 linear
feet; and,
o Fire damage to PVC electrical chases, two (2) junction boxes, electrical
conductors, and three (3) power pedestals.
Due to the damage sustained to the internal foam floatation of the dock units, we recommend the
complete replacement of the three (3) above -mentioned floats on Dock B. Additionally, flame and
heat from the fire completely melted electrical conductors and components within the Dock B
modules and will require full replacement of the cables within the limits of the damaged float
modules. Furthermore, removal and replacement of all above -mentioned electrical pedestals,
dock boxes, and accessories on Docks A and B are recommended.
Bellingham Marine, Inc., the manufacturer of the floating dock modules, has advised the lead time
for dock production is approximately 20 to 24 weeks.
Event #2 — Pier Extension Barae Collision
On October 31, 2022, the steel pier extension at Waterfront Park was struck by a barge resulting
in severe damage to approximately 100 feet of the 700-foot long structure in two (2) specific
locations further described below. We understand the incident is currently under investigation.
The pier has since been closed to protect the public.
CME engaged an underwater structural engineer to conduct an inspection of the entire pier length.
The findings of this inspection are enclosed for Council's review. The barge's main point of impact
and area of most significant damage was concentrated in the area of Pile 41 with a secondary
impact at Pile 11. No damage was identified at the adjacent timber fishing pier. '
Based on field inspections, the damages are summarized below:
• Significant buckling, rotation, and, bending of three (3) HP14x73 steel plumb piles and
three (3) batter piles at Piles 40, 41, and 42;
• Buckled wavescreen waters, sheeting, and pile cap totaling ±48 feet at Piles 39 through
43;
• Buckled wavescreen sheeting totaling ±4 feet at Pile 11;
• Extensive superstructure damage, including structural steel channels, brackets, handrails,
and bar grating totaling ±96 feet at Piles 36 through 44; and,
• Damage to electrical handrail lighting conductors, conduit, and power supply units.

We recommend that all damaged H-piles, sheeting, and superstructure components be removed
and replaced to original specifications. Steel suppliers have advised the lead time for steel sheet
piling and H-pile delivery is approximately 4 to 5 weeks, and superstructure structural steel is
approximately 14 to 17 weeks.
Summary of Repair Costs
Due to the level of damage sustained and the critical nature of the pier and wavescreen to protect
the inner harbor facilities of the marina, our office recommends that repairs be carried out an
emergency basis to restore the pier to its existing condition. Furthermore, we recommend the
immediate in -kind replacement of the fire -damaged floating docks and electrical infrastructure
resulting from the vessel fires as damage to the floatation material within the docks may result in
differential levels of buoyancy and unanticipated stresses within the adjacent floating dock
modules and structural connections. All components will be replaced in kind according to the
original specifications of the marina, pier extension, and wavescreen.
To effect these repairs, quotes have been solicited from three (3) marine construction contractors
and are summarized below. Original copies of the quotes are enclosed for your review and further
use. Due to the related location and nature of the work, quotes have been reviewed in aggregate
for the benefit of the Borough to consolidate mobilization costs where feasible.

Based on this information, we recommend awarding the lowest responsible quote for floating dock
and pier extension repairs to Agate Construction Co., Inc., of Clermont, NJ in the amount of
$1,446,000.00. By copy of this letter, we request that the Borough Attorney prepare the necessary
Resolution of Award and forward any required documentation to the Borough's insurance adjuster
for reimbursement.
Upon authorization to complete the pier extension repairs, our office will issue a notice to the US
Army Corps of Engineers New York District advising that the work is anticipated to be conducted
within the January let to June 301' mudline disturbance moratorium related to essential fish habitat.
Work will be limited to the removal and replacement of three (3) pile bents and is anticipated to
be completed within five (5) working days.
No additional regulatory notice is anticipated for work related to floating dock repairs, as work will
not include any mudline disturbance.

