CALL TO ORDER Mayor Sternquist called the City Council Regular Meeting to order at 7:32 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City and telephonically. 2. ROLL CALL PRESENT: Councilmember — Chavez, Vizcarra, Man, Sternquist ABSENT: Councilmember — Yu ALSO PRESENT: City Manager Cook, City Attorney Murphy, City Clerk Kuo, Administrative Services Director Paragas, Parks and Recreation Director Matsumoto Councilmember Chavez made a motion to excuse Councilmember Yu and seconded by Councilmember Vizcarra. 3. INVOCATION — Jerry Jambazian, Wonder Cleaners & Draperies, located at 9136 E. Las Tunas Drive, Temple City, provided the invocation. 4. PLEDGE OF ALLEGIANCE — Mayor Sternquist led the pledge of allegiance. 5. CEREMONIAL MATTERS — PRESENTATION — None 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Peter Choi, former Chamber of Commerce President/CEO, thanked City and City Council for their support of the Chamber of Commerce and him during his tenure. Steve Stafford, Temple City resident, shared that CVS store on Rosemead Boulevard is closing on March 1 and commented on the need for the City to develop a plan to replace the businesses leaving the city. Jing Li, Temple City Library Manager, announced upcoming library programs and events. Chile Gomez, Temple City resident, asked for information for City's elected representative and street repaving schedule. City Council Minutes February 7, 2023 Page 2 of 8 7. CONSENT CALENDAR Councilmember Chavez made a motion to approve the Consent Calendar Items. Seconded by Councilmember Vizcarra and approved by the following votes: AYES: Councilmember — Chavez, Vizcarra, Man, Stemquist NOES: Councilmember — None ABSTAINED: Councilmember — None ABSENT: Councilmember — Yu A. APPROVAL OF MINUTES The City Council is requested to review and approve: 1. The Minutes of the Special City Council Meeting of January 10, 2023; 2. The Minutes of the Special City Council Meeting of January 17, 2023; 3. The Minutes of the Regular City Council Meeting of January 17, 2023; and 4. The Minutes of the Special City Council Meeting of January 25, 2023. Action: 1. Approved the Minutes of the City Council Meetings; and 2. Found that approval of the City Council Minutes is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. B. PLANNING COMMISSION ACTIONS The City Council is requested to receive and file the actions of the Planning Commission Regular Meeting of December 13, 2022. Action: 1. Received and filed the Parks and Recreation Commission Actions; and 2. Found that approval of the Commission Actions is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. C. ADOPTION OF RESOLUTION TO ALLOW CITY COUNCIL MEETINGS TO BE HELD REMOTELY PURSUANT TO AB 361 City Council is requested to consider the safety and procedural issues involved in holding remote meetings pursuant to AB 361 and to adopt Resolution No. 23- City Council Minutes February 7, 2023 Page 3 of 8 5654 to authorize the Council and Commissions to meet virtually or via a hybrid of in -person and virtual attendance through February 28, 2023. Action: 1. Reviewed use of teleconferencing or videoconferencing for Brown Act -covered public meetings of the City Council and City commissions; 2. Adopted Resolution No. 23-5654 to authorize the use of such technology for meetings until February 28, 2023; and 3. Found that adoption of Resolution 23-5654 authorizing the use of such technology for meetings until February 28, 2023 is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. D. AFFIRMATION OF CITY COUNCIL REORGANIZATION DATE The City Council is requested to affirm Council reorganization on March 7, 2023. Action: 1. Affirmed Council reorganization on March 7, 2023; and 2. Found that affirming Council reorganization date is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. E. ADOPTION OF RESOLUTION NO. 23-5652 APPROVING PAYMENT OF BILLS FOR FISCAL YEAR 2022-23 The City Council is requested to adopt Resolution No. 23-5652 authorizing the payment of bills. Action: 1. Adopted Resolution No. 23-5652; and 2. Found that adoption of the resolution authorizing the payment of bills is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. 8. PUBLIC HEARING City Council Minutes February 7, 2023 Page 4of8 A. INTRODUCTION AND FIRST READING OF ORDINANCE NO. 23-1069, SERIES C CODE AMENDMENTS OF TITLE 9 (ZONING REGULATIONS), CHAPTER 1 (ZONING CODE) AND AN AMENDMENT OF THE GENERAL PLAN LAND USE ELEMENT TO CLARIFY MIXED -USE AND RESIDENTIAL DENSITIES The City Council is requested to continue the public hearing regarding the proposed amendments to Series C Code Amendments of Title 9 (Zoning Regulations), Chapter 1 (Zoning Code). City Manager Cook requested City Council to open the public hearing to receive comments but continue the public hearing to the next meeting. Mayor Sternquist opened public hearing. Hearing no request to speak, Mayor Sternquist closed public hearing. Councilmember Chavez made a motion to: 1. Continue the public hearing to the next City Council meeting on February 21, 2023; and 2. Find