Savannah Beach, Tybee Island, Ga.
December 6, 105.
The regular meeting of Council was held today at 5 :00
P.M. in the Council Room in the Town Hall and was attended by
Mayor Dutton, who presided, and Councilmen Hosti, Walsh, Young,
Slotin, Lovell, Farrell and Town Attorney Alexander.
The minutes of the meeting of November 15th were read
and adopted.
Councilman Walsh moved that Thomas M. Reed be appointed
Superintendent of Public Works at a salary of $200.00 per month
by the month,' effective December 1, 1945, Councilman Farrell second-
ed and the motion passed.
The Mayor stated that he wanted Mr. S. R. Kent to learn
how to operate the disposal plant and had requested Councilman
Young to send him after which, Mr. Carter resigned, that Mr. Hamil-
ton went to the plant with Mr. Kent and explained to him the opera-
tion of the plant, the Mayor said that Councilman Young informed
him that Mr. Carter had removed all labels from the valves, Council-
man Young stated that Mr. Kent can handle the plant at the present
time and that he had Mr. Stark assisting him.
The Mayor informed Council that Mr. Singleton stated that
work on the sewerage system was getting along fine, and they were
waiting on the pump to arrive.
Councilman Lovell asked how Mr. Carter was notified that
Mr. Kent was to take over as head of the sewerage department,. Coun-
cilman Young stated that the committee had decided to have one man
in charge, and that he had instructed Mr. Kent to go to Mr. Carter,
on Thursday, Mr. Carter came to his house seeking information, was
informed about Mr. Kent, and was told by. Mr. Carter that he would
not work under Kent or anyone.
Mayor Dutton informed Council that we now own Fort Sereven
and the Beach Lots and that the Town was granted ninety days with
which to make financial arrangements and he had appointed Councilman
Slotin, Town Attorney Alexander and himself a committee to go into
the matter. Councilman Slotin moved that the following Resolution
be adopted. Councilman Young seconded and the motion passed. -
A RESOLUTION
WHEREAS, at a regular meeting of the Mayor and Councilmen.
of the Town of Savannah Beach, Tybee Island, Georgia, held on Thurs-
day, November 15th, 1945, a resolution was passed authorizing and
directing the Mayor of said Town of Savannah Beach to submit a bid .
to the United States Government for the purchase of certain real
property, together with the improvements thereon, located on Tybee
Island, Chatham County, Georgia, in an amount equal to the appraised
value cif said property; an exact description of said property being
hereto attached;

AND, WHEREAS, said municipal corporation has now been notified
that said bid, in the amount of two hundred thousand dollars
(4200,000.00), has been accepted by the United States Government,
and that the United States Government is now ready to convey said
property to said municipality upon the payment to it of the amount
of said bid;
AND, WHEREAS, said municipal corporation desires to issue revenue
certificates for the purpose of acquiring said property as a sys-
tem useful in connection with the obtaining of a water supply and
the conservation, treatment and disposal of water for public and
private use, and useful in connection with the collection, treatment
and disposal of sewerage, and including intercepting sewers, trunk
connections and.other sewer and water mains, pumping stations and
equipment, and useful for parks,, tennis courts, swimming pools,
playgrounds, athletic fields and grand stands; and including build-
ings to be used for amusement purposes or educational purposes or
a combination of .the twa;
BE IT THEREFORE RESOLVED, by the Mayor and Councilmen of the Town
of Savannah Beach, Tybee Island, Georgia., in Council assembled,
that said municipal corporation issue, in anticipation of the col-
lection o-f the revenues from said property, certificates in the
amount of two hundred thousand dollars (4200,000.00), to provide
funds to pay the cost thereof, said certificates to be issued in
accordance with the provisions of the "Revenue Certificate Law of
1937 0, as amended, being Chapter 87 -g of the Code of Georgia, and
in accordance with Article VII, Section VII, Paragraph V, of the
Constitution of the State of Georgia of 1945, said revenue certi-
ficates to contain the following provisions : -
1.. That said certificates shall be secured both as to princi-
pal and interest, by said real property and the improvements there-
on, in accordance with the provisions of said "Revenue Certificate
Law of. 1937".
2. That said certificates shall be dated as of January 1st,
1946, and shall be payable serially in the amount of five thousand
dollars ($5000.00) each year, on the anniversary of the date of
such certificates, for nineteen (19) years, and one hundred Five
thousand dollars ( 4105,000.00) on the twentieth (20th) anniversary
of the date of such certificates.
3.. Interest on such certificates shall be payable semiannually
on July Ist and January 1st of each year, at the rate of not ex-
ceeding four per cent (4 %) per annum.
4. Said municipality shall have the right to call all, or
any part of, such certificates for redemtion at any time by giving
thirty (30) days notice in writing to the holder thereof as ap-
pears from the books of said municipal corporation, interest on
such certificates as may be called to cease as of the call date
stated in such notice. Said municipality may determine by lot
which certificates shall be called, in the event that it determines
to call a part of such certificates. Such certificates shall be
called at the face value thereof.

