There being no further business, Council adjourned subject to the call of the Mayor. Savannah Beach, Tybee Island,!Ga. July 1R, 1946. The regular meeting of Town Council was held today at in the Council Room and was attended by Mayor Dutton, sided, and, Councilmen Peters, Young, Farrell, Lovell, and Town Attorney Alexander and also by Messrs. W.J. B. Smith. S:00 P.M., who pre - Host , Biotin, Bryan and W. -Mr. Bryan requested permission to move some of the-hutments that have been sold at Fort Screven to several locations in the Town limits. He stated that the buildings would not be rolled but would be moved in sections on large trailers. Permission was granted pro- vided that the Town would not be responsible for any damages that may be incurred. Mr. Smith appeared before Council to petition that his beer' license not be revoked, he having been reported as selling beer to minors. Mr. Smith stated that he had ascertained that a sailor had purchased it for the boys from one of his employees. He stated that he has always refused to sell beer to minors, Mr. Smith was requested to instruot his employees to be very careful of this in the future after which he was excused. The minutes of the meetings of June 13th and July 13th were read and adopted. Councilman Farrell moved that Henry M. Buokley be elected Clerk of Council and ex- officio Treasurer for the ensuing year as of May 1st, 1946 at an annual salary of $3,150.00, payable monthly. Councilman Peters seconded and the motion passed. Councilman Young moved that Robert A. Stewart be appointed Chief of Police and ex- officio Tax Collector at an annual salary of $2,520.00, payable monthly. COuncilman Farrell seconded'and the motion passed. Councilman Young moved that A. Leopold Alexander be elected Town Attorney at an annual fee of $900.00, payable by the month. Co t+ noilman Peters seconded and the motion passed. 240 Councilman Young moved that Dr. C. 0. Henderson be elected Health Officer for the ensuing year. Councilman Peters seconded and the motion passed. The May or informed Council that the new convict camp had been completed and was now in use. Councilman Slotin moved that the County Officials be invited to visit the new camp and also tb-be the guests of the Town. Councilman Peters seconded and the motion pass- ed. . A group of bills presented by the Espy Paving Company was referred to the Finance Committee to handle. The Mayor stated that there was some dispute in the assess- ment of property in the Fort Soreven sub - division as some of the pur- chasers had been billed for taxes by the Town when they had not ac- quired the property. Councilman Young moved that taxes be pro -rated based on the date of the warranty deed except that the taxes would start as of the first of the following month of the fiscal year. Coun- . oilman Farrell seconded and the motion passed. Councilman Peters moved that the assessment on the hammock owned by Henry M. Dunn be reduced to $5,000.00 from 37,000.00 and that the assessment on the hammock owned by Julius Kahn be reduced to $4,000.00. Councilman Biotin seconded and the motion passed. Councilman Young moved that the following resolutiof be adopted. Councilman Peters seconded and the motion passed. A RESOLUTION WHEREAS, the Town of Savannah Beach, Tybee Island, is the owner of certain telephone lines, poles and equipment within the Fort Soreven Reservation on Tybee Island, and said Town has no need or use for the same; _ BE IT THEREFORE RESOLVED by the Mayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled, that the Mayor if said Town be, and he is hereby, authorized and directed to negot- iate with Southern Bell Telephone and Telegraph Company for the sale of said equipment at such price as said Mayor may think proper. BE IT FURTHER RESOLVED that in the event of a sale of said equipment, said Mayor be, and he is hereby, authorized and directed to accept the purchase price which may be agreed upon, and to execute in the name of said Municipality any deed, bill of sale or other in- strument necessary or proper in order to convey title to said property to said purchaser'and to close said sale; and that the Clerk of Coun- cil of said Town be and he is hereby, authorized and directed to attest the same and to affix the corporate seal of said Municipality thereto. Councilman Young moved that the.following resolution be adopted. Councilman Farrell seconded and the motion passed. A RESOLUTION WHEREAS, the Town of Savannah Beach, Tybee Island, is the owner of a certa n tract of land known