CALL TO ORDER Mayor Sternquist called the City Council Regular Meeting to order at 7:30 p.m. telephonically and in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: Councilmember — Chavez, Vizcarra, Yu (telephonically), Man, Sternquist ABSENT: Councilmember — None ALSO PRESENT: City Manager Cook, City Attorney Murphy, City Clerk Kuo, Administrative Services Director Paragas, and Community Development Director Reimers 3. INVOCATION — Pastor Kelty, Community of Christ, provided the invocation. 4. PLEDGE OF ALLEGIANCE — Mayor Sternquist led the pledge of allegiance. 5. CEREMONIAL MATTERS — PRESENTATION A. INTRODUCTION OF CAMELLIA ROYAL COURT Sabrina Macy, Camellia Festival General Chairman introduced the Royal Court. Banner Carriers: Hiroyoshi Sakamoto (Field Elementary School), Alyssa Marie Ureta (La Rosa Elementary School), Lucas Jurick (Emperor Elementary School) Dia Velazquez (Longden Elementary School), King Clifford Chen (Emperor Elementary School), Queen Camden Chavez (Emperor Elementary School), Prince Andrew Huerta (Emperor Elementary School), Princess Jasmine Lane (Emperor Elementary School), Prince Camden Long (Emperor Elementary School), Princess London Dang (Cleminson Elementary School). 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Helen Shaw, Southern California Gas representative, made remarks about the price of natural gas. 7. CONSENT CALENDAR City Council Minutes February 21, 2023 Page 2 of 8 Councilmember Chavez made a motion to approve the Consent Calendar Items. Seconded by Councilmember Vizcarra and approved by the following votes: AYES: NOES: ABSTAINED: ABSENT: Councilmember — Chavez, Vizcarra, Yu, Man, Sternquist Councilmember — None Councilmember — None Councilmember — None A. APPROVAL OF MINUTES The City Council is requested to review and approve: 1. The Minutes of the Special City Council Meeting of February 7, 2023; and 2. The Minutes of the Regular City Council Meeting of February 7, 2023. Action: 1. Approved the Minutes of the City Council Meetings; and 2. Found that approval of the City Council Minutes is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. B. TRANSPORTATION AND PUBLIC SAFETY COMMISSION ACTIONS The City Council is requested to receive and file: 1. The actions of the Regular Transportation and Public Safety Commission Meeting of January 11, 2023; and 2. The actions of the Regular Transportation and Public Safety Commission Meeting of February 8, 2023. Action: 1. Received and filed the Transportation and Public Safety Commission Actions; and 2. Found that approval of the Commission Actions is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. C. AUDIT REPORTS FOR PROPOSITION A, PROPOSITION C, MEASURE R, MEASURE M AND TRANSPORTATION DEVELOPMENT ACT ARTICLE 3 FOR FISCAL YEAR (FY) 2021-2022 City Council Minutes February 21, 2023 Page 3 of 8 City Council is requested to receive and file the FY 2021-22 audit reports. Action: 1. Received and filed FY 2021-22 Proposition A, Proposition C, Measure R, Measure M, and Transportation Development Act Article 3 Audit Reports; and 2. Found that approval of the audit reports is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. D. ADOPTION OF RESOLUTION NO. 23-5657 AMENDING THE CITY'S RECORDS RETENTION SCHEDULE City Council is requested to adopt the resolution amending the City's records retention schedule. Having an updated record retention schedule is crucial and can help reduce current and future records storage costs, eliminate duplication of records, increase efficiency and take advantage of current technology and changes in law. Action: 1. Adopted Resolution No. 23-5657 (Attachment "A") adopting the City's amended Records Retention Schedule (Exhibit 1); and 2. Found that approval of the City's Records Retention Schedule is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3), no environmental review is required. E. ADOPTION OF RESOLUTION NO. 23-5656 PROCLAIMING TERMINATION OF A LOCAL EMERGENCY City Council is requested to consider termination of a local emergency as the spread and effects of COVID-19 has significantly decreased, and no longer constitutes conditions of extreme peril. The City is effectively able to control services, personnel, equipment and facilities. As such, conditions warrant the termination of the local emergency. Action: The City Council: 1. Adopted Resolution No. 23-5656 (Attachment "A"), proclaiming the termination of a local emergency; and City Council Minutes February 21, 2023 Page 4of8 2. Found that adoption of Resolution