5. Said certificates shall be transferrable on the books
of said municipality by the holder thereof upon complying with
such requirements as may be prescribed by said municipality.
6. Lost, damaged or destroyed certificates may be replaced
by duplicate certificates in accordance with such conditions and
requirements as may be prescribed by said municipality.
7. All moneys derived from the sale or rental of all, or
any 'part of, said propetty shall be placed in a separate fund by
said municipality, and shall be used only for the payment of in-
surance premiums on such property, the payment for repairs and for
the preservation and maintenance of such property, and the payment
of principal and interest on such revenue certificates, until such
revenue certificates have been paid in full, principal and interest,
and no part of such fund shall be used for any other purpose.
Said municipality may issue ad interim certificates pend-
ing the issuance of permanent. certificates, and, if so issued, such
ad interim certificates shall be subject to all the provisions of
this resolution as fully as such permanent certificates would be.
9. Said municipality agrees that so long as any of such certi-
ficates are outstanding it will maintain fire and extended coverage
insurace on the improvements on said property in an amount equal to
at least fifty per cent (50%) of the face value of the outstanding
certificates, any proceeds or moneys.received from such insurance
to be placed in separate fund above referred to. Nothing herein
contained shall prevent s:id municipality from using any moneys re-
ceived from such insurance for the rebuilding or repair of such
property as may be destroyed or damaged by any of the hazards in-
sured against.
10. Said municipality may issue such certificates in such de-
nomination as it may deem best, no certificate to be issued, how-
ever, for the amount of less than one thousand'dollars ($1000.00).
11. Said municipality will keep accurate books of account
showing the receipts and disbursements from said separate fund
above referred to. Such books shall be audited at least once
each year by a Certified Public Accountant, and shall be opened
for inspection at any reasonable time by the holder of any cer-
tificate or certificates, or his duly authorized representative
or agent.
12. Said municipality shall be at liberty at any time, in
its discretion, to sell all, or any part of, .such property, but
such sale shall be for an amount not less than the appraised
price of the particular property sold, and such purchase price
shall be deposited in such separate fund, subject to the provi-
sions of this resolution, and if any part, or all, of such pro-
perty shall be sold, the purchaser or purchasers of such property
shall hold the same free and clear of any lien created by the
issuance of such certificates.

13. Said municipality shall have the right, in its discre-
tion to rent all, or any part of, such property to such person
or persons, or corporations, as it may deem best, for such amount
and upon such terms as it may deem best, but shall not rent all,
or any part of, such property for a longer period of time than
five (5) years at any one time.
14. It is understood that said municipality is not obligated
in any way t� pay any principal or interest, or other amount
herein agreed to be paid, except from the income or sale of such
property, as herein set forth, and the debt created by the issuance
of such certificates shall not be a debt of said municipal torpor-
ation except to the extent set forth in Chapter g7 -8 of the Code
of Georgia, and the rights of the holders. of such certificates shall
be limited to the rights afforded such holders in accordance with
the provisions of such Chapter of the Code of Georgia.
15 Said municipality agrees, that in the event of default in
the payment of principal or interest on such certificates, the holder
or holders thereof may avail themselves of any of the remedies
granted them by Chapter 87 -8 of the Code of Georgia._
' 16. Such certificates, or ad interim certificates, shall be in
such form, and contain such provisions, not in conflict with this
resolution, or the Constitution or laws of the State of Georgia,
as may be determined by said municipality.
BE IT FURTHER RESOLVED, by the authority aforesaid, that
the Town Attorney be, and he is hereby, authorized and directed
to take such proceedings as may be necessary,or proper to comply
with the provisions of said "Revenue Certificate Law of 193 7",
as amended, and said provision of the Constitution of Georgia,
for the validation of such certificates.

Beach; Tybee Island, do hereby certify that the foregoing is a
true and correct copy of a resolution adopted at a regular meet
ing of the Mayor and Councilmen of the Town of Savannah Beach,
Tybee Island, Georgia held on December 6th, 1945; that the Mayor
and Councilmen is the governing body of said Town-of Savannah
Beach; and that said resolution was adopted by a vote of a majori-
ty.of the members of said governing body.

