The regular meeting of Council was held'today at 4;00 P.M., in the Council Room, and was attended by Mayor Dutton, who presided, and Councilmen Young, Peters, Farrell, Lovell, Slotin, Hosti and Town Attorney Alexander, also by Mr. B. Taylor Smith end Mr. W. J. Lynch. • Judge B. B. Heery administered the oath of office to Mayor Edward A. Dutton as follows:.; OATH I, Edward A. Hosti' Judge Heery stated that he felt-it an honor indeed to be given the priviledge of swearing in the Mayor and his board of Aldermen and he wished them all success for the ensuing term after which Judge Heery excused himself. Mr. B. Taylor Smith stated that first he wanted to extend his congradulatione to the new board and that he wished them luck end secondly he was appearing to protest against the operation of a wood and coal yard on °Jones ,ivende and Thirteenth Street as he feels that since that section of the Island is developing into a fine residential area, that Council had recently zoned the entire . aection in which this wood yard was located. Mr. Smith was excus ed. Mr. W. J. Lynch presented a new map of the Fort Screven development and stated that if there-were no changes to be made by Council that it would be filed in the Clerk's Office in the Superior Court, but first the Town must approve it. Councilman Slotin moved that it be adopted. Councilman Peters seconded and • the motion passed. The minutes of the meeting of April 14-th were read and adopted. Hosti Councilman Farrell moved that Councilman Slotin be elected Chairman of Council. Councilman Peters seconded and the motion passed. Councilman Farrell moved that Councilman Peters be elected Vice- Chairman of Council. Councilman Hosti•seconded and the motion passed. Councilmen Slotin moved that the election of the Clerk of Council, Chief of Police, Town Attorney and Health Officer be posponed until the next meeting of Council. Councilman Young seconded and the motion passed. • In reporting on Tybrisa Pavilion Councilman Slotin stated that the Town was offered the Pavilion on a ten year lease, with the provisal that after two years the owners would have the right to take it back and they to pay the pro -rata share of cost at that time, they are to repair it and the Town is to pay one -half of this cost. The estimated cost for work under the pavilion is $7,500.00 and other work to be done on the pavilion should not make the total cost to the Town over $5,000.00, if the owners repossess the pavilion after two years they are to pay the Town eight - tenths of the cost. Councilman Young stated that in connection with the public rest rooms that they should be placed on the South -west corner of Tybrisa pavilion. The Mayor requested that he have something definite at the next meeting. Councilman Farrell reporting on the new convict camp buildings stated that the work was held up waiting for the plumbing to be installed and that Councilman Young had some offers from several plumbers to do the job, Councilman Slotin stated that the bids should have been gotten in a business like manner and moved that bids be advertised for and that they be forwarded to the Mayor and that the job be given to the lowest qualified bidder. Councilman Young seconded and the motion passed. 222 The Mayor informed Council that he had sold on of the small cottages owned by the Town to Mr. James N. Carter for 1300.00 and stated that he had an offer of $500.00 for the other. Councilman Slotin moved that this building located on Butler Avenue, in the public Park near the electric distribution plant be sold for 4500,00. Councilman peters seconded and the motion passed. The Mayor informed Council that several parties were negotiating for the large electric crane in the machine shop at Fort Screven but he had received no offers. The Mayor stated that a pay station telephone was need- ed in the lobby of the Town Hall. Councilman Young moved that the Mayor be authorized to have it installed. Councilman Peters seconded and the motion passed. The Mayor asked if the lease-by the Tybrisa Company to the pastime Bowling Alleys included the Town's first aid station. Councilman Young stated that all of the second floor had been leased to them. Councilman Siotin moved that the matter of arr- anging for a first aid station be-turned over to the Mayor with power to act. Councilman peters seconded and the motion passed. The Mayor'informed Council that a. movement was on the way to reorganize the Chamber of Commerce and asked that all Councilmen support it. • The Mayor stated that the official opening is the llth and that and advertisement should be put in the papers advertising this opening. Councilman Slotin moved that the Town advertise the opening at a cost' not to exceed 4100.00. Councilman Hosti seconded and the motion passed. The Mayor informed Council that in connection with the 1945 budget that all the departments had 'taken in amounts beyond that anticipated and that Councilman Slotin did a fine job. Councilman Siotin stated that in connection with the service men's memorial