CALL TO ORDER Mayor Pro Tem Man called the City Council Regular Meeting to order at 7:38 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: Councilmember — Chavez, Vizcarra, Yu (telephonically at 7:40 p.m.), Man ABSENT: Councilmember — Sternquist ALSO PRESENT: City Manager Cook, City Attorney Murphy, City Clerk Kuo, Public Safety Supervisor Ariizumi, Community Development Director Reimers Councilmember Chavez made a motion to excuse Mayor Sternquist for cause. Seconded by Councilmember Vizcarra. 3. INVOCATION — Pastor Darrel Kelty, Community of Christ, located at 5851 Temple City Boulevard, provided the invocation. 4. PLEDGE OF ALLEGIANCE — Mayor Pro Tem Man led the pledge of allegiance. 5. CEREMONIAL MATTERS — PRESENTATION A. YOUTH COMMITTEE UPDATE Hannah Kwok, Youth Committee member, reported on the recent and upcoming Youth Committee activities and projects. B. CHAMBER OF COMMERCE UPDATE Peter Choi, Chamber of Commerce President/CEO, provided a quarterly update of Chamber activities, announced upcoming events, introduced Chamber board members, and invited 5 Chamber members to speak about their business and the services they provide. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA — None City Council Minutes November 15, 2022 Page 2 of 8 7. CONSENT CALENDAR Councilmember Chavez made a motion to approve the Consent Calendar Items. Seconded by Councilmember Vizcarra and approved by the following votes: AYES: Councilmember — Chavez, Vizcarra, Man, Yu NOES: Councilmember — None ABSTAINED: Councilmember — None ABSENT: Councilmember — Sternquist A. APPROVAL OF MINUTES The City Council is requested to review and approve the Minutes of the Regular City Council Meeting of November 1, 2022. Action: Approved. B. TRANSPORTATION AND PUBLIC SAFETY COMMISSION ACTIONS - MEETINGS OF SEPTEMBER 28 AND OCTOBER 12, 2022 The City Council is requested to receive and file the actions of the Transportation and Public Safety Commission Regular Meetings of September 28 and October 12, 2022. Action: Received and filed. C. PARKS AND RECREATION COMMISSION ACTIONS - MEETING OF OCTOBER 19, 2022 The City Council is requested to receive and file the actions of the Parks and Recreation Commission Regular Meeting of October 19, 2022. Action: Received and filed. D. APPROVAL OF AGREEMENT FOR SERVICES WITH MICHAEL BAKER INTERNATIONAL INC. (MICHAEL BAKER) TO CONDUCT CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) ANALYSIS FOR A SUBDIVISION OF 23 LOTS AT 6355, 6362, AND 6415 OAK AVENUE The City Council is requested to approve the Agreement for Services with the environmental consultant to analyze the proposed project for compliance with the CEQA. Action: 1. Approved the Agreement for Services with Michael Baker; and City Council Minutes November 15, 2022 Page 3 of 8 2. Authorized the City Manager to execute the Agreement for Services with Michael Baker for an amount not to exceed $ 247,530.80. E. REQUEST FROM THE TEMPLE CITY CAMELLIA FESTIVAL FOR SUPPORT AND AUTHORIZATION FOR USE OF STREETS AND FACILITIES FOR THE 2023 CAMELLIA FESTIVAL The City Council is requested to review and approve the requests from the Temple City Camellia Festival for the festival that will take place from February 24 - 26, 2023 at Temple City Park. Action: 1. Authorized use of City owned facilities, as identified in the attached letter from the Camellia Festival to the City Manager (Attachment "A"); 2. Authorized use of streets and parking areas including temporary parking bans and street closures for the festival and parade as identified in the attached letter from the Camellia Festival to the City Manager; 3. Approved the permit for use of the Los Angeles County (County) Library parking lot for the 2023 Camellia Festival and authorize staff to execute; 4. Approved permit for consumption of alcohol in City Park, pursuant to Section 4-4- 0 of the TCMC for 2/24/23 — 2/26/23; 5. Authorized Bingo in Temple City Park, pursuant to Section 4-1 F of the TCMC and waiver of the license fee; 6. Authorized sponsor banners in Temple City Park and Live Oak Park, pursuant to Section 3-5D-10 of the TCMC; 7. Authorized use of City's Social Media accounts to advertise Camellia Festival activities; 8. Authorized Camellia Festival banners and flags in Temple City Park, pursuant to Section 3-5D-10 of the TCMC; and 9. Authorized City contribution of $50 to each organization that constructs and enters a float in the parade. F. AWARD OF PUBLIC WORKS CONTRACT TO CONCEPT CONSULTANT, INC. FOR CITY HALL TRELLIS REPLACEMENT PROJECT, CAPITAL IMPROVEMENT PROJECT (CIP NO. P23-07) The City Council is requested to approve the Public Works Contract for the City Hall Trellis Replacement Project. Approval of the contract will allow the contractor to begin work. City Council Minutes November 15, 2022 Page 4 of 8 Action: 1. Awarded a Public Works Contract (Contract) to Concept Consultant, Inc. (Attachment "A") as the lowest responsible bidder for the City Hall Trellis Replacement Project, CIP No. P23-07 and authorized the City Manager to execute the Contract in an amount of $277,565.00; 2. Authorized 15% of the construction phase budget as contingency budget allocation to be used if necessary for unforeseen conditions at the City Manager's discretion; and 3. Approved a Fiscal Year 2022-23 budget amendment of $351,120.00 from account #14-980-81-6010, Project P23-07. G. ADOPTION OF RESOLUTION TO ALLOW CITY COUNCIL MEETINGS TO BE HELD REMOTELY PURSUANT TO AB 361 The City Council is requested to adopt Resolution No. 22-5641 to authorize the Council and Commissions to meet virtually or via a hybrid of in -person and virtual attendance through December 15, 2022. Action: 1. Reviewed use of teleconferencing or videoconferencing for Brown Act -covered public meetings of the City Council and City commissions; and 2. Adopted attached Resolution No. 22-5641 to authorize the use of such technology for meetings for a period of 30 days. H. CONSIDERATION TO RELAX OVERNIGHT PARKING ENFORCEMENT DURING THE HOLIDAY SEASON The City Council is requested to temporarily relax overnight parking enforcement from December 18, 2022, to January 3, 2023, to allow families to gather during the holiday season, without having to worry about obtaining an overnight parking permit. Action: Relaxed overnight parking enforcement from 12:00 midnight on Sunday, December 18, 2022, to 11:59 p.m. on Tuesday, January 3, 2023. I. ANNUAL OVERNIGHT PARKING PERMITS — WAIVER OF EXPEDITING FEES The City Council is requested to temporarily waive fees related to expediting annual overnight parking permits for Fiscal Year 2022-2023. Action: Temporarily waived fees related to the expediting of annual overnight parking permit renewals for Fiscal Year 2022-2023. City Council Minutes November 15, 2022 Page 5 of 8 J. PETTY CASH REPORT The City Council is requested to review, receive and file the Petty Cash Report. Action: Received and filed. K. VISA CARD REPORT The City Council is requested to review, receive and file the Visa Card Report. Action: Received and filed. L. ADOPTION OF RESOLUTION NO. 22-5640 APPROVING PAYMENT OF BILLS FOR FISCAL YEAR 2022-23 The City Council is requested to adopt Resolution No. 22-5640 authorizing the payment of bills. Action: Adopted Resolution No. 22-5640. 8. PUBLIC HEARING A. SECOND READING AND ADOPTION OF ORDINANCE 22-1066 OF THE CITY COUNCIL OF TEMPLE CITY AMENDING TITLE 7 BY ADOPTING BY REFERENCE THE 2023 LOS ANGELES COUNTY BUILDING CODE (TITLE 26), ELECTRICAL CODE (TITLE 27), PLUMBING CODE (TITLE 28), MECHANICAL CODE (TITLE 29), RESIDENTIAL CODE (TITLE 30), EXISTING BUILDING CODE (TITLE 33), CALIFORNIA GREEN BUILDING STANDARDS CODE, WITH CERTAIN AMENDMENTS, ADDITIONS AND DELETIONS BY ADDING A NEW CHAPTER 10 ELECTRIC VEHICLE CHARGING STATIONS PERMITTING TO TITLE 7 City Council is requested to adopt the 2023 Los Angeles County Building Codes by reference to bring the City into conformance with State law. Community Development Director Reimers gave a summary of the staff report. Mayor Pro Tem Man opened public hearing. Hearing no request to speak, Mayor Pro Tem Man closed public hearing. No comments or questions from the City Council. Councilmember Chavez made a motion to read by title only, waive further reading, and adopt Ordinance 22-1066 updating Title 7 of the Temple City Municipal Code, updating the City's building regulations. Seconded by Councilmember Vizcarra and approved by the following votes: City Council Minutes November 15, 2022 Page 6 of 8 AYES: Councilmember — Chavez, Vizcarra, Man, Yu NOES: Councilmember — None ABSENT: Councilmember — Sternquist ABSTAINED: Councilmember — None B. ESTABLISHMENT OF AN EXPEDITED, NON -DISCRETIONARY MULTI -FAMILY REVIEW PROCESS AND A LIBRARY OF PROTOYPE ARCHITECTURAL DESIGNS FOR MULTI -FAMILY PROJECTS The City Council is requested to adopt the proposed ordinance and resolution to further the City's effort to achieve its state -mandated housing goals and to ensure that future multi -family development is compatible with the City's existing built environment. City Manager Cook gave a brief introduction for this item. Mayor Pro Tem Man opened public comment. Hearing no request to speak, Mayor Pro Tem Man closed public comment. Councilmember Chavez made a motion to continue the public hearing to the next City Council meeting on December 6, 2022. Seconded by Councilmember Vizcarra and approved by the following votes: AYES: Councilmember — Chavez, Vizcarra, Yu, Man NOES: Councilmember — None ABSTAINED: Councilmember — None ABSENT: Councilmember — Sternquist 9. UPDATE FROM CITY MANAGER — commented on upcoming city events and called on Parks and Recreation Director Matsumoto to provide an update regarding the usage of the EV charging station at Primrose Park after implementing a charging fee. 12.
