Savannah Beach, Tybee Island, Ga.
April 4th, 1946.
The regular meeting of Town Council was held today at
4:00 P.M. in the Council Room, and was attended by Mayor Dutton,
who presided, and Councilmen Farrell, Hosti, Lovell, Peters, Young,
Slotin and Town Attorney Alexander and Mr. Charles H. Walsh.
Mr. Walsh appeared before the board to protest against
the zoning of his property located between Jones Avenue and 1st
Avenue and Tenth and Eleventh Streets. Mr. Walsh was then excused.
The minutes of t1le meeting of March 7th were read and
adopted.
Mr. Frank Soboleski protested against the assessment on
his property, lot 3, blk. 5, Bay Ward, Councilman Young moved that
the improvenemts be reduced) •150.00, Councilman Lovell seconded and
the motion passed.
Counoilman Farrell moved that the following Ordinance be.
adopted. Councilman Young seconded and thO motion passed.
AN ORDINANCE
TO AMEND AN ORDINANCE CREATING AN AREA WITHIN
THE CORPORATE LIMITS OF THE TOWN OF SAVANNAH
BEACH, TYBEE ISLAND, TO BE KNOWN AS "AREA But
AND TO ZONE THE SAME BY EXCEPTING CERTAIN LOTS
FROM THE PROVISIONS OF SAID ORDINANCE; AND FOR
OTHER PURPOSES.
BE IT ORDAINED by the Mayor and Councilmen of the Town
of Savannah Beach, Tybee Island, in Council assembled, and it is
hereby ordained by authority of the same: -
1. That an ordinance creating an area within the corporate
limits of the Town of Savannah Beach, Ty)Dee Island, to be known
as "Area B", and to zone the same, be, and it is hereby, amended
by adding thereto a paragraph, to be numbered 0411, which shall
read as follows:-
The provisions of this ordinance shall not be app-
licable to Lots Numbers One Hundred Nine (109) and
One Hundred Ten (110), Ward Three (3), according
to the official map of the Town of Savannah Beach."
2. That Paragraph 4 of said ordinance be renumbered "5".
3. That all ordinances and parts of ordinances in conflict
herewith be, and the same are hereby, repealed.
Counoilman Lovell moved that the following resolution be
adopted. Councilman Peters seconded and the motion passed.

A RESOLUTION
WHEREAS, the Town of Savannah Beach' has not exercised
its privilege of renewing a lease on Tybrisa Pavilion in accordance
with the terms of a contract entered into between said Municipal-
ity and the Tybee Amusement Corporation, the owner of said prop-
erty, and the'preeent lease expires on May let, 1946;
AND, WHEREAS, said Tybee Amusement Corporation has offered
to put said Pavilion in good repair, renewing all necessary piling
supporting said pavilion, and painting said Pavilion, and has agreed
to lease the same to said Municipality for a period of ten (10)
years, beginning on May 1st, 1946, the terms of such lease to be
agreed upon by said Municipality and said Tybee Amusement Corporat-
ion;
AND, WHEREAS, it is deemed advantageous to said Municipal-
ity and in furtherance of the comfort and convenience of the cit-
izens of said Municipality, and the visitors thereto,_ that said
offer of said Tybee Amusement Corporation be accepted;
BE IT THEREFORE RESOLVED by the Mayor and Councilmen of
Savannah Beach, Tybee Island, in Council assembled, that the
Mayor of said Town be, and he is hereby, authorized and directed
to execute a lease on behalf of said Municipality with said Tybee
Amusement Corporation, in aceordanoe with the terms hereinabove
set forth;
BE IT FURTHER RESOLVED by the authority aforesaid, that
upon the execution of said-lease, said Municipality shall pay to
said Tybee Amusement Corporation the sum of Five Thousand Dollars
($5000.00), or an amount equal to fifty per cent (50 %) of the cost
of repairing or replacing 'said piling and painting said Pavilion,
whichever amount is the leaser, and said sum of money be and it
is hereby, appropriated fo"r such purpose.
Councilman Slotin moved that the following ordinance be
adopted. Counoilman Peters seconded and the motion passed.