that the cost of the bronze plaque would be 1240.00 with additional cost for names and recommended that the finance committee be authorized to have this memeorial put in place at a cost of not more than $1,000.00 and suggested that it be placed at the end of the plat on Butler and Atlantic Avenues. Councilman Young moved that the finance committee be authorized to handle the matter. Councilman Peters seconded and the motion passed. Councilman Slotin stated that in connection with the sale of the water facilities at Fort Screven that the Tybee Water Works had agreed not to charge the Town for water service for the next ten years effective May lst, 1946, 1 1 1 Councilman Slotin moved that the consession stand on Tybrisa pavilion be leased. for not less than $500.00 for the season and that the Mayor be authorized to handle the matter. Councilman Lovell seconded and the motion passed. Councilman Slotin stated that Mr. L. L. Gooch wanted to rent a space on Tybrisa Pavilion 20 by 16 feet, to operate a photograph gallery, that he would put up the necessary build- ing end offered $300.00 for the lease for the season. Councilman peters moved that the request be granted. Councilman Young secon- ded and the motion passed. A petition was read from Mr. J. L. Strong that he con- templated purchasing a tract of land around Estill Station and want- ed the streets in the area. Councilman moved that the matter be turned over to the Town Attorney to advise Mr. Strong that the Town objects to the closing of streets. Councilman Peters seconded and the motion passed. Councilman Slotin informed Council that a considerable pile of scrap material that had been accumulating had been sold_ for junk, that there is some more to sell after which these unm sightly spots will look more presentable. Councilman Slotin called attention to the Harmony Club violating the zoning ordinance. Councilman Slotin moved than an auditor be employed to audit the books for the year of 1945. Councilman Young seconded and the motion passed. Councilman Slotin moved that the February bill of the Espy Paving Company for $11,491.61 covering the.instailation of sewerage lines in Venetian Terrace be paid. Councilman Young seconded and the motion passed. Councilman Biotin moved 'Mat bills for the month of April amounting to 31845.05 be paid. Councilman Lovell seconded and the motion passed. Councilman Lovell asked what had happened to the new fire hose that the Espy Company owes the Town. Councilman Young stated that he had authorized Mr. Kent to get some hose and thet this. new hose was gotten and used by him doing work in the Sewer- age Department. Councilman Young was requested to check on get- ting some additional hose for the Fire Department. Councilman Slotin suggested that the Police Department and Fire Department be combined into one and if necessary the personell be increased. The fire committee was requested to work it out and see what could be done. Councilman Lovell stated that the seawall and jetties et Tilton Street are in urgent need of repairs. This condition should be attended to at once, he was requested to get an estimate as to the cost of the required work. 224 Councilman Hosti stated that James Chrest, the toll collector, requested an increase of 310.00 a month in his salary, Councilman Peters moved that it be paid effective May lst, 1946. Councilman Young seconded and the motion passed. Councilman Hosti informed Council that the Nash police car does not operate efficiently eonoug to catch speeders, it was referred to the Police Committee to work it out. Councilman Hosti informed. Council that Mr. R. F. Gambill of the Espy Company stated that if the Tout wants the cement side- walk layed down Butler Avenue it should act now. It was the opin- ion of Council that no one knew anything about this proposed prof jest. Town Attorney Alexander informed Council that there was no objection to a real estate firm erecting a sign on their prop- erty. Councilman Farrell stated that he had discussed with Mr. Gambill the cost of working over some of the streets. A Comm- ittee consisting of Councilmen Farrell, Young and Slotin were app- ointed to meet next Wednesday afternoon and go into the matter. Savannah Beach Post # 154 of the American Legion petit- ioned for a whiskey and beverage license for use of the legion home in Fort Screven Reservation. The matter was referred to the Police Committee with power to act. Councilman Young stated thet the property owners on Sixteenth Street had gotten together and were having sidewalks laid. The cost was 33.20 per lineal foot and that they wanted the Town to pay 01.00 per lineal foot of this cost for the curb -. ing, the cost to the Town would be about 31,320.00. Councilman Slotin moved that the Town not put down any curbing this year. There being no second the motion was lost. The Mayor stated that he had informed Mr. Espy that he could not and would not give any authority to do the job until-Council met. and approved it. Council- man Young moved 'that the property owners be