that this project is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to Section 15305 of the CEQA Guidelines pertaining to minor alterations to land use limitations and Section 15061(b)(3) of the CEQA Guidelines because the project is not a project as defined in Section 15378 and it can be seen with certainty to have no possibility of a significant effect on the environment. Seconded by Mayor Pro Tem Man and approved by the following votes: AYES: Councilmember— Chavez, Vizcarra, Man, Sternquist NOES: Councilmember — None ABSTAINED: Councilmember— None ABSENT: Councilmember — Yu B. ESTABLISHMENT OF AN EXPEDITED, NON -DISCRETIONARY MULTI -FAMILY REVIEW PROCESS AND A LIBRARY OF PROTOTYPE ARCHITECTURAL DESIGNS FOR MULTI -FAMILY PROJECTS The City Council is requested to continue the public hearing regarding expedited, non -discretionary multi -family review process and a library of prototype architectural designs for multi -family projects. City Manager Cook requested City Council to open the public hearing to receive comments and continue the public hearing to another City Council meeting date uncertain. Councilmember Chavez made a motion to: 1. Continue the public hearing to another City Council meeting date uncertain; and 2. Find that this project is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to Section 15305 of the CEQA Guidelines pertaining to minor alterations to land use limitations and Section 15061(b)(3) of the CEQA Guidelines because the project is not a project as defined in Section 15378 and it can be seen with certainty to have no possibility of a significant effect on the environment. UNFINISHED BUSINESS — NONE 10. NEW BUSINESS A. CONSULTANT SERVICES CONTRACT AWARD TO SWA LANDSCAPE ARCHITECTS FOR PLAYGROUND RENOVATIONS AT LIVE OAK PARK AND TEMPLE CITY PARK City Council is requested to award consultant services contract for the playground renovations at Live Oak Park and Temple City Park. City Manager Cook provided a brief introduction and background for the Live Oak Park and Temple City Park playground renovation. Parks and Recreation Director Matsumoto gave a brief summary of the staff report. City Council made comments and asked questions about the project. Mayor Sternquist opened public comment. Hearing no request to speak, Mayor Sternquist closed public comment. City Council made final comments about the project. City Council Minutes February 7, 2023 Page 6 of 8 Mayor Pro Tem Man made a motion to: 1. Award a Consultant Services Contract to SWA Landscape Architects for the playground renovations at Live Oak Park and Temple City Park and authorize the City Manager to enter into a Contract once reviewed and approved as to form by City Attorney; 2. Approve a budget amendment in the amount $236,000 from the American Rescue Plan Act (ARPA) funds, Fund 14; and 3. Find that the Playground Renovation project is not subject to CEQA review pursuant to 15302(b), which exempts from CEQA review projects that replace an existing structure with a new structure that is substantially the same size, purpose and capacity. This agenda item meets the criteria for this exemption because the playground structure will replace the same existing feature at Live Oak Park and Temple City Park. Seconded by Councilmember Chavez and approved by the following votes: AYES: Councilmember — Chavez, Vizcarra, Man, Sternquist NOES: Councilmember — None ABSTAINED: Councilmember— None ABSENT: Councilmember — Yu 11. UPDATE FROM CITY MANAGER — None 12. UPDATE FROM CITY ATTORNEY — reported out on Assembly Bill (AB) 2097 which prohibits public agencies or cities from imposing a minimum auto parking requirement on most development projects located within half -mile radius of a major transit stop. He stated that this bill currently will not have an impact on the city. 13. COUNCIL REPORTS REGARDING AD HOC OR STANDING COMMITTEE MEETINGS A. SCHOOL DISTRICT/CITY STANDING COMMITTEE (Councilmember Man and Councilmember Chavez) — Formed 1/3/2012 Reported on the standing committee's meeting on January 19, 2023. The standing committee received an update on the Science Olympiad Tournament and discussed about emergency preparedness. Future standing committee meeting topics to include how the City can assist the school district to increase student enrollment, facilities joint use agreement to resume pre-COVID programs on school sites, and explore opportunities for hiring a school Resource Officer to address the mental health of students. PRIMROSE PARK ART ELEMENT AD HOC (Councilmember Vizcarra and Councilmember Yu) — Formed 5/19/20 No report. E. CITY BASED HOMELESS PLAN STANDING COMMITTEE (Councilmember Vizcarra and Mayor Sternquist) — Formed 3/16/21 No report. F. MAYOR STERNQUIST — commented on the Mayor's Round Table event, the library's invitation for Councilmembers to read at story time, and invitation to ride in the Camellia Festival parade. 15. RECESS TO SUCCESSOR AGENCY TO THE TEMPLE CITY COMMUNITY DEVELOPMENT AGENCY MEETING At 8:50 p.m., the City Council recessed to the Successor Agency Meeting.