Councilman Young. Moved that the following ordinance be
adopted. Councilman Hosti seconded and the motion passed.
AN ORDINANCE
AN ORDINANCE TO PROVIDE FOR THE TAXATION OF REAL AND
PERSONAL PROPERTY IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND,
GEORGIA, FOR THE FISCAL YEAR COMMENCING MAY 1st, 1946; AND FOR
OTHER PURPOSES.
SECTION 1. Be it ordained by the Mayor and Councilmen of
the Town of Savannah Beach, Tybee Island, Georgia, in Council
assembled, and it is hereby ordained by the authority of the same,
that the rate of taxation upon real estate and personal property
within the limits of the said Town of Savannah Beach, Tybee Island,
Georgia, for the fiscal year'commencing May let, 1946, shall be
TWO AND TWENTY-TWO HUNDREDTHS (2.22) PER CENT upon the assessed or
returned value of same, the value of real estate improvenents to be
ascertained from the returns of the Committee on Assessments of
said Mayor and Councilmen and the valuation of personal property
to be ascertained from the returns of the owners °thereof, in pursu-
ance of the scheme and plan contained in Sections One; Two, Thrlee

and Four of the Ordinance to provide for the assessment of taxable
property in the Town of Savannah Beach, Tybee Island, Georgia, and
the mode of valuing such.property for taxation and to carry into
effect the provisions of.the Act of the General Assembly of the
State of Georgia, approved August 19, 1922, Section 21, passed in
Council assembled October 13, 1922; and it is further ordained that
if any person or persons shall refuse or neglect to pay the tax
required by this ordinance within seven (7) months after same shall
become due, or shall fail or refuse to pay any DOUBLE TAX assessed
as above provided within.thirty (30) days after same shall become
due, the Clerk of Council, as Ex- Officio Treasurer of said Town,
shall issue execution therefor and the further sum of one Dollar
01.00) for.costs, and the Chief of Police and Ex- Officio Tax
Collector shall proceed with such execution in the same manner as
now provided by the law in such cases of execution lodged with the
Sheriff of Chatham County.
SECTION 2. Every person who shall pay one -half (i) of his
taxes on or before the 15th day of May, 1946, and the balance of said
taxes on or before the 15th day of November, 1946, shall be entitled
to a deduction to ten (10) per cent on account thereof, and the
Clerk of Council and Ex- Officio Treasurer of said Town is hereby
authorized to make such deductions upon receipt of tax. The pro-
visions of this section shall not apply to licenses for doing busi -.
ness in said Town, the rate for such licenses being net. The prov-
isions of this section shall apply, however, to those persons or
companies required by the provisions of Section 92 -5902 of the Code
of Georgia to make returns to the Comptroller General of Georgia.
SECTION 3. All ordinances or parts of ordinances conflict -
ing with the provisions of this ordinance are hereby repealed;
provided, however, that so much and such parts of ordinances passed
.as provided for the execution of tax assessments, or part thereof,
shall continue and remain in force so as to authorize the Clerk
of Council and Ex-Officio Treasurer to issue executions and the
Chief of Police and Ex- Officio Tax Collector to collect same until
said taxes or assessments shall be fully paid.
Councilman Hosti moved that the following Ordinance be

AN ORDINANCE
AN ORDINANCE TO PROVIDE FOR THE RATE OF LICENSES FOR
DOING BUSINESS IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA,
FOR THE FISCAL YEAR ENDING APRIL 30th, 1947; FIXING PENALTIES FOR
THE VIOLATION; AND OTHER PURPOSES.
SECTION 1. Be it ordained by the Mayor and Councilmen of
the Town of Savannah Beach, Tybee Island, Georgia, in Council
assembled, and it is hereby ordained by the authority of the same,
that the licenses for doing business'in the Town of Savannah Beach,
Tybee Island, Georgia, for the fiscal year ending April 30th, 1947,
shall be payable on or before the commencing of such business and
shall be as follows:

SECTION 2. In the event any business or calling not speci-
fically mentioned in the above list set forth shall be established
in the Town of Savannah Beach, Tybee Island, Georgia, the Mayor and
Councilmen reserve the right to establish a license fee for same
by- Ordinance, which fee is to be of equal dignity as the' license
specifically mentioned in the above Section, provided, however,
that such license shall not be more than the sum of Five Hundred
Dollars ($500.00).