referenced project in Carteret, NJ. Our pricing sheet is attached. The anticipated duration of this work is 2 to 3 weeks.
Agate's proposal is based on the following inclusions, exceptions, and scope as outlined below:
1. Proposal is based on the information provided by CME Associates, specifically the following documents:
a. Email dated 12/9/22 with links and attachments
2. All pricing is based on one (1) mobilizations to the project site.
3. Pricing includes eight (8) %" dia x 9-1/4" SS studs with coupler inserts in the 8x20 unifloat. This was not specifically called
out in the scope document but is required.
4. Pricing is based on the assumption that a Carteret owned bulkhead can be used to launch the new and remove the old
floats.
5. Agate requires free and clear access to the work site at all times.
6. The pricing in this proposal is based on continuous, uninterrupted access to the work from the time Agate mobilizes to the
project site until completion of Agate's features of work.
7. Agate is responsible for the layout of all of its work.
8. Agate shall provide sufficient supervision to properly manage all phases of the work.
9. Our proposal specifically excludes the following:
a. Liquidated or Consequential Damages
b. Removals other than mentioned above
c. Utility Relocations of any kind, including cutting/capping of any utilities
d. Sump Pits and Dewatering
e. Handling, treatment and disposal of contaminated soil or groundwater
f. Hazardous material handling protocols of any kind
g. Sediment and erosion control measures
h. Vibration & settlement monitoring
i. Surveys of existing properties or structures

screen at the referenced project site for the Lump Sum Amount of $1,149,760.00. The lump sum amount

• Purchase 2 Additional Pair of Sheets with Stingers as a Contingency if Needed.
As an Alternate to the above, Bird will ASAP mobilize to the site, remove and dispose of the superstructure,
perform a survey of the existing area and demobilize from the site for a Lump Sum Amount of $155,000.00.
Should this option be exercised, Bird will provide a credit of $36,000.00 to the base contract for the removal
of the existing superstructure.
The above pricing is based on the following:
1. Reconstruction will in accordance with Envar Services, Inc. Wave Screen Drawings as received
from CME Associates on November 15, 2022.
2. Bird Construction has based its proposal on its interpretation of the information provided and will
revise its pricing as necessary upon receipt of any future information, including additions,
clarifications and/or modifications or after demolition is complete and addition damage is
revealed.

Dear Mr. Zwingraf:
Agate Construction Co., Inc. is pleased to provide you with this proposal for the revised scope you have requested pricing for on the
above referenced project in Carteret, NJ. Our pricing sheet is attached. The anticipated duration of this work is 2.5 months.
Scope Clarification:
1. Remove/replace 96 LF of pier superstructure from Bent 36 to Bent 44. Pricing includes lights Inside of railing sections, and
replacing six (6) cantilever angle supports and pile caps on bents 36-39, 43 and 44.
2. Remove/replace three (3) plumb and three (3) batter HP14x73 piles at Bents 40, 41 and 42.
3. Remove/replace 15 pair of steel sheet piles, 48 LF wale and 50 LF SSP cap from Bent 36 to 37.
Agate's proposal is based on the following inclusions, exceptions, and scope as outlined below:
1. Proposal is based on the information provided by CME Associates, specifically the following documents:
a. Email dated 11/4/22 and attachments
b. Emails dated 11/8/22 and attachments
c. Email dated 11/9/22 and attachments
d. Email dated 1/6/23 and attachments
2. All pricing is based on one (1) mobilizations to the project site.
3. Agate requires free and clear access to the work site at all times.
4. The pricing in this proposal is based on continuous, uninterrupted access to the work from the time Agate mobilizes to the
project site until completion of Agate's features of work.
5. Agate is responsible for the layout of all of its work.
6. Agate shall provide sufficient supervision to properly manage all phases of the work.
7. This proposal includes four (4) days of an electrical crew for the repair of existing conduit. Should more than 4 days be needed
to repair the existing electrical system, an additional cost of $3,250/day will apply.
8. Our proposal specifically excludes the following:
a. Liquidated or Consequential Damages
b. Removals other than mentioned above
c. Utility Relocations of any kind, including cutting/capping of any utilities
d. Sump Pits and Dewatering
e. Handling, treatment and disposal of contaminated soil or groundwater
f. Hazardous material handling protocols of any kind
g. Sediment and erosion control measures

9. Steel sheet piling and HP14x73 piles have a lead time of 4-5 weeks.
10. Superstructure structural steel has a lead time of 14-17 weeks.
11. This proposal and pricing expires ten (10) days from the date listed above. After that date, pricing Is subject to change.