given permission to lay the sidewalks on Sixteenth Street without cost to the Ton, and providing that all the property owners agree to have the work done. Councilman Lovell seconded and the motion passed. Councilman Young stated that he had contacted Mr. J. W. Lang who had.put in his application for the position of plumbing and building inspector, that he had given him copies of the several codes and he was informed by Mr. Lang that he would accept the combined position at 3200.00 per month and that all fees collected would go to the Town, and moved that Mr. Lang be employed at a salary of 3200.00 a month, by the month, effective May 15th, 1946. Councilman Slotin seconded with the proviso that there are not any similar positions at the same time. 1 1 1 A petition from Mrs. Lizzie G. Cooper requesting that the ditch adjacent to her property be either opened or filled, was read. Referred to Councilman Farrell. The report of the years operations of the Public Library was read end it was the opinion of Council that the library did a very good job. Council having been informed that T. B. MoCarroll had not as yet paid the $400.00 due for back licenses covering the operation of the Chinese Ball Came for a part of the season 1945, Councilman Lovell moved that the licenses of the Glass Hat and the Novelty Bar be held up. Councilman Hosti-seconded and the motion passed. Several requests having been made that horses be per- mitted on the Island, Councilman Young moved that they be per matted on the Island provided there is no objections from prop- erty owners and also that the places where the horses are stabled be kept clean. Councilman Hosti seconded and the motion passed. The report Of Town Engineer Davis was referred to Councilman Young. Council extended a vote of thanks for the lovely flowers sent and instructed that they be sent to the hospitals and to those confined with illness. Councilman Slotin stated that he had Mr. Reed send him a list of surplus material and moved that this stuff be sold. Council- man Peters moved that the Mayor and Couneilmarm Slotin get prices and sell. Councilman Young seconded and the motion passed. Councilman Hosti moved that the following Ordinance be adopted. Councilman Young seconded n.nd the motion passed. AN ORDINANCE TO PROHIBIT THE BELLING OR OFFERING FOR SALE OF ANY GOODS, WARES OR MERCHANDISE ON ANY OF THE STREETS, THE STRAND OR OTHER PUBLIC PLACES IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND; TO PROVIDE A PENALTY FOR THE VIOLATION. OF THIS ORDINANCE; AND FOR OTHER PURPOSES. SECTION 1. BE IT ORDAINED by the Mayor and Councilmen of Savannah Beach, Tybep Island, in Council assembled, and it is hereby ordained by the authority of the same, that from and after the, adoption of this ordinance it ,shell be unlawful for any person, firm or corporation, through its employees, or in any other manner, to sell, or offer for sale any goods, wares or merchandise on any of the public streets of the Town of Savannah Beach, or on the Strand thereof, or on the beach or in any public park, unless special permission has been granted for doing the same by the Mayor and .Councilmen. 226 SECTION 2. THE FOREGOING SECTION shall not be con- strued to prohibit the display, offering for sale or sale of any goods, wares or merchandise immediately in front of the place of business of the seller. SECTION 3. BE IT FURTHER ORDAINED by the authority aforesaid that any person, firm or corporation biolating the pro - visions of Section 1 of this ordinance, either personally or by and through its employees shall, upon being convicted thereof, be fined in an amount not to. exceed one hundred dollars ($100.00) or be imprisoned not to exceed thirty (30) days, or both, and each individual sale or attempt to sell shall_ constitute a separate offense. SECTION 4. BE IT FURTHER ORDAINED by the authority aforesaid that any employee or agent violating the provisions of Section 1 of this ordinance by selling, or offering for sale, goods, wares or merchandise belonging to another, upon the conviction there- of, shall be fined in an amount not to exceed one hundred dollars ($100.00) or be imprisoned not to exceed thirty (30) days, or both, and each individual sale or attempt to sell shall constitute a separate offense. SECTION 5. BE.IT FURTHER ORDAINED by the authority aforesaid that all ordinances, and parts of ordinances in conflict herewith be, and the same are hereby, repealed. Councilman Siotin moved that the following Resolution, be adopted. Councilman Peters seconded and -the motion passed. A RESOLUTION WHEREAS, the Mayor and Councilmen of the Town of Savannah•Beach, Georgia, have been advised that Dr. Emerson Ham, who has served as Assistant Health Officer of the Town of Savannah Beach for several years is entering private. practice in the City of Savannah, and will no longer be able to serve as Assistant Health Officer of Savannah Beach; AND, WHEREAS, during his tenure of office Dr. Ham has rendered very valuable services of this town, particularly in connection