No. 23-5656, proclaiming the termination of a local emergency is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3), no environmental review is required. F. VISA CARD REPORT The City Council is requested to receive and file the Visa Card Report. Action: 1. Received and filed; and 2. Found that receiving and filing the Visa Card Report is exempt from review under the California Environmental Quality Act (CEQA) per Section 15061(b)(3). G. ADOPTION OF RESOLUTION NO. 23-5658 APPROVING PAYMENT OF BILLS FOR FISCAL YEAR 2022-23 The City Council is requested to adopt Resolution No. 23-5658 authorizing the payment of bills. Action: 1. Adopted Resolution No. 23-5658; and 2. Found that adoption of the resolution authorizing the payment of bills is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. H. UPDATE ON CITY'S CAMPAIGN CONTRIBUTION LIMIT FOR 2023-2024 The City's campaign contribution limit is automatically adjusted according to the Consumer Price Index in January of every odd year. City Council is requested to receive and file an update on the adjustment of the City's Campaign Contribution Limit for 2023-2024. Action: City Council: 1. Received and filed the update on the City's Campaign Contribution Limit for 2023-2024; and City Council Minutes February 21, 2023 Page 5 of 8 2. Found that receiving and filing the update on the City's Campaign Contribution Limit is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3), no environmental review is required. 8. PUBLIC HEARING A. INTRODUCTION AND FIRST READING OF ORDINANCE NO. 23-1069, SERIES C CODE AMENDMENTS OF TITLE 9 (ZONING REGULATIONS), CHAPTER 1 (ZONING CODE) AND AN AMENDMENT OF THE GENERAL PLAN LAND USE ELEMENT TO CLARIFY MIXED -USE AND RESIDENTIAL DENSITIES The City Council is requested to hold a public hearing regarding the proposed amendments to Series C Code Amendments of Title 9 (Zoning Regulations), Chapter 1 (Zoning Code). City Manager Cook gave a brief introduction of the proposed code amendment. Community Development Director Reimers and Associate Planner Gulick gave a summary of the staff report. City Council made comments and asked questions regarding the proposed amendments to Series C Code Amendments of Title 9 (Zoning Regulations), Chapter 1 (Zoning Code). Mayor Sternquist opened public hearing. Hearing no request to speak, Mayor Sternquist closed public hearing. City Council made final comments regarding the proposed amendments to the Series C Code Amendments of Title 9 (Zoning Regulations), Chapter 1 (Zoning Code) and directed staff to amend Section 6 "Window Signage", clarifying that any signs within five feet of a window will be counted towards the maximum window sign area. The City Council also directed staff to amended Section 15 "Home Occupations", by removing personal services as a prohibited use, modify that music lessons are allowed to begin no earlier than 8 a.m. and no later than 8 p.m., and that no more than one unrelated student is permitted at a time. Additionally, City Council directed staff to prohibit music lessons for saxophones unless they are headphone -based. City Council also directed staff to delete Sections 9, 11, 12, and 13 relating to "Exterior Staircases", which will be discussed at a future meeting. Councilmember Yu made a motion to: 1. Find that the project is exempt from further environmental review pursuant to Sections 15061(b)(3) and 15378 of the California Environmental Quality Act (CEQA) Guidelines; City Council Minutes February 21, 2023 Page 6 of 8 2. Introduce for first reading by title only and waive further reading of Ordinance No. 23-1069 (Attachment "A"), Series C Code Amendments of Title 9 (Zoning Regulations), Chapter 1 (Zoning Code) with the changes to sections 6 and 15, and deletion of Section 9, 11, 12 and 13 of the Ordinance as discussed by City Council; 3. Schedule the second reading of Ordinance No. 23-1069 for March 7, 2023; and 4. Schedule the adoption of Resolution No. 23-5653 (Attachment "B"), Amendments to the General Plan Land Use Element to Clarify Mixed -Use and Residential Densities (Attachment "C"), for March 7, 2023. Seconded by Councilmember Chavez and approved by the following votes: AYES: Councilmember — Chavez, Vizcarra, Yu, Man, Sternquist NOES: Councilmember — None ABSTAINED: Councilmember — None ABSENT: Councilmember — None City Clerk Kuo read the title of Ordinance No. 23-1069. 9. He also commented on the upcoming Camellia Festival and the city hall trellis renovation. 12. UPDATE FROM CITY ATTORNEY — no report. 13.
