AN ORDINANCE TO ADOPT AN AMENDED AND
RESTATED REDEVELOPMENT PLAN FOR THE LANDFILL
RECLAMATION IMPROVEMENT DISTRICT 1N THE
BOROUGH OF CARTERET
BE IT ORDAINED, by the Mayor and Council of the Borough of Carteret. as
follows:
Section 1.
a) The Borough of Carteret Planning Board, after due consideration and in
conformance with the Local Housing and Redevelopment Law, has recommended
the adoption of the Amended and Restated Redevelopment Plan ("Redevelopment
Plan") for the Carteret Landfill Reclamation hnprovement District established by
Ordinance 95-40, as amended by Ordinance 96-14 ("District"), with the area of
the District sho~vn on Figure 1 of the Redevelopment Plan; and
b) The Redevelopment Plan proposes developmant guidelines for the
development of commercial uses as set forth Section 5 of the Redevelopment
Plan; and
c) The Redevelopment Plan is in furtherance of the goals and objectives of the
Borough with respect to the District and of the Large Site Landfill Reclamation
and Improvement Law; and
d) The Borough Council of the Borough of Carteret has reviewed the
Redevelopment Plan and held a public hearing about the Redevelopment Plan to
receive the comments of the public; and
e) The Redevelopment Plan is attached herelo as Exhibit A.
SECTION 2. The Redevelopment Plan is adopted as the official
redevelopment plan for the District, in accordance ~vith the Local Housing and
Redevelopment La~v and the Large Site Landfill Reclamation and Improvement
Law. The Rcdevelopment Plan amends, restates and supersedes the
redevelopment plan referred to in Resolution 95-346, adopted by the Borough
Council on November 2, 1995.
SECTION 3. The zoning district map of the Borough's Land Development
Ordinance is hereby amended to reflect the applicability of the Redevelopment
Plan to the District and the Borough's Land Development Ordinance as it affects

the District is hereby superscded by the Redevelopment Plan to thc extent set
forth therein.
SECTION 4. All Ordinances and/or provisions thereof inconsistent with tiao
provision of this Ordinance shall be and are hereby repcaled as to the extent of
any such inconsistencies
SECTION 5. If any section, subsection, part, clause or phrase of this
Ordioance shall be declared invalid by judgment of any Court of competent
jurisdiction, the section, subsection, part, clause or phrase shall be deemed to be
sever able from the remaindcr of this Ordinance
SECTION 6. This Ordinance shall take cft'ect twenty (20) days following final
passage and publication according to law.