with the operation of clinics during the summer season; BE IT THEREFORE RESOLVED by the Mayor and Councilmen . of Savannah Beach, Tybee Island, Georgia, in Council assembled, that the Town officially express its regrets on losing Dr. Ham's services, and that it express to him its best wishes for his continued success in his work. BE IT FURTHER RESOLVED that a copy of these resolutions be spread on the minutes of Council, and.that a copy be sent to Dr. Ham. 1 1 1 Councilman Peters moved that the following - Ordinance be adopted. ORDINANCE AMENDING AN ORDINANCE ADOPTED AT TILE MEET ING OF THE MAYOR AND COUNCILMEN OF SAVANNAH BEACH, TYBEE ISLAND, HELD ON APRIL 4th, 1946,' PROVIDING FOR THE RATE OF LICENSES FOR DOING BUSINESS IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR THE. FISCAL YEAR ENDING APRIL 30th, 1947; AND FOR OTHER PURPOSES. SECTION ONE. BE IT ORDAINED by the Mayor and Council- men of Savannah Beach, Tybee Island, Georgia, in Council assembled, and it is hereby ordained by the authority of the same, that en ordinance entitled "An Ordinance to provide for the Rate of Licenses for Doing Business in the Town of Savannah Beach, Tybee Island, Georgia, for the Fiscal Year Ending April 30th, 1947", adopted at a meeting of Council held on April 4th,. 1946, be, and the same is hereby, amended in the following particulars;- 1. By striking therefrom the provision reading as follows;® follows : - "Each and every dealer in balloons and /or novelties on streets -® 025.00." 2. By striking therefrom the provision reading as "Each and every dealer selling peanuts from trucks or stands and using vendors on streets ©- 425.00" 3. By adding there -to the following provision;® "Each and every dealer 'selling peanuts or popcorn from truckb or stands, each article - - -- 025.00" 4. By adding thereto the following provision; - "Each;and every owner or operator of a novelty pin ball machine, costing 0.05 per play, where nothing but free games are given to the player 015.00" 5. By adding thereto the following provision;- ":Each and every owner or pperator of a novelty pin ball machine, costing 4.01 per play, where nothing but free games are given to the player -- -- $5.00m 6. By adding thereto the following provision; - "For transferring from one person to another, or from one location to another any license for the sale of intoxicating liquors, or for the sale of beer, provided that no transfer shall be authorized without the approval of Council -- -- 025.00" 2284 7. By changing the license charge for each and every owner or operator of an amusement park containing riding devices only to x$200.00. SECTION TWO. BE IT FURTHER ORDAINED by the authority aforesaid, that all ordinances, and parts of ordinances, in conflict herewith be, and the same are hereby, repealed. See. page 20S. Councilman Young moved that the following ordinance be adopted. Councilman Lovell seconded and the motion passed. AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE TO REQUIRE THE OWNERS OF PROPERTY IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, TO CONNECT PLUMBING FIXTURES ON THEIR PROPERTY WITH THE SANITARY SEWERAGE SYSTEM NOT LATER THAN APRIL 30th, 1946, AND TO .PROVIDE THAT SAID FIXTURES SHALL BE CONNECTED WHEN PROPERTY OWNERS ARE NOTIFIED BY THE PLUMBING INSPECTOR THAT SAID FIXTURES ARE UNSANITARY,. AND TO PROVIDE A PENALTY FOR THE FAILURE TO DO SOs SECTION 1. Be it ordained by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, Georgia, in Council assem- bled, and it is hereby ordained by the authority of the -same that an ordinance aelopted by said Mayor and Councilmen entitled "An Ordinance to Require the Owners of Property in the Town of Savannah Beach, Tybee Island, Georgia, to connect- - plumbing fixtures on their property with the sanitary sewerage system not later than April 30th, 1946, and to provide that slid fixtures shall, be connedted immed® iately when- property owners are notified by the plumbing - :inspector that said fixtures are unsanitary, and to provide a penalty for - the failure to do so, and for other purposes ", be and the same is hereby, amended by striking therefrom the phrase "on or before the thirtieth (30th) day of April, 1946", and inserting in lieu thereof the phrase "on or before the thirty -first (31st) day of October, 1946 ", so that said section shall read as follows;- "SECTION 1. .Be it ordained by the Mayor and Councilman of the Town of Savannah Beach, Tybee Island, Georgia, in Council assembled, and it is hereby ordained by authority of the same, that all owners of real property within the limits of said Town shall, on or before the thirty -first (31st) day of October, 1946, connect, or cause to be c=onnected, all plumbing fixtures located on the real estate woned by him or them with the sanitary sewerage system in said Town; provided that this requirement shall not apply to outside showers or hydrants on said property." SECTION 2. All ordinances and parts of ordinances in conflict with the provisions of, this ordinance are hereby repealed.