NOTICE TO THE ATTORNEY GENERAL

TO THE ATTORNEY GENERAL OF THE STATE OF GEORGIA.
The Mayor and Councilmen of the Town of Savannah Beach,
Tybee Island, Georgia, a municipal corporation in Chatham County,
Georgia, desiring to issue revenue certificates as prescribed in
the "Revenue Certificate Law o-f 1937 ", incorporated in the Code
of Georgia as Chapter 87 -8, passed a resolution in said Town of
Savannah Beach on December 6th, 1945 at a regular meeting of said
Mayor. and Councilmen of said Town, as provided in Section 87 -804
of the Code of Georgia, sid.resolution having been adopted by a
majority of the members of said governing body..
That under said resolution, the Mayor and Councilmen
of said Town of Savannah Beach.apecified the amount of revenue
certificates to be issued, and for what purposes, the interest
they were to bear, how much principal and interest is to be paid
off annually, and when they were to be fully paid off, together
with other conditions relating to said revenue certificates, a
certified copy of said resolution being hereto attached, marked
11Exhibit A" and made a part hereof.
NOW THEREFORE, the Mayor and Councilmen, heing the
governing body of the municipality, the corporate name of which
is "Savannah Beach, Tybee Island", notify you as Attorney General
of the State of Georgia, in accordance with the provisions of
Section 87 -815 of the Code of Georgia, in place of the Solicitor
General of the Eastern Judicial Circuit of Georgia, because of
the absence from the Eastern Judicial Circuit of Georgia of the
said Solicitor General, in writing, of the fact that such resolu-
tion has been passed by the governing body, and of the intention
of said municipality to issue such certificates.
YOU ARE, THEREFORE, requested, as provided in Section
87 -816 of the Code of Georgia, to file a petition to the Superior
Court of Chatham County, Georgia, in the name of "The State of
Georgia vs. Savannah- Beach, Tybee Island", for the purpose of
confirming and validating the revenue certificates so authorized
to be issued by said resolution

Councilman Siotin moved that the Town purchase the four
Beach Lots from the United States Government, known as lots. 31,
32, 33 and.34, Central Ward for 016,750.00 and that the following
Resolution be adopted.. Councilman Walsh seconded and the motion
passed,
A RESOLUTION
WHEREAS, at a regular meeting of the Mayor and Council-
men of the Town of Savannah Beach, Tybee Island, Georgia, held on
Thursday, November, 15th, 1945, a resolution was passed authoriz-
ing and directing the Mayor of said Town of Savannah Beach to sub-
mit a bid to the United States Government for the purchase of oer-
tain real property located on Tybee Island, Chatham County, Georgia,
in an amount equal to the appraised value of. said property; an
exact description of said property being hereto attached;

AND WHEREAS, said municipal corporation has now been
notified that said bid, in tha amount of sixteen thousand seven
hundred fifty dollars (416,750.00) has been accepted by the
United .States Government and that the United States Government
is now ready to convey said property to the said municipality
upon the payment to it of the amount of said bid;
BE IT THEREFORE RESOLVED by the Mayor and Councilmen of
the Town of. Savannah Beach, Tybee Island, Georgia, in Council
assembled, that the Clerk of Council and Ex- officio Treasurer of
said Town be, and he is hereby, directed to draw a voucher in
favor of the United States- Government, or such branch or agency
thereof as may be proper, in the amount of sixteen thousand seven
hundred fifty dollars (416,750.00) , in payment of the amount of
said bid, and the Mayor of said Town be, and he is hereby, directed
to tender such voucher to the United States Government, or the
branch or agency thereof as may be proper, in return for a deed to
the property described in the exhibit attached hereto.
BE IT FURTHER RESOLVED that said Mayor and said Clerk of
Council be, and they are hereby, authorized and directed to do and
perform any other act or acts necessary or-proper in order to
carry out the purposes of this resolution, which is to pay said
amount of money to the United States Government and to receive in
return a deed to said property.
The Mayor stated that. it was to the Town's advantage
to buy the four beach lots and asked how they should be disposed
of, Councilman Slotin stated that several parties want to buy
them, that the Town should not be in the Real estate business,
that the four lots should be sold as a whole to the highest bidder
with the right to reject any or all bids, that no preference
should be given anyone. Councilman Walsh moved that when the
property is ready for sale that the Town request sealed bids
with the right to reject any or all bids and that the Mayor,
Councilman Slotin and Town Attorney Alexander be empowered to
handle. the matter. Councilman Lovell seconded and the motion
passed.
The Mayor informed Council that the Georgia Munici-
pal Association was holding its annual meeting in Atlanta on
December 12th and that an invitation had been extended to him
to attend. Councilman Walsh moved that the Mayor be authorized
to attend the meeting, Councilman Young seconded and -the motion
passed.
The Mayor informed Council that a new sewerage contract
had been presented by the Federal Public Housing Authority cover-
ing the handling of sewerage from Fort Sereven by the Town,.
Councilman Young moved that the Mayor be authorized to sign it,
Councilman Walsh seconded and the motion passed.

