ORDINANCE NO, 64 -137
AN ORDINANCE OF THE CITY OF TEMPLE CITY
AMENDING THE TEMPLE CITY MUNICIPAL CODE
TO PROVIDE REQUIREMENTS FOR THE CONSTRUC-
TION AND INSTALLATION OF SIDEWALKS, CURBS,
GUTTERS, DRIVEWAYS, PARKWAY TREES, AND
DEDICATION OF RIGHT OF WAY IN CONJUNCTION
WITH BUILDING CONSTRUCTION
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN AS
SECTION 1. Sections 3926 through 3929 are hereby added to
the Temple City Municipal Code to read as follows:
"3926. Curb, Gutter, Sidewalk, Driveways and Parkway Tree
Installation Requirements where improvements Made.
(a) in all zones no structure shall hereafter be erected,
nor shall any alteration of or addition to an existing structure be
hereafter made where the building permit value of such alterations or
additions exceed $1,000.00, or there has been an aggregate expense of
$1000. over a 3 yr. period,or 25% of square footage of the existing
structure /s, whichever is most restrictive, unless concurrently with
such construction, alteration or addition, all driveways, curbs,
gutters, sidewalks, and parkway trees shall be constructed and install-
ed in accordance with the city standards and specifications on file in
the office of the City Clerk, unless driveways, curbs, gutters, side -.
walks and parkway trees, already exist in accordance with the standards
of the city along all street frontages of the lot or lots on which the
building or dwelling is to be erected, altered or additions made to
same.
(b) Street as used in this section shall include privately
owned and maintained rights -of -way where the same are open for general
public use and for general vehicular traffic.
(c) The building inspector shall not issue a certificate of
occupancy or accept any structure for public utility connection until
the provisions of this section have been complied with or a variance
therefrom has been obtained, pursuant to the provisions of Sections
3928 and 3929 of this Code.
"3927. Same. Adequate Streets Adjacent to Structures.
(a) No structure shall hereafter be erected, nor shall any
alteration of or addition to an existing structure be hereafter. made
on any lot or parcel of land any portion of which abuts upon a street
unless the one half (2) of the highway which is located on the same
side of the center line as such lot or parcel of land has been dedi-
cated and improved as provided in Section 3926.
"3928. Same. Agreement to Dedicate & Improve.
(a) In lieu of dedication and improvements, the City may
accept an agreement to dedicate and improve signed by all persons hav-
ing any right, title, interest, or lien in the property, or any portion
thereof, to be dedicated. The signatures on such agreement shall be
acknowledged and the City shall record such agreement in the office of
the County Recorder of this County.
"3929. Same. Modification.
(a) The Superintendent of Streets may grant a temporary
modification to the provisions of this Article and relieve the appli-
cant either from compliance with all or a portion of the provisions
thereof if he finds:
1. There is in existence or under negotiation a contract
between the City and a contractor to install the required improvements,
or

2. The City is unable to furnish grades within a
reasonable time, or
3. The required construction would create a drainage
or traffic problem, or
4. The lot or parcel of land adjoins a street for a
distance of one hundred (100) feet or more and only a portion of said
lot or parcel of land is to be used for such building or structure,
then dedication and improvements may be required only along that por-
tion of the street which fronts on the portion of said lot or lots to
be improved.
5. There are in existence partial improvements satis-
factory.to the Superintendent of Streets and he deems construction of
additional improvements to be unnecessary or constitute an unreason-
able hardship.