as Town Hammock, which has been sub - divided into a number of lots, and is traversed by a road- way extending from U. S. Highway No. d0 to the property heretofore conveyed for the use of the 4 H Clubs of Chatham County; AID, WHEREAS, saod Town now deems it desirable to offer for sale and to sell all of said lots on said Town Hammock as shown on said subdivision, and the Assessment Committee of Council has appraised the same and placed a valuation on each of said lots; BE IT THEREFORE RESOLVED by the Mayor and Councilman of Savannah Beach, Tybee Island, in Council assembled, that the Mayor of said Town be, and he is hereby, authorized to make sales of any one or more of said lots as shown on said subdivision for not less° than the Valuation placed on said lot'or lots by said Assessment Committee, to any purchaser or purchasers, for cash, and to execute any deed or other instrument necessary or proper to convey good title to such purchaser or purchasers., in the name of said Municipality; and that the Clerk of Council of said Town be, and he is hereby, authorized to attest the same and to affix the corporate seal of said Municipality thereto. BE IT FURTHER RESOLVED by authority aforesaid that said Mayor be, and he is hereby, authorized to'make any sale or sales in accordance with the terms of this Resolution, without referring the same to Council, or to any Committee thereof, for approval, it being the intention of Council to confer full and complete authority on said Mayor to make such sales. Councilman Siotin seconded and the motion passed. A RESOLUTION WHEREAS, on June 29th, 1946, Mr. I. Movsovitz sustained damage to his automobile by running into a sewer pipe extending above the surface of the street at the intersection of Fourteenth Street and Fourth Avenue in said Town, and has presented a claim to said Municipality for the amount of said damage; AND,. WHEREAS, the Town Attorney has advised that in his opinion the Municipality is legally liable therefor; BE IT THEREFORE RESOLVED by the Mayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled, that said claim be approved, and that the Clerk of Council be, and he is hereby, authorized and directed to draw a Voucher in the sum of Twenty Dollars and Eighty -four Cents ($20.84) in favor of I. Movsovitz, as payment in full for said damage.. Councilman Peters moved that the following resolution be adopted. Councilman Farrell seconded and the motion passed. A RESOLUTION WHEREAS, on July 4th, 1946, Mr. A. M. Williams sustained damage to his automobile at the intersection of Fourteenth Street and Fourth Avenue by running into a sewer pipe extending above the roadway, and through his attorney, Mr. E. J. Haar,_ has presented a claim for such damage to the Town of Savannah Beach, Tybee Island; AND, WHEREAS, the Town Attorney has advised that in his opinion the Municipality is liable legally therefor; BE' IT THEREFORE RESOLVED by the Mayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled, that said claim be approved,_ and that the Clerk of Council be, and he is hereby, authorized and directed to draw a voucher to Mr. E. J. Haar, Attorney for A. M. Williams, in the amount of Forty -five Dollars and Fifty four Cents ($45.54) in payment of said damage. . Councilman Young moved that the following Resolution be adopted. Councilman Farrell seconded and the motion passed. A RESOLUTION WHEREAS, the Mayor and Councilmen d Savannah Beach, Tybee Island, has' been advised that property owners on Sixteenth Street in said Town, between Butler Avenue and the Strand, have had laid at their own a *pense the pavement on either side of Sixteenth Street by Espy Paving and Construction Company; AND, WHEREAS, said property owners were informed by the Town Engineer that if they would pay for sad paving said Town, would pay the sum of $1.00 per lineal foot for the curbing, and were under the impression that said Town Engineer had authority to make this statement, although he had no such authority; BE IT THEREFORE' RESOLVED by the Mayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled, that said Town pay to said Espy Paving and Construction Company the sum of One Thousand Three Hundred Twnety Dollars ($1,320.00), being payment at the rate of One Dollar ($1.00) per lineal foot. for the curbing on said part of Sixteenth Street, with directions to said Espy Company that it refund to any property owners who. have already paid this charge, the proper amount of money; and that the Clerk of Council be, and he is hereby, authorized and directed