A petition was read from Mrs. Nell Devine, Chairman
of the Community Christmas Tree Committee requesting a donation
Councilman Walsh moved that 450'.00 be donated, Councilman Young
seconded and the motion passed.
Mayor Dutton informed Council that Mr. Nitchke and
Mrs. Backus representing the 4 -H Clubs, had looked at a site
on the hammock owned by the Town and had agreed on a location,
then they went to Fort Screven and looked at some of the hut-
ments there with the view to using some of them at the site
selected for the 4 -H Camp, Councilman Siotin moved that the
Mayor be authorized to allow the use of the necessary land on
the hammock owned by the Town to the 4 -H Club with the proviso
that the land revert back to the Town when the camp ceases to
operate. Councilman Young seconded and the motion passed.
Councilman Siotin moved that the following resolution
be adopted, Councilman Welsh seconded and the motion passed.
A RESOLUTION
WHEREAS in accordance with the provisions of the
Charter of the Town of Savannah Beach, it is necessary that a
place be designated in the City of Savannah, where the Regis-
tration Book of said Town of Savannah Beach shall be kept open
in accordance with the provisions of the Act of 1939, amending
said Charter of said Town of Savannah Beach;
BE IT THEREFORE RESOLVED by the Mayor and Councilmen
of the Town of Savannah Beach, Tybee Island, Georgia, in Coun-
cil assembled, that the Clerk of Council be, and he is hereby,
instructed to keep said Registration Book open on the days and
between the hours required by law in the Office of the Clerk of
the City Court of Savannah, in the Court House at Savannah,
Georgia.
The Mayor informed Council that relative to the sewer-
age lines needed in Venetian Terrace that Mr. Singleton, Mr.
Hamilton and himself checked on the matter and Mr. Singleton
stated that he wanted to study it, it will soon be necessary to
put in additional sewerage lines in this area and it should be
done now while the Espy Company is here. Councilman Walsh moved
that the Mayor, Councilmen Siotin and Young be appointed a com-
mittee to handle the matter, Councilman Hosti seconded and the
motion passed.
Councilman Siotin moved that the Stubbing Account with
a balance of $2,989.93 be closed out and the funds transferred
to the General Account, Councilman Young seconded and the motion
passed.
Councilman Siotin stated. that the balance of funds
withheld by the F. W. A. on the Sewerage project Docket No.
Ga. 9 -244, under the Attaway contract could not be gotten until
the project is completed.

The matter of whether the Town Engineer's services
were needed any longer was discussed. Councilman Slotin moved
that Mr. D. R. Davis, the Town Engineer, be notified that his
services would not be needed after January 31st, 1946.. Council-
man Young seconded and the motion passed.
Councilman Walsh moved that bills for the month of
November amounting to $ 612.94 be paid, Councilman Young sec-
onded and the motion passed.
Councilman Farrell stated: that.Mrs. John E. Grace was
interested in buying several lots in the hammock owned by the
Town, Councilman Slotin moved that the Mayor and the Chairman
of the Finance Committee put a price on the lots wanted and sell
them and that the Mayor be empowered to execute the deed. Coun-
cilman Hosti seconded and the motion passed.
Councilman Young informed Council that a new pipe was
necessary to maintain the sewerage lines, and that bids had been
received from several concerns in Savannah quoting prices, it
was decided that before this pump was purchased that an effort
be made to buy it from government surplus stock, it was decided
that Councilmen Farrell and Young get together with Mr. Reed and
ascertain what other equipment is needed by the. Town.
There being no further business the meeting adjourned
subject to the call of the Mayor.

who presided, and Councilmen Walsh, Hosti, Young, Farrell,
Biotin, Lovell and Town Attorney Alexander'also by a committee
consisting of Mrs. Nell Devine, Mrs. Annie M. Daum and Mrs. Sis
Blackburn, also Mr. Zent and Mr. Stribling of the F. P. H. A.
Mrs. Blackburn speaking for the committee requested
the Town to erect a playground for the benefit of the children
on the Island. The Mayor informed them that the Town intended
doing this, after whioh the committee was excused.