SECTION 3. This ordinance shall be subject to alterations
or repeal in whole or in part at any time during the fiscal year
beginning May lst, 1946, should it be deemed advisable, and no
such amendment or repeal shall be construed to impair the right
of Council to assess or levy tax for the whole of such year when-
ever made.
SECTION 4. Any person, firm or corporation owning or
operating any riding devices, -or passenger vehicles for hire, before
being issued a license therefor,. shall deposit with the Clerk of.
Council a policy of insurance against personal injury and property
damage, with a receipt showing that the premium thereon. has been
paid for the length of time covered by the license, in such company
and in such amount as may be. approved by the Mayor and Councilmen,
for the benefit of any person. or persons who may be killed or ins
jured or sustain damage to property by reason of the .operation
thereof.
SECTION 5. The Mayor and Councilmen reserve the right
to refuse to issue any licenses for any purpose for reasons deemed
sufficient by them.
SECTION 6. Any person procuring a license on or after
November 1, 1946, shall pay one -half the fee therefor set forth
in this Ordinance.
SECTION 7. Any person, firm or corporation violating any
of the provisions of Section 1 of this Ordinance shall, upon
conviction before the Mayor's Court of said Town, be subject to be
fined in the sum of not more than One Hundred Dollars ($100.00) or
be imprisoned not more than thirty (30) days, either or both or
any portion of either or both in the disoreation of the Court.
SECTION S. All ordinances or parts of ordinances con-
flicting with the provisions of this Ordinance are hereby re-
pealed.
Councilman Biotin moved that the following Ordinance
be adopted. Councilman Lovell seconded and the motion passed.
AN ORDINANCE
TO CREATE AN AREA WITHIN THE CORPORATE LIMITS
OF THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND,
TO BE KNOWN AS "AREA C ", AND TO ZONE THE SAME
IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE
III, SECTION VII, PARAGRAPH XXIII OF THE PRESENT
CONSTITUTION OF GEORGIA, AND AN ACT APPROVED
FEBRUARY 1st, 1946, AMENDING THE CHARTER OF
°SAID TOWN; AND FOR OTHER PURPOSES.
BE IT ORDAINED by the authority of the Mayor and Council-
men of the Town of Savannah Beach, Tybee Island, in Council assem.
bled, and it is hereby ordained by authority of the same;-
1. That there is hereby created an area within the corp-
orate limits of Savannah Beach, Tybee, Island, which shall be daetig
noted as "Area C "., which area shall be bounded on the North by the.

Southern line of Center Street, on the East by the Strand, on the
South by the Northern line of Fourteenth Street and on the West by
the Eastern line of Butler Avenue.
2. From and after the passage of this ordinance it shall
be unlawful for any person ro erect, or cause to be erected, within
said "Area C ", as above described, any improvements excepting
single family homes or residences, or to use any of the improvements
within said area for any other purpose than homes or single fam-
ily residences.
3, From and after the passage of this ordinance it also
shall be unlawful for aiy person to alter or remodel any improv-
ments now located within said "Area Co, so that said improvements
when so altered or remodeled shall not comply with the requirements
of Section 2 of this ordinance.
4. That all ordinances, and parts or ordinances, in con-
flict herewith be, and the same are hereby repealed.
Councilman Young mooed that the following resolution be
adopted. Councilman Peters seconded and the motion passed.
A RESOLUTION
WHEREAS, the Mayor and Councilmen of Savannah Beach,
Tybee Island, have learned with profound sorrow. of the death of
Charles Vincent Walsh, which took place at Savannah, Georgia,
on March 19th, 1946;
AND, WHEREAS, Mr. Walsh had been a member of Counoil of
Savannah Beach since June 4th, 1941, and had been Vioe- chairman of
Council since 1942, and during all that time had rendered valuable
service to the Mayor and Councilmen and to the Town of Savannah
Beach, and had devoted a great deal of his time and ability to the
performance of his duties as Councilman;
AND WHEREAS, the Mayor and Councilmen realize that they
will miss his wise counsel, his untiring efforts and his. unusual •
ability, as well as the warm feeling of friendship between himself
and all the other members of the governing body of the Town, which
had grown stronger during his long service as a member of the body;
BE IT THEREFORE RESOLVED that the Mayor and Councilmen of
Savannah Beach, Tybee Island, in council assembled, that in the
death of Charles Vincent Walsh, the Town of Savannah Beach has lost
an able and capable official, and the Mayor and Councilmen, individ-
ually, a true friend and associate.
BE IT FURTHER RESOLVED that the Mayor and Councilmen, both
officially and individually, extend to the family of Councilman
-Walsh their deepest and most sincere sympathy in their great sorrow.
BE IT FURTHER RESOLVED that a copy of these resolutions
be spread upon the minutes of the Municipality, and that the Clerk
of Council be, and he is hereby, directed to send a copy to the
- family of Councilman Walsh.

