HomeMy Public PortalAboutORD 08/05ORDINANCE NO. 008/5 AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 70, THE GULF STREAM DESIGN MANUAL AT ARTICLE IV, SITE DEVELOPMENT REGULATIONS, SECTION 70 -68 RELATING TO LOT SIZE AND DIMENSIONAL REQUIREMENTS, AND SECTION 70 -72, RELATING TO SPECIAL EXCEPTION FLOOR AREA RATIO; AMENDING ARTICLE V, AREA WIDE STANDARDS, AT SECTION 70 -97 RELATING TO ARCHITECTURAL STYLE; AMENDING ARTICLE VI, DISTRICT STANDARDS AT SECTION 70 -187, RELATING TO TABLE OF DISTRICT STANDARDS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS Section 1. The Code of Ordinances of the Town of Gulf Stream is hereby amended at Chapter 70, Gulf Stream Design Manual; Article IV, Site Development Regulations, Section 70 -68, Lot Size and Dimensional Requirements, to read as follows: "Sec. 70 -68. Lot size and dimensional requirements. The following requirements shall apply only to lots created after the adoption of this chapter. Nonconforming lots which were legally subdivided and recorded in accordance with the regulations in effect at the time of the subdivision, but prior to the adoption of this chapter, shall have all building rights provided under this chapter and chapter 66 provided all other applicable requirements are met. Section 2. The Code of Ordinances of the Town of Gulf Stream is hereby amended at Chapter 70, Gulf Stream Design Manual; Article IV, Site Development Regulations, Section 70 -72, Special Exception Floor Area Ratio (FAR), to read as follows: "Sec. 70 -72. Special exception floor area ratio (FAR). (a) Lots of less than 7,576 square feet. Up to 2,500 square feet of floor area may be permitted on any legally established lot of record of 7,576 square feet or less, subject to the following: 1 (1) Maximum floor area. The maximum floor area is 2,500 square feet. (2) Specific standards for review. Site and structural design elements including, but not limited to: a. Height of the structure relative to neighboring structures; b. The location, number and size of windows, doors, porches, balconies and outdoor lights; C. The location of patios and walkways; and d. The location, size and types of hedges, walls and fences shall provide a level of privacy to occupants of both neighboring properties and the proposed structure equal to or greater than that provided if the proposed structure size conformed with the applicable floor area ratio. (b) Roof projections. Up to 300 square feet of roof projections (covered, unenclosed floor areas) may exceed the maximum permissible FAR subject to the following: (1) Maximum floor area. The maximum floor area in excess of FAR is 300 square feet. One or more roof projections may be approved under this special exception provided the total floor area of all projections does not exceed the maximum permitted FAR, by more than 300 square feet. (2) Specific standards for review. a. The roof projection(s) shall be compatible and complementary to the architecture of the structure and shall add appropriate architectural detail and relief to a facade. b. The roof projection(s) shall not make the structure look more massive. C. The total floor area of the roof projections shall not exceed the maximum permissible FAR by more than 300 square feet. d. For each one square foot of roof projection over the maximum permissible FAR, two square feet of roof projection must be provided that are within the maximum permissible FAR, and all shall remain forever unenclosed. e. Prior to the issuance of a certificate of occupancy or certificate of completion, the owner of the property shall prepare and record a deed restriction which, at a minimum, shall provide that all roof projection areas required to remain unenclosed as per approval of this special exception shall remain so for as long as the structure is in existence or exceeds the maximum permissible FAR." Section 3. The Code of Ordinances of the Town of Gulf Stream is hereby amended at Chapter 70, Gulf Stream Design Manual; Article V, Areawide Standards, Section 70 -97, Architectural Style, to read as follows: 2 "s :. 70 -97. Architectural Style. The town should maintain an overall character of traditional architectural styles associated with South Florida and the dominant styles currently within the community. (1) Preferred. Gulf Stream - Bermuda Anglo Caribbean British Colonial Georgian Spanish Mediterranean Revival Colonial West Indies (2) Discouraged. Monterey Non - descript, which is to be defined as not having an apparent architectural style including but not limited to vernacular. (3) Prohibited. A -frame Art Deco Contemporary Geodesic dome Cracker Modern glass cubes Traditional styles uncharacteristic to South Florida, e.e. English Tudor, Victorian For additional regulations, please refer to Section 70 -187 for District Standards in reference to architectural styles." Section 4. The Code of Ordinances of the Town of Gulf Stream is hereby amended at Chapter 70, Gulf Stream Design Manual; Article VI, District Standards, Section 70 -187, Table of District Standards, to read as follows: "Sec. 70 -187. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby declared severable. Section 6. Repeal of Ordinances in Conflict. All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 7. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Gulf Stream. law Section 8. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by PASSED AND ADOPTED in a regular, adjourned session on first reading this 5th day of September , 2008, and for a second and final reading on this 1 oth day of 00-ro b r , 2008.
