HomeMy Public PortalAboutCity Council_Resolution No. 23-5653_General Plan Amendment to clarify densities for Mixed-Use and Multi-Family Projects that have a Mixed-Use Land Use Designation_3/7/2023_RegularRESOLUTION NO. 23-5653 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, APPROVING A GENERAL PLAN AMENDMENT TO CLARIFY DENSITIES FOR MIXED -USE AND MULTI -FAMILY PROJECTS THAT HAVE A MIXED -USE LAND USE DESIGNATION WHEREAS, the State of California Government Code Section 65300 requires the City to adopt and maintain a General Plan that contains certain elements, describes its long-term goals, and develop policies and programs to achieve those goals; and WHEREAS, the City adopted its General Plan on December 5, 2017; and WHEREAS, on December 13, 2022, the Planning Commission held a noticed public hearing for the proposed General Plan Amendment to clarify densities for mixed -use and multi -family projects that have a Mixed -Use land use designation. The Planning Commission reviewed and considered information from the staff report, staff presentation, input from the members of the public, and recommended approval to the City Council; and WHEREAS, public notice was provided as required by law and City Council public hearings were held to consider the proposed General Plan Amendment on February 7, 2023 and February 21, 2023; and WHEREAS, on February 7, 2023, February 21, 2023, and March 7, 2023, the City Council held noticed public hearings for the proposed General Plan Amendment to clarify densities for mixed -use and multi -family projects that have a Mixed -Use Land Use Designation. The City Council reviewed and considered information from the staff report, staff presentation, and input from the members of the public. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA AS FOLLOWS: SECTION 1. The proposed amendment meets the findings for a General Plan Amendment required in 9- 1C -6.H.5 of the Temple City Municipal Code as demonstrated below; The proposed amendment would not create an internal inconsistency in the General Plan. The proposed change to the General Plan Land Use Diagram and the Land Use Element is a clarification of the original intent. It is consistent in every manner with the intent, goals, objectives, and policies of the General Plan. The proposed amendment would not be detrimental to the public health, safety, or general welfare of the city. The proposed General Plan amendment is proposed to provide clarity between the wording in the General Plan Land Use Diagram, the description and intensity of the allowed uses in the Land Use Diagram and the Zoning Code. The proposed change does not modify the allowed densities but only provides clarification. Resolution No. 23-5653 Page 2 of 2 SECTION 2. The City Council adopts the proposed General Plan Amendment, which is attached and incorporated by reference as Exhibit A. SECTION 3. The City Council find that this Ordinance is not subject to environmental review under the California Environmental Quality Act pursuant to CEQA Guidelines Sections 15061(b)(3) and 15378 because it can be seen with certainty that the Ordinance has no possibility of a significant effect on the environment. This Ordinance corrects errors and clarifies what densities are allowed for multi -family residential and mixed -use projects for properties that have a Mixed -Use land use designation. It coincides with the existing Zoning Code and past practices. It can be seen with certainty that it will not result in any physical changes in the environment, and any subsequent projects would undergo their own CEQA review. SECTION 4. The City Clerk shall certify to the passage and adoption of this resolution. Mixed -Use (MU) Mixed -Use Project: 2.0 Floor Area Ratio (FAR) with a minimum of 0.5 for commercial and maximum of 13-36 dwelling units per acre / 3.1 people per unit. Commercial Only Project: 0.5 Floor Area Ratio Multi -Family Residential 7-36 dwelling units per acre / 3.1 people per unit Single -Family Residential 0-6 dwelling units per acre / 3.1 people per unit Item 2: The Legend of the Land Use Diagram is amended as follows, with additions in underline and deletions in strikethrough.