Councilman Peters moved that the following resolution be
edopted. Councilman - Farrell seconded and the motion passed.
A RESOLUTION
WHEREAS, a resolution was adopted at the regulat meeting
of the Mayor and Council of Savannah Beach, Tybee Island, held on
March 7th, 1946, authorizing the Mayor to ask for sealed bids for
two (2) buildings owned by the Municipality located within the Pub-
lic Park;
AND, WHEREAS, all the bids which had been received were
opened at the meeting of the Council held on April 4th, 1946, and
were deemed inadequate, and -all of them were rejected;
BE IT THEREFORE RESOLVED, by the Mayor and Councilmen of
Savannah Beach,' Tybee Island, in Council assembled, that the Mayor
of said Municipality be, and he is hereby, authorized to sell the
house owned by said Municipality, located within said Public Park
on Fifth Street, a short distance west of Butler Avenue, at pri-
vate sale, for such price as he may deem proper, with the proviso
that said building be removed from the Public Park by the purchaser
within such time as the said Mayor may allow for this purpose,
and that the said Mayor be, and he is hereby, authorized to execute
any necessary papers in order to carry out such sale in the name of
the Municipality; and that the Clerk of Council of said Municip-
ality be, and he is hereby, authorized and directed to attest any
such papers, and to affix the corporate seal of the Municipality
thereto.
The Mayor informed Council that the teen-age group using
the auditorium for tis Friday evening dances was getting out of
hand and were becoming very boisterous and noisy and that unless
conditions were corrected they should be stopped from using the
building.
The Mayor informed Council that in connection with the
cocktail party he was authorized to give while the Monetary Con-
ference was in session in Savannah, that it Was given at the
Brass Rail.
The Mayor stated that in connection with the government
trucks - recently purchased that Councilman Slotin telephoned him
relative to purchasing some of these trucks and that he sent
Mr. Reed and Mr. Kent to Chatham Field to purchase several of them,
that the cost for seven vehicles purchased by the Town was $2366.00,
and that it was necessary to sign an affidative that this equipment
would not be sold for three years.
Councilman Lovell moved that the parking space South of
the pavilion be opened on weekends commencing April 6th. Council-
man Peters seconded and the motion passed.
Councilman Lovell moved that the official day for opening
the summer season be set. for Saturday May 11th. Councilmn Hosti
seconded and the motion passed.

Councilman Young moved that the next regular meeting of
Council be held on Monday May 6th at 4 : oo P.M.. 'Councilman it ma_n Lovell
seconded and the motion passed.
Councilman Young stated that nothing had been done as yet
regarding the rest rooms as he had been unable to get men to do
the work, he suggested that the rest rooms be placed on'Tybrisa
Pavilion.
Councilman Farrell stated that with the small number of
convicts that he had that he was doing the best that could be done,
he needed more men. The Mayor appointed a committee consisting of
himself and Councilmen Peters and Slotin to call on Judge Houlihan
with the view of getting more convicts.
The Mayor informed Council that in connection with some
of the work done on the sewerage system by the J. G. Attaway Co., .
that was not properly functioning, the Espy Company submitted an
estimate and stated that it mould be cheaper to tear out some of
the lines where there was excessive infiltration and do the work
over.
A petition was read from Lester E. Sheffield who was
recently dismissed as a Town employee, requesting that he be paid
for months service as he was not given proper notification. Pet-
ition refused.
The question of what to do with the large crane in the
machine shop at Fort Soreven kas brought up and Councilman Peters
moved that the Mayor and Councilman Slotin be appointed a committee
to sell it. Councilman Farrell seconded and the motion passed.
Councilman Slotin suggested that a form letter be gotten
up and delivered to the business houses informing them that their
licenses will be due May 1st and must be paid not later than May
15th.
Councilman Slotin moved that bills for the month of March
amounting to $2200.10 be paid. Councilman Young seconded and the
motion passed.
Councilman Slotin moved that the following resolution
be adopted. Councilman Young seconded and the motion passed.
A RESOLUTION
WHEREAS, at a regular meeting of the Mayor and Council -
men of Savannah Beach, Tybee Island, held on Marsh 7th, 1946, a
resolution was adopted accepting an offer of the Savannah Electric
& Power Company to purchase, certain electric lines, poles, trans-
formers and other electrical equipment which said Municipality
acquired by deed.from the United States of America, located in
what was formerly known as the Fort Screven Reservation on Tybee
Island, Georgia;