to draw a voucher in favor of said Espy Paving and Construction Company in said amount of One Thousand Three Hundred and Twenty Dollars ($1,320.00). bTE: The Clerk was instructed to make the check payable to the Espy Paving Company. Councilman Slotin moved that the following Ordinance be adopted. Councilman Peters seconded and the motion passed. AN ORDINANCE TO PROHIBIT PARKING ON THE WEST SIDE OF THE STRAND BETWEEN 16th AND 18th STREETS IN THE TOWN OF SAVANNAH BEACH; TO PROVIDE A PENALTY THEREFOR; AND FOR OTHER PURPOSES. SECTION 1. BE IT ORDAINED by the Mayor -and Councilmen of- Savannah Beach, Tybee Island, and it is hereby ordained by. authority of the same, that it shall,be unlawful for any person to park any motor vehicle, or horse -drawn Vehicle on that part of the Strand between Sixteenth Street on the North, Eighteenth Street on the South,_the property line of the lots fronting on the Strand on the West, and the Western boundary line of the parking area operated by said Town of Savannah Beach on the East, with a low fence separa- ting it from the Western portion of the Strand, to which this Ord. inance is applicable. SECTION 2. BE IT FURTHER ORDAINED by the authority afore- said that the provisions of Section 1 of this Ordinance shall not be construed to prohibit the stopping of-any suoh behicle in front of any hotel for the purpose of loading or unloading, such stop to 244 be for not more than twenty (20) minutes. SECTION 3, BE IT FURTHER ORDAINED by the authority afore said that any person violating the provisions of this Ordinance, upon conviction thereof, may be fined not exceeding Ten Dollars ($10.00), or imprisoned not exceeding three (3) days, or both. SECTION 4. BE IT FURTHER ORDAINED by the authority afore- said that all ordinances and parts of ordinances in conflict here- with be, and the same are hereby-,repealed. Councilman Slotin moved that the following Ordinance be adopted. Councilman Peters seconded and the motion passed. w ) f AN ORDINANCE TO PROVIDE THAT NO FOOD SHALL BE SERVED OR SOLD IN ANY BUILDING, OR FROM ANY BUILDING, IN THE TOWN OF SAVANNAH BEACH, UNLESS SUCH BUILDING BE PROVIDED WITH HOT RUNNING WATER; AND FOR OTHER PURPOSES. SECTION 1. BE IT ORDAINED by -the Mayor and Councilmen of Savannah Beach, Tybee Island, and it is hereby ordained by authority of the same, that no person, persons or corporation shall sell or serve any food or food products in or from any building or stand in -the Town of Savannah Beach, unless said building or stand be supplied with hot running water. SECTION 2. BE IT FURTHER ORDAINED, by the authority afore- said, that this ordinance shall have rlo application to. the serving of food in private homes, but shall only apply to places where food is served or sold to the public. SECTION 3, BE IT FURTHER ORDAINED by the authority afore- said, that any person, persons or corporation violating the provis- ions of this ordinance, may, in the discreatiofl of said Mayor and Councilmen, have his, her or its license revoked, and upon conviction of such violation, may be punished by a fine not to exceed One Hund- red Dollars (e100.00), or imprisonment not to exceed thirty (30) days, or both. SECTION 4. BE IT FURTHER ORDAINED, by the authority afore- said, that all ordinances and parts of ordinances in conflict here- t___ with be, and the same are hereby, repealed. Councilman Slotin moved that the following Ordinance be adopted. Councilman Peters seconded and the motion passed. AN ORDINANCE TO PROVIDE THAT NO TEMPORARY BUILDINGS. SHALL BE USED FOR EITHER RESIDENTIAL PURPOSES OR BUSINESS PURPOSES IN THE TOWN OF SAVANNAH BEACH; TO DEFINE 0TEMPERORY BUILDINGS0; AND FOR OTHER PURPOSES. 1 1 245 SECTION 1. BE IT ORDAINED, by the Mayor .and Councilmen of Savannah Beach, Tybee_Island, and it is hereby ordained by author-. ity of -the game, that no temperory building shall be used for either residential or business purposes within the Town of Savannah Beach. . SECTION 2.. BE IT FURTHER ORDAINED by.the authority afore- said that the term 0Temperory building0.as used in this ordinance,. shall 'mean any building not constructed in accordance with the build- ing ordinances of said Town, and for which a permit has not been issued(` in accordance with the ordinances.of said Town. SECTION 3, BE IT FURTHER ORDAINED by the authority afore- said, that.all ordinances and parts of ordinances in conflict here. with be, and the same are hereby, repealed. Councilman Young moved that estimates be gotten on the cost of rebuilding the Tilton Street