HomeMy Public PortalAbout2022.04.02 Special Meeting MinutesMINUTES McCall City Council Special Meeting McCall City Hall - Legion Hall VIA TEAMS Virtual April 7, 2022 Call to Order and Roll Call Work Session Adjournment CALL TO ORDER AND ROLL CALL 1 Mayor Giles called the Special meeting of the McCall City Council to order at 5:30 p.m. Mayor Giles, Council Member Maciaszek, Council Member Nelson, Council Member Nielsen, and Council Member Thrower all answered roll call. City staff members present were Anette Spickard, City Manager; Bill Nichols, City Attorney; BessieJo Wagner, City Clerk; Erin Greaves, Communications Manager; Linda Stokes, City Treasurer; Michelle Groenevelt, Community Development Director Brian Parker, City Planner; Chris Curtin, Information Systems Manager; Traci Malvich, Human Resources Manager; Nathan Stewart, Public Works Director; Vlatko Jovanov, Network Administrator; Meredith Todd, Assistant City Planner. Also, in attendance were members of the public WORK SESSION 1 AB 22-084 Education on Building Moratorium City Attorney Bill Nichols opened the work session with an overview of the legalities regarding moratoriums and a history of moratoriums in the City of McCall. Community and Economic Development Director Michelle Groenevelt gave some additional information regarding moratoriums and how moratoriums have been used in other communities. Director Groenevelt updated the Council on current solutions staff is working towards related to housing and planning as directed by Council. Additionally, Director Groenevelt noted the work being done between the Sewer District and City Staff, short term rental code updates to address health and safety issues, and past building permit numbers compared to current building permit numbers. Mayor Giles asked staff to address impact fees. Director Groenevelt noted that impact fees are a way to fund and ensure that new development is paying for the impacts on the community and is a way to relieve the general taxpayers from paying for growth. The Council did an impact fee study in the past and chose not to adopt and implement any impact fees at that time. Mayor Giles thanked staff for providing a complete information packet addressing multiple tools available to Council to address issues in the community. Attorney Nichols addressed the legal requirements around impact fees. Council Member Nielsen asked Attorney Nichols if the City could issue a moratorium on the issuance of permits and licenses for specific businesses. Attorney Nichols noted there would need to be a specific imminent peril to health, safety, and welfare that is uniquely caused by the specified business. Council Member Nelson commented on the Housing Action Plan and other solutions City Staff is working on for the affordable housing issues facing the community. Council Member Thrower asked Director Groenevelt about code barriers for the Housing Action Plan. Director Groenevelt noted the feedback has been a lack of sewer capacity limiting the ability of applicants to take advantage of the current incentives in code. Additionally, Council Member Thrower asked about ways to develop code to skew development towards housing for residents. Director Groenevelt noted updating code to incentivize development for housing residents has been a goal of the last two comprehensive plans with a focus on how to stay a real community and not just become a community of second homes and visitors. The Housing Action Plan consultant and staff is currently working on a tool to help formulate strategies to deal with housing issues the community faces. Attorney Nichols noted the city does not currently have the authority to require residency for property ownership. Council Member Thrower asked if an applicant is going to take advantage of the voluntary deed restriction program, can the City require that at least 50% of the units be for local workforce? Attorney Nichols noted the City needs to be careful and keep the program voluntary to avoid constitutional issues by putting a limitation on what someone can do with their property. Attorney Nichols noted that City Council does a good job of investing in planning and following through with direction to staff. Council thanked staff and legal counsel for the detailed education and time that went into the discussion.