AND, WHEREAS, since the adoption of said resolution said
Municipality has caused notice to be published once a week for
three consecutive weeks in the Savannah Evening Press, a. newspaper
published in the county in which said Municipality is located,
setting out the price and other general terms and conditions of
such proposed sale;
AND, WHEREAS, on April 8th, 1946, ten (10) days will have
passed from the last publication of such notice, and no objection
or protest thereto has been made;
BE IT THEREFORE RESOLVED by the Mayor and Councilmen of
Savannah Beach,,Tybee Island, in Council assembled, that the
resolution of March 7th, 1946, be and hereby is readopted as fully
as if the same were set forth herein;
AND BE IT FURTHER RESOLVED, that if, on April 8th, 1946,
no protest or objection to the. sale of such property hes been filed
by at least twenty (20) per cent of the qualified voters of said
Municipality, the Mayor of said Municipality be, and he is hereby,
Authorized and directed to execute a deed, or other proper
instrument, in the name of said Municipality, conveying_ said
property, together with all necessary easements,, rights of way
and appurtenances necessary or desirable in connection with the
repair, maintenance, or servicing of the same, to said Savannah
Electric and Power Company at and for the sum.of Ten Thousand Fifty.
seven Dollars and Seventy-two Cents (10,057.72), and the Clerk of
Council of said Municipality be, and he is hereby, authorized
and directed to attest the same and to affix the corporate seal

real estate which se.id Municipality acquired by deed from the
United States of America, located in what was formerly known as
the Fort Sereven Reservation on Tybee Island, Georgia;
AND, WHEREAS, since the adoption of said resolution, said
Municipality has caused notice to be published once a week for

erty.has been filed by at least twenty per cent (20 %) of the qual-
ified voters of said Municipality, the Mayor of said Municipality
be, and he is hereby, authorized and directed to execute a deed,
in the name of said Municipality, conveying said water lines, pipes,
pumping stations, a chlorinator, a tower and water tank, and a
tract of land on which is located a pumping station as shown on
a map made by D. R. Davis, Town Engineer, dated March 19th, 1946,
which isr'ecordedin the office of the Clerk of the Superior Court
of said County, in Plat Record flip, at page 355, and also a. lot
or parcel of land known and designated as Lot Number Seven (7),
Block Twenty-two (22) of a subdivision of said Fort Sereven Reser-
vation, made by W. J. Lynch, C. E., March,'1946, said lot contain-
ing a water tower and tank, a chlorinator and a pump house, and hav-
-ing a frontage of 74.401 feet on Thrushwood Avenue, a depth on
its Eastern boundary line of 154.631 feet, a width on the Northern
boundary line of 69.951 feet and a depth on its Western boundary
line of 170.581 feet, being bounded on the North by the United
States Lighthouse Reservation, on the East by Lot Number Six (6),
said Block, on the South by Thrushwood Avenue, and on the West
by Dovewood Drive, together with all necessary easements, rights
of way and appurtenances necessary or desirable in connection with
the repair, maintenance, or servicing of the same, to said Tybee
- Water Works, at and for the sum of Twenty -one Thousand Dollars
(021,000.00), and the-Clerk of Council of said Municipality be,
land he is hereby, authorized and directed to attest the same and
to affix the corporate seal of said Municipality thereto.
The Mayor appointed Councilmen Slotin and peters a comm-
ittee to get estimates on bronze plaques.
A petition requesting that ice cream carts, selling ice
cream on streets, be permitted. Councilman Hosti moved that permi-
ssion not be granted. Councilman Peters seconded and the motion
passed.
Councilman Lovell presented a bill of $35.00 against the
Savannah Beach Fire Department and moved that it be paid. Council-
man Young seconded and the motion passed.
Councilman Young stated that on Sixteenth Terrace near
the od Harris house that it was necessary to construct a manhole
and moved that the Espy Company be authorized to do this work at the
same rate that they are doing other work of this nature for the
Town. Councilman Lovell seconded and the motion passed.
Plans were presented to Council showing a proposed entrance
marker into the Town limits. Councilman Slotin moved that an est-
imate be gotten as to the cost of this and that the Mayor be auth-
orized to handle it. Councilman Young seconded and the motion
passed.
A quantity of oyster shells was offered to the Town at
ten cents per bushel at the pile but it was decided hat to pur-
chase them.

Councilman Slotin moved that the 1945 whiskey license of
the Seabreeze Hotel by John M. Wall be transferred to the Seabreeze
Hotel by George Thomas. Councilman Young seconded and the motion
passed.
There being no further business Council adjourned subject
to the call of the Mayor.