groin. Councilman Hosti seconded and the motion passed. The matter was referred.to Councilman Lovell. Councilm =n Biotin informed Council that Mr. D. R. Davis had informed him that the Town owed him two -weeks pay to cover a vacation that he did not get. Councilman Young moved that he be -paid the two weeks salary. Councilman Farrell seconded and the mot- ion passed. The Mayor informed Council that the'pictures of the former Mayors were now ready and that they would be hung in the Council Room. The Mayor asked wheather the Municipality should erect or rebuild steps from the seawall to the Beach in front of the area being, developed by the Fort Sereven Developing Company. It was decided.that anything erected there would have to be done by others than the Town without liability to the Municipality.. The Town Attorney was instruc ted to write the Fort Sereven Developing Company the decision of Coun4 oil. Councilman Slotin suggested that a public rest room could be placed in the area where the police station and parking space booth is now located and that all be combined in one building. Then he suggested that the Police and Fire. Departments be combined since the Town cannot maintain paid fireman at this time, during the winter the police headquarters would be at the jail and during the summer the police station could be located where it is now. Councilman Lovell stated that he had talked to Fire Chief Edmund J. Solomon and suggest- ed to him that the doors to the fire station be kept locked and that the key be placed in a box for emergencies, the matter was referred to the chairmen of the Fire, Finance and Police Committees to study and report back at the next meeting. Councilman Biotin moved that bills for the month of June amounting to 31989.01 be paid. Councilman Peters seconded and the motion passed. Councilman Lovell suggested that racks to hold the small fire extinguishers be placed on some of the Towns vehicles. 246 Councilman Lovell had copies of the proposed new fire ordinance and asked that it be.studied and he would like to have any suggestions.so that it could be passed at the next meeting. Councilman Farrell stated than now since the Town has the new tractor a schedule of charges should be made for -its use,. Council- man Lovell suggested that the Town's work should be attiinded to first. A committee consisting of Councilman Farrell, Young and Biotin were to make up a scale of charges for the use of the tractor and report back at the.next meeting. An asphalt mixer was offered to the Town at a cost of approximately $1,200,00, Councilman Farrell stated that Mr. Reed. said that the Town could do work Very much cheaper by having the use of one. It was decided that atthe»proper time one could be borrowed from the City of Savannah. Councilman Farrell stated that it would be necessary to get a new location for the convict guards at the new convict camp ad the present set up is inadequate, the matter was referred to the Public Works Committee to handle. Councilman Young stated that Wiederman & Singleton have recommended that a gas flame trap be installed on the digester at the treatment plant as with the present set up it is dangerous and may cause an explosion and also cause a very bad odor at times, he also stated that the dome of the digester was leaking and should be sent to the factory for reconditioning, cost of these would amount to approximately $250.00. He also stated that it was necessary to erect a storage building at the treatment plant to store supplies, etc., he stated that.this building would cost very little. Council- man Lovell moved that the work be authorized. Councilman Biotin - seconded and the motion passed.. Councilman Lovell stated that it seems to be the tendency of contractors doing work for the Town to tear up things and then leave them without making the necessary repairs. He also stated that in connection with the repair work being done on Tybr3.sa Pav- ilion that he did not think it was going to hold up. Councilman Young informed Council that nine street lights ., had been planed in the Fort Screven area. Attention was called to the practice of automobiles driving out on the public dock and also the using of the docks for storage, the Chief of Police was instructed to contact the parties who stored the large piling on the dock and to notify them to remove it immedia- tely and also the Chairman of the.Public Works Committee was request- ed to block off the entrance to the public dock so that vehicles would be unable to drive out on it.
