HomeMy Public PortalAboutOrdinance 65-144ORDINANCE NO. 657-144 AN ORDINANCE OF THE 'CITY OF TEMPLE CITY, CALIFORNIA, DECLARING THE INTENTION CF THE CITY COUNCIL CF SAID CITY TO FORM VEHICLE P RKING DISTRICT NO. 3 OF SAID CITY AND TO ACQUIRE AND IMPROVE LANDS FOR PARKING PLACES, AS PROPOSED I M THE PETI- TION THEREFOR, AND FIXING THE TIME AND PLACE FOR HEARING AND GIVING NOTICE THEREOF. .•+IEREAS, on Cc'tober 1", 1964, a Teti cion For the Forma- tion oF a vehicle parkin? district under the provisions of the Vehicle Parking District Law oF 1943 (Part 1 oF Division 18 oF the Streets and Highways Code) was Filed in the o'.F i ce of the City Clark, and said petition was duly signed by -he requisite number of qualified signers and contained all cF :he matters and things recuired by law and was in every resrect su`Ficient; and ':1HEREAS, said Petition was checked by said City Clerk and said Clerk made a certificate to the effect that said Peti- tion is signed by the recuisite number oF qualified signers and presented said petition and said certificate to this City Council, and jHEREAS, proceedings have been duly taker. under the Special /'ssessment Investigation, Limitation and Maiority Protest Act of 15:31 (being Division -- of the Streets and Highways Code) and Pursuant thereto a reoort has been orepared and filed and a hearing set thereon for the same time and Place as the time and place herein fixed for hearinq of Protests and objections; NOW, THEREFORE, the City Council oF the City of Teml i e City, Cal i ornia, DOES CRDIN as follows: Section 1. That this City Council hereby Finds and declares that the public interest and necessity recuire the ac- quisition and improvement described in said petition and herein- after described, and that the Property to be acquired as described in said petition and as hereinafter described is necessary For t' :e purpose, and this City Council hereby declares its intention to Form tha vehicle parkin district pr000sed in said Petition and to acquire the lands and construct the improvements proposed in said Petition. Section '. That the number of the proposed vehicle parkin) district shall he Mo. 3 and such district shall be desi- nated "Vehicle Parking District No. 3 of the City oF Temole City." Section vehicle 3. That said Proposed v._hicl� arking district lies entirely within the boundaries oF said city and that a gen- eral description oF the exterior boundaries of said Proposed dis- trict is as follows, to wit: Beginning at the southeasterly corner oF Lot 186, as shown on mao oF Tract No. 6561 recorded in Book 7', Pages 34 and 3 oF Mars in the of ice c,` ' :he County Recorder of Los Angeles County; thence easterly in a direct line through the southeasterly corner of Lot 171, said tract to the center line oF Camellia /venue (60 feet wide) as shown on said may; thence southerly alorr said center line to the center line of Las Tunas Drive (Formerly San Gabriel Avenue) (100 Feet wide) as shown on said mail; :-'Pence west- erly along said last mentioned cen er Una to the center line cF Temple City Boulevard (cormerly Sunset Boulevard) (80 Feet wide) as shown on said ma-); 435 thence northerly, along said last mentioned center line to the center line of WoodruFF Avenue (60 Feet wide) as shown on said man; thence easterly along, said last mentioned center line to the northerly prolongation o-`' the easterly line of Lot '03 said -tract; thence southerly in a direct line to the point of - beginning. Said proposed boundaries are shown on a mad, oF said proposed assessment district entitled "Maio Indicating by a Boundary Line the Extent of the Territory Included !ithin Proposed Vehicle Parking District No. 3 of the City of Temple City," which map is on file in the office of :he Ci;:y Clerk of said city and to which mao reference is hereby made for a description of said proposed boundaries. Such mao shall govern for all details as to the extent of such proposed district. The City Clerk is hereby directed to File a cony of said map with the County Clerk of Los Angeles County within fifteen (13) days after the adoption oF this ordinance, as required by Section 3.1 1 1 of the Streets and I -I i a sways Code. Section 4. That a c,eneral description oF the lands in said city to be acquired For narking °laces, which lands are to be acquired in fee simole, is as hollows, to wit. Lots 186 and 187, Tract No. 6561 as shown on map recorded in Book 72, pages 34 and 3'. of Maps in the office of the Recorder oF Los Angeles County. Section 5. That the above described larking olaces are Proposed to be improved by the construction tL'reon of work and imorcvement, and a general description oF the improvements proposed to be made and - constructed thereon is as follows, to wit: 1. Clearing and grading, including the removal of any existing structure or other obstruction as necessary. 2. Paving with as?naltic material, tocether with suitable base, where required. 3. Construction c= Portland cement concrete driveways as required, to provide ingress to and e-ress from said parking lot. . Removal, construction and reconstruction eF sidewalks; curbs and gutters, as required. 5. Construction of wheal bumpers. Painting stall lines and directional lines and arrows, and installation of appropriate information signs. 7. Installation of lighting system. a. Construction of retaining walls, as recu i. ed. Installation of walls or fencing, or both as required. IC. Construction of olanting areas, together with lands - caping, water lines and sorinkl ina system. 11. Any necessary work and materials appur :tenant to any oF the foregoing or necessary to comely with city ordinances. Section 6. That the estimated cost and expense of the oro- posed acquisition and improvement is the sum of $- ", 000. of which sum $63,"011. is the estimate of the cost and $`d ; 0. is the es- timate oF the expense. 436 " Section 7. That pursuant tc Section 31L=6:-..1 of the Streets and Highways Code said petition contains a reouest that if the petition is signed by owners, as defined in Sections 31 30 31530.1 and 31537.3 of said code, owning lands cF an assessed value oF not less than 61'p% oF the total assessed value of all assessable lands in the oroPosed district, as defined in said Sections 31530 and 3153:).1, which lands also ccnstitute more than one -half of the area of all assessable lands in the ,Pro- posed district, then in lieu oF the limit provided by Section 3156 3 of said code, the limit on the assessment shall be an amoun not exceeding 35% of the assessed valuation cf all land in the district subject to assessment and all improvements on such lard, as shown by the last equalized county assessment roll,_determined in accordance with the orov i s i ons of Section 3 l'U6". This City Council has determined and hereby determines that said petition is signed as specified in such request and accordingle the limit stated in said Section 31569.1 shall be substituted For the limit stated in said Section 31569 and shall be applicable to the district formed pursuant to said Petition. Section 8. That an assessment will be levied pursuant to said Vehicle Parking District Lao oF 19'43 ulon all property in the proposed vehicle parking district subject to assessment under said Law to pay the costs and expenses of the acccvisition and improvement. Section 9. That serial bonds, bearin" i.-terest at a rare not to exceed six per cent (6 %) per annum, shall be issued under and as provided in said Vehicle Parking Distract Law of 1943 to represent assessments not paid within thirty (30) days after the date of recordation of the assessment. The bonds shall extend over a period or term or nineteen (13) years Frail the 2nd day of January next succeeding the next September 1st Following their date. In accordance with the terms of said petition, the reden.p- tion provisions of said bonds shall require the payment of a premium of three per cent (3 %) oF the unpaid ?rinciaal, as Pro- vided in Section 31682 of said Law. Section 10. Section